The City's record
What the City's record shows
Built only from the City's minutes (165_CC_Reg_Minutes_12_13_2016.pdf). Page numbers are the minutes' own. Discussion is in the minutes' text; it is not summarised here.
Attendance (the roll call)
The roll call could not be read reliably from the minutes' text (the reading did not include Clarence Whipple Jr., who voted later in the meeting), so it is not stated here; the first page of the minutes is the record.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
375 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 22 voices separated from the audio.
28 short machine repair(s) (31 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 92.6% of 15,957 content words.
Dotted words (521 places) are ordinary wording differences: hover or tap to see the other reading.
375 passages (21% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
01:07:08 (9 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

I'd like to thank Mr. Mayor and the council members, Mr. City Manager and Assistant City Manager, my new friend, and Anthony for the years we've worked together and the city staff. For some reason,
really not supposed to be here. And I had a few minutes. So I got out of the truck and I walked around. And I was amazed, amazed at the activity in downtown Cocoa. And I can remember when I moved to Cocoa and assumed the position ‸ in the Parks and Recreation Department, I can remember at 5 o'clock there was nothing in downtown Cocoa. Yeah.
‸ So ‸ I commend city management and city council for the foresight and the development. ‸ I'm biased, obviously. I always feel that parks and recreation are a core function of county government. I think I have ‸ trouble getting that across ‸ to certain individuals. But I think that parks are an important quality of life. I know it's a cliche. Absolutely true. But if most folks move, when they move to a community, what do they look for? They look for schools. Obviously, they came for a job. They might look at infrastructure.
So thank you so much. It's been a tremendous, tremendous journey. I'm glad that I could work with and for the city of Cocoa. And together, there's been a lot of accomplishments. And there's a lot more to do.

it. But one thing that you realize when the light bulb goes off and it says it's time, and before you wouldn't listen to that, you'd say, well, there's just one more thing I have to do, one more thing I have to do. But guess what? There's always one more thing. Let somebody else have the fun doing it. So thank you so much. Thank you for those kind words. I will pay you your $10 after the meeting for what you said, but thank you so much.

you, Mr. City Manager. I was sitting in my office this afternoon, and our PIO, Yvonne Martinez, walked in and brought me a picture. And as you can see, it's a picture of the Tank of the Year, and it was taken by a local photographer.

1052 Mitchell Street before I get to the urgent point I want to thank Councilwoman Warner for the dedication the time the effort and I mean the hours that she put in to making Thanksgiving dinner in my front yard a success as well as Brad Whitmore who I think is there for actually showing up and helping out and contributing to getting the last-minute items that we needed to get I appreciate all of that now to Council and specifically to the city manager and the city attorney I have been here going on two years now asking the city to get on board to assist use cameras in this neighborhood I sent out email and phone calls Matt and

city attorney I don't believe anybody committing a criminal act on a public street has any right to privacy at all and I don't think Mrs. Sheriff's family feels that way I don't think the Ortiz family feels that way and I know damn well I don't feel that way because at that time Friday morning I actually thought it was my windows that got shot out. And the caliber of bullet that went through those people's homes is not your everyday 38 special. so can we actually get together this is a gift it's not costing you anything but if it was up

in the middle of Mitchell Street the Sunday before Christmas And it wasn't till the sergeant was standing there looking at the video that somebody realized there was actually blood in the street they were ready to drive off I've got kids that are out in the streets unfortunately unsupervised and I am talking about two-year-old toddlers I'm talking about three and four-year-olds six and nine-year-olds And no, it wouldn't be a surprise to have one of them walking out of their houses at three o'clock in the morning. That car after it got hit and after my neighbors houses got hit went flying down Mitchell Street which we've been telling you Mitchell Street is a drag strip for

Mitchell Street and crashed at Mitchell and Pineda so my question to you is, are we really concerned with privacy issues on a public street and a public right-of-way Because I'm sorry but every case I've read every case I've researched all the way to the US Supreme Court you have no right to privacy on a public street or a public right-of-way and on that one

probably about 15 pages it just lays out what the law is and providing certain ideas and background information for the city to consider with respect to these cameras okay so that is available to be reviewed analyzed and the city from ‸ policy perspective can do whatever it desires to do within the confines of the law but I'm not going to sit here and have some individual imply that I said that somebody has a right of privacy for sit standing on a public right-of-way I have never opined that period but and then let us let us let us

serious study and for the city to decide on what what what what it wants to do with respect to this technology all right But there are significant legal issues that need to be taken into consideration, including the right to privacy ‸ under certain circumstances understand that are in play here. so it's something that can be can be looked at yeah

I'm doing well um good evening to all the city council members and the staff of the city um I'm upset about that that's like that's really upsetting to to this is this is where we live and um that's very upsetting and um you know I try to be a positive person
um I ‸ came here with dreams 35 years ago about what this town would become, what it would be, why wasn't it happening 35 years ago. Yes, we've come a long way, and along the way, we're gonna ‸ have problems I'm gonna ‸ read a little note that I've been jotting down today um I put on delegations grease and dumping okay grease and dumping
um it was covered up by sand um but it was not dug up or cleaned up I called the EPA last week I called the health department I walked up to the city hall I don't know if I'm pronouncing his name right I think it's
saw all of the disgusting mess. He's been very understanding. He has come down and listened to my complaints as a business owner in the downtown area. Garbage is ongoing problem. Mr. Troy

photographs for all of you to see. How it's looking these days. You come to work, you come to City Hall, you don't walk past dumpsters overflowing for weeks at a time with mattresses sitting there. That's what I pass on my way to work, to my front door in this downtown. I'll give you some of the pictures while I continue to read.

This has happened continuously in the back of my property. It's disgusting. I almost was going to take a sample and put it in little containers so everybody on this city council knows what the stench is of grease being poured into the ground. Okay, so you see the lovely pictures of the mattress that stood there for over a month behind the dumpster that Troy Stefan has for his restaurants to throw their garbage in. I recycle. Does this downtown city have any restaurants recycling containers? The rest of the cities in the United States do that I go to. It might be some thought. Let's recycle. ‸ The city allows outdoor dining. I'm all in for it. I love outdoor cafes. I love to eat outdoors. But whose responsibility is it for cleaning the dirty sidewalks? When the pavers were laid down here many years ago, the color is terracotta and beige.

I notice they have a fence and they have mesh to protect pedestrians walking around a construction site. The property behind my building that's going to be developed has a piece of plastic that's been strewn around it for over a year. That is not a proper fence. My AC units are there. The intake of dust and dirt being moved around there is being sucked in. Those are my air ventilations into my store.
Why there is no fencing around that property where construction is and where my property is is beyond me. I'm trying to be positive here, but it's getting harder and harder to be positive what I pass on the way to work. Okay. Fencing. I just have. Okay. So the dirt has been moved. I
easement for the water and the drainage and the gas to be continued with. I had an attorney. I have an attorney. He has written a letter to the city. I hope that the city and my attorney and myself can work together.
But let some of the restaurants get away with murder. It is a sin shame on the city. We must strive to be a better, caring community here at home for the citizens and visiting tourists. And most of all, our environment and our planet Earth. Clearly, the citations have not been enough.
I'm sorry you're out of time. And I am out of time. Yeah. By law, I have to do that. But have you been ‸ talking to the city, right? John, what can the city do as far as the ‸ fresh grease?

We've had multiple. The building official has ‸ gone to the business that's been doing the dumping, made multiple visits and spoke with him. And so code enforcement has been involved. I ‸ have witnessed the trash as well myself. And

the bank regarding the dumpster to take care of it. So the ultimate responsibility is the bank because it's on their property. But both parties really need to take care of it.
the property. And that's what they do have. They're not required to have the same kind of fence you see over at SunTrust because that's a different situation. But they are required to have the siltation fence. And we have had Steve Angeline, who's the building inspector that you're referring to, have multiple conversations with the contractor because I see it every day too. I walk by it every day. And the siltation fence,
by the work they are being done. There is going to be some, I mean, it's a construction site. There is going to be some temporary impact. I'm trying to minimize that the best that we can. Once it's completed, it'll be a better situation. But in the interim, I know it's
is not the first time. It's been all over back there. And now it's, they've, they've given it. My building was just painted. I painted that, I had that building painted. There's grease up against the new paint.

‸ There were a lot of happy, smiling faces from the vendors at the end of it as ‸ well as with the attendees. We'd like to extend a special thanks to the city staff who worked with us to make it possible. Couldn't have done it without you. Look forward to working the next one coming up soon as our next Art and Craft Fair. I'm going to get into something that I actually know about at this point, the Sail to the Sun ICW Rally. Second year visiting here. First year was a great success. Second year was as well. They arrived as planned
Stayed an extra day due to weather. They left on the following Wednesday. While they were here, they ate, drank, shopped, enjoyed the holiday bazaar. Some went out to Cocoa Beach. There was a tour out to Kennedy Space Center in conjunction with Space Coast Brews Cruise providing the transportation. They came back and said, Cocoa is an amazing stop. This is a great place. There is so much to do here. It's so cool. It's a wonderful place. One of the highlights was

love having you. We want to encourage more boaters to come in. And when you go home, please tell all your friends. And that is the idea is we're spreading word of mouth. And that's why we go to the effort to do this because via the Internet and word of mouth, we're trying to get ourselves on the map as more of a boating destination.
put on their boats and fly for conversation pieces and whether they're on their boats or on their desks at home. They went over very well again, but ‸ it's got a nice reference to Cocoa there. We bought a couple extras at request. We have two available if anybody wants to buy one. Beyond that, one of the really nice comments that was made, Wally Moran, who guides this, ‸ got up and said that Cocoa is leading the state of Florida and sets the example for how a city should ‸ take care of their visiting boaters. And I thought that was a wonderful compliment. Great PR for us to do this.

Extra security down at the docks and on the water, which we need to continue doing because we do still have problems down there and there are still reports of theft and that will torpedo our efforts faster than anything.
going to present that idea this evening and my minute and a half left. In a nutshell, we have two problems. One is the docks aren't really proper for dinghies. The dinghies go under them. There's a real simple fix for that. The other one is getting people in and out
I've got a great idea for that that's cost effective. Basically, what we're talking about is on the docks, putting fender boards along on the pilings to keep the dinghies from going under.
I'm talking about. And the other is there's an unused piece of seawall between the end of the boardwalk and the boat ramps that we could put three dock ladders on.
up and easily climb up a ladder safely. It's a protected area. It would increase our dinghy capacity by at least six boats. And it would be ‸ much safer egress, ingress for people getting in and out of them, which reduces the risk for the city.
And it's this little slice of sidewalk right along here. I will pass that along. And what I mean by a dock ladder, they look like this. This is the one in my backyard. It's about five years old. It looks just like it did when I bought it. Nothing moves, nothing to break, nothing to maintain. Also got online and pulled ‸ just any old one out as an example with a little technical information about how they're built. We could buy three of these for less than $500.

Okay. We're going to talk about the tourism marketing co-op program and what we're looking at for this year. So each year, for the last few years, we have been working with the tourism office on a marketing program. In 2015, you can see it was a co-op program for billboards. And these are some of the billboards that were up throughout the state. I think they went into other states as well, Georgia, along the major highways. And so these are just some of the billboards that you see here.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:34:02–00:34:05 · unresolved: the words are not shown (unclear audio); listen to the recording
So we have the traditional billboard program, which is... It's a $25,000 co-op where we would get... This year, the co-op will get us four to eight billboards, depending on location. It's a 12-month permanent billboard location that we get to choose.
So what the difference is between what we've had in the past is that we are getting permanent boards as opposed to vinyls that move when there's an opening.
how many boards we had. Now we'll have a set number of boards that will be part of the branding for the tourism office for the county. And for this buy, we would get four to eight billboards, depending on ‸ the locations we choose.
before. Right. The second option that we can do is we can do kind of a hybrid program where we take... We do the billboards. So we would get one to two billboards. Same thing. We get to choose the location. And they would be permanent boards for 12 months. And then we would mix that with a digital marketing program as well. And we would work with the TDO, the tourism development office, ‸ with their social media platforms and market ‸ through their Facebook. And with that, we would be able to get demographic information and analytics that we don't get to get when we have the billboards.
They just recently ‸ did a video for Cocoa Beach. And it's 24 hours in Cocoa Beach. I'm not going to play the whole thing, but I do want to play a little bit of it because I just want to show you this. ‸ They are doing a lot more videos, a lot more digital marketing.
So that's just a little bit of it, but I wanted to show you, this is one video they did, 24 hours in Cocoa Beach. They promote it through your social media channels. And so it's just ‸ a great tool. A lot of social media is going to video now. And it's a great way to market and promote the area.
Then this is an example of some of the analytics that they get. This was on that 24-hour in Cocoa Beach. They drew statistics. I think this is for a one-week time frame, November 14th through the 29th. And you can just see the impact that it made. And they can get cost analysis from these videos, click-throughs. They can get analytics as demographic information from who's using it. It kind of gives you a sense of, you know, are you getting your money's worth? How many people are actually looking at the video? It tells you, kind of

you where the best places to market and promote those videos. So those are just a few things I wanted to show you. So those are the two options that we have. And I wanted to introduce the director of the tourism office. Eric Garvey

Well, thank you. Thanks for having me. Samantha's great. ‸ She gets ‸ what's happening in the media landscape. It's changing so quickly. About a year ago, we established a relationship with Facebook, Instagram. They're one company. And we committed significant budget to promoting across their ‸ platforms. In exchange for that, we have access to pre-sophisticated digital science. And that's allowed us to have confidence in how we scale up when we market across their digital platforms. And that's what Samantha's describing to you. That video example she showed ‸ in one week. I don't know if you could see the number, but it was close to a million impressions just in one week with that approximately $4,000 spend. Now, billboards still have their place in our overall media plan. But as Samantha ‸ was referencing, with outdoor media, by its nature, you really don't have any idea who is responding to it. You just get a global impressions. And on I-95, you're probably talking somewhere around 20 million vehicles will pass that billboard a year. The very interesting point about digital media is not only do you get the impressions, the scale-up impressions, but you also are getting those impressions ‸ to the people that you are targeting who are most likely to visit here. And in fact, I was sharing with Samantha, we have the ability through our relationship to actually target visitors, for example, visitors who might be in Cocoa Beach. We can target them with your Cocoa Village message to encourage them that while they're here in market, to come across the rivers and enjoy the shopping and entertainment that's available here. So it allows you to do a little bit more, be a little bit more strategic, in addition to having the scale to give you the impressions that you're getting through your billboard campaign. So we ‸ are thrilled to work with you on this program. It's a dollar-for-dollar match. We ‸ promote Cocoa Village as an attraction for our tourists who arrive here on the Space Coast. As you heard earlier, a presentation about the fondness for Cocoa Village is just one of those places that people love to come to. It's authentic. The ‸ shopping is great. The dining is great. ‸ So we are pleased to be a partner in helping to create greater awareness for Cocoa Village. And I can answer any questions that you might have.
And we got mass scale, which was an okay strategy. There was nothing wrong with that. It was good. But over time, what we saw is as the economy came back, more advertisers were picking up the best spots. And
We were seeing some of our placements on some highways and byways that didn't have the same kind of impact. So that's why we decided that this would be a good time for us, since we do have budgets available, to go ahead and lock down some premier sites, billboard sites, and so
might end up in South Carolina. And, you know, it had no relevance. So this gives us better control of the placements, and, you know, and we think overall it's the right time to make that shift and it'll be just as effective.
we partner with some other retailers. It's great. And we, you know, we beat up the billboard vendors pretty good to make sure we get the absolute best rate and the best placements. We also, as a point of note, we buy so many that on a monthly basis we're driving all of our placements now and reviewing them to make sure that they're in good shape, that they're not obscured by vegetation or anything.
Right. And you went to a different not so much you have a different look. Remember how uniform they all kind of look? They all kind of related to each other, all the cities? Yeah. It's a little ‸ more wide open. I like that.

catching. Yeah, they catch the eye a little bit better. So we've been doing things like that to just enhance them. And those are also things you couldn't do when the boards moved around.
Mr. Mayor, billboards are certainly effective media and way of advertising. But I recently took a marketing class and a remark that was made to us by the instructor was, if a picture's worth a thousand words, the video's worth a million. So that is the direction of advertising. I don't care what industry you're in. It's ‸ the YouTube videos. It's the online, like Facebook, Instagram, Snapchat. You know,
Sure. To kind of go off of what he said as far as, like, if someone's visiting Cocoa Beach, they can target the person that's in Cocoa Beach. Facebook knows where you're at at all times. You are not hiding from anybody. So if Facebook knows you're in Cocoa Beach, they're going to send a message, our Cocoa Village video to you and say, why don't you come over here for the day and spend shopping and dining and doing all the fun things that you can do in 24 hours.

you know, and I also wanted to point out, too, which I think is quite impressive, is they spend so much money, they have so much money in Facebook, they have their own Facebook rep that is, like, assigned to them. So the buying power that they have, and I'm not saying it is they spent, it's an investment. They have invested so much into Facebook. They

plugging away congratulations again mr. Whipple good to see you back up here on the dais ‸ we have two new council members, andand if you just give me just a second here. There were some comments made earlier this evening under delegations which I really take exception to I know how hard the city council the city manager, the police chief works regarding fighting crime in this community. And
the council directed that I take a look at the legal issues regarding the use of outdoor surveillance cameras I spent an extensive ‸ amount of time researching that issue and providing a detailed legal opinion back in February of this year that legal opinion was given in April of this year by email that's my understanding to the individual that spoke this evening and I just want to pass since we have two new council members that weren't around this year I want to pass out that legal opinion and

could not install surveillance cameras and public rights away. Nowhere in this legal opinion does it say that somebody has a right to privacy standing out there in the middle of a public right-of-way And there were some implications or implied you know statements that ‸ that individual made. That perhaps my legal opinion may be
could have could have maybe helped with getting video surveillance regarding this this in this unfortunate incident and that's the farthest thing from the truth and I just want the record to reflect that

you know I think we've said before that I know the mayor and other council members have said before you know, the city would never stop until, you know, you know ideally that there's there's never a crime committed in the city. But unfortunately we have individuals that are facing circumstances and they make bad decisions and they impact the lives of other members of our community in a negative way. uh And we're very fortunate that we have a police department, a police chief, and his leadership team that are striving to make changes and build relationships with the community. And not just relationships in terms of a transaction
but actually building a foundation in the future with uh our younger generation and members of our community. So i I would like to commend them. And I know that there's always things that can be done differently. And maybe, and I know police chief and I have talked about it.

solutions and and varied varied approaches and innovations in policing to uh to try to arrest, you know, or or deal with the issue that we're facing with, you know, some of the individuals in our community. They're not doing the ‸ right thing because
that live every day, work hard and do the right thing, care about their, you know, their, their fellow neighbors. We, I mean, I can't, I go back to, I think about hurricane Matthew as devastating as it was to our community. uh the number of neighbors that were helping neighbors and caring for each other and looking out for one another that were looking out and reaching out to the, the, ‸ first responders, the public works personnel, the utility people that were out in the field and offering their assistance. So, um I just, it's, I just, I'll just leave it at that. um so, uh we will, I'm sure maybe then in the near future we'll have a after you have opportunity to digest the uh the city attorney's memorandum uh

additional pledge where the city must, you know, covenant to budget and appropriate additional other funds other than the fire assessment. And we did have to we did put together a debt service reserve fund to provide additional assurity and comfort. But so that's really ‸ The reason
