The staff’s recommendation is that the fine / lien be reduced to $2,773.32 which is the cost of staff to
prosecute this case. This reduction is based on the gravity of the violations, the length of time it took the
property to come into compliance, and the total amount of the City’s Cost.
Property owner was sworn in: Tim Levensaler, 2260 Sykes Creek Dr., Merritt Island
Chairman Roberts asked if this was new construction. Mr. Levensaler gave an overview of the property
and what was done. The property was a vacant storage lot that AT & T owned. Mr. Levensaler went to
the city and asked what the use code for the property. Mr. Levensaler assumed that he could park cars
on the property and put milling down, which was not allowed. He was also required to get a site plan for
the property which turned into new construction. He had to merge the property on 213 Factory St and
699 Hughlett together to make it one property which is the 699 Hughlett address. Mr. Levensaler
renovated the property into a 22-unit apartment building and the other added property was for overflow
parking. More discussion amongst the Board members, property owner and staff.
Motion by Vice Chair Otero, seconded by Ms. Scott, to approve staff’s recommendation to City Council
the lien reduction be in the amount of two thousand seven hundred seventy-three dollars and thirty-two
cents ($2,773.32). Vote on the motion carried unanimously

The Code Enforcements Board and staff’s recommendation is that the lien be reduced to the amount of
zero.
Property owner was sworn in: Deborah Raskett, 2565 Washington St, Melbourne & Renee Wiebelt, The

Ms. Raskett told the board that she never received any notices about the hearings. Ms. Raskett found
out about the lien when she went to sell another property. She stated the previous owner did the work at
the property and she thought the lien was closed. Ms. Wiebelt said she did the closing on the property 3
years ago when she bought the property. Emails back in forth between herself and Manager Bunt at the
time. Ms. Wiebelt stated that Manager Wilkinson had a copy of the emails. Vice Chair, Otero asked what
the plans were for the house. Ms. Raskett said renovate it and then rent it. Ms. Scott and other board
members asked when the property was purchased. Her response was October of 2022. Manager
Wilkinson said the email that he has in front of him does state from Manager Bunt the case was closed.
Chairman Roberts asked Manager Wilkinson if this was incorrect and should not be a lien. Manager
Wilkinson answered there should not have been a lien. More discussion amongst the Board members,
property owner and staff.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
358 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 20 voices separated from the audio.
42 short machine repair(s) (51 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 92.5% of 15,531 content words.
Dotted words (525 places) are ordinary wording differences: hover or tap to see the other reading.
358 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:49:48 (20 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

All premises and exterior properties shall be maintained free from weeds and plant growth in excess of 12 inches. Weeds shall be prohibited, defined all grasses, annual plants, and vegetation other than trees and shrubs. And, of course, it's not to include certain types of flowers or garden beds and that type of thing. As you can see here, the entire front yard has an accumulation of grass and sawgrass and that type of thing of weeds above the 12 inch. Taken again, May 29th of 2025. The case was started on August 27th, 2024. Code enforcement arrived at the reference property. During an active patrol of the neighborhood, code enforcement observed outdoor storage junk, trash debris, tall grass.

Issue an order requiring the violations be corrected. Property brought into compliance immediately. and consider an imposition of a daily fine of up to $250 per fine per day until compliance is met. Staff available for any questions. Is the residence occupied? I've been by several times. This is my zone, so I actively patrol it. I have not seen anybody at the residence. There is a ring camera there.
Because ‸ the trash that's out by the road, is that where the trash is picked up, or would you know? Because I'm just wondering, because if it's out by the road, why wasn't it picked up? Is there anyone here for the property first?
wouldn't know if there was anybody here for the property. I have seen trash cans put at the road, and they've been removed from the road. So I can't say for certain that somebody is living there or is not living there. But from the assumption of trash cans being placed at the road and being removed from the road, my assumption would be that somebody either stays there or is at least using the property to some effect.
Yes. The violation for 6-900B1 is not listed on the agenda item itself. However, it is listed on the notice of violation. So I believe code enforcement is asking the board to find all violations of all three. Is that correct?

I'll make a motion. Based on the evidence and testimony presented, which is incorporated into the order, I may define the respondents in this case in violation of the city codes as charged.
On August 21st. In the event, respondent does not comply by this date after considering the factors in section 162.09 Florida statute, a fine in the amount of $75 per day per fine. Um, will be imposed for each day.

March 17th, I mailed out a notice violation to the address according to the property appraiser, which was 516 West King Street via certified mail. The USPS showed that it was delivered March 20th. April 8th, I went into the business physically and spoke to the owner's son. He stated that his mother had passed away
He wasn't aware of the business ‸ tax receipt. I gave him the permit technician's number at City Hall and informed him how to go about getting the BTR. May 28th, I checked the BTR website at work for the status. The business still showed that it was still behind going back to the same

his client didn't receive the notice violation, but had received the notice of hearing, informed the attorney that a copy could be emailed to him, and it was. And as you can see, on June 9th, the owner's son came to City Hall, paid the delinquent amount regarding the BTR for the business. The notice of violation, as I mentioned previously, that was mailed, gave the business until April 17th, 2025 to come into compliance. And again, the business was behind three years in business tax receipts. On the left, you can see the notice of hearing that I ‸ mailed out that went out certified mail. And on the right is my affidavit of posting and showing that it was posted down here in City Hall. On the left, you can see the USPS tracking that it shows, as I stated on the other slide, that it was mailed, or I'm sorry, delivered March 20th.
just had these for reference in case there's questions that come up. Staff recommendation, staff requests the code enforcement board find to respond to owner in noncompliance, as the business tax receipt was not renewed and active in the time frame given. In the notice of violation, in addition, was three years delinquent. Staff is requesting a finding of fact in this case. I'm available for questions.

to try and get a understanding when you don't give us anything to go on. um Because, you know, this ran for 66 months. um I mean, in that time, I know we've had turnovers with our officers, but within this time, of 66 months being on the road, um ‸ just a difficult one.
No, I understand that. I just... weWe didn't know it was in violation until, I guess it was about six months ago. That's when we found out. Because when the code officer came by and he went through the house and looked at the fence in the pool and I signed the paper, I thought it was over. And
officer um did you pull to did you pull it up to see if any of her permits had been pulled and approved? all Any of that stuff had been done before we came today?
uh i can I can tell you what we have here in the system. There was a fence application uh applied for in January of 2019. It with with it was withdrawn and never completed.

So let me ask a question. I mean, maybe... I'm not sure if this was the same thing that you were touching on. But can how could we have a lien reduction packet submitted and approved if we still have an open permit?
It's not an open. It was withdrawn. And from the notes I was just about to say before I asked the second question, the notes regarding the fence, from what I see in the comments from the officer, it was only a couple sections. And it would not require a permit if they're just maintaining it. If they're going to replace the whole thing and put it up, that's one thing. That's what all I got from the notes from the officer. But as far as the case, the permits were done on June... I'm sorry.

Well, I i think that what, I think I would agree with the statement. I think what staff is is saying is that I believe there may have been some mistakes, essentially, that were made and that they question why violations were found for sections, uh for the permits required, both for the fences and then also under 2A for the screen room.
this to actually get an accurate number of, ‸ for instance, what would be owed as far as the time frame to where it was, was found non-compliant to the time it became in compliance because this can't be correct by what we're talking about here.

management. We began managing the property in July 1st of 2017. um the liens were already in place. um so, by May 2020, we had completed all required exterior repairs, including
and all exterior violations were deemed compliant. However, we were informed, um the city extended the original code violation to include build building 1719 due to a prior management failure to properly secure the building and mitigate liability risk. Permits for building 1719 were obtained on September 18th, 2020. At which point the daily fines ceased. unfortunately, the lien remains in place, which currently prevents us from securing a bank loan for roof replacement across 15 buildings. The lender requires either the final lien amount or a lien waiver from the city in order to proceed. We respectfully request consideration for a lien reduction or waiver.

‸ Under the guidance of new management and newly appointed board, we remain committed to maintaining the property in full compliance. ‸ at this time, the only remaining obstacle is resolving the roof violation, which the loan would directly address. approval of a lien reduction or waiver would enable us to complete this critical improvement and ensure the continued safety and upkeep of the property. and it's just what we need.
Does it need a new roof? I would put a new roof on it. But as far as, you know, there has been some repairs to the roof, but it's out of my scope to say that they need to completely replace the roof for all the buildings.
