Agenda (the City's wording)
The City's agenda for this meeting is on file (BA_Reg_Agenda_10_16_2024), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
129 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 12 voices separated from the audio.
15 short machine repair(s) (16 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 93.2% of 5,991 content words.
Dotted words (143 places) are ordinary wording differences: hover or tap to see the other reading.
129 passages (19% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

First and foremost, ‸ want to thank the city for an outstanding job, for taking care of all of us during the hurricane. Unfortunately for most of some of the staff and leadership, they spent probably about two weeks of bonding together when their EOC here for us, and they kept the village safe and the community safe. So if you see any of the workers, please thank them for that, because they gave up their time and their talents and put them right here for us and left their families at home. And it's very important. So we're very fortunate to have such leadership here. Now I'll start the meeting. So we'll call to order, please.

All right. So just to tell you a little bit about the lounge. Um, so what we are having is not your typical cigar shop or where you can get your CBD or your oils. What we're trying to accomplish here is given a different experience of a lounge, um, doing parents events for beer and wine, just to give a little bit more of a flavor to the palates and options to those who do smoke. There are beginners as well, ‸ aficionados as ‸ well.
So we pride ourselves in, uh, in educating people, uh, with cigars. Uh, cigars are completely different from every other tobacco product that is out there. It's a natural product. These are premium hand rolled cigars by the

Carmen and I are also cigar rollers. So we do hand roll cigars on site as well. And we do teach and educate people on the tobacco culture and the history of it.
[00:15:52]Speaker 9 (introduced as “Carmen Rivera” — machine-transcribed, not verified)
‸ So this is just a little bit of what we kind of put together to talk about the parent experience that we're trying to accomplish in the cigar lounge. So we are going with different, for example, with

because of the different notes that the wine can bring into the cigar without giving and taking away from the other product as well as the ‸ coffee, which it can bring, uh, ‸ mocha notes, uh, more of a naughty tobacco flavors that you can present as well. And just to tell you about the beer,
[00:16:29]Speaker 9 (introduced as “Carmen Rivera” — machine-transcribed, not verified)
beers are actually fermented and prepared in layers. And it's a big similarity with the tobacco itself. Tobacco, you got to start with the filler, with the binder, with the wrapper, and it has a long process where you can get different notes in between each wrapper and each leaves. So that's why we're trying to also educate our clientele, not just of the pairing, but also the experience and the culture that goes behind the flavors to their palate.
And one of the reasons why we did apply for this license and not a full liquor license is because we're not a bar. We're more of a cigar lounge. Um, and like I said, our main priority is the cigars. So it's a place for people to do business or come and unwind. And this is just a different option or something that they can add to their cigar experience.

a lot of us concerned because it contradicts where you read in other areas of the application. So I'm going to be bringing those up and please make a note of it. So I don't spend too much time on one item or other. That way I can go over each of the, uh, items or talk with the, uh,
Clearly identified of what's required for them to stay open for business. And, uh, if it's going to be strictly beer and wine, I think that should be very clear rather than it contradict itself in other parts of it. That's one thing. Um, the other, uh, is there is ‸ going to be no food there. So they're doing it by seating. Um,
uh, bathrooms are the bathroom sufficient for the number of people that are going to be available to frequent the place. I think there's 21 seats. Is that correct?

Right. Um, the hours of operation, what they're concerned about is music. Nobody's mentioned anything about outside music. Are they going to be promoting outside music?
Mr. Greenwood, this property has no outside seating. They, they're trying to request a sidewalk cafe ‸ permit for the front of the right in front of the, which is what other places are

Okay. Now, this decision, this variance, and I want to stress this to people because for some reason they find it surprising when the statement is made. Once this is addressed and voted on,

If they decide to not continue the business in the future, could it be a setup in a way that when they decide to close the current business, that the variance stops at that time, not six months later, even if they're not even open for business?
Would you like me to respond to that? Please. Okay. Generally, no, we don't. The first special exception because we... The board is approving a use. It's not specific to a ‸ particular owner. And that's why it does run with the land. That's the typical... That's the ‸ general rule for special

rather than something specific to ‸ an owner, it should run with the land. Now, we have provided an additional condition in this case that if the use is abandoned by either this owner or ‸ subsequent owner for a period of six months, then at that point, the special exception will be abandoned and terminate.
question here. What Mr. Greenwood is asking, instead of it saying six months, could it be proposed that it would be 30 days after the building is abandoned, that the special exception dies with it, opposed to letting it be six months? Thank you.

their business license. If the business license is still active and if for some reason they decide to sell the business to someone else, then the business license is kept active.

It's that, and correct me if I'm wrong here, but my understanding ‸ is that once a property has been given the exception for a beer, wine, alcohol, whatever,
part. Okay? To put it in simple terms. And the question that Mr. Greenwood is asking is that could the special exception instead of reading that you currently have six months, let's say that they decided, did well, and they want to move down the street to something larger. The something larger may already have, I'm making an example as I go here, so stay with me. Something larger may have already a beer and wine license, so you don't have to come back and ask. But now your piece of property that you're vacating, let's just say somebody else comes in and it may not be the makeup and cosmetic feel that we're looking for, but that piece of property

Yes and no. Yes. And that's a good question. Yes and no. But the beer and wine license remains with the business. The property's already been approved. I will use case in point. An example.
had a beer and wine license. Okay. I don't sell beer and wine, but if somebody else came in behind me, if I retire, they can have beer and wine and not have to come and it might not be what we want.
Yeah. I mean, to be clear, the, the special exception is separate from their license with the state to serve alcohol. Correct. Correct. Okay. So, and this, the license to serve alcohol is, doesn't run with the land. Those, those are given specifically to, you know, the owner or the operator of the business.
land use. Correct. That is permitted on that property. Um, to do something like 30 days would be very unusual. Um, every other, uh, area in the code that talks about abandonment of uses. For example, if you have a nonconforming use, um, you're allowed to continue that use until you have abandoned that use and that the abandonment has occurred for a period of six months. So the six months is sort of consistent with how we approach, um, the abandonment of uses.

that we have included a condition that they're there, the site plan or, you know, the, the conceptual plan that they provided is binding. So if let's say there was a, another, um, you know, I don't know, beer and wine or a beer and wine shop that wanted to open, they would have to conform to the same kind of seating, request seating plan and so forth.
So, you know, there, we have tried to, um, or at least the staff, I think has tried to, uh, put conditions on it so that it won't, you know, become something that's unlike what is before you today.

All right. So that's permanent. Unless we put a condition on it. I know you mentioned that, uh, uh, you all are leaning more on the six months requirement before that gets done. And, uh, I've seen other examples where in 30 days, that's usually something that could make it a lot simpler and easier to follow that. Uh, if they decide to sell or move on and go somewhere bigger, uh, that basically it's what was stated by the board.
We're worried about what happens in the future has nothing to do with them. I like everybody that I've shared the information to that owns a commercial property in the downtown Cocoa village area. They're very supportive of it. It's the caveat. Uh, of the unknown and what could happen later. There are people out there that are looking for that. And we did mention, uh, and this is something that we're definitely going to look into the ordinances. They need to be looked into.
plat past representation of the city. And there's another one. That's a good example. I'm not going to bring it up right now, but we're stuck with it and it's nothing but a negative situation in the village and has been. It's something that we're very protective of value wise with our property. So the staff did make wonderful concessions on it. And I'm glad that they looked at that. My compliments to the staff, but basically all the points that we're making is what happens in the future. Not that we're against these people here for their business. We want it to work. I want to see them there. So does the rest of the commercial property group that heard about it.
which I happen to know. And so with it being so permanent, that's why these conditions are important to go over. So that it eliminates a lot of the fear and concerns. The contingencies, I think, are good that the staff is beautiful. Thank you very much, Lucy. I know that you all worked a lot on this and so did the attorney, but it's just the little fine tuning that the previous application put a scare on everybody that owns the property in the village. That's what this is all about. So I'm hoping that you could potentially consider fine tuning that and also eliminating calling it a beer. ‸ I mean, a lounge bar serving alcohol ‸ when you say serving alcohol in this here, this
It doesn't say anything about beer and wine. It should be specific to beer and wine, not like it says here, because alcohol later, because it's written like that and it runs with the land. They could bring liquor there because it's a little vague, even though they're saying beer and wine.

understand. And we know that it's currently allowing that with the code. But if you ‸ remember, I did mention that these are ordinances, which involves the code that needs to be looked over in order to prevent some of the concerns that I'm presenting today. And they definitely need to be reviewed. This is something that's going to be pursued.
Definitely. But again, it's ‸ to fine tune what we have in the village and ‸ not go off course and to protect what we got. So I highly hope that you consider some of the little tweaking on this and making it. I know you mentioned that this is the way the code is written, but the code is wrong and it needs to be corrected.
what it really means, I kind of think it should strictly eliminate and just put like you did in another part of the application, strictly beer and wine. That needs to be stressed on this for it to go with the land.
