The City's record
What the City's record shows
Draft minutes printed in the City's agenda packet of 2025-06-19, pp. 10–16; approved by the Code Enforcement Board according to the draft minutes of 2025-06-19 (that draft's own approval is not found in the records on file); the motion does not say whether they were amended. The City has not posted the approved minutes. The approving motion, “to approve to the minutes of May 15, 2025”, is in the draft minutes printed for approval in the 2025-08-21 agenda packet (1954_8_21_25_Agenda_Packet.pdf, packet pp. 9–18).

found in compliance.
Property owner was sworn in: Mark A. Yates, 1112 Ohio St, Cocoa
Attorney Eick asked if the previous case that came before the Code Board had been closed. Officer
Simpson started yes; a new case had been started once the property owner stopped communication in
January. He told Mr. Yates if he kept in contact he would work with him. There was a fire at the property
and the State Fire Marshal asked Code Enforcement to come out to the property and do a site visit. This
is when Code Enforcement was able to walk the entire property and get pictures. Attorney Eick reminded
the Code Board members that this was a new case. Mr. Yates gave an overview of his property and why
it is still not in compliance. Chairman Roberts asked several questions about why he did not stay in
contact with the Code Officer and what his plan going forward was for the property? More discussion
amongst the Board members and staff.
Motion by Ms. Scott, seconded by Vice Chair Otero, to approve Staff’s recommendation and give the
property owner until June 18, 2025, and find the Property Owner in violation. Vote on the motion carried
unanimously.
NON-COMPLIANCE:
1. CE-24-860 – 900 Friday Road
Code Enforcement Officer Justin Simpson provided an overview of the Case history and presented
exhibits for the Board’s review. Officer Simpson testified that the Property Owner is in violation of App. A,
Article. XV, Sec. 2 (a) Permit Required of the City of Cocoa Code. Officer Simpson stated a Notice of
Hearing was sent on May 1, 2025, sent certified and posted on the property and property owner
remains in violation.
Benjamin Weismann: attorney for the property owner.
The property owner’s attorney spoke about permits that were applied for. Attorney Weismann asked for
more time to complete the work rather than the date of March 20, 2025, that was given at the last
meeting. Chairman Roberts explained to the attorney that there was no more time to be given as this
was a non-compliance hearing. Attorney Weismann said the property owner was not given proper notice
of the start date of the fine. Attorney Eick responded that a notice was sent with the information of the
violation and the fine start date if not brought into compliance. Discussion amongst the Board members
and staff.
Motion by Vice Chair Otero seconded by Mr. Muller, to approve Staff’s recommendation and find the
Owner in Non-Compliance. Vote on the motion carried unanimously.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
301 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 16 voices separated from the audio.
34 short machine repair(s) (42 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 91.8% of 11,748 content words.
Dotted words (337 places) are ordinary wording differences: hover or tap to see the other reading.
301 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
01:06:13 (9 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
And by our heads, Lord, we thank you for allowing us to be here today. Lord, just continue to guide us and bless us in the best way of the city. In Jesus' name we pray. Amen. Amen. I have a pledge of allegiance.

So he's in the process of that. So then ‸ the second that approval happens, that permit will be submitted. So currently, all of the issues that have been raised in the past are being addressed. And there is progress and there is compliance. It's just taken a little bit longer because unfortunately, I'm sure everyone who's worked with contractors before knows, they don't always respond or do things as quickly as you would like. It takes you really it takes time to find a contractor willing to do that because the contractor is legally liable for the previous work when they attach their own permit to it. Yes. So the essence of it is originally we got this. I'm an absentee owner as stated, so it's pretty challenging, but that doesn't exonerate me from any responsibility. But I got the original ‸ communication of the violations and took care of all of them immediately, except the situation with the roof.
that the violation was based on dark spots on the roof. There was no leaks. So I questioned the validity of having to replace the roof. So that went on back and forth until they referenced a couple of codes and whatnot. So, you know, I exceeded it, went, pulled the permit. But I will mention, actually, we came here for one of these hearings. And they gave me a certain timeframe to do the hearing. And then after that, there was some storms. And I ‸ did the due diligence of getting some estimates and whatnot.
the least, but I pulled the permit and we finally got it done and taken care of. So that's it. And there's no violations, no nothing. That's the gist of it.
So now you felt like they were, because there were dark spots, there were, there were no leaks inside. Um, I mean, again, I know you're a general contractor, but like, if you are working with them, they usually, we don't even end up with to get to being a violation.
Where do we go in that process being a general contractor? And then they're trying to tell you what they see is wrong and you guys going back and forth. So my, my thought process, general contractor, you, they tell you, this is the deal. Then you guys get together and see what the deal is.
Oh, so we spoke this afternoon? Yes, sir. Oh, okay. So, uh, and, uh, from my perspective, I've been very communicative and, and cooperative the whole way through. So I, you know, I, I don't know how to answer that. I, the whole time when they've requested something, I've complied. Sometimes it's taken some time, but we've addressed any issues or concerns, except that whole roof thing, which, like I said, it was a debate because I didn't feel it

that you're doing something that you're not going to be in violation. So again, I'm still, my disconnect is you ended up coming here for being in violation. And I'm just still trying to understand how we get here. You
so he was having problems getting contractors, but he kept in contact, but it was, you know, he had ‸ came in front of the board and, uh, you know, then reached a non-compliance date, but he kept in contact even during, you know, during, during the non-compliance hearing.

so do you have any idea where, where the ball dropped? Because it ‸ had to be a disconnect. They cut in the chain for a general contractor to be standing here in front of us over a roof issue.
you guys work with them. And then even when you come in here, we understand how difficult it is to get a roof done. ‸ And we give people a lot of grace because of the roof issue.
I think I'm understanding. I think somewhere in listening to you, my thought process is maybe he wasn't given enough time, given the fact of the contractor issue, that maybe he wasn't given enough time to correct the issue. And maybe that's why it went into default the way it did is what I'm thinking. So like, for example, ‸ hurricane, we know we had it bad last year. You know, let's just say, for example, he was only given 30 days.
30 days is not really realistic, given that contractors were price gouging and not available and giving them ridiculous prices. And maybe he wasn't given enough time because given the testimony, he was in constant contact. He, you know, I ‸ think maybe given your, your question, maybe he wasn't given enough time to fix it.

Do you guys have the ability to wait one more month to bring it in front of us again to say that he's noncompliant? Or are you required to bring it to us at that 60 day mark and say, he's noncompliant at this point? However, there's a storm. There's extenuating circumstances. And we would like to extend his timeframe. Do you have that ability?
If you give them a compliance state, they have to comply by this time. And even if the, if the, you know, the court board attorney can confirm this, even if we don't have, you told them to comply by, you know, January.
