LIEN REDUCTIONS
1. CE-09-102 – 1112 Myrtle Ln
The Code Enforcement Board held a public hearing on June 18, 2009, at which time the Board found the
owner, Patrick Badgett in violation of the following: Sec. 6-105 (a) permit required.
The Code Enforcement Board provided the owner sufficient time April 3,2009 to correct said violation.
Therefore, consistent with the Code Enforcement Board’s Order a Non-Compliance Hearing was held on
January 25, 2010.
The lien ran at $50.00 per day from April 4, 2009 until compliance was achieved on September 6, 2024.
Code records show the case was closed leaving a fine of $281,720.00. The current owner (Richard
Carey), is requesting that the lien be reduced to $5,000.
Staff utilized the following factors in making its recommendation to reduce the lien:
•Whether the current owner owned the property at the time the violation(s) occurred; No
•Applicant resides at the property: No
•The number of violations related to the subject lien; One
•Number of Inspections performed: 24
• Property Taxes: Taxes are paid through 2024
• Other Liens: Records show no outstanding liens on the property. No water liens
• Property Inspection: The property was inspected this morning, March 20, 2025, and
was in-compliance before the Code Board Hearing. An inspection will also occur prior
to the Council Meeting
The current market value of the subject property; the current market value is $179.000.00 according to
the Brevard County Property Appraiser as a Single-Family Residence.
Staff submitted their cost sheet and the in total amount of $3,074.43
Staff’s recommendation is that the fine/lien be reduced to $3,074.43 which is the cost of staff to prosecute
this case. This reduction is based on the gravity of the violations, the length of time it took the property to
come into compliance, and the total amount of the City’s Cost.
Property representative was sworn in: Elizabeth Felipe, 1090 Bianca Dr, Palm Bay
The property representative answered questions from the Code Board Members. They asked about the
cars in the driveway and was it a rental property. Vice Chair Otero said there was a car parked in the
yard which is a violation. The representative stated there is a renter living at the property. Ms. Scott
asked why the property owner asked the lien be reduced to $5,000.00. More discussion amongst the
Board members, property owner and staff.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
185 suspect passage(s) marked in place; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 11 voices separated from the audio.
10 short machine repair(s) (12 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 92.6% of 7,726 content words.
Dotted words (244 places) are ordinary wording differences: hover or tap to see the other reading.
185 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
00:02:19 (3 s) — neither reading has words
01:03:27 (10 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

2025, okay? So, that's the official date that the squatters were kicked out of my father's home. Mind you, they have completely demolished and destroyed my father's home. um The disgust and the filth that was allowed to go on and they were still there and then not be arrested for squatting or anything like that or any type of accountability on their parts is appalling. But they had no accountability. They just left. And so,
okay? So, the um pictures that you see on what was that? March the um 7th? Those pictures right there are are me paying people, uh contractors to clean the the filth that they had all around my father's home. ‸ mind you, my dad passed on
I was not allowed to get in there to get any of his possessions or get anything. Their filth had contaminated all his stuff. So the the stuff that you see on March the 7th, that is their filth and everything that my dad possessed had to be trashed. Okay, so I came down on March the 8th. That was the day after they had put a sign in my in my yard, ‸ in my dad's yard, which is now mine, in the yard, and um to see how the progress of the house being cleaned was. ‸ Okay. um Mind you, I live six hours away from here in Alabama. Okay. So I came down on that weekend to see how the progress was to see the letter in the yard from the code enforcement. Okay. With the notice of this hearing today. That was on March the 8th. This is March the 20th in the middle of the week where I had to take off work to come down for something I just got in the mail. So officially in the mail, I got a certified letter right here that

certified on March the 12th. I was able to pick up the actual paper because as you see right here back home, if you you miss a certified letter, they put one of these in your post office box to tell you that you've missed a certified letter. Okay. So ‸ on the 13th at 8 a.m i went to the post office and that's when i got this letter that is notifying me of this particular hearing right here. um and so that was on March the 13th. That's last Thursday for me to get here for ‸ hearing. So all that said is I'm a little confused because from what

on the the timing of um needing to get everything back into code when I'm just now being made aware of anything um other than we finally got the sheriffs to get the squatters out of mymy father's home. And i was just, I'm just able to be able to get it cleaned up. So the timeline is not, is not um fair or suitable. um I was, I was, ‸ listening to the prior

I'm just now on January 31st, even acquiring this property. So I need more time to be able to get everything um up to code. That is my father's property. That is my inheritance. I'm fully aware of his condition. I'm hurt deeply because of its condition. um It is not going to stay like that. But the time period needs to be extended.
Okay. Well, again, thank you for coming. um We want to get this taken care of. We're not looking to try and make money off you by no means. um did you when you came to the property did you find a notice posted on the property
I actually picked this this paper of the hearing up from my post office, signed for it, which you all can check and see with the certified the certified mail and everything on march the 13th 2025.
okay let me ask you a question now going back I know you're saying uh ‸ picked it up in March, so there should have been something posted before then uh previous time when you were here.
When you say that you had the squatters there. So shortly after that, it was found inin violation. Excuse me? am i Am I right or wrong? At some point in time. um I just want to find out when did all this transpire uh after Yeah,

that I didn't even have to come to this hearing. And I was like, no, if this when I got this in the mail and it's a whole legal process, I must represent myself. So the very first time was March 28th, 2025 is when

is for the windows. It is secured. Knowing the situation that the young lady has gone through in the passing of her father, I would leave it at ‸ discretion of the board. I mean, the tax rolls currently have the address for the mailing at, you know,

Okay. That's, that's the correct address. I have mail. If you all want to see the mail, um that is stamped from, from the um from rachel m sandoff clerk of the city court and um comptroller from january to 6 2025.
which was needed to be able to get Amanda Lee Grant and Courtney Dwayne Brown out of the house and their occupants, whoever they had in there with them. And mind you, they busted out every window in my father's house. Like, it's despicable.
code enforcement's goal is voluntary compliance. If she's asking for additional time farther than, uh June, then I would leave it at the discretion of the board. I mean, we have an open line of communication with the property owner now. I gave the young lady my business card. She's got my number and officer, uh Simpson's number. The property is secured. If you notice the picture from today,
from all the debris, the fence in the yard, the trash that was on the side of yard and the rear of the yard. We did have two previous violations. They did comply with that before today's hearing. So, with that being said, I would just leave it at ‸ discretion of the
a contractor to have the windows replaced and get a permit for that. That may take some time for her to find a contractor that's able to go ahead and put the install the windows and get the property cleaned up the way she'd see fit.

Now, what is and I'm sorry, just ‸ second. um So but you said you're saying it's leaving it up to the board. But as long as it's covered the way it is, is that it would that be fine? What would.
No, because it's exterior structure. And as the code says, I mean, yes, it is secured for where they won't have many squatters. Right. In the in the building anymore. But the
it could, you know, invite other folks in there like she just had evicted. So I would ask the board to hold her some kind of time frame to. and But, you know, at the same time, understand the situation that she's in and give her some time to hire a contractor and place the windows in. there

paint starts chipping or something in that effect. And then I wouldn't want it to be a repeat offense so that, you know, you understand so that everything is covered now and she get it taken care of. Or instead of like in the six months she gets the windows done and then y'all come back and say, oh yeah, by the way, the roof needs to be done.
According to the inspector that is expected to cite the roofs in fair condition. The only question is the windows, for the exterior structure at this time. okay And as a code enforcement manager and working with the property owner, I wouldn't let that happen to come back
Flag: numbers, amounts, negation or names differ between the machine readings · 00:37:56–00:37:58 · unresolved: the words are not shown (unclear audio); listen to the recording
concern, my concern is, number one, I'm not from here, okay? Number two, I will have to hire someone. So I do not know the time frame of your contractors nor building material and stuff here. So
foot in my mouth and have to come back before the board and say, oh yeah, no problem, I can get it done within two months. And you all, your contractors and stuff are backed up three, four months. You see what I'm saying?
It needs to be something better where it can be done. Number one, nobody in this room wants this property looking better than I do. This is my father's home.
Just. Can we do a follow-up? Well, that's what I was going to suggest. I would incline to suggest that we go 180 days with updates every 30 days. Because essentially, as from the outside looking in, what this property needs, it needs the TLC. But the most important thing is being secured and the board taking down in windows. um Whether windows, the whole window need to be replaced or get a glass company to come in and replace the actual glass. Which is something that's possible because just replacing the glass um wouldn't need a permit, correct? I believe that all the windows have been
to do that. Because, as she had noted, um the time frame of backlog, uh we're finding that it's taking uh individuals who have with issues with their windows or doors.
I mean it there's a lot of construction going on and there's a lot of uh windows and doors that are being replaced um throughout the city and throughout the county. So
So I would like to see some type of plan to where we get some type of updates to ensure that she's her due process is being done but we're also um being ‸ realistic to ensure that number one this task can be done in some suitable time
Flag: words were replaced by a machine repair · 00:42:31–00:42:32 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
you. The goal is to allow you to get this especially with uh with mitigating the circumstances and you don't even live here. So that is understandable and uh we sympathize with you. um question now you had something chief? I'm just letting y'all finish. I was waiting on the motion. Okay. um I'm looking at just seeing if we could table this because opposed to just going ahead and ruling on it. I would prefer to to table it for 30 to 60 days but still with updates to find out where we are with it. Because again she's done some work already. She's done more. She's gotten two things complied and there were three things on ‸ there. So with that being said she's diligent trying to make progress. um that's

six months to even get a permit, um i I think that may be somewhat of consideration from the board to maybe table it, if that's what you're going to do, six months to see what they could bring back and
could bring back if she's even attempted to do that. That might be, because every 30 days you might not get a whole lot because everything is backed up. So she, just like
to where we forget about it, but we still may have something to talk about it to see where it is to say, hey, we'll table it again because she's trying. So it's not like other things that she's not trying. So she's made progress. okay
have a contract or something, showing improvement within eight months and bring it back to the board? That way and then we we don't, we're not holding,
a stash report. We have it on the record. We have a board order on the record. Instead of table it and pushing this and kicking can a can down the road, we go ahead and hold the one, the property owner responsible, and at the same time we're working with the property owner to get voluntary compliance. So we're asking for, I mean, staff, my recommendation to the board would be
have them come back and show us a contract, show us that they're working, that they have it lined up to go ahead and have the windows installed, or at least a couple quotes, something to show us that they're moving forward with an eight month time frame.
specific actions by any specific date, ‸ getting a contractor, that sort of thing. I think maybe, you know, the best that we can do is table it or give a very long time for compliance. um Because really, you know, what we're doing here in this hearing is just finding if she is in violation or, um uh yeah and you know, what fine might be appropriate to impose. um But certainly we can table it and you know check in, that sort of thing. But as far as specifically ordering her to do XYZ, getting a contract, I'm not sure that's a something we should do.
All right, so check this out. How about this? I'll make a motion. uh I'll make a motion to table this six months. Second. Motion on the floor with a second. All in favor say aye. Aye. Those opposed? Motion passes unanimously. How about that, ma'am?
All right, well, again, um just make sure you touch base with him so you guys can have an open line of communication so we can find out where we're going.

so we usually buy the properties as hardship properties directly through members of the family, like in this particular case where it went through the probate. um they do run a title search on the property um because this was in probate I'm going to assume um and I say assume because I'm not Richard who knows the full story that they couldn't do anything with the property till it finished going through the probate, and then they immediately started working on the property.
we didn't purchase it through the title company we went directly with a family member so it was not your traditional closing where you get to the title insurance

Right. They, they run a title usually on the property as they're working with the sellers to see if there's any value in the property. And if we've purchased a property like this particular one that had a code matter or something, we know that we're going to be fixing the properties because we don't leave our properties um in disrepair. We, to be quite honest with you, we, we bring the properties to great condition. If
