2. CE-25-529 – Tax # 2461918
Code Enforcement Officer Jason Brimm provided an overview of the Case history and presented exhibits
for the Board’s review. Code Enforcement Officer Brimm testified that the Property Owner was in violation
of City Code Appendix A, Zoning, Art. XI, Schedule of District Regulations. Sec. 12, District and
intent, CG, General Commercial District. (D) Prohibited Uses and Structures (2) of the City Code.
Code Enforcement Officer Brimm requested that the Board find the Property Owner in violation and be
given until November 19, 2025 (30 days) to come into compliance or impose a fine of up to two hundred
and fifty dollars ($250.00) City Code Appendix A, Zoning, Art. XI, Schedule of District Regulations.
Sec. 12, District and intent, CG, General Commercial District. (D) Prohibited Uses and Structures
(2) per day until found in compliance.
Chairman Roberts asked Officer Brimm if the vehicle seemed operable? Officer Brimm stated that he did
not believe it was. The property owner told Officer Brimm that the vehicle would be removed by tonight or
Friday. Attorney Eick wanted to add for the record that the citation subsection General Commercial
District.(D) Prohibited Uses, she just wanted to add that for the Board and for the record that Section 12
(a), describes the principal uses that are aloud in CG General Commercial states that all the principal
uses and structures aloud in professional service district and the neighborhood commercial district aloud
except residential uses and child care centers, day nurseries or kindergarten. The section itself does
indicate that residential uses are not permitted in the CG zoning district just wanted to add for the record.
Chairman Roberts had questions of how this would be different from the case last month in downtown
Cocoa Village which he had an RV. Manager Wilkinson explained that downtown Cocoa Village area has
the same zoning class but more stringent codes that follow up with the zoning classification in the CG
zoning and the Cocoa Village area. So, it may be the same violation, but downtown Cocoa Village area
has more stringent code than this case does. More discussion amongst the Board members, attorney
Eick and staff.
Motion by Vice Chair Otero, seconded by Ms. Scott, to approve Staff’s recommendations and find the
Property Owner in violation and a fine of two hundred and fifty dollars ($250.00) per day. Vote on the
motion carried (5) Aye (1) Nay Mr. Brown. Mr. Brown wanted to amend the motion to fifty dollars ($50.00)

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
78 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 10 voices separated from the audio.
8 short machine repair(s) (11 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 93.2% of 2,833 content words.
Dotted words (77 places) are ordinary wording differences: hover or tap to see the other reading.
78 passages (30% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

after ‸ citizen called in a complaint regarding the RV. The lot did not have a code history. I went to the lot, observed the RV parked there, spoke with the two individuals that was living there and still living there. Spoke with them at length. They were staying there and are staying there. The property owner was trying to help them out because they're at the moment without a home. I let them know about resources from 211 and other resources that uh were in the area, housing for homeless and other options that they might have had. Pretty much have extended this to about where we're at now, 90 days. I've spoken with the property owner at length regarding it. He's understanding that he's tried to help out them, but he's on the same page as he's understanding that they have to move the RV. And as of this evening,

that um all the principal uses and structures allowed in professional service district and the neighborhood commercial district are allowed, except residential uses and child care centers, day nurseries, or kindergarten. So ‸ the section itself does indicate that residential uses are not prohibited permitted in um the CG zoning district. And I just wanted to add that for the record. um
Just for my clarification, um you say CG zoning different district. um Would that be, how would that be different? and i I get what you're saying, but I'm just trying to wrap my hand head around. How's that different from the case we had last month that was in downtown where he had the RV? and I'm just trying to just get a familiarity to what the difference would be. I know we they had the same thing because he had a trailer there before and then we had the other uh situation for the polls. but But again, um would that be the same? I know the area is a little different, but is that the same because both of them are commercial?
Mr. Chair, to answer your question, the one from last month, previous case, it's got more, the Cocoa Village area, it's got the same zoning class, but it's also got more stringent codes that follow up with the zoning classification

because it sounded like the way it's in violation, it sounded a bit different than that one in which it's kind of the same. And ‸ that's the only reason I
asked. It's the kind of same kind of violation, yes, sir, but it's more the code for Cocoa Village area is a more stringent code than the one for the regular commercial general zoning. Do
I i suspect that it ‸ right, I believe it is a different zoning district from last month. This one is in the general commercial zoning district. And again, I was just trying to provide for the record that there is a section that describes ‸ residential uses are not uh permitted in that uh

So that would not be an appropriate motion. So I think what we would need to do, so there's a motion on the floor. And if there's no second, then that one would die. Okay, so that's seconded. And then Mr. Brown, if you would like to make a motion now to ‸ amend, you may do that.
Amend the amount of money? Yes. I would like to see the amount of money at $50 a day, which is plenty of fine for somebody to get the whole thing going. It's not always easy for some people.

was scheduled to be picked up Saturday, October 19th. Deborah, the niece, also inquired as to what the code case was in regards to. I replied and let her know. And today I inspected the property and it was still found to be in violation. Photo was taken and uploaded. The property owner did show up and
him. I let him know that I was aware of the pod being picked up on the 16th after his niece had let me know. I told him he's more than welcome to stay and encouraged to stay for the meeting, but it was not a requirement. I let him know that I will follow up with him with whatever the findings are. This is the property today. The pod is still there on the storage containers. And there's no running fine or any fixed liens that I recall.
The property owner, he told me Saturday morning sometime. He's ‸ the owner of the property and his niece apparently rented the pod. So she emailed our case coordinator or called and then I was notified and she let me know via the email that it would be picked up Saturday.
I have a question. On these fines, as stated by the code officer, the fine is up to, up to, the city suggests maybe, I don't know what they suggest, but the fine is up to, depending on how much of a critical problem it is.

give it to them within reason. Even at $50, it's $200 a week. If it's so much a day, $50 a day, that adds up. I wouldn't want to have to contend with that. I'd get it paid off. But that's just my old way of thinking.
