Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_08_18_2022), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
262 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 16 voices separated from the audio.
20 short machine repair(s) (22 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 91.2% of 10,997 content words.
Dotted words (225 places) are ordinary wording differences: hover or tap to see the other reading.
262 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:04:24 (42 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all.

Mr. Chair, if I can just elaborate a little bit. This is a vacant lot, so there's no primary structure on it, but they put up a fence, and they put up that fence without a permit. There's chronic trash and litter scattered throughout the property, and even though they cut the

would just like to mention also, you can see the number of vehicles throughout the many months, and they don't change. There's chronically tires and other auto parts scattered on that property. It's a vacant piece of property with no primary structure or driveway.

We've asked that question, and it's been denied by the people next door that it's theirs. So we're not quite sure. So we had to cite the property owner, the owner of this property.
I would have to walk on the property and get the plate, which I cannot do. I can't see the tags from the right-of-way. At one time, the white pickup truck was parked facing out, and you could see that it was a current tag, but nobody ran the tag.

without a permit. I educated them, and the property owner actually owns the roofing company. So I provided extensions during a set period of time to allow for them to get the permit. It was never pulled. I double-checked it this morning, and no updates have been given from the property owner.
And, Mr. Chair, this was a complete re-roof. They finished the roof over the ‸ main portion of the house, and then on that addition is where they stopped. But they've had ample time to pull a re-roof permit.

Property address is 409 Churchill Drive. I'm submitting a packet of documents and photos associated with this case. The photos actually depict the property during my visits. They show my findings of accessory structure, section 6-1001G, exterior general condition, section 6-1003A.
During my first inspection, I found the property in violation of the above-mentioned sections of the city code. I've attempted to gain voluntary compliance in this case. But as of my last inspection this morning on August 18, 2022, the property remains in violation. I have

The compliance is achieved. The amended amount is due to the property owner and property manager removing the violation for accessory structures. Which I observed this morning.

So I was obtained, my services, I received a phone call from the owner. His residence is California, but he's out of the country ‸ majority of the time for work and asked if I could assist him in his problems. At that time, he had a problem tenant, which was responsible for the trash and stuff around the property and the condition of the house on the inside. So once he's secured by services, I proceeded to evict the tenant and clean up the property, removing the debris inside and out. And the flat roof has been an issue trying to find companies that are willing to do that type of roof. Typically, we always try to provide two or three estimates, and to find two or three companies that are willing to do that type of roof has been an issue for us.
stuff that has to be addressed. So the issue will be that ‸ I now have two estimates on a roof, and as soon as I hear back from him, he's in Italy right now, so time frames are always a little convoluted.
not going to order work to be completed until I have his funds in hand to be able to pay the vendor once they're done. So I have asked for a six-month extension to be able to get the roof done, get the painting done, and then we'll start on the inside.
Yes, I would expect the vendors to apply for their own permitting. I have asked the one company. I have asked the inspector if he had any kind of issues with the first guy that gave me an estimate, and I just got the second estimate yesterday. So actually, it came in late last night, and I saw it today.

‸ No. It's vacant and actually gutted. There was a rat problem. And ‸ the interior is going to also require removing ceilings to get everything cleaned out. It'll have to have new duct work.
It's going to be a full reno from the roof to the floor. The cabinets, the bathrooms, ‸ everything's... Other than the drywall on the walls currently has been removed. But we're going to have to go further and take the ceilings out in order to be able to clean up what's in the attic.

would recommend, especially if he decides to go through an eviction process, I would recommend probably a 90-day change, at least, if, of course, it's up to the board. But if he decides to do an eviction, it's probably going to take a couple months.
this carport where the roof is beginning to sag, and there's some rot in that beam that's up there. He would have to do that. So, I would recommend a minimum of 90 days.

That's correct. And if you wanted to make a motion, giving him 30 days to clean up the accumulation and the outdoor storage, but I'll refer to the board's attorney for recommendation on that.

the property owner because there is case law and attorney general opinions that do provide that they are the ones that are able to, depending ‸ on the way the codes are written and such, get the property to come back into compliance. And on the matter of two separate dates, if you all were looking to kind of bifurcate and split the due dates, if you will,
compliance dates, I'm able to do that, of course. It just gets a little more complicated in making the motion and ensuring compliance by both of those type of dates, but it's certainly up to the board.
to next month to now, first we give time to get the small things cleared up, and then he has some type of direction by that time of how he wants to proceed with his tenant, keep them there or put them out? I mean, what do you think?

has testified that he's been successful in getting the trash and some of these violations cleared, and then they reoccur, and the cause for the reoccurrence is that the tenant is there. I don't understand how short of
to ‸ clear and clear those violations and have them remain clear. So the root cause is having the tenant, and he has expressed the desire and willingness to take care of that through eviction. I think he's just underestimated how long that would take. So
reach out to him to get this resolved, that him as the owner has taken responsibility. He's dealt with the tenants, but he has avoided code enforcement until tonight. So I think 90 days is appropriate for him to

Our concern right now is the sway and the rotted wood that's up over the carport. If you look at the pictures of the rear of the property, you will see that there's also some issues in the back with some sways. ‸ But our main concern is what's over the carport. It would probably behoove him to redo the whole roof, but I'm not his property manager. So our main concern is this area right

I'm submitting a packet of documents and photos associated with this case. The photos accurately depict the property during my visits and show my findings of permit required, Appendix A, Article 15, Section 2A, Site Plan Approval Required, Appendix A, Article 13, Section 1B.
During my first inspection, I found the property in violation of the above-mentioned sections of the city code. I attempted to gain voluntary compliance in this case as my last inspection on August 18, 2022. The property remains in violation. I have been working on this case since
I have made attempts to contact the property owner. I brought this case before code enforcement board as I have been working ‸ this case for 85 days and the violations have not been fully resolved. I sent the notice of hearing on July 28, 2022, and it was sent certified and posted on the property in violation. ‸ Staff finds in case 22-0238 that the owner is in violation and recommends 30 days be given to come into compliance
Mr. Chair, for the record, I would like to mention that the property owner has been in and consulted with the planning and zoning department, and he has sent several emails, so he has been in contact with staff.

evening, Chairman. Good evening. Ladies and gentlemen of the board. This case has been a tough one because I've been trying to follow all the rules and regulations. I am an excavating contractor, and I submitted the proper paperwork to achieve a permit, and I received a topographic survey from my engineer and went to the building department, and as far as they were concerned, everything was fine. I didn't need a permit from them. So they waited for ‸ planning and zoning to come out, and they never came out, and they said, okay, go to Public Works to see if ‸ there's anything from them that you need. So I did. I
to, spoke to a woman named Joanna, a lovely woman, and she presented the topographic maps to her supervisor, and he came out and he said, this is private property, you're all set. There's nothing you need from us.
small shed. In the beginning when I bought, purchased that property, it was to store heavy equipment, you know, backhoes, excavators, dump trucks, that sort of thing. And it's approved for that. And, um, so, so that's what I continued to do, but I needed more space because I started leasing to a, uh, nationwide trucking company that has brought a lot of

There was no retention pond required, according to my engineer, because there was no buildings on the property. It's all an impervious surface, so there was good drainage. And I have been out there several times during the heaviest of rainstorms. And there is no water that collects in this depressed area.
room for the trucks. And I was going to continue and put a swale along the backside and run down the side. It's what I do for a living. People call me for drainage problems. So, on top of that, the area I started filling in, there's an easement from, on the deed, from FPL that requires me to maintain access 10 feet from the fence to the utility pole. So, I took that as, you know, I'm required to maintain a road or maintain access so they can work on the utility pole or the transformers. So, that's what I did.
neighbor next door complained. And she said I was flooding her up. Now, I have people that have been there 20 years and they have never seen any water in this location. So, I guess the problem continued. And I went to, like I said, the building department, public works. They all agreed I didn't need a permit because I was just filling in a slight depression.
filling in a slight depression you need a permit for. Route breaking, clearing of land, that sort of thing, yes, you do need a permit. But there's many times when houses have, because of previous contracts contractors back in the day, they were very stumps.
even after visiting building department and public works and they said I didn't need a permit because of this complaint, all work had to stop. So I haven't been able to do anything with the ‸ property or with the fill. and ‸ it's remained as is, but I've been in contact with my engineers and they are working on the problem. But there's been a ‸ shortage of staff in planning and zoning. And as much as the individual is trying to accommodate, it's a difficult situation for her. And each time I take one step, there's another problem added or another request. And now the request for a permit from St. John's Water Management, additional requests that just keep making it more and more difficult. I'm a 100% service-connected disabled veteran with limited resources and I'm just trying to secure a retirement for my wife. I'm 69 years old and I can't work like I used to.
Mr. Chair, if I can maybe sum this up a little bit, first of all, we're dealing with zoning. This is not a residential piece of property. It's not a private piece of property. The business that was there before was much smaller. He actually expanded his whole parking area. Under the guidelines of the city, to expand that, he needs a site plan. And he needs a site plan because all parking areas require paving, landscape, and drainage. The problems that he's running into now would have been curbed had he not put the cart before the horse and came in and did a site plan, filled everything out, and had to do. The other problem is the surface that he's using is not approved for an expansion of the parking lot. So, all this would have been answered had he come in and got a site plan in the beginning. So, yes, he's running into problems ‸ now because we're kind of doing things after the fact. He does have to get with St. John's. There was clearly some issues there of where he's put the dirt.
He needs to answer all of zoning's codes. The fact that he spoke to the business tax receipt technician in the building department and did not speak to the building official or anybody in planning and zoning, sometimes you get answers to the questions that you're asked and I don't know what was asked of her.
so it doesn't concern public works And that is true except for the fact that during the site plan approval process, stormwater engineer Abby would have looked in and said your stormwater needs to go here. He doesn't even know where he needs to drain off because there's no site plan to tell him any of that. So basically he just dumped a lot of dirt and created a much larger parking lot. So what we need to do is get a site plan so that he can do things properly and then he will know exactly where the water needs to flow, where it has to go. ‸ and then there may be some issues in the fact that he's expanded the usage and he may have to come up to current codes and not what this property was originally grandfathered in, but that's for planning and zoning to review in a site plan.
Flag: words were replaced by a machine repair · 00:53:40–00:53:40 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
But at the end of the day he needs a site plan. He needs to meet the stormwater, the flow, make sure that the surface he put down is approved. and that will take some time because he's got to draw up plans and stuff for that. But that's kind of where we are. It's not a residential property.

she told you the same thing, and I have the emails back and forth. All I'm saying in front of this board because we want compliance, is you put the cart before the horse, you did all this work, it does need to be approved. Public works does have a concern based on the stormwater. So you can have all the maps ‸ you have but that all has to be put together and then approved and stamped approved then you continue. So we just need to play catch up. I'm not debating that you spoke to Tori and Terry who sit at the front counter in the permitting department, but they're not certified planners, They're not working for zoning and they're not building. and my correspondence with you from day one has always been the same. Get a site plan, do this, do this. Same with Joanne.
You really needed to speak to the stormwater engineer who I put into our emails because she's going to tell you exactly how she wants that water to flow and drain. So we need to go from here and you just need to get your site plan and whatever permits they're going to require from you. And you know this because
And it's put a great hardship on me because I, frankly, I don't have the abilities I used to have. I've been in the hospital for the last three years and it's been tough.

process is at this point you need to do drawings. You need to apply put an application in the city. You may or may not need St. John's depending on wetlands or whatever. You've got to have a drainage plan and approved service to park on. That simple.

surfaces and it's going to be based on the percolation of what it is. And it actually says in the code that the community services director and the city engineer will consider other types of materials.
part of the site plan approval would be to submit the materials you intend to use and then they would approve it. So, of course, ‸ concrete and asphalt, no-brainer, thumbs up, ready to go. Anything else, you have to ask their permission. It's going to deal with percolation. Is it going to push water into the storm area? Because, you know, you've got coquina, you've got dirt, you've got millings, you've got all kinds of substances. Those would have to be approved. So when you do this, that's what you would tell them you used and then they could make a determination

Thank you very much. I just have a question about the grandfathering of the fill. The filling. So you go to Google Earth and you look down and ‸ go back to 1985.
Flag: numbers, amounts, negation or names differ between the machine readings · 01:05:05–01:05:07 · unresolved: the words are not shown (unclear audio); listen to the recording
2002 was when the fill ‸ was first placed in that property. All right. And it was... It's been there for 22 years. The client has added more to it. But if we go back to zero, which would be before any fill was on that property, that property cannot be filled at all because it's not 100% or 90% in a FEMA flood map.
Okay. And just for the record to answer your question, the grandfathering was what it was. ‸ Had you kept it in that same area, it's a grandfathering, but now you've expanded, changed, and elevated. So that's a question
the planning and zoning board because the ‸ grandfathering is only what was preexisting. You can't expound and go greater than, and then still claim the grandfathering. This is why I think we should have done all this first and got that straight. But I would make mention to that to planning and zoning, and then see if you need to go to the Board of adjustments or planning and zoning, to look at that. Because there has been quite a bit of fill added ‸ to the existing. So I would take that up with them.
Okay. So I think there's like two things going at the same time. One is ‸ code enforcement and the other is a minor site plan. So I'm just wondering, I've been doing this for a long time, and I'm wondering, I'm in
city. So we enforce zoning codes, stormwater ‸ regulations. We are the enforcement officers. Now if planning and zoning tells you that you're fine, then code no longer has a case because you've satisfied them. Or if public works tells you you're fine, then we no longer have a case. But we are the enforcement arm for all of those divisions. That's how that works.
If you restored it back to the way it was before you did it, yes. Our case would close at that time. Then you could start the other process and do whatever you needed to do.
if we take off the fill that's recently been placed, take that off, and then keep the property as it was grandfathered in, and let it be as ‸ is. A truck, a truck storage area. Is that, is that, is that a possibility? If you pull it back to where it was?
Yes, if you restore it back to like what it was, this is a photo from 2021 before he put it in and I'll submit that into evidence and let the board look at it.
So the option is, we could do what I just said or we could improve the property. The client wants to improve it, but if it's going to be impossible because of being in a floodplain, then we want to go back to leaving what it is.
