Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_08_19_2021), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
430 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 20 voices separated from the audio.
49 short machine repair(s) (62 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 91.7% of 17,353 content words.
Dotted words (479 places) are ordinary wording differences: hover or tap to see the other reading.
430 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

I visited the site a total of 10 times and found some progress made on the property. I've attempted to gain voluntary compliance in this case, but as of my last inspection on August 19, 2021, the property remains in violation.
and brought it before the code enforcement board as the violations have not been fully resolved. I sent a notice of hearing on July 29, 2021, and it was sent certified and posted on the property in violation. Staff recommends in case 21-0058 that the owner be found in violation and given 30 days to come in compliance

I received this afternoon a request from the attorney representing the property owner for a request for the, uh, case to be heard in September. Um, as the, uh, attorney had a conflict and the property owner, um, is sick. Uh, so they requested that the, uh, case be moved to September if it's your pleasure.

by, uh, Officer Carter. Um, after my first inspection, I found the property in violation of a permit required, which has since complied. And then sales or rental or new and used automotive vehicles, agricultural equipment, major recreational equipment, um, operating business without a VTR.

Well, the first misunderstanding, well, I'm not gonna ‸ say it's ‸ misunderstanding when they had the pictures of the cars there. About two doors down. There's a car lot next to me that he moves his cars around. He parks his cars and which, which is, I gave him permission to park him there while he moves them and rotates the cars because he's right on 520 and there's not much room between there. But I spoke to him and asked him to make sure he doesn't do that. I

their state, all the licenses they have to apply for to be there. It's just in limbo right now due to what mailing and COVID some offices being closed. I spoke with the code enforcement officer a few times. I've tried to be open,

honest as possible to him with them. All I'm asking for is we both agree that 30 days should be done. But after I got these papers, I'm asking, can I have like a 45 day maybe to help these guys get the, all the paperwork they need for their licenses on their business and the building permit thing I had resolved. They just had it under the wrong permit.

It's acceptable, but Mr. Chalk needs to figure he's talking about licenses from the Department of Agriculture and other places that are holding them up because they're ‸ auto service center. He would still need to make application with the city of Coco for business tax receipt. And then the property would have to meet all zoning requirements of paving landscape and drainage. So 45 days may not be sufficient. It might be sufficient for him to get his licenses with the state, but I think he's going to have more work to do when he applies for his city business tax license.
That's that's correct. Um, I, they, these are my tenants that actually don't work. That's not my business. My tenants have applied and this is the, they're going through the steps.

I'd be more inclined to do 60 days as staff to give them that much time to deal with that. Cause see, they're going to make some changes to that ‸ property. All right.

Now, if that thrift store, if you guys want me to have, I've, I've always respected the, um, the, the people behind it that give out free food and stuff. That's why I've never asked them to move it. Yes, a picture that you're looking at there as well as a some wood along the side of the house on the west side of the house off the side of the house from there.

he was trying to get somebody else to pull the permit, but he has not been successful as of yet. Probably because they don't want to sign off on the work.
And I would just like to point out the damage went from the welcome sign to the actual load bearing beam on the corner. That was all fixed and repaired underneath and down the beam.
I move the case 21114 that the property owner be found in violation of the above mentioned codes and be given 30 days to come into compliance or be fined $25 per day until compliance is achieved. Second.

conversations with some of the workers. The property owner himself has not contacted me on this particular building. He's contacted me on other cases in the past and doesn't enjoy his conversations with me. So he doesn't contact me too often.

Leasing the business out. He still has a business, he has a current business tax receipt at the property for, he at one point had some auto sales that he was doing out of the property. It still shows as current, but it hasn't been being operated there and it would not be relevant to the work that they're doing there now.
Yeah, he removed all his cars. He has not been selling cars there for the last few months, but then this tire guy showed up and, um, did all this. So he doesn't have anything to operate from that location and not even sure if that location would be suitable for zoning wise for tires. Based on how many tires he actually has on the property.

Well, two things. Number one, the violator should notify us that they've complied to violation and show us some sort of documentation. That's typically, well, typically say, look, I have no more chickens or I took down the coop or this is a case. They might even provide us a photograph, some sort of contact to let us know that they came into compliance. That's their responsibility. As far as the fence, no. There's no permit for the fence. That was just placed up as a site obscuring type thing. So, that's kind of where we are now. If she can provide us proof, we would easily close the case.

In 2016, the city enacted a pilot program to see about allowing a certain number of chickens in residential areas provided that they came in and got a permit from planning and zoning. And it was a two-year pilot program. In that whole two years, only one person in the entire city came in and got a permit for chickens. He lives on [address]. Nobody else did.
still have chickens. But the ideal situation in the ‸ pilot program would be to get a permit with zoning, have it documented, and then stay within the number of chickens or fowl that you would be allowed under the program. But right now, there is none. So, they can have dogs, cats, anything labeled as a domestic pet. They can't have pigs, they can't have ducks, they can't have chickens, roosters, any type of barnyard type animal. They're all excluded.
Councilman Dial here. I have been talking and working with our city manager about bringing this back. He's been real busy with the budget. I thought we're going to put this on hold until he comes up with a plan.

And it's a matter of just the chickens. We've also set a precedent in numerous other cases that we brought before the board where people were found in violation for this ordinance for having chickens.

The initial complaint was a rooster. There was a rooster back there that was waking up one of the neighbors pretty consistently every morning. He was doing his thing. ‸ But she was getting real annoyed with him. So, when this first started, I talked to the lady and I gave her the complaint.
And then I told her she's going to have to get rid of the rest of the chickens because I found out they weren't allowed at all. So, she did get rid of the rooster, came partially in compliance with what I'd asked her to do. But then the chickens have still been there consistently. I have no reason to believe yet that she has gotten rid of them because she was so adamant that she was not going to do so. She may have, but I have, I mean, I have no legal right to go look in her backyard unless she wants to allow me to. So.
the code board and told her that I'm trying to get the city manager to bring this in front of the, uh, to bring it back to the trial progress. A lot of people got chickens in the city and everybody thought we could still have chickens in the city and
he's just, you know, addressing the question of a possibility of an ordinance and maybe that could play a factor into the timeframe, but I don't know that it's actually evidence.
Yeah. I would suggest we move ahead with it and, uh, let her, uh, either prove she doesn't have any chickens or let the city manager address it from that standpoint.

So I have been requested to get rid of the rooster. That's what I did. Rooster was gone. Rooster was also waking me up as well as everyone else. So that wasn't a problem. Chickens are still here. I called as soon as I got the notification. The 19th of August, I believe when it was posted asking what I needed to do.
Or do I need to come to the meeting? He told me to come to the meeting. So I'm here. The birds are still there. If the birds need to go, the birds can go. Not the end of the world. I just want to do what's right. I have a lot of money invested into it. So if there was a chance I could keep them, I would love to keep them. But I'm not trying to make a big deal out of this either.

We had a case before the board. I just want to mention this. I think it has to do with this type of situation. Some young girls had some beautiful little chickens ‸ and they actually brought the chickens into the when we were over to the other place there.
You're going way back. So they brought the chickens in and the little girls just these are their pets and they weren't making any noise. And we made a, we made a ‸ vote on if there's no, this if there's no more type of violation that

neighbors to be upset. They could keep the chickens and if there was any problem, the chickens had to go. So I can tell you that was before our board at one time. So.
Well, the issue now though is that there is on the record a code that says you can't have these animals. Section 5-32 apparently. And I think at the time there was that too. So.

What I would say on the front end here is because this is now a non-compliance case, the board by law, by statute, can't change the outcome other than to say it is complied or it still is not complied. But we still want to know what it is you or the owner. You are the owner?
The shed and then you still had some outdoor storage you were going to take care of when you got the shed taken care of, I believe. Right. I know, I'm aware that you've applied for ‸ permit. Yeah. But at this point it's still not in compliance. So as soon as it comes in compliance and the outdoor storage is taken care of and the shed is either approved or disapproved and removed, then that's going
was a little bit older ‸ picture. But there's still a little bit of outdoor storage ‸ besides his tractor and his boat. But he's got a, he's working on trying to get this permitted as a shed.
That stuff alongside the shed is gone there now. But the, he's working on trying to get a shed. And my understanding was, is the outdoor storage, if he got his shed taken care of, the outdoor storage would go in the shed.

into compliance ‸ then whatever you do behind a privacy fence is not visible. so well Unfortunately, as of today. That was probably shortly after lunch time
actually, if you just come to wherever your storage area is going to be, just make sure that that's got an opaque fencing around it. because that's what's required in zoning for a storage area. So you don't have to come all the way up to the, you can go, you can make a smaller, like in front of that truck, you can come that way and screen it that way. You just have to make sure that wherever you're going to store is screened from, from the view.
miscommunication of what style fence to be used. So now that I know that it needs to be screened yesterday, I went up and put all the screen up because I was unaware it needed to be out of sight. I thought it just needed to be fenced in. So somebody didn't have to come up and get hurt. but I will now screen the uh cemetery as well. so And what he's referring
covering over the fence um to act as a screen, but typically slats and screening is not allowed. But I'm talking to them to find out because he's already put up the chain link fence um through. So

record, as you can see, he has numerous chemicals, numerous tools. He has barbecue grills, charcoal um to the point that he even has a fire extinguisher. um He has glass bottles throughout the property. It's a residential neighborhood. Kids are in the neighborhood. Somebody could get cut hurt um A fire could start. There was even an incident the other day where a car drove through his yard and ran over a lot of this. So this is all just a hazard and can cause a safety issue.

Sir, this stuff. I'm going to show you the pictures of yesterday. It looked like a bomb. had came through my front. yard All those bicycles were ran over by this car. basically because I think it was coincidental. The code enforcement officer came through Friday evening. He posted the poster came Saturday morning. He put, uh 10 day notices on all my cars because their uh tag had expired. But I went
here to go on to the car. It was almost time for this meeting tonight, so I didn't apply them to the car, but I have them right here. Those cars are mobile.

the code enforcement officers said to do, and that was to come through and plow all my stuff out. So all of that stuff that you see in the yard, it's gone. It's been plowed out. It was even taken across the street into my neighbor's yard where I could show you pictures where they took down her chain link fence. It went into the neighbors adjacent to her and ripped up his grad and went back across the street and hit another neighbor's yard. So all that that you see in the picture there has been bulldozed away. ‸ They turned over my my my my dog kennel that's in the front yard because I keep a dog out where I sit. My other dog died yesterday. The one that I put up, the dog will bite sign. She died. After 13 years of owning the dog, she died. So it took me some time to get my bearings together because a bomb had just went off in my front yard with this car riding through it like the ‸ code enforcement officer. Somehow coincidentally said the day before that he was bulldozing.

that the items were blocking the right-of-way and causing an obstruction, we did have our abatement contractor come because that area from the sidewalk to the road is all city right-of-way So we removed those items because they created a blockage on city right-of-way So where you see that barbecue grill and the stuff that we got the tree on. Right. Not the stuff on his private property, but the stuff between the sidewalk and the road. So we did move those because they were an obstruction to
Yes, sir. But I take care of that. Myself and I was moving it back over because we were doing the lawn during that time. iI went off with this guy to do some scrapping to get some extra money. When I came back, everything was gone.
Mr. Chairman, this property has looked like this for the last five months. It is a nuisance. It is a hazard. Somebody's going to get hurt there. We have given
went round and round with him about what he could have couldn't have. At the end of the day, this is a serious, serious code violation and a serious problem. And Mr. Collins needs to be aware that he does need to keep it clean. Even now.
I am aware, Mr. Chairman. Okay. But this guy has a uh a problem with me. This guy has a problem with me. I would like for them not to come to my property and send the officer that's over my case,
when they come to my house. I wake up in the morning, I come out. They make it known Friday evening, early Saturday morning, early Monday morning, early Tuesday morning. and then the car crashes through at 9 45. well i tell them i fought for the right for you to speak to me like this. And I listen to what they say. And I try diligently to get it in compliance. And it is closer. And if they're honest with themselves, they will tell you that it's close

‸ okay. He has actually, he's got a very large piece of property. It's actually three lots wide. It's that vacant lot that you see there, which is actually his property, where the house is and then next to it. and then He has room to park them. The reason why you had to go get tags is because
they're on the right of way with no registration on them. So we red tagged them and gave them 10 days. If he's got the tags, he put them on, we will not tow his vehicles away because
vehicles and then he can park them out there. That's not the issue. The issue is the fact that in in the photo, they are not tagged or registered. So that's, that's the issue with the tags. Sobut the tags are the least of the worries as this property. I mean, this property, we receive complaints daily on this property and how bad it looks and how bad it is. And quite frankly, it's probably the worst property we've shown you tonight.

No, actually, uh actually, this is the third time I've been here and uh the first two times we came here, uh this situation was tabled because they couldn't articulate the actual violation. I've gotten a couple of these notices saying that we were in violation, but nothing outlining what it was. um At one point, there were mobile vending out there that we quit doing months ago. I mean,

Site plan to the city and apparently they never got it or lost it. I don't know what the case is with that. um but obviously we want to be, we want to be in compliance. this is actually, this is a non-compliance This is actually already coming. It was already found in violation for those items. Speaking to the owner of the business that was covered with them as well. he was directed to go talk to planning and zoning to submit his uh revisions revisions also for the seating out as far as
That wasn't initially part of the original plan. As far as what he's saying, he submitted uh ‸ last check when I talked to planning and zoning is they haven't received anything uh related to uh ‸ site plan or an approved site plan for it. So actually
the the barriers were part of the original plan. We were told that if we put the barriers up that we could use every square inch of the out of the exterior unit, which is why we did provide. We did provide this. I don't know what happened. And
And that has not been done in all of this time. So, um he did submit an original site plan planning and zoning is saying that the property is different than what they originally approved.

Correct. But once we drop it off, you know, we got to wait for the approval and nobody's ever gotten back in touch with me. And, uh and another thing that kind of bothers us, I got my business partners here with me tonight. um we've seen you guys come by and take pictures, but nobody's coming and told us what the deal is. ‸ actually tonight is the first I've heard about any other violation other than the, uh mobile, the mobile

No, they said the barriers were fine, but you're using them as a table, so it added to your seating. Yeah. So that's what they were originally talking about,
Okay. um So we had one meeting, it got table for 30 days to try to get it ‸ resolved, came back, we got tabled a second time, then we had a third hearing where they found it in violation and then still gave 90 days. um So all we really need ‸ to do is go up to planning and zoning and revise your outdoor seating, revise your outdoor plan, because now you have a bar and a music stage, right
permit or get signed off that it's not going to be required to have a permit, but because it's attached, it's more than likely going to need a permit, and that's it. That is all that needs to be done. ‸ No problem. And then, yes, the mobile vending was there and then ceased. Yeah, we quit
We only have two choices. Either you're compliant or you're not. And at this point you still are not. So we haven't taken a vote yet, but that's the way it's going to have to go.
