Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_09_15_2022), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
290 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 14 voices separated from the audio.
39 short machine repair(s) (44 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 87.3% of 12,863 content words.
Dotted words (299 places) are ordinary wording differences: hover or tap to see the other reading.
290 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:21:58 (7 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

the agenda ‸ was never heard at this meeting. Therefore there was no minutes relating to that address. Okay. So it may have been on the agenda, but then removed and therefore there was no minutes. Um, this sub secretary did not write in there that that case was removed or what you just did in the beginning of this meeting. She did not add into those minutes.

because that does serve as temporary fencing. It'll keep a child out. It will not keep an adult out, but he's going to give him until November 1st to get the permit and then for this shed area here.
sketch and attempt to get a permit as well, but I wanted to make note of that because he did contact me and sent me an email stating that he talked to Mr. Solomon.
right if we ask the code officer to give a little more detail what the picture, explaining what pictures go with ‸ which violation? explaining the violation.
Okay. Mr. Chair, what the ordinance states is that if the boat and trailer or recreational vehicles over 22 feet in length, it has to be parked past the front setbacks of the house. So in this particular case, we have a 20 foot boat on a 22 plus foot trailer that has been moved down the driveway. It needs to be put back on the side of the house.

This is a close-up version of the issues ‸ up on the roof for roofs and drainage. ‸ Again, we have a stop work order that was posted for the fence, the shed, and picture of the roof and drainage issues. This is a picture of the makeshift fence that surrounds the pool after he took down his other fence. And that's going to go with the permit required. And the pool and spa enclosures 6-1002B. ‸ This is another picture that shows the boat and the items in the back along with the fence. So we're covering permit required,

Okay. So let me help focus you. Is this all right, Mr. Chair? I'll help focus you. What we're talking about is four violations right now. The roof. And if you saw the pictures, there's a tarp on there. It's been evaded. Well, if the, if the officer could tell what date those pictures of these pictures are.
12th. We're taking it long before, long before now, because the situation has been evaded. The tarp that is on there, I didn't place that tarp on the roof. I took in three, a family of three from New Mexico who were having. What

And the family of three that I took in rent-free for eight and a half ‸ months, the wife of the family was residing in the Florida room. So, when that leaked, she became, you know, I don't know, she became very upset. And her husband went and bought this humongous tarp. And he put the tarp over not only the flat roof,
This has been abated. This is the proof. I don't know what more you require of me. The tarp that was so inside me was not placed there by me, but I took it down. I put the 60 mil rubberized membrane over the flat roof to seal it, and the leak was stopped. So the roof has been abated.
Well, even if we find you in violation tonight, you still have time to call the code officer for them to come by and take a look at it and clear these violations. Do you understand that?

from a legal standpoint, what grounds would we have to stand on? We had a motion, accept the motion. I don't want to go against anything as far as ADA related.
Well, yes, that is a concern. But he has testified that he understands the violations that are against him. He's read all the emails and there has been quite a back and forth with code enforcement. And I have been able to communicate with him. And he seems to understand what the violations are. It's just his opinion that he's cured them. And it's really up to the board to make a determination whether the evidence you've been presented is a cure.

Mr. Chairman, just for the record, as you can see in the photos, new sidewalks were placed in and some renovation work was done on this building. It's been vacant for quite some time.
I did have a conversation with the owner and she told me of her intent and I did tell her that I would let the board know that since the stop work order was posted, they did cease work, but they still need to get the permit to finish the renovations and all the stuff they need to do on this building.

Correct. And like on this north corner that you were talking about where the electrical mass, right, they put a new one up and started to run it through. Okay. So they did that. ‸ They did the interior demolition and they started putting in the sidewalks.

I may, just for some of the pictures, this is the original picture of the aerial just over a year ago, and you can see it was a highly wooded lot of trees along North Cocoa Boulevard. They came in and they basically clear cut the property to look like this and then placed down a large amount of rock and stone. The property owner, tidal wave roofing, then moved in trailers and trucks, and this has been the condition of the property for the last year. They did move the vehicles. As far as the weeds and grass, all they're doing is spraying it with Roundup. They have no site plan. They have no approval. They've gotten none of that, and we've been working with them since April.

Mr. Chairman, just for the record, they have numerous chickens penned up on the property, as you can see in this picture here, and they built a large chicken coop. The city ‸ does have a new ordinance that allows you to get a permit for up to five chickens.
the chicken coop or add on to their fencing and stuff in the back to kind of screen it. So basically we're discussing the fact that they have chickens and they did some building on a coop to house the chickens. They need to go into planning and zoning and get a pilot program permit to have the chickens and then that'll tell them the requirements of the coop and go from there.
You can have up to five hens. And there is a rooster on this property. Yes, there is a rooster on this. ‸ That's what the first picture was was a rooster. Yes.
I've sent notice to them when I spoke to the individual who claimed to be the property owner initially. It turned out to be the tenant. He told me that they have gotten it. They just they'd get to it when they get to it.

Mr. Chairman, just for the record, on the photos, as you can see, there's fascia damage. There's need for protective treatment, which is what covers the exterior general conditions and some damages around the property. Also, we have windows that have been broken. There's been some attempt to put wood in, but people are still pushing in the windows. The whole exterior of the property needs some workman like maintenance, as you can see in the photographs that were presented to you.

‸ Mr. Chair, just for the record, you can see in the picture, this picture here shows you the need for protective treatment. It also shows you the dry rotted fascia and the dry rotted wood all around the roof. It does encompass a picture of the boarded up window. This next picture shows you three windows that are boarded up. And again, you can see more dry rot and you can see the damage in the roof. The shingles are worn. You can see the dark spots where they're holding water. And here's another picture of the boarded windows with the chipping, peeling paint and the dry rot. And then that's on the back of the house. The entire fascia up into the roof section is dry rotted. And there's actually a hole in the roof. Quite sure that there's animals up there. And those were the reasons for roofs and drainage, protective treatment and boarded up windows.

Yeah, I'm just changing my recommendation from 30 to 120 in the hopes that you can start with the small stuff and work your way up and hopefully find somebody to do the roof. And get that done.
probably would still take you 30 days or so and then you'd have to get the roof done. But it sounds to me like that would be the last thing that you need to do. So, I mean, I'm just throwing that out there as 120 days, the board can give you whatever they see fair.

Dennis, if he works with you and comes back within the 120 days and still needs some more time, can you give it to him? Or do we have to go back to the board and if, you know, if he's working on everything and things are getting cleared up?
Well, it depends on what your, how your motion is worded. Um, if you just give him 120 days and he's going to be within three or four days, I'm sure we could probably work something on that. But if it's going to be an extension at time, I think something like that would have to be included in your motion in order for staff to, to do that. I would like to see, ‸ we've been working on it since last October. So I'd like to see some progress, the roof and stuff is the big stuff, but I'd like to see at least the property cleaned up the best that we could.

If he wants to make repairs to that roof, say he wants to put a piece of plywood in to stop the main leak and all, and put some roll roofing over and all, can he do that himself? And just to keep the property from getting worse?
Um, in my capacity, I wouldn't recommend that. Um, if anything, he might want to put a tarp up to stop the leak from the house, but I wouldn't go through all that because, um, the sheathing and the trusses underneath are damaged and I just don't know that that's going to help matters. I think it's going to make it worse.

Those opposed. Motion passes. You have 120 days with, if I'm not mistaken, 30 day updates to continue to try and clean up the exterior. Um, just get with the code enforcement officers. They'll give you their card and you just continue to update them. Um, if you get something completed, you think they need to come take a look at it. Just give them a call. All right.

found the property in violation of the above mentioned sections of the city code. During my re inspections, I also found the same to be true. We attempted to gain voluntary compliance in this case, but as my last inspection this morning, September 15 2022, the property remains in violation. We have been working on this case since October 18 2021 and have made attempts to contact the property owner. I brought this case before the code enforcement board as I have been working this case for 332 days. The violations have not been fully resolved. I sent the notice of airing on July 28 2022 and it was sent certified and posted of the property in violation.

And Mr. Chair, just for the record, the photo show as in this photo, there's two sheds on a vacant lot. The issue with that is that there's no primary structure and

So they would need permits and special exceptions or lots joined together depending on what he wants to do because he does live in that neighborhood. But that's what we're looking at is these two sheds that have no permits and a vacant lot with no primary structure.

Well, we don't know because they're not permitted. Typically, they would have to be tied down with anchors and were strapped, but we don't know how they're placed there because he didn't get a permit to do so. And they're back on the property. So we don't walk back there to take a look.
these been on the property or do you know? The first one that you see there was placed there within the last couple of years based on the aerials of the property appraiser. The other shed actually goes back probably 10 to 12 years ago. I'd have to look at the aerials again, but it started out with the one shed and then he put the other shed. And when we did our sweet, that's how we noticed it. But the aerial does show that that white shed in the back has been there for quite some time. That property looks like it goes pretty deep. It is. It's a long skinny piece of property. And I'd have to go back and do some checking.
mean, there may have been one time where there was an actual house on that property and it got condemned, but that would go way back into the early 2000s or so. So the one shed we're not quite sure of and he could work that out with planning and zoning based on age and what the building official would require. But this shed definitely is a newer shed and it was recently put on ‸ and it needs a permit.

They come and go and the main part of the lot will be mowed. But a lot of times around the shed, like in this picture here, you'll see they leave the high grass and there's another picture here. They don't cut in there all the time. So
part of the lot gets mowed pretty regularly. So in the outdoor storage is the, the, there's some scaffolding that's left out there on the side of the building here. Okay. And then there's some other materials, um, appears to be tar paper or something along those lines that are just stored out there. And then here we have some cones and some other, um, old mowers and bicycles and stuff and a car and a vehicle. But that vehicle is not always there. So it must actually be operable. Okay.

the house. The outside storage is a cement mixer, and there's a couple commercial mowers just by that pickup truck that are just left out there. And they leave car batteries and tires on occasion, which is shown in this picture here. You can see the battery. There was a couple tires here and there. And then the parking in the yard is self-explanatory. There's always cars parked in the yard and even on

That's his trailers. And we have spoken with the property owner who owns a lot next door and he's actually told them to get them off his property. So we have a case with that property owner and he is doing his civil action with the neighbor next door to get his trailers off the, the property.

this case we're bringing, we've got a case on the property next to him for his, but it's his trailers. All that stuff you see on the vacant lot is his. Okay.
with, with the property owner. Okay. But since he's not the cause of the violation, we're trying to work with him a little bit and see if we can't get that stuff off there.
spoken with him a few months ago, um explained everything that had been done, that he was given extra time. He said he was going to get taken care of. He never did. I spoke to him, I think in July over the phone, uh right shortly after I posted to the hearing and explained to us explain, explained it to him again. he said, he'd just get to it at some point, hopefully before the board. And that's the last communication I've had with him.

I'm submitting photos that I took during my re-inspections of the property. They accurately depict the property during my visits. This case was brought to the Code Board on May 19, 2022 and was found in violation of site plan approval required. ‸ Appendix A, Article 13, Section 1B. The site plan was required for the changes to the property made by the property owner, which had resulted in erosion. Also for the alterations made to the City right of way. The given compliance date
