Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
423 suspect passage(s) marked in place; inspection incomplete: language review; 3 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 18 voices separated from the audio.
41 short machine repair(s) (47 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 90.3% of 16,548 content words.
Dotted words (519 places) are ordinary wording differences: hover or tap to see the other reading.
423 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (3 stretches). Something may have been said here that the transcript does not have:
00:11:34 (2 s) — neither reading has words
01:37:45 (21 s) — neither reading has words
01:45:28 (9 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Thank you, sir. Welcome back. Thank you. Do so noted. All right. So with that being said, we at our last meeting, we had our voting for our chair and vice chair.
was that there were a number of board members not present. So I would recommend that we open the floor for nominations and then to ensure you don't have any additional ones. Yes, ma'am.
you still? Yes, yes, sir. Okay. Yes, sir. Are there any other nominees? Okay. So we have two that are present. So what is the protocol due to Mr. Brown not being here?

They should be coming into uh compliance, hopefully by tomorrow or whenever building will send them back there, accepted. So, but as of tonight, they are still currently in violation. the
the following next couple slides, you're going to see uh the violations for prohibited uses and structures. The violation did exist because the business engaged in selling alcohol bar lounge type atmosphere, which needs special permissions by planning and zoning. Plus, they did not have a current BTR to operate for the uh their back uh back unit. So, ‸ here you have the uh the original sign that was posted there. As of uh yesterday, they posted a new sign there stating that the backyard is closed. They are no longer conducting business. They are in compliance um for violation of prohibited uses as of this time.
when you um clicked or took a picture of the QR code from the first sign, this is where it brought you um on your phone and this is kind of what brought it to our attention for the prohibited uses. As you'll see through the slides, they had uh numerous activities and different events that they were hosting in the back they they called the backyard. um As you can see just from this slide here, rotating craft beer selections. um Just a couple other different things that they were trying to incorporate. And then of course this one here, all day happy hour, again, meeting the special exception which they did not have. um Also the violation of the BTR for not operating a business whatsoever. um These are the different inspection dates that we went.

imposed. Any violation of the same code by the same respondent within five years from the date of this order may be treated as a repeat violation for which a fine of up to 500 per day may be imposed.
so this is what we talked about last week for those who weren't here we're looking to go on record to say there was a previous violation that has been corrected. So no fine for that, but still have one violation. And with that being said, if these, if this comes up with this business again, within the next five years, instead of going 250 per day for the violation,

from now. and Let me make an addendum to that. um Just because there was a previous violation and they wanted to ensure that it's in the record that there was a previous violation for prohibited uses and structures, but it is now in compliance. So I want to ensure that we read that in.
It was the if the board's going to find that they were in violation, but they are in compliance now and no fine be imposed. So that would be number five And then the BTR would be a number one on the motion sheet.
it off. Just like we were discussing last time. Yes. okay for uh I guess for instructional purposes we're going to go with uh first violation which is Chapter 12 Local Business Taxes,

So we initially we're going to bring this just to have uh noted of the violation with no fine. And then when we did a little bit more research, we found out the no commercial rental use. um And then that's why he went ahead and applied applied for it. From my understanding, he should be able to get it by as early as tomorrow. It is all and how quickly the building department processes his request. The application is in.

So I moved to find respondent. Was in violation of city code as chain charged and failed to correct the violation by the time specified for correction by the code enforcement officer. ‸ That violation is now corrected and no fine is imposed. Any violation of the same code by the same respondent within five years from the date of this order may be treated as a repeat violation.

Well, I asked because we have it 250 per day on the first and then 500 per day. So, verbiage should be taken out per day for 250 But, remain for the 500
That's specifically for the BTR only. That was uh an error on my part. The 250 is just a flat fee or a flat fine of 254 BTRs only. In other instances, you we could do 250 per day for uh per violation.

uh site plans are usually required in order to get building permits. um The site plan that is on file is from the previous owner. There's no current um site plan on file for the work being done. And um from my understanding, the owner originally was speaking with planning and zoning on trying to convert it to rental and leasing ‸ apartments. And he was instructed then that any construction being done or any conversions would require site plans. um And thus he decided ‸ either to not go that route or I can't really speak for the property owner. But he was told then that site plans would be required.
So I guess I have to advise the board that building permits do not require site plan approval. A site plan would be triggered. The need to obtain a site plan would be triggered if there was a change of use
Flag: words only one machine reading has (possibly not said) · 00:31:03–00:31:07 · unresolved: the words are not shown (unclear audio); listen to the recording
that would be the focus i would I would recommend to the board that you focus on that issue um because that is the only thing that would trigger the need to obtain a site plan approval.

And to your knowledge, everything from what you showed from January to now that was done without a permit or anything because they were still under the stop work order?

on 5 February. According to him, he believed that since he had been in contact with CEO Gonzalez, that there was no more violations or anything. So he removed the stop work order. We posted a new stop work order because still no building permits or, anything had been filed with the city. And he was still constructing and still making renovations. uh we visited the property on 4 February and he had actually covered up the stop work order. And then when, uh myself and my manager spoke with the property owner on 5 February, ‸ had been completely removed, uh from where we had posted it.

a change of use. And the premises has been operated as a motel the entire time. There was a period in the very beginning where he was using more exacting standards for who he would let uh into the motel purely because, as you saw from the photos and as you can imagine, there was lots of issues with ‸ the premises. There was issues with the previous owners, uh people who were being there in terms of crimes and there had to be officers on site at all times. So as part of a plan to improve the clientele of the motel so they could be safe. So it gave the appearance of a lease of this appearance of a apartment complex, but there's not been any apartment rental occurring. So with that, there were

understand ever since a communication he had with code enforcement that they're referring to that type of language has been removed. The only thing now that he is doing that's in any way similar to uh apartment

he does still do background checks on people if they want to. But he only offers daily and month and uh weekly rentals. So a daily and a weekly rental is not an apartment complex and it matches the use of the zoning and the evidence.
So there's not actually any evidence before you of apartment uses other than some signs from a long time ago. There's no current ever since the notice was posted uh in September. And then we move on to the accumulation of trash and litter. There's been no pictures presented of trash and litter that's been there since the notice‸ violation was posted. And I do have some photos of the premises. And as you can see from his photos and if you would like to review these photos if I could approach. uh For you guys to review them if you're interested. It would show that there's not really debris anywhere. So obviously he needs to,
the debris needs to be removed, but there's not currently any debris or trash issues with the premises. And then when we get to the experienceexterior structures, of course, ‸ you're sort of in a catch-22 here. so And this is why

allowance for fixing these types of things from an emergency perspective. Now, he was supposed to apply for the permits much quicker than he has. And there's been a miscommunication of what's required from a permitting perspective from the city versus the state. That's why I understand from speaking to the owner. So
walls anymore. So there isn't actually an outstanding issue for one, two, or four. And the only thing I would request that's different, from other than, of course, a finding of only a violation of number three, is that maybe there's given a 60-day time period to apply for the permitting to get everything up to code.
Flag: words were replaced by a machine repair · 00:37:48–00:37:48 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
contractor, uh in doing so, it does take a little bit of time to get that approved and to get all that corrected. But construction, there's no more construction on the premises, as I'm aware.

‸ What happened to this? I know they probably didn't tell you. But what happened with the stop work order? Because when you post a stop work order, that means everything stops. So then they should be able to get in contact with code enforcement officers to actually have some communication, some clear lines of communication before now we go spend out more money when we possibly shouldn't be doing this at this time. So let's address that, because that's one of the things I have the biggest problem with,
completely agree, sir. I think that the issue there was he spoke to a code enforcement agent, I believe his name was Gonzalez. And from his understanding, Mr. Gonzalez had ‸ what had approved it. I don't think there was a misunderstanding here on how this functions, I think. And it

Lofts. He believed that uh Augusto said everything was fine, and that's why he thought the work order was dispensed with when he explained to him Because from his understanding,
to discuss converting this uh motel into single bedroom apartments. And he found out about the zoning and all ‸ that, so he changed his mind from that. And I think that, along with these leasing postings, which is obviously not the smartest idea of a way to you know increase uh the uh type of the value of the property in terms of people who are um staying there, uh it was probably not the best method, but that combined uh finding with the previous discussion is what led to this belief that there was a single bedroom apartment uh rental scheme going on. Which was not the case, and then from his communications with Mr. agosto uh Mr. Gonzalez rather, I believe there's just a miscommunication here where he thought when he spoke with him he toured, he has toured the building with the code enforcement multiple times. He believed that
Officially, there were officially they were two stop work orders. um we had We had told him when he covered up the second stop work order and removed the covering that that was his third warning of a stop work order.
So the ordinances do consider a circumstance where you can ignore even a stop work order to fix those. When you have an issue with the structure, like for example, if the structure of this room randomly collapsed, of course, you should be applying to it for a building permit immediately after. That was a huge mistake and that's what needs to be fixed. And I think we can all agree there needs to be a permitting fix here so everything's permanent. But you are allowed to immediately fix structural issues even without permits and even without uh the with a stop work order. That's what states in the Chapter

Well, I guess i it's not my place to advise the board to dismiss or not. um But what I'm saying is that you would need to determine that there was a change of use. And meaning, I think that the testimony has been that it was a motel and that it is no longer operating as a motel.

So, again, on the, on, without, the issue of, without a permit, the attorney has, is admitting that there is a violation of number three, which is failure to obtain the building permit.
The reason why I'm providing that is more of an explanation of why, um the, hotel the motel operate acted the way he did. It doesn't excuse his conduct. He was supposed to get building permits, and he didn't. But it's why he did it, and the idea is about, the ultimate goal here is to come into compliance, and to act in accordance with the law. And it's more of an explanation that was not a willful, as I know how it sounds, but I'm trying to explain. ‸ he wasn't, it sounds like he just gets these stock recorders, trashes them, and ignores them. And I'm trying, and I'm just providing some context for why he acted the way he did, because he's not, from my understanding of them, there wasn't this, ‸ under uh intentional willful violation violation. It was a negligent violation of thinking that there was this emerging had to be done. And then when co-enforcement walked the property with him, misunderstanding ‸ the words that they were telling him.

you go to the picture for today? Because we're looking at this one. Now the building looks completely different. That would not constitute as an emergency, though. So,
You know, it had to be done. You know, they had to ignore everything. But now we're looking at a completely different building. I don't think that would be an emergency to ignore
there hasn't been structural changes. So when you do repair a window or you repair an awning or those types of things, it will look completely different. Even if from a structural perspective, the outside may look different, but the inside, the core structure has not changed at all.
Right. But if there was a stop work order, the building looks painted. So if, a stop if correct me if I'm wrong, if a stop work order, that means stop. ‸ Like you can't do anything, but they continued. They
know, I understand what you're saying. The emergency parts, you know, the doors, the windows, stuff that will put in danger ‸ the public. ‸ but I don't think the public's in danger by painting the building. I don't think the public's in danger. I
I guess I just want to advise the board. I think we're getting a little uh off topic. um Frankly, I would suggest that we focus on the actual violations that were cited because failure to, you know, to abide by a stop work order is not even a cited violation here. So we might be getting a little bit off topic.

‸ and while while we're waiting on that um this attorney so in this uh number one my question is is because of the time frame, and they may, they have brung it into compliance from then to now, even though it was a forward or previous situation. So even, um but, and uh Officer Simpson didn't bring it into compliance. uh So will we wait for the officer to bring it into compliance or by his testimony and showing that it is brought into compliance, then that's still acceptable?
if the board were inclined to find that a violation did exist, right, after the notice of violation and the time given in the notice of violation, ‸ but it has since been corrected, that is also a possibility in terms of emotion and there would be no fine imposed for that. So that would be again, a number five on the motion list. If that's what the board was inclined to do.
So, again, it's it's been seconded, so it's really not permissible to do that. So, but if if the board as unanimously consents to rescinding the motion, then you can kind of start over.

yeah‸ totally understand that, but I thought the process was that we went through the steps completely, and then... when the board... denies or does not uh pass the the motion, we can go back and rescind ‸ right? Isn't that what we're supposed to be doing? No, we were saying now we can go ahead and just skip that and just say automatically rescind. When
uh to to rescind or withdraw the motion, then it can be withdrawn. You don't have to go through the whole process. But that's, again, only if there's a consensus. In this case, there was. Okay.
Well, we have not. you Theyhe testified to those things, but has those things, are those been proven, especially as far as the site plan? Because that is the biggest thing, because once again, you put a sign out and now when you put that sign out, you're changing the in the usage of the facility. So now you can't just say, oh I take that back because now you showed intent to do something different. So, it has not been proven that that's the case. ‸ Again,
it's the code enforcement officers burden to prove that there was a change of use. That it was essentially that it was a motel and that it is no longer operated as a motel.

full compliance so that we don't have an issue here. words in your mouth for when you found it, but part of what I was suggesting is, is you were thinking of tabling it. If we tabled this right now, it would give them the time to provide the case that you would want for some of these evidentiary things. And
after this hearing is to go get with the contractor, get everything uh fixed. As you can see from the pictures, there's not an intent to, you know, operate a subpar facility or anything like that. There was just a huge misunderstanding. So I do believe tabling provides both sides a more equitable outcome.
because we was just on this for a really long time, so I was going to recommend that if, I was going to recommend that if we do decide to table it, that we table what um we're unsure of, right? Like we got proof that there is probably no trash. We know that the exterior structure was fixed because the windows and doors and all of those things were fixed. So then the only thing on the table is three and four. If that's the case, if y'all are still confused, I i don't feel confused. But if there's still some unreadiness, ‸ we're going

My recommendation would be finding the facts for one and two, a fine, daily fine of 250 a day for all the permits required effective ‸ immediately, and then table number four. Or draw number four, I'm sorry. Okay. It's a commercial property. They're currently active in the business. They've got residents residing in there, and there's no permits. Pull. And there was three stop work orders prior to today's hearing.
No actual evidence provided that anyone's there right now. But also, it would be drastic to have one person in a code enforcement hearing being given immediate fine when everyone else, in their own recommendation, gave a month. So if they wanted to do that, at the very least, I think it would be fair to give a month to come into compliance with building permits, it's not even possible to get burning building permits that quickly.

initially talked to the real estate agents on the property she told me that the property has some violations. And, well, first of all, it was owned by the bank and
We were supposed to close within 30 days. And then the agent got back to me and said that the bank was taking care of the violations. And that as soon as they do, we can close on the property so I waited probably two months and after the second month the realtor called me up and told me okay the bank because I guess they had to see ‸ you guys
I don't know. So after the second month, the realtor called me up and said we can close on the property I wired the money to the closing company and closed on the property and then probably like a year I don't

Case was closed, leaving a fine of $117,000 and the owner, James Yoder, is requesting the lean to reduce the city's cost. Mr. Yoder, I do believe, is here.
you tell us? A long time ago. First, I went 30 years and didn't have a single violation. So it shows I take care of my property. But the roof had aged and code enforcement notified me. And it was a metal roof and it had pitting. So I was on Social Security at the time. And I found this high tech paint and ‸ painted the whole thing. It was supposed to seal everything and it was white. I took pictures.
The gentleman was very nice. He said he'd look at it the next week. Well, like four years went by. I thought I didn't get a letter. I didn't get a phone call. So that's why it got so large. I thought it was okay. But one day I got a letter and it said they were going to take legal action and that there had been a fine running. I called them that day of course and said I didn't know. But I said I would respond immediately that, you know, I didn't know. But right away I started calling everybody.
I was on Social Security and I couldn't get anybody to work with me. But God blessed me and I inherited a lot of money from my business partner. So I called a lot more roofers, called painters, and I had everything done.

Everything's been cut down. I hired two landscape companies. I cut the ones, the only thing they told me about was the one by the house. And you can see by the photo I've left, cut everything down and there's a four foot border around the whole house.
Yes. The property is maintained and Mr. Yoder has been contacting me since I've started with the city and he's very been forthcoming and trying to get this resolved.

and y'all forgive me this is an off question because I don't know and they you know they say no stupid question. um so with would uh a fire causes damage? Would that stop? Would that, would that stop? uh links or, or just code, uh violations. Let me say that.

but uh that madam attorney would could you answer that question because it's just for my my just curiosity would if there was a uh violations if there were violations on a home or business and there was a fire with those with those violations stop
I suppose it would depend on the severity of the fire and you know whether or not if the whole structure was eliminated, then the fines may stop running, but the lien remains, right? The lien attaches to the property itself, um so but
