Lien Reductions:
1. CE-20-1252 – 1203 Alamanda Lane
The Code Enforcement Board held a public hearing on February 18, 2021, at which time the Board
found the owner, SAI PROPERTY INVESTMENT INC in violation of the following:
XXII.Permit Required App A Art. XV Sec 2 (a) XXVIII.Rental Business Tax, Ch 6 Sec. 6-2003
The Code Enforcement Board provided the owner sufficient time to correct said violation. Therefore,
consistent with the Code Enforcement Board’s Order a Non-Compliance Hearing was held on June
18, 2021.
The lien ran at $25.00 per day from May 21st, 2021 until compliance was achieved on May 23, 2024
Code records show onsite inspections were conducted by Officers Steven Murdick, Augusto
Gonzalez and Myself. The case was closed leaving a fine of $27,450.00. The current owner, is
requesting that the lien be reduced to $1000.00.
Staff utilized the following factors in making its recommendation to reduce the lien:
•Whether the current owner owned the property at the time the violation(s) occurred; No
•Applicant resides at the property: NO
•The number of violations related to the subject lien; Two
•Number of Inspections performed: 11
• Property Taxes: Taxes are paid through 2024
• Other Liens: Records show no outstanding liens on the property. No water liens
• Property Inspection: The property was inspected this morning, January 16, 2025
and was in-compliance before the Code Board Hearing. An inspection will also
occur prior to the Council Meeting
The current market value of the subject property; the current market value is $147,350 according the
Brevard County Property Appraiser as a Single-Family Residence.
Staff submits their cost sheet and the in the total amount of $1,685.16
Staff’s recommendation is that the fine/lien be reduced to $1,685.16 which is the cost of staff to
prosecute this case. This reduction is based on the gravity of the violations, the length of time it took
the property to come into compliance, and the total amount of the City’s Cost.
Chairman Roberts asked Manager Wilkinson the date the case started to when it came into
compliance to stop the lien. The case started in October of 2020, found in violation in May of
2021. The fines accumulated for 3 years with 2 violations. Attorney Spira stated he was there to
answer any questions about the property. Chairman Roberts wanted to know why the property
owner did not try and take care of the violations sooner. Attorney Spira stated that the property

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
159 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 10 voices separated from the audio.
12 short machine repair(s) (17 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 91.9% of 6,001 content words.
Dotted words (193 places) are ordinary wording differences: hover or tap to see the other reading.
159 passages (27% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

do is you would open the floor for nominations. And if there's more than one nomination, then you would vote on those individuals in the order, you know, in like alphabetical order or whatever. And the person who receives the majority would be elected. So, um since we have two, then that that's what I would suggest is you take them in order.

Well, there's no secret ballots anyway. You would have to put your name on it. um But if you would like to do it by writing it down on a piece of paper, that's fine too. Or you can just do a verbal, um you know, ‸ a verbal motion.
Sure. the the The board can do either one. ‸ But if you're going to use, if you're going to write it down on a sheet of paper, you do have to write your name,
um That is up to the board. I mean, if you would like to postpone until um next month, I believe that's fine as long as, um you know, the chair is willing to serve right now. And I assume you are, because you you're you're actually the chair. So, um
continue. To the will of the board, what would you like to continue to next month? A vote to continue next month. All in favor of next month, say aye. Aye. If that's what you want, i

Those are in compliance, so there would be no fine imposed for those because they they came into compliance within the time ordered by the board. yes so what I think their staff is trying to present to the board is that there will be potentially two violations that will that were are in non-compliance and there will be a $25 a day fine imposed for those two. correct And they're just trying to inform the board of that. It's not imposing any new fines or changing the board's order from pre from the previous hearing
Okay. So now just from ‸ board standpoint, is anybody else thoroughly confused? because again I understand what they're saying but that's not the way it had been before
and that was it It wouldn't be, it wouldn't be that we are, are, what is it? What is the word? I forgot the word just doing it separately right you see ‸ I'm saying it was just like you in non-compliance compliance and that's just that was it for the whole thing and not just does that I mean like like like you in compliance or you non-compliance and that was it or just you know we
of violation are prepared and we are making recommendations on fines for each individual violation and so um when a non-compliance case comes back to you, you do need to determine each violation individually whether or not they have come into compliance. You are not saying you're just in non-compliance for you know for all of them. you're You're determining that for each violation individually.
so essentially this is just my thought and maybe I'm thinking too far so if it's if it's done like this we're gonna ‸ have a almost a separate case for each violation. When you look at it, because now instead of, okay, they had four violations and usually they're supposed
Flag: numbers, amounts, negation or names differ between the machine readings · 00:20:39–00:20:40 · unresolved: the words are not shown (unclear audio); listen to the recording
they had to have all these violations completed by the date. So now they have they complete two and still have two left. So now we're still now they're being separated. Correct. correct

can I ask the attorney a question please if we uh you have ‸ on the order they're finding the fact for the August hearing we had four violations So if they, uh for the compliance here and you had

They reverted and now one of the previous violations that was cured is now no longer cured. Are we gonna ‸ open that back up? It's kind of like a wormhole.
so if for example if one of these ones we complied this this evening we'd have to start a whole new case send, give them a notice of violation, give them time to correct, then bring it back in front of the board, possibly as a repeat or just a regular case.
sir that's if the ones you comply tonight later on next week or next month they have the same type of violations then it would be a new case brought from the board but it'd be the same violation has that happened yes
Flag: words were replaced by a machine repair · 00:24:46–00:24:46 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
Can we make a motion to amend the agenda to take one off without reopening the other? ‸ because again my thing my thought process again like I said before we have to be spot on spot

all on the same page. So so you if you have an individual that have say, four violations, they go out and check, they fix two. When they put it on the agenda for your review when it comes up, technically, in my opinion,
Flag: numbers, amounts, negation or names differ between the machine readings · 00:27:09–00:27:15 · unresolved: the words are not shown (unclear audio); listen to the recording
not fixed. So it should be on the agenda, and I just want to make sure you're on the same page, as non-compliant. They can still update the board if you want to make any other changes,
in compliance are in compliance, and the two that are not are in non-compliance. You would make the differentiation there. Okay, so... Not just say they're all in non-compliance Okay.
So as far as the gender purposes, you would have two sections, kind of what he was talking about, where you have compliance with the two. And in the non-compliance area, you have the same address.
Flag: a language review questioned the wording; numbers, amounts, negation or names differ between the machine readings · 00:28:19–00:28:20 · unresolved: the words are not shown (unclear audio); listen to the recording

believe so yes so what I'm trying to get to is your client on this property at that time. They had two violations. They have multiple properties in which they had to had to do maintenance on those properties and had to get business tax receipts for those properties what was going on that they didn't take care of this property and I asked that question for specifically and I'm gonna put it just plain plain as I can be it's ‸ in the area where we would normally call the hood so is there a reason why your client did not give attention to this

they're paying their attorney. They could at least sit in the maintenance guy or somebody that did some kind of work that actually knows something about the property because they just said the attorney and the attorney has nothing besides he's here representing them.
have to confirm that I'm asking because like the this it's it's a a lien that's been going and then they've been making money I follow off of it from this property and and just now coming into compliance and it's not that work I mean because it's just like if ‸ I'm not mistaken and I'm I'm a truck driver so like you just go and apply for your license right? And
and now you ask I mean now they're coming for a lien reduction but you know I mean to me and not against you but to me and I'm just gonna voice myself you've been making probably

think it's a little presumptuous as to the amount of the rent and whether or not it was taken in I don't know that I don't have the answer to that right right you may have the answer to that because you have the water bills so you may know if there were tenants there or not I I don't right
done followed followed this time because it could have went another year before they applied for their license I mean you know just get this permits required that they needed so I I'm just that's that's my voice that's all
