Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_07_21_2022), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
195 suspect passage(s) marked in place; inspection incomplete: language review; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 12 voices separated from the audio.
17 short machine repair(s) (21 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 91.7% of 8,750 content words.
Dotted words (213 places) are ordinary wording differences: hover or tap to see the other reading.
195 passages (21% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
01:01:58 (11 s) — neither reading has words
01:02:16 (3 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

It should actually be July 21st, 2022. And, and I would also for the record like to mention that the correction date on every case should actually be August 20th. It's actually showing July 21st, 2022. So I'd like to make that correction before submitting it for approval.

and drainage. This morning, the property remains unchanged. The commission of trash and litter is still present. The exterior general condition remains the same in the roof and drainage as well. Part of the exterior has been fixed and that is the only progress made to the property, but the overall general condition showing this photo showing from this morning remains uncured. I visited the site nine times during my final inspection. I found the property in violation of the above mentioned sections of city code.
but as of my last inspection on July 21st, 2022, the property remains in violation. I've been working on this case since October 6th, 2021, and I have made attempts to contact the property owner.

To my understanding, the bank owns it and they were just working on trying to fix it, but were unable to give any deadlines, even when I expressed the exterior conditions and the severity of it. I had some back and forth and provided extensions, but at no point did they actually get any permits or get anything done. There were squatters there at some point, I believe, and there was

My initial inspection showing January 7th of 2022 shows the accumulation of trash and litter, storing outdoors and weeds in the carport and in the exterior portion of the home.
and the trash and litter and the outdoor storage items remaining in the carport and the exterior portion of the home. And this is a close-up of some of those items from that inspection, exhibiting the ‸ trash and litter and the storing outdoors. This photo from May 17th follow-up shows the weeds particularly here in this photo and the overgrowth exceeding 12 inches in height. From May 17th, again, the outdoor storage and the accumulation of trash and litter
comes comes up to trash and litter and storing outdoors. ‸ I also noticed the weeds on the property. There is some progress made, but the overgrowth in the grass and weeds still exceed the 12 inches in height on the property.

made attempts to contact the property owner. I brought this case before the code enforcement board as I have been working this case for 265 days, and the violations have not been fully resolved. I sent the notice of hearing on May 26th, 2022, and it was then certified and posted to the property in violation. Staff finds in case 21-0736 that the owner is a violation and recommend 30 days be given to come into compliance ‸ or a fine of $75 per day be imposed for each day. The violations remain until compliance is achieved. The property owner is here.

And just for the record, since it was conversation, she did also mention that she found somebody to get, remove all the weeds from her fence. I don't know if everybody caught that when she was stating that, that she had found somebody to go in and finish the rest of the weeds and stuff that have grown up through the fence.
Flag: words were replaced by a machine repair · 00:18:40–00:18:41 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
Um, the area by the fence has weeds that have grown up into the fence and all around the fence line. That's all she has left. And she's going to do that.

just to come in and weed around the fence was getting ridiculous. So, you know, when you're on a fixed income, you can't, you know, I know they have to make a living too, but that was just a bit much.

Yes. But the only difference is the main part of the yard, like in this picture has now been cut. So it's just the fence line and around the property corner. There's a lot of high weeds, but
Yes. They're hard to get rid of. Um, to answer your question, um, the boxes and stuff still remain along the carport wall. ‸ So that has not been corrected.
we, we cited it for both accumulation of trash and litter, which covers any kind of trash plates, bowls, cups, garbage thrown around. Um, because she does feed cats out there. And then ‸ the outdoor storage is the items in the boxes. Um, they're stored outdoors. Our biggest concern with the cardboard boxes is it breeds bugs and the moisture on the boxes being outdoors.
Well, there was like paper bowls, stuff just scattered across. I'm assuming it's because the cats were fed and, and gone. I don't, I don't really know the reason, ‸ but she had some trash and litter on her pictures. That's all been cleaned up and it's just the boxes going along the side.
Okay. First of all, ‸ the, I work with two cat rescues. So I have cat stuff all over the place. I also take care of what are called community cats. And I have found that a lot of people have no idea what they are. They're cats that have been abandoned by their owners. They find a place where somebody will feed them and they kind of congregate there. I feed them one paper plates. That way I can just pick them up and throw them in the trash. And sometimes they would come and I hadn't picked them up yet because I had up to eight cats at one time. Now, all of a sudden, I'm down to two. One came back the other day and he looked like he was half dead and I was so mad I was ready to kill somebody.

right now. The bags are going. The feline pine is going to the head of our organization. The other bags are going to a foster mother and the boxes are going to our shelter in MIMS. And they will be gone within the week. I go to MIMS next Thursday. So I'll take all the boxes up there with me. I take all the boxes up there with me now. But I'm not making a special trip to MIMS just to take cat ‸ litter off.

And on her testimony, they're not hers, which is good because we do have a limit on how many you can have. I would recommend that she keeps it as clean as she can because with the high ‸ grass, now you're not just getting cats. You're getting raccoons ‸ and other things, which is the issue. But she says she can clean up that little bit of stuff that's left under the carport and do the weeds within 30 days. So I think we'd be fine.

Correct, ma'am. And you would come back before this board to have that actually put in. So, it ‸ doesn't automatically hit you per se, ‸ that you come back for a non-compliance hearing.
I am submitting a packet of documents and photos associated with this case. The photos accurately depict the property during my visits and show my findings of ‸ permit required. Appendix A, Article 13, Section 5C. All right. During my inspection on January 7th, in this photo ‸ depicts the work in question that requires a permit, which is a staircase leading up to the property. At this point, it also needed to be painted, which they did at a later time.
permit. March 25th update. At this point, I had been in contact and provided an extension with the property owner to obtain that permit for ‸ the staircase that was done without a permit. They did go ahead and paint it, but they still required a permit and it was not attained at that time.
the property in violation of the above-mentioned sections of the City Code. I have attempted to gain voluntary compliance in this case, but as of my last inspection this morning,

He was fairly disrespectful in working with the code folks. So we're kind of back to square one with having to get a new contractor to help us. We've had this property in our family since 1997, and we fully intend to resolve the issues. We've identified that we needed to have things painted, the house was painted, ‸ stairs were painted. Those we could have done promptly. The engineering piece was a little harder, and still kind of hard. And if possible, we could have 90 days to correct that and get somebody in to fix, you know, resolve it. That'd be great. My wife has been working all the details on talking back and forth if you want more information about that.

We had a change of tenants and we wanted to start fixing it up. And that was our first thing to do because the steps previously there were very unsafe. And
yeah, so we had that contractor come in and do the work and he said, oh, look, you know, it doesn't need a permit, but if it does, I'll take care of it. Well, obviously he exceeds the value and was determined

been through several contractors or ‸ more than several just to find somebody who would be willing to work with us. And then the latest one that we worked with,
worked with us for about three months. And like he said, it's been through about four engineers. Wasn't really polite working with the people ‸ at the city and kind of just threw up his hands. And so we're like, Jerry said, starting over.
If ‸ the railing meets the code, the building code, if the slope of the staircase meets the building code, there's actually a degree that you can slope your stairs.

I'm submitting photos that I took through my re-inspections of the property. They actually depict the property during my visits. All right, photo one is findings from, is that March 11th? On a follow-up, this photo exhibits the protective treatment that's required on the exterior wall there. This one from January 11th is showing the protective treatment, the accumulation of trash and litter, and the weeds. All right, this photo from March 4th, it's
in the same with miscellaneous trash out on the exterior part of the property, as well as the inside, and the protective treatment on that exterior wall. July 7th, when I posted for non-compliance hearing, it's showing the exact, it's in a better condition. There has been some progress made, but there, ‸ it does still require some protective treatment to the property

the property to let mail, so the mailman could put mail inside the box. So I didn't receive a copy of it. I only aware of it when I saw the sign that the code inspector put outside, that's the time I understand what's been going on with the property.
in me purchasing the property with those violations before, I think I do a good job by correcting a lot of it. And I'm still waiting on permit to do other more jobs inside the property so

violations, he could have obtained one. But he was here at the hearing when the findings was made. What he has left is he has the wall that needs to be painted because all the stone has come off and it's molded and mildewed. And then the tree debris that he's cut has to go. Everything else, he's done a great job. He's mowed the yard. He's cut the trees, cut it back. But those are the violations.
Weeds were on the original, but you couldn't get to the one corner of the property because the trees had become overgrown. So he chose to go ahead and go one step further and cut the property and make it look good. So on this, that portion there that you see in the corner, that was completely covered with trees you couldn't even see. He cut all that out and that's how we got to the trash and stuff.

Well, yeah, but he's still been working on that. This is from July. He's still cutting and getting rid of weeds and stuff. So he's not completely fixed on that and he still has the wall to do because this is a non-compliance hearing. It's not a finding a fact hearing.

and I gave them the, they gave them my email ‸ address so they could email to me, but I never received it on an email. I spoke to someone about it to know what the violation was. I never received a copy of anything.

Yes. What, what we can do is if he comes into compliance after today, we can stop the case immediately. And then any fines that have accumulated, he can come back for a lien reduction or a lien amnesty. Okay.
Okay. We got a second. I guess we'll take the vote again. ‸ All in those in favor, please say aye. Aye. And those opposed? Okay. Motion carries. There you go. Get it taken care of and talk to the gentleman and get it all squared away.
And as soon as you do, let them know we'll close it. Yeah. And then we'll discuss with you how you can go about a lien reduction or amnesty for whatever is acquired. So we'll be good. Okay.

And Mr. Chairman, this was for the fence that you can see is leaning and detached. It's also like that on the other side. And for that shed that you see in the backyard, um, they had that on the side of their house and they put it there with no permit. So all they've done is move it from the side to the backyard. They still have not obtained a permit as of today and the accessory structure is still in need of maintenance.

Joanne has done such a beautiful job. She always does a job about five times. ‸ Then I went to the city manager. Called there about four times. Palm fronds. Even if somebody came by in a little pickup truck they could pick them up. I go and take the time and I cut it. I put it out neatly. They don't want to pick it up. How can we have people being fined to clean up their property and then they won't pick up the... It's just like we've seen a picture tonight there. There was some palms and all sitting there. Somebody's got to pick it up. And there's a lot...
to that question. Some of it is above my pay grade, so I won't comment on it. We try to distinguish that when we cite for violations because it's out on the right of way. So we try to do that. Sometimes it's not stacked properly and that's a problem. Sometimes it's other issues which we deal with on a daily basis. There's a lot of places throughout the city that has the yard waste that sits out there. But at the end of the day, that's really between Public Works and Waste Management and their contract. So we handle it if it's not stacked properly. If not, we try to deal with the private property, not so much the right of way in those instances.

I mean, I'm always picking up, ‸ you know, ‸ how much land I have there. I'm constantly picking up ‸ Wawa and Dunkin' Donuts and this and that. Constantly picking up, which I know it's my obligation as a landowner. And you do a good job. I try to keep it up.
I did want to mention that I will not be here at the next meeting in August as we are taking our son to college on that day and I will get somebody to cover for me that night.
