Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
298 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 22 voices separated from the audio.
19 short machine repair(s) (23 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 93.8% of 13,918 content words.
Dotted words (254 places) are ordinary wording differences: hover or tap to see the other reading.
298 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:32:28 (7 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

It's a future land use map comprehensive plan amendment for the Grissom 46 acres annexation. And I just want to say if there's anyone, uh, if the applicant is here, uh, for this item, raise your hand at, thank you.

per acre, to city of Cocoa industrial. This request is being made concurrently with ordinance 03-2026, which is a zoning map amendment to change the zoning from county general use to city of Cocoa M2, which is our manufacturing and industrial zoning. It's also in consider in consideration of ordinance 01-2026, a request to annex these properties into the city of Cocoa. The annexation itself doesn't require planning and zoning board approval. However, it does require two city council hearings. The first hearing is scheduled for April 14th. The second is tentatively scheduled for April 28th. The applicant has requested the planning and zoning board's recommendation of approval of the rezone and the comp plan amendment prior to presenting their annexation requests before city council. Although staff is not requesting approval of the annexation today, the request for the comp plan amendment will be presented in context with the annexation as they are directly related.

Staff will request that this be a condition of approval. And so the subject parcels to receive this comp plan amendment are located generally east of Grissom Parkway, north of Oxbow Circle, and south of Canaveral Groves Boulevard, west of a 370-foot-wide Florida Power and Light right-of-way, and more specifically northeast of the intersection

any new development in the service area requires. Per the city of Cocoa code chapter 22, any non-city property that requires the city of Cocoa wastewater service and is contiguous to the city boundary must be annexed into the city. In this case, the southern boundary of the annexation area is contiguous to the northern boundary of the city of Cocoa.

Industrial LLC, who is seeking to purchase, combine, and develop the aggregated property as an industrial complex of the warehouse and distribution operations, contractor offices, light and heavy manufacturing, outdoor storage, and heavy equipment rental repair service and sales. The applicant provided a concept plan and these example photos with their application.
allows for four dwelling units per acre. With this amendment, the applicant is seeking the city of Cocoa industrial future land use designation, which, according to the city of Cocoa comprehensive plan, shall be regarded as appropriate for activities associated with industrial development, which can include materials processing, materials assembly, product manufacturing, and storage of finished products. Uses can include manufacturing facilities, warehouse distribution centers, and truck terminals.

and light industrial zoning designation as part of another ordinance. And just kind of an overview of the surrounding property uses. You have, basically to the north, you have the county vacant properties, and there is residential manufactured homes there to the northeast of the site. And over to the west, ‸ off of Grissom, you have a Dollar General, you have the Brevard Christian Church, and you have a United Rental Storage, which is under construction at the moment.
City of Cocoa, and then, of course, Amazon. And I wanted to go back one slide and just mention that the surrounding future land use there to the ‸ west is

And then, so the planning and zoning staff report covers the analysis. According to chapter 15 article two sections 1510 and 1511 for compliance with the comp plan to determine the impact to the city elements. And that has determined that the future land use change will not negatively impact the city's budget, but will contribute positively to the city's economic base. That preliminary analysis has shown that the city can provide services at the same level of service provided to other residents and businesses.
Flag: numbers, amounts, negation or names differ between the machine readings; a language review questioned the wording · 00:11:26–00:11:34 · unresolved: the words are not shown (unclear audio); listen to the recording
Another consideration is per the comp plan regarding neighborhood protection and in consideration of the low densities, uh, ‸ residential characters surrounding the county land use. The city will require an opaque compatibility buffer, which will minimize visual noise and environmental impacts from the new, um, industrial future land use assignment.
applicable comprehensive plan goals, policies and objectives, which include, but are not limited to, uh, goal 1.1 to create and maintain a broad range of land use activities,

That is, um, it establishes or to establish and maintain a stable and growing economic base. And then to the right there, we have our, uh, future land use table, uh, showing that, uh,
Flag: numbers, amounts, negation or names differ between the machine readings · 00:13:02–00:13:03 · unresolved: the words are not shown (unclear audio); listen to the recording
the city council also approves the request to annex the subject parcels into the city. So the condition of the condition is, uh, that the future land use map comprehensive plan amendment will only be valid if city council also approves the request to annex the subject parcels into the city of cocoa ordinance 0 1 2026.

some specific information if we could discuss that in reference to the tree mitigation and also the buffer, the opaque buffer. I'd like a little more information of how that's going to be, uh, handled.
So, um, so the applicant intends as mentioned intends to, um, uh, replace or mitigate, uh, the, the trees that are being removed. And that will be obviously according to our code requirements. And
requires a wall between industrial and residential land uses. And zoning. So, so that will be, that will be part of when they come for site plan development. Yes.
Yeah. And there is a height, there is a height limit. I believe it's 10 feet for the industrial zoning district. So, so that would be their maximum. And I do know they are working on a tree survey at the moment. So, so when they get ready for their to submit their site plans, it will include the tree survey.

They, um, they are required to submit a phase one environmental site assessment. So we'll, we'll be seeing that, but their initial analysis is that they're not, um, there's ‸ low to a little impact, environmental impact. But like I said, we'll take a look at that analysis when we get it.
general public. And I'm just clarifying for their sake that there was no responses. They will receive regarding this. So I just want to clarify that because there was only one that I was truly concerned with. And if that neighbor didn't say anything, I don't think there's much else for us to really say here today.

And because of that, they are required to annex into the city. So the general use county zoning, uh, covers rural residential unimproved land and areas without specific development trends. However, this is low density in character.

‸ and I'll um let them go through more detail of the intent for these homes in their application. In terms of wetlands, um this was an important item through the staff review. We also found the application consistent with the conservation element in terms of the protection of the higher quality wetlands on site um on-site mitigation of tree removal. In order to be consistent with this policy,
and it was found that the um habitat was not um available, or there was no protected species on on the property. uh With that, staff has recommended approval of the proposed large-scale site plan and preliminary flat, finding that it does meet the requirements of the city's code, as well as comprehensive plan. over 30 dwelling units but we're only seeking seven. We're not looking to change the future land use designation here or the zoning. So we're looking to keep all of that the same and develop within those means so the RU 17 and the RU 215 zoning that is there today is consistent with the low and very low density future land use classifications I did turn the map, so notice
but this just helps us to zoom in. So when we were initially considering the design of this seven lot subdivision, there were a lot of things we thought about. The first was reducing access onto Indian River Drive and then it was the conservation of wetlands stormwater treatment and retention and then buffering with the existing homes. So you can see that in no situation are any of these new lots proposed immediately adjacent next to an existing home. The existing homes are all either next to a conservation area or a retention and landscaping area. Sorry to go back. So
due diligence and design. So this is what we submitted back in 2023 to the city. And you can see the difference here is that there is that private access drive on the west side of the lots that connects to Dixon Boulevard

of you know lots five and six. You can see that they have that shared driveway in the middle in the orange. And we're doing something interesting with the homes here. We're rear loading the garages. So the front of the homes are facing the rivers, the driveway is coming up the middle, and then the users of those driveways will head behind the house where they can go in the garage or they can turn around. And what that will do is that will make it so anyone pulling out onto Indian River Drive doesn't have to back out there are limited driveways so it reduces those conflicts with vehicles coming through and this design that I showed you before it is consistent with the land development regulations and the comprehensive plan
is what you were looking at so it depends on the market rate at the time that this is developed but probably around 1.5 million dollars would it be my guess there are significant costs to do this development for so ‸ few lots so they will be upwards of 1 million dollars
which I've colored in just a little bit to talk about some important points so while we're consistent with the land development regulations and the comprehensive plan we are providing a significant portion of

quality the blue areas are the retention and then the yellow is the development area where those single family lots will be back in August of 2024 as we were going through this process with the city and working on stormwater and design and driveways
so they could see what we were proposing and I asked people to reach out to me should they have questions so I had ongoing communication with four different property owners in the area and I'm just going to summarize some of the things that we talked about their concerns if you have questions or want to get into more detail we can do that but generally speaking there were four concerns that the neighbors had the first and most importantly which we've already talked about earlier with staff and their consultants is the roadway flooding and the stormwater the second concern was traffic the third concern was driveways and the fourth concern was conservation and wetlands so to touch on those a little bit I'll start with the
Flag: numbers, amounts, negation or names differ between the machine readings · 01:04:47–01:04:51 · unresolved: the words are not shown (unclear audio); listen to the recording
been put in a conservation easement where we are preserving those wetlands up there near the uplands on the west side of the property so we designed the project to minimize the wetland and surface water impacts to the greatest extent practical and
which are low quality and isolated with significantly altered hydrology invasive vegetation and limited ecological function So mitigation will consist of a combination of on-site and off-site wetland mitigation in addition to us putting money and mitigation credits into an approved mitigation bank. So for the roadway flooding and stormwater, we're definitely aware of
of the occasional flooding events that happen on Indian River Drive and to some of the low-lying homes along that area and you know we of course we share that concern with our neighbors However, we neither own, maintain, or have control over that roadway.
over is how high we are building these homes to make sure not only these homes that are being built are protected and out of the flood zone, but that we don't have any adverse impacts to on any of our neighbors. And so all the documentation that we have submitted and our correspondence and communication with the city, we have verified that there should not be any adverse effects on any of our neighboring properties.
institute of transportation engineers calculations each single family lot only creates about 9.6 trips per day so we would calculate this out at about 66 trips per day for this neighborhood which is definitely still within the acceptable level of service for the adjacent roadways just for comparisons purpose the Indian Hills subdivision just to the north with 38 homes that's about 357 trips a day so very de minimis impact for the transportation system here

a plan that we think meets the performance standards Okay? We know it meets the performance standards And the reason why I say that is because there's a net reduction of water Leaving that that's basically a flume ride down that hill to the river, okay? Now one of the residents mentioned that that that system always discharges, right? Because what happens is it gets to the bottom and it like sort of pops out over the curve and enters the river We're going to control that with this project, okay? We're going to be able to say we are meeting the conditions of the performance standards for not only water quality but for water quantity, okay?

call a bypass ‸ system, okay? It has a sort of a system inlets of a network of inlets like a header basically all along the backside of that And so it picks up that water and lets it get around the property ‸ and and you know get to the river, right? So it doesn't want to move in the north towards the north. It doesn't want to move towards the south It'll it'll kind of make its way up there down to the bottom and serve as not only for hydrating the wetland and the conservation easement to the to the west But

Indian River if you get a 10-year event in most cases local roads are designed for a 10-year event And maybe in this case, it's probably some somewhat worse obviously based on what everybody's saying But if there's a capital improvements project that you all looking at or something that we can work together on We're certainly willing to entertain that
