Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
221 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 11 voices separated from the audio.
27 short machine repair(s) (31 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 92.0% of 9,912 content words.
Dotted words (316 places) are ordinary wording differences: hover or tap to see the other reading.
221 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
Lord, thank you for just continuing to bless us. Lord, just continue to wake us up and give us the best of our mind and judgment. Just continue to bless us throughout our journey. In Jesus' name we pray. Amen. Amen. All right. Have our pledge.

Our copy return receipt requested. May 5th notice ‸ violation was returned as unclaimed. May 8th the re-inspection ‸ property was conducted and it was found to still be a violation. No contact from the doctor. 17 June a re-inspection was done, same status, the 11th same status.

the reference property and observed the property remains violation. This is the affidavit posting when it was posted August 1st to the property. This is the, I'm sorry, this is the request that the doctor sent to the office and he's requesting for a waiver for appearance and a continuance. The reason I uploaded this was at the bottom it says the code enforcement officer has no objection to the request for a continuance. And I know from working with officer Simpson on this issue that he tried for months to speak to the individual and was there was delay after delay after delay.
Here's a photo from today. Same status RV. I'm assuming his personal vehicle parked there. And another closer shot of the camper in the camera. Staff recommendations. Staff recommends the code enforcement board find the property in violation, issue an order requiring the violations be corrected and assess the daily fines of up to $250 per day. violation be imposed if the property is not

was never stated, that he was okay with the continuance. Because he went to the property several times, spoke to the doctor, spoke to staff. So it was a well-known issue that he was trying to get addressed.
If, like, say a property owner is working with us and they're making good faith effort to solve whatever the problems are. Okay. But in this instance, there had been no efforts whatsoever, like pulling permits, meeting, hiring a contractor, nothing of that sort was done. It was just, you're given a violation and then there was no progress from ‸ that point.

Address is 2526 Stanford Drive. I'll be presenting it. Before we go further, I'd like to inquire as far as ‸ legal matter concerning the pending foreclosure on the property. It was initiated back in September of last year. One of the respondents were dismissed, but it is still essentially floating in the legal world. So I wanted to inquire before presenting it to the board as to whether we should continue with it or table it and revisit it again later.

I can give you an update on that if you would like. I mean, there's an ordinance that's pending that um would attempt to streamline the process. um The way the, the way the ordinance is drafted, there'll
Flag: numbers, amounts, negation or names differ between the machine readings; a language review questioned the wording · 00:26:58–00:27:05 · unresolved: the words are not shown (unclear audio); listen to the recording
apply for a lien reduction. That would be the formula that calculates, um under different circumstances, significant reductions right off the top. And then the, the, applicant will be afforded an opportunity to make full payment to avoid any, um any hearing whatsoever. And if they, if they prefer not to uh you know pay ‸ that, um that, ‸ that bottom line number after the calculation, then they can request a hearing

hearing. It's only if the property owner or the applicant decides that they do not want to pay the reduced amount that's determined based on a calculation. So the, the purpose of it was to try to streamline the process and get, um you know, and get the matters resolved, uh voluntarily and administratively. And the formula is based on a lot of, experience and past practice, of watching the lean reductions make their way through the process. So
Flag: words were replaced by a machine repair · 00:28:25–00:28:26 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
amount to try to resolve it quickly and get payment quickly. So it's in it it's a different approach. um And uh right now it's passed on first reading. They'll have one more hearing. We'll see what the council decides. um So trying something a little different.

And I thought we did a pretty good job on it. And they had the final say anyways. So who's coming out ahead? At least they could come and talk to us. We could get things worked out. I don't think it's a good idea whatsoever. But what do I know?

based on what experience do they have? Because they do not come to this room and sit with us when we have these meetings every month and listen or see these people crying when they're telling us what is happening. Like we had one person in here that had, you know, major heart attackThey couldn't handle what was going on.

a violation on his property for a long time, and he wasn't taking care of it. He was overseas. So, I mean, everybody's got different uh problems, and that's why we're here to talk about it. Why else are we on the board? I mean,
Flag: words were replaced by a machine repair · 00:31:50–00:31:50 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
got to talk about this here. We're talking a lot of money to some people too, a lot of money. I don't think it's going to work. It's just my idea, but I thought that's why the city formed the code enforcement. board So we could help not only penalize people money, but to help them. Let's get it going back. I hate to see this old house go down if it goes down. That's a nice location. It's a cute little place. oh ‸ I'd be ready with that with hammer and nails in a minute. but uh i just like to talk to people and get it worked out that's why we're here
an applicant at the end of the day doesn't want to deal with the administrative reduction then they can request the hearing and explain to the City Council the reasons why they want a further reduction so the ordinance doesn't prevent those those things from happening mr. Brown so um you know most of most of themyou‸ want to get into it, most of the lien reduction recommendations that come from the board are, um you know, recover administrative costs.

getting a staff recommendation, going to the Code Enforcement Board, and then going to the City Council again just to resolve a lien reduction where, um at the end of the day, the council just recovers the cost of prosecution. So, they're trying to, the council, you know, is trying to expedite the process a little bit. And, you know, that's what, that's what the ordinance was designed to do.

get a title so I can salvage the car. And you wouldn't believe what I had to go through just to get the title for my car. I think we do pretty good here.
it's disgusting. But I, I, I, I, I'm just one person. I thought we'd done ‸ pretty good job here. I think we got some people that got some good heads on their shoulders to decide and help people.
It's just the whole process, um of, of the city council hearing many of these, uh lean reduction requests. there have been a a plethora of them, especially in the last several months. So, you know, they're in the process of modifying, um the code ‸ enforcement provisions and they're looking for, you know opportunities to streamline process. I mean, so these cities councils do that all the time.
everything work quick and everything. Somebody's going to get hurt. And somebody's going to have to pay for it. ‸ we're playing with people's lives here. I'm 82 years old. I had a bad, bad accident. I didn't break one leg.

I think it's so much better. So much better. And it's because of different boards we got now. People caring. And uh this takes the personal effect away from a person coming in here and saying, ‸ Help me out. Help me out

But maybe I'm wrong, folks. I just want to speak up and let them know. I think that board agrees with me on a lot of stuff here that we got to talk to people instead of saying, well, we've been waiting and it takes so long to do this and that. So many liens have been on for years. What are we going to just get them all through and oh everything's going to be beautiful? No. And besides, what's the city here for? That's their job, to do

is? So they would, if they were like, you know, they do the calculations in a formula and they still don't like the dollar amount. So then they would go to like a city council meeting or they would request a special hearing.
um but I think it also uh going, ‸ going off with what Mr. Brown is saying is, is that we get to hear the citizens come, the residents, excuse me, uh of Coco come before us. And we get to listen to them more humanely than just numbers. Because it's not always just the numbers. It's always, it's just always something else happening.

final decision. And you know I don't know what else to say. um I respect I respect your comments. You've been a very uh valuable um member of this board for four decades. That's
New members have to learn how it goes. I gotta know how this goes. everybody's gotta know how it goes so we get things done in the end and we're not yelling and mad at each other. We're happy that we did what we could do. But
about what you're doing, you care about the citizens coming in, you want to hear their story and be able to weigh in and have, you know, the opportunity based on your long-standing history and experience. But as, um I would speak from just my experience, as a citizen, I would rather have an expedited process only because the wait time is long, because they have to wait for ‸ here and here, then what if, you know, something happens and we don't meet? They like continuously have to wait. So if we look at it from a standpoint of what's better for the citizen, it's the the reduced process of waiting. And so I speak to that because I spent 25 years ‸ United States Air Force and all we did was hurry up and wait. And I really don't like waiting. But I think, you know, the council meeting is still open, we still get to hear. We just don't get to weigh in and make the recommendation. But if we look at what's best for the citizen in regards to their time, giving them their time back and honoring their time, then as long as the calculations include those hardships that we always hear about, where they're allowed to kind of, you know, put stuff in the system where it would get looked at, then it could be, you know, beneficial for them. And I think we should give it a shot.
beforehand. um Or maybe I'll just watch it from the house because that could prove to be a really long meeting. But i I think this may be good for the citizen at large, like it may feel um not, oh not so good to us because it was something that you all have done for years and you extreme, you know, for an extreme long time to be able to weigh in. But I think if we look at it from that citizen's perspective and them having to wait and go to multiple hearings,

So I would probably surmise that they got some pretty smart young folks. They got some statisticians over there that'll figure that out. But remember, that the the citizen can still be like, no, this is not going to work. You all have to hear the whole point of the story.

give to the council, right? Like maybe it is a special hearing or maybe... Because I don't think fighting the new system is going to work, right? So maybe the suggestion is it is a special meeting or something like that to give the individuals their time without, you know, they had holding everybody else's time in a chokehold. We gave them ‸ Right. But all we did was recommend, too, they ended up having to go to city council anyways.

the property and compliance, are going to file the application for the lien reduction, that lien reduction application is going to have them plead their case there in that application of what the situation is. And that will go before the city manager. City manager has the opportunity at that point, based on the calculations to provide them with an approval of here is what that calculation is based on all of the documentation that we have, the value of the home, etc And then he will provide them with a number. The homeowner, property owner has an opportunity to accept that offer or go before city council. So that person will be able to plead that case in front of staff and the city manager for that lien reduction before they can choose to go take that offer or go before council. We're not looking at charging somebody a 200 000 fine and and recouping that. that the

months old because they have sat in a hopper waiting to get in line. And we're trying to resolve that for the property owner so that they can move forward with selling their house and doing the other things that they need to do in order to move forward with their lives. And a lot of them have sat for years without having a resolution. A lot of that is because we've had, we have staff turnover and documents get misplaced. And when you get new staff, you get new managers, you find documents in a folder that have been there for two years. And you bring that back before the board when if we have this process, it will move a lot faster for the applicant.
on a formula and that formula will be presented to the applicant and they can choose to accept it or go to council for requesting an additional reduction.
Yes. Yes. And also providing an incentive. I mean, what when this board conducts a Massey hearing, right, what happens? Code enforcement officers will prepare the order. And the order will be recorded. And that will, you know, then because they're not in compliance. Then the lien starts, right? So, but what does this board ultimately want to happen when it issues an order? Ordering a property owner to come into compliance.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:53:34–00:53:40 · unresolved: the words are not shown (unclear audio); listen to the recording
it has incentives to rec to to the property owner to come into compliance. For example, there's a matrix table. Once that order is recorded after the board conducts its Massey hearing, if the property owner brings that property into compliance within a year of recording that order, they get a 90 reduction on the fine because they acted quickly to bring the property into compliance. It backstops as a, as a property owner incentive to get the property into compliance
generous the reduction is, but there is, there's some serious generosity to get the property owner to bring it into ‸ compliance and then pay a reduced lien amount administratively and be done. And, you know, I think that compliance is the number one goal on code enforcement and there's ways to incentivize property owners that don't come into compliance with a Massey or with at a Massey here prior to a Massey hearing by trying to give them a financial incentive to still bring it into compliance. ‸ even after the board has issued an order imposing the fine.
still like to have the people be able to come and speak to us, tell us their story. I do. Because it's a sad story. Some of those fines are going to bankrupt people. Bankrupt them. a lot of people can't even buy food half the time now.
And I want those homes fixed so when you go down the street you don't look at something and say, what happened there, you know? There's a lot of nice neighborhoods we got, but have a bad home in there? What does it do? tears it up Tears it up with crime and everything else. I mean, we got a lot to, ‸ see,
so we consider it. But our main objective is not that money, because the city don't need that much money to keep going, ‸ to take it take your house away.
like uh ‸ banks that come in and they're stuck with a foreclosure or this or that. We can push some of that stuff right through. Right through. No problem. But there's certain people i I've seen that come through here that was sad. And, uh hey, I'm just making it myself. I'm not in the best of shape now. A couple months ago I was styling. I was just have
a car crash. oh ‸ Look out, folks. Thousands and thousands of dollars gone. I don't even have a car to drive. So I don't want to complain. I'm just telling you, there's other people who've got a lot of problems and they come and talk to us. I don't like the ones that snub the nose. They don't have to talk to us. Well, it'd be smart to talk to us if you got a problem. Don't avoid it. That's like whatwhat the city wants to

Yes, I totally agree with you. And if it's if it's regarding the... uh I'm not sure. Correct me if I'm wrong, uh attorney. I think... Did you say that that City Council is getting too many cases that we've approved uh just for the staff recommendations that Did I hear that correctly?
No, I guess when my question is um that one of the reasons for making this this new process, is streamlined is it because... Maybe I misunderstood you, but uh did you say that they they saw that too many cases were going in front of them because we have reduced it to costs effective? Or cost... uh
Flag: words were replaced by a machine repair · 00:59:39–00:59:40 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
But the council still has to have a hearing and still has to hear from the applicant in order to agree to just accept the costs. And other times the board's making recommendations and, you know, we're going to the council and the applicant still disagrees with everybody's recommendation and they want something different. So there's things that are built into theinto the proposed ordinance to incentivize compliance and to incentivize people that bring it into compliance. ‸ another example, not only bringing it into compliance sooner, gets you a higher reduction. Many times you have property properties that are found in violation. The violator is no longer the owner of the property. Somebody comes in and gives you the story. I know I just acquired the property. I'm the one that brought it into compliance and I should be given a reduction because I brought it into compliance. Well,

but at the end of the day, ifif you go through whatever the formula incentives are and you still can't pay it, you have hardship, you complete your case to the to to the city council and then the council can decide. That's not being taken away from people. um And
go to the city council. Now, you know, the administrative part is that these are, if the council adopts it, it's law. Okay. So the council is saying, basically saying ahead of time with these, if these certain things occur, you get an administrative reduction. If you want to pay that amount, it's all over. put in this ordinance is that at the end of the day, a lien cannot exceed 50 of the assessed value of the property. To add a little bit more reasonableness, you know, of course, you've got to come into compliance, but there's a constitutional balance on how much you can impose a lien, a penalty like that on on property, and it depends on value, right?

exceed 50 of the assessed value if you pay it administratively. Now, that that may not happen in many cases, but there's a circuit breaker in there, and there's legal reasons why that's in there.
