exhibits for the Board’s review. Code Enforcement Officer Brimm testified that the Property Owner was in
violation of Chapter 6 – Buildings, Construction and Property Regulations. Article III – Property
Maintenance Standards. Sec. 6-900 Generally. (b) (14) of the City Code.

Property owner was sworn in: Reese’s Mary Michelle Dunn and James Brown, 2414 Tulane Dr.
Senior Code Officer Brimm asked the chair if he could give a brief overview of the last meeting then move
forward. Officer Brimm showed the pictures from the morning of the board hearing taken by Director
Neuterman. Ms. Dunn discussed what happened at the July Code Board. She was asked to either dim the
lights or place under the soffit which she explained made the lights brighter. Code Officer Brimm stated
that she was asked to take sections of the lights out to make the lights not as bright. Mr. Otero asked City
Attorney Eick about the discussion at the last board meeting and not having a city ordinance for this type
of nuisance. Attorney Eick explained there is not a specific code about lighting. But it was brought under
the general nuisance section which says any other condition that constitutes a nuisance to the public which
is continually or repeatedly maintained the abatement of which would be in the best interest of the health,
safety and welfare of the city residence. Attorney Eick stated that is in the code and is more of a catch all
for the ordinance. Ms. Dunn continued her discussion about the lighting and not being a nuisance to her
neighbors. Mr. Muller asked Ms. Dunn questions about the food truck which is a commercial vehicle and
is on residential property. Ms. Weatherspoon stated that what is being discussed should be about the
lighting and not the other items being brought before the board members such as cost to the property
owner. Officer Brimm explained that he was in contact with the property owner all the way up to last meeting
but hasn’t had any contact since. Mr. Muller explained that he is a contractor and had questions for Ms.
Dunn about the lighting and the cost. Mr. Brown wanted to discuss other neighbors in the neighborhood
that have violations Attorney Eick explained the ordinance again. Ms. Dunn asked why he was targeting
her. Ms. Weatherspoon let Ms. Dunn know that Officer Brimm does not have a dog in the fight he is just
doing his job. More discussion amongst the Board members, property owner and staff.

Chairman Otero said the violation is tor buildings, construction and property regulations, but nothing to do
with the overgrown grass. Officer Burrows stated it was strictly for the fence issue. Deputy Director Jennifer
Justiniano explained that the code that was cited was that the fences and walls shall be maintained
structurally sound, so it was cited because of the fences leaning which was not structurally sound. More
discussion amongst the Board members and staff.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
266 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 15 voices separated from the audio.
39 short machine repair(s) (48 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 94.4% of 13,070 content words.
Dotted words (421 places) are ordinary wording differences: hover or tap to see the other reading.
266 passages (20% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
01:14:35 (18 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

This is as of this morning around 4 50 a.m This is Down one house from the property You can see the the lighting of the house and if you Notate on the right you can see a spotlight on that house in comparison to the lighting of the house that's in question for the violation
You can see Essentially just the lighting of the house it's hard to see anything beyond that I tried to do a close-up of it so you can see It appears the the lighting previously that we spoke about is still on the trim of the house and there's been lighting Installed or placed underneath the soffit But the issue is that it Compared to the previous photos, it's actually brighter

There no what was stated is that there isn't a specific code about lighting Again lighting specifically this um case was brought under um The general nuisance section which says any other condition that uh constitutes a nuisance to the public, which is continually or repeatedly maintained the abatement of which would be in the best interest of the health, safety, and welfare of the city's residents. So
as more like a catch-all right. It's not something that lighting isn't specifically addressed in the code, but there can be other conditions that would meet Would fall under this, you know As ‸ a public nuisance.

I heard that so so you see what you're saying now you're you're you're asking To be safe you're asking um To be able to live in your house safely, correct? Well guess what your neighbors are also asking to live in their house uh
It's not comfortable with them. violation is City Code Chapter 6, Building Construction and Property Regulations. Article 3, Property Maintenance Standards, Division 4, General Requirements, Section 6-1001G. Property owner did allow for the following violation. Accessory structures. All accessory structures, including detached garages, fences, and walls, shall be maintained and structurally sound and in good repair. On May 7th, code enforcement received a complaint about a fence falling and in disrepair. On the 11th, I visited the site, found several sections of fencing that were on the side of the parking lot, either down or needing repair. I sent a notice of violation by certified mail ‸ posted a copy at City Hall and on the property. On July 1st, I received additional information regarding down fence at the rear of the property and sent an amended notice of violation, certified mail posted it at the City Hall and property. As of today, the property is still in violation.
This is the back fence. From this angle, you can't really see how badly it's leaning over because of the weeds. On the other side it's it's obvious that it's only being held up by the concrete it's leaning on.

Our building inspector was requested to go out and check the property. Of course, we found where the fire initiated around the electrical panel. But inside the full ceiling was completely redone. Half of it was
the other part where my son tried to paint it and which was prior to see, make sure it looks clean and ‸ realized he got sick because of the paint to finish out. But we never got to even paint. It still hasn't paint. It's still exactly the same way.
parents are going to depend on how the application is submitted. If everything is submitted required by the building plans examiner. This could be an owner builder permit that is pulled. However, the documentation for Florida building code is going to be requested. So it depends on if that comes in when the application is submitted, how long it takes for that person to respond to comments. If there is anything missing. So it's hard to give an exact time frame depending on how that comes in.

had confirmed earlier today that she received information to file the permit online. Also in 2023 there was an owner builder permit pulled through citizen serve by the property owner for a fence so a permit has been applied for ‸ in the past we also have phones that she can contact voicemails that she can leave emails so our building department is very very open to communication um this is the first that i've heard that she's come into the building
yeah they give me back and send me back home and tell me to get it done go online and get it back done how i say I'm having problem with it trying to submit I will get stuck on one end and I try to open it up and to send me somewhere I don't understand which way to go and I say at least my daughter if I can tell her what to do they say just go back give me I can even bring the formants and show you that ‸ I did I I
someone who is not computer literate in this day and age has no other recourse to submit a permit application they can't come in hand delivered it deliver it and you couldn't scan it and put I'm just asking
so the state of Florida is actually starting to enforce that all building permits have to be submitted online other than you know emergency situations um when there is no online option
they they do offer guidance so it is not simply a you're on your own we're not going to help you right um if the if the assistance is requested we will provide that
did your husband apply for that permit in 2023 probably you did okay um ‸ so I mean we have no way of knowing who applied for that permit I'm just saying that perhaps she could come into the office and ask for help as opposed to you know trying to file a permit on your phone not everybody has a computer anymore and it would be you know if we want her to get a permit let's make it accessible for her because obviously she doesn't understand how to apply for a permit.
she still has to do it online. Correct. yeah But yeah it would be on the computer that you all are providing for her as opposed to her doing it on her personal phone.
And, and if you're trying to apply on your phone, how can you make a telephone call? I'm trying to do, you know, if you're already not computer literate, that would make my head explode. If I had to, I'm trying to apply online and I get stuck. oh now I have to call you from the phone that I'm applying online. It's just, it is a mess. So, um yeah that's just i wanted to clarify that. Okay. Any other questions?
