Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_03_18_2021), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
289 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 16 voices separated from the audio.
31 short machine repair(s) (38 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 92.0% of 11,740 content words.
Dotted words (307 places) are ordinary wording differences: hover or tap to see the other reading.
289 passages (21% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:32:48 (10 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
Property address is 614 Stone Street. For the record, I'm Steve Murdoch, Code Enforcement Officer. I'm submitting ‸ the packet associated with this case. The photos accurately depict the property during my visits. After my first inspection, I found the property in violation of accumulation of trash and litter, weeds, district intent, principal uses and structures. I visited the site a total of nine times and I found no progress made on the property. I've attempted to gain voluntary compliance in this case, but as of my last inspection, March 18th, the property remains in violation.
before the code enforcement board as they have not been fully resolved. I sent a notice of hearing on March 1st and it was sent certified and posted on the property in violation. Staff recommends in case 20-908 that the owner be found in violation and given 30 days to come in compliance or a fine of $75 be imposed for each day the violations remain until compliance is achieved. And there's not a representative here tonight.

Okay. And we're asking the board because it was here last month and it was tabled to return to the board in 30 days. So we wanted to bring it back and just update you and let you know that he's done that. And we'd like to remove it and see where it goes. If he doesn't fulfill the agreement, we'll come back.

Property address is 3236 Forest Hill Drive. For the record, I'm Steve Murdoch, code enforcement officer. I'm submitting a packet of documents and photos associated with the case. I'm the father of my daughter. She said she couldn't deal with this. She has an issue going back two years. I was playing what she can't deal with, and she had a collision back truck and has a traumatic brain injury, and she just can't turn loose anything now. In

compliance. I believe, just a matter of time, my opinion, when the moratorium goes off for closure, she'll probably lose the property, but she can't turn ‸ loose of it now because she thinks it's got to hold on to something. That's my opinion.

Correct. Yes, sir. The items under the porch and around and what's out front, and then there's some rust stains along the wall. He doesn't necessarily have to paint it if he can get them cleaned off.
We'll do our best to get everything done for it. There's no water there things to bring anything in to be done. And we'll try to get everything done. I just wanted to let him
think it, I would hope it would be. It should be sufficient time, so what's left to be done. The only other issue, I guess, is the pool and we're trying to do something to the pool, cover it, or whatever, because there's no electricity to keep it going, in it and clothing's not changing the pool itself.

I'm submitting a packet of documents and photos associated with this case. The photos accurately depict the property during my visits. After my first inspection, I found the property in violation of permit ‸ required, site plan approval required. I visited the site eight times and found no progress made on the property. I've attempted to gain voluntary compliance in this case, but as of my last inspection, March 18th, 2021, the property remains in violation. I've been working on this case since October 13th, 2020.

There was an area of the right of way that was, has been paved and the permit would be through public works. The complaint actually came in from public works related to modifications to the right of way without permit. And that would also, that also figures into the site plan as well.
put down? I would let the property owner speak to the reason being it was, it was paved to the, to the, to the roadway itself along, along the Highland stretch.

I don't know why. FPL doesn't do anything about it, but long story short, all I, all I did was pay a paper to come in there and meet the line of the roadway with, you know, with my, at my property there, which was already hot top. We just went over the hot top that was there and you could put a couple of inches over to beautify it. Um, after speaking with Mr. Murdoch, I wasn't really notified about any of this stuff until sometime, probably in late February. I never got the notices at the post office for what reason. I don't know why. Um,
and he asked me to speak to Abigail, which I spoke to Abigail a little bit about it. Uh, she told me to speak to somebody what a place called bright line. Uh, bright line was there doing some work on the railroad tracks. Um,
and what he said to me was, he says there's 12 inches of the roadway area and the right of way area that are going to be, would be affected by this. The guy said to me that he didn't even think it was a problem because they were going to have to put concrete over that anyways. And it would be a better base than what

property better. That's not doing nothing more than that. Um, and I, I would like to have 90 days if it's possible because it's taken me probably 21 days just to have a response back from Abigail.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:17:21–00:17:23 · unresolved: the words are not shown (unclear audio); listen to the recording
I would have improved it. If not anything at all, rather than what it was, it was all potholes and crumbled rock way. And just, it was just, it was a mess. And, you know, all it is now, it's smooth hot top that can easily have concrete poured right over without a problem. But after speaking with them, I'm happy to do what they've asked me to do. Uh, they did tell me that this project is not going to be anything that's happening until nine
Flag: words were replaced by a machine repair · 00:17:50–00:17:50 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
do. Uh, but since I've been speaking to Mr. Murdoch, I will ‸ go ahead within, if I could have 90 days would be helpful because with this COVID and people not working and trying to get in everywhere, I will go pull a permit and pay for it and, uh, do what I have to do to make things right.
city and the gentleman? Well, I don't, I don't want to ignore the fact that he's going to have to go to planning and zoning and do a minor site plan revision to encompass the area that's been added, um,
Now that's not a major site plan. It's just a minor, but I don't want to bypass them either. So he has to get the permit from public works for the ‸ right of way and then the minor revision for the additional paving on his property. So if he can do all that in the timeframe you give, that's, that's fine.
Staff doesn't really have an objection to 90 days. He's got to get the permit from public works and then it's probably going to take a good 15 to 20 days depending on how quickly he gets to zoning. A lot of this is going to depend on him, but he just has to, he's

we have ‸ to cite the property owner. So that's between Mr. Thistle and his contractor. Who's going to come and pull the permit. Public works is a little different than building.
Okay. A question. Sure. The 11 inches that's was paved over the roadway. Matt be happy to take my Saturday and Sunday and go chip it off to the edge. If

put this much black top on the roadway. But literally like this, this much, I'd be happy to go over there with a line and chip it and break it and remove it. If it makes, makes you feel any better.

No. Would it be, would it be susceptible to, um, table this for next month to see the progress? Um, if he, he was able to get with, uh, planning and zoning, um, and everyone else too. If he's able to get that, are we able to table it until next month?
Flag: words were replaced by a machine repair · 00:21:24–00:21:25 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
We've also in the past done 90 days with 30 day updates from staff to the board on the progress of cases. So you could give 90 days and we could let you know each month where he's at and how it would be.

And that the, uh, gentleman will be given, uh, 90 days. To, um, get the permits and required, uh, site plans up to date. And that there'll be 30 day, uh, updates with the city to make sure everything is being taken care of.

That's correct on the building end of it. But then because you crossed into the right of way, public works is asking for a utilization permit to utilize their right of way. Okay, so that's the difference. But yes, normally it's up to the contractor to pull the permit.

gallon wet and dry vac, emptied it six times just in the hallway. I had insurance come out, and they had six people helping me get everything out of the house. Had to throw the carpet away, the furniture, the couches, and recliners, and things like that. and I've been uh replacing the wood, repainted the hole inside the house, all the window blinds,
replaced them just because they were old. Now it's just me trying to get them back in. I had a car wreck and fork my left shoulder. I had surgery on my right shoulder already, so I'm kind of limited on what I can lift.

Mr. Chairperson, if I could. um Sir, I would just like to tell you that you still would need to go to planning and zoning and get approval for those storage containers. Okay. Let's
a permit. I will meet you there. You do not need a permit. What you need is the zoning approval for violating setbacks and the fact that they're there. And I will go there‸ And
the code requires, which is 30. But you need to have that on record. So you go there. You apply for the pods to be temporary storage. List your reasoning. They keep that in the record. It's not a permit. It's just a form that you fill out so that they can monitor the thing and i'll let them know that this board
today. It's a zoning compliance form that they fill out. What you should have done in the beginning was go there, fill it out. They would mark the date that you went there and how long you had to keep them. But since we're where we are, we'll do a 60 day I just need to get that on record with zoning. Because my notice of violation was, uh was exactly required

But I ‸ have to admit, I kind of feel blindsided by everything that's happened, particularly when I explain the situation to those that are involved here. I'm not trying to avoid responsibility, but I wonder, too, about the fairness of possibly having to remove the old fence and not having a fence at all in that particular part of town, which, as you know, is somewhat crime-ridden, where my property, my vehicles, one of them, which is ‸ antique, will be put in danger. So to be clear, I want to license the vehicles in short order. I want to put up a fence, but I only have two days a week to do it. And if it rains one or two days, I don't have that. So 30 days is just not practical for me to comply with that, and I'm asking more time to do so. So thank you.

The fence, you have two options. One is to take it down and have nothing. But if you do that, then you're going to be faced with having to get a site plan to determine where the new one goes. If you're just replacing what's there, you don't have to do that.

Because the moment you cross more than 50% of the structure, the fence that's there, that all goes away. Uh, they both have clarified that what has to happen here. You, you of course can build a, build a house on the property and then fence it. Or I guess that the option is to just take the fence down, right?
He could put a, uh, structure there if he was going to use it for business purposes. But again, he has to start at square one and go to planning and zoning, do a site plan, mark out paving, drainage, and landscaping.

enable him to put it an accessory structure. I.e. the fence on the same footprint that he would be able to store his equipment there. And so to do something like that, uh, does the. Building have to be completed or does the site plan have to be in process?
Okay. So the site plan would take whatever time that takes. And then the permitting would take whatever time that takes. And once the site plan is complete and the permit is approved, he then has up to, I think ‸ it's a year to actually do the construction.

um, in the building department, but now I'm getting more information and some of that information actually is consistent with some of the plans I had for the property. I understand that you're concerned with the community, how it looks and the beautification. And I'm right there. I just need some time to take care of it is all.
Mr. Chair, if I can, if I can just add, um, what's, what's before you today, what we cited, I mean, his plans are excellent and he can still do them. If he could just get the vehicles tagged so that they meet the code, secure and replace any openings there on the fence and then cut down all the weeds that surround the fence and the high growth he's done with our code violation. Then if he wants to take two years to go through that process, he, he definitely can.
He was just cited basically for the accessory structure where the fence is starting to fall. He can prop it back up. Um, anything that would not require a permit, replacing minor slats, and then basically registering the vehicles and cutting the grass. And then we're done and then he can take five years after that if he needs it to develop and, and, and do his property the way he wants. I think going into a longterm agreement like that,
that's what he wants to do. That's what I would recommend is that we just concentrate on this, get this taken care of, and then he can work on the other stuff as long as he wants.

I sent the notice of hearing for noncompliance on March 1st, 2021, and it was sent certified and posted at this time. The property remains in violation.
actually what it is, is you're talking about an entire apartment complex, right? So they have been working and they have made progress, but they have not corrected all of the violations. Like they've actually done some re roofs and put new roofs on, but they haven't done all the buildings. They've started fixing some of the fences, but not all the fences. So there's been progress, but not, not everything has been corrected. Okay.

Um, they did just recently fix some of the, um, exterior grounds, like the messed up asphalt. ‸ But again, not all the violations have been fully corrected.

Let's see. We, um, we were given the 120 days. And like I said, this is, um, 16 building property, 120 units. Um, fly on one side, hold on the other. We have been doing everything we can. And unfortunately, just like everybody else, we get things scheduled with contractors. We get scheduled. My asphalt on the road and the potholes just finally got completed on March 5th after getting rescheduled for two months. Uh,
contract. And we did just get an estimate contract signed off today. So it's just a matter of time. So we're seeking to see if we can do a 90 day extension with a 30 day status hearing just to comply with the rest due to conflicts of time.
That's just, I want this stuff done. I, I understand the things that need to, but it's, um, I get excited. Something's happening. And then I get a phone call and email that we have to reschedule. And then it's

There really are like two things we can do. One is we can find you compliant, which you know, you're not. Or we can find you noncompliant. That's the only choices we have under the law, under the statute in Florida. So that's kind of where we are now. If we find you noncompliant, then that gives you basically all the time in the world. Because the
‸ until it's all complete. Um, it won't, the fine will continue until everything is complete. So my question would be first is have the, uh, the owners of this property, uh, bought into the fact that they've got a lot of repair needed here.

Same thing you said that then you have all the time. Then you can always come back when it's over and come for a lien reduction. And then that's where the covert and everything comes into play and determines. You know, whether we forgive or reduce or do whatever with the fines. So, okay. You did explain all that. ‸ I did explain. I don't know if it was one of these people that I spoke to on the phone.

I mean, it's not the end of the road once they finish and if they can do it in 90 days, that's actually pretty quick. We can be back here in a lien reduction hearing and address all that stuff then.
I appreciate that. But at this juncture, I think the noncompliance is a way to go. Let them finish at their schedule and then let them come back afterwards. And explain everything.
Mr. Chair, I'd like to make a motion, please. Go ahead, please. But I have a question first. Seeing that there's so many apartments there and a lot of the vehicles end up abandoned and whatever, can they have a policy in there where they can automatically tow those out of there? So, Ashley
has already done that and ‸ she's actually created stickers that she's sticking on them. Right. So, ‸ that's part of what they've been trying to do to keep that in compliance. You'll see in one of those pictures

Now, they are starting on that. Right now, there's just one Mercedes that has been there in several of the pictures that you saw. But we're trying not to hold this ordinance to new vehicles that are coming in because that does happen. Vehicles that are there today and go away, new ones come in and go. So, she's working on that. That's one of the things that they've definitely done.
And then the area out front where they have a water leak that's causing some erosion. They have a silt fence, but that's only temporary. ‸ But I'll work with them on that to get this done as quickly as possible.

It looks more to be a hobby shop. It's the same vehicles. Some of them have been tagged and have since not had tagged in different states of disassembly currently. Initially, when the case started, those were tagged and running vehicles. But it looks like they're kind of hobbyists to me.

Mr. Chair, yeah. The first one is not present. So at this time, we'll push that to April. They're not here to make their request. Yes. 122 Rosa L is here for their lien reduction.
