for the Board’s review. Code Enforcement Officer Brimm testified that the Property Owner was in violation
of Chapter 6 – Buildings, Construction and Property Regulations. Article III – Property
Maintenance Standards. Sec. 6-900 Generally. (b) (9) and Chapter 6 – Buildings, Construction and

Property Maintenance Standards. Sec. 6-900 Generally. (b) (9) and up to two hundred fifty dollars
($250.00) Chapter 6 – Buildings, Construction and Property Regulations. Article III – Property
Maintenance Standards. Sec. 6-900 Generally. (b) (14) per day until found in compliance.
Property owner was sworn in: Reese’s Dunn, 2414 Tulane Dr. and James Brown
Mr. Brown asked if the lighting was for security or decoration? Ms. Dunn wanted to read in her hearing
statement to explain that her exterior security lights were sited under the city nuisance ordinance and
wanted to clarify and clearly explain the citation does not meet the legal definition of a nuisance and why
the case should be dismissed. Security lights were professionally installed in 2015 and have not changed
in eleven years. Ms. Dunn stated there were multiple inspections with the lights being properly installed
and did not violate any City of Cocoa ordinance. Ms. Dunn further explained that the City of Cocoa does
not have a lighting ordinance that prohibits her lights. Ms. Dunn continued to read from her hearing
statement and about her neighbor across the street that was complaining. Ms. Dunn filed a formal complaint
of cease-and-desist order to the complaining neighbor and also filed a formal complaint with the City of
Cocoa and submitted a notarized affidavit documenting on going harassment and misuse of the Code
Enforcement Department to target her. Ms. Dunn wanted to talk about the vehicles in the grass and the
seventy-two-hour window she was able to have the cars in the yard. Chairman Roberts explained to have
more lights on the street she would need to talk to City Council. Chairman Roberts had questions about
lighting code. Officer Brimm stated currently there isn’t a lighting code as far as the brightness effecting
neighboring properties that is why it was sited under nuisance. Discussion about the vehicles that are
parked in the grass and getting a permit for a driveway. Manager Justiniano let the board members know
that a permit was applied for earlier this year for the extension of the driveway. According to Planning and
Zoning, Ms. Dunn has a large material of artificial turf in the backyard. She was directed to follow up with
the city engineer to obtain authorization for the material artificial turf to be installed in the backyard to be
considered pervious. Ms. Dunn explained she is over the lot coverage even if she removes the turf per
Planning and Zoning. Vice Chair Otero wanted to try and come up with a solution because he felt that the
lighting was too much. Ms. Dunn wanted to explain why she needed the lighting. Vice Chair Otero asked
if they could dim the lights so not to affect the neighbors. Director Neuterman wanted to make a suggestion
as to the other neighbors in the area. Their lights are on the soffit to face down and not on the fascia might
be a solution for the brightness. Mrs. Weatherspoon explained to Ms. Dunn that she has been given a lot
of suggestions to be able to keep her lights. Chairman Roberts asked Ms. Dunn how long she thought it

would take her to resolve the lighting issue. Mrs. Scott asked Officer Brimm what it would take to satisfy
code. Would it take her to move the light underneath or have them removed, Officer Brimm stated yes.
More discussion amongst the Board members, property owner and staff.
Motion by Chairman Roberts, seconded by Mrs. Scott, to amend Staff’s recommendation twenty-five dollars
per day ($25.00) Chapter 6 – Buildings, Construction and Property Regulations. Article III – Property
Maintenance Standards. Sec. 6-900 Generally. (b) (9) and table (item #2) Chapter 6 – Buildings,
Construction and Property Regulations. Article III – Property Maintenance Standards. Sec. 6-900
Generally. (b) (14) to August 20, 2026, meeting and find the Property Owner in violation. Vote on the
motion carried unanimously.

5. CE-26-0417– 900 Friday Rd

6. CE- 26-001553 – 1103 Myrtle Ln.
Code Enforcement Officer Willam Burrows provided an overview of the Case history and presented exhibits
for the Board’s review. Code Enforcement Officer Burrows testified that the Property Owner was in violation
of Code Appendix A. Art. XV. Sec 2 (A) Building permits of the City Code.
Code Enforcement Officer Burrows requested that the Board find the Property Owner in violation and be
given until August 15, 2026 (30 days) to come into compliance or impose a fine of up to two hundred fifty
dollars ($250.00 Code Appendix A. Art. XV. Sec 2 (A) per day until found in compliance.
Property owner was sworn in and translator: Jose Luis Castillo Rodas 1103 Myrtle Ln, Mario Conseco
(translator)
Mr. Brown asked Officer Burrows to read the violation again and what it was for. Officer Burrows stated it
was for the enclosed garage. Chairman Roberts asked why a permit wasn’t pulled. Mr. Rodas said the
person doing the work did not tell him he needed a permit for the work. Chairman Roberts said it has been
over a year and still has not applied and why. Mr. Rodas said he applied for the permit 3 months ago and
was denied. Manager Justiniano said a permit was applied for on October 13, 2025, with a lot of
documentation but was missing signed and sealed plans and other detailed drawings for the mechanical,
plumbing and electrical. Manager Justiniano explained the other items that are required by the Florida
Building code. The plans examiner asked for documents which were not turned in. They were sent a 10-
business day notice. On December 9, 2025, the permit was denied due to know response by the applicant.
Chairman Roberts asked why if he applied in October that he never replied about the items needed. Once
the permit has been denied the property owner will have to reapply and make sure to turn in the signed and
sealed plans and other items per Manager Justiniano. Per the new House Bill there are only so many days
they have to review and request documentation, and they will be needed before the application is done to
make sure the review is done properly. Vice Chair Otero had questions for Manager Justiniano about the
permit. Vice Chair Otero translated the conversation between him and the manager. More discussion
amongst the Board members and staff.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
311 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 17 voices separated from the audio.
32 short machine repair(s) (42 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 91.1% of 12,750 content words.
Dotted words (310 places) are ordinary wording differences: hover or tap to see the other reading.
311 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
01:05:43 (22 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

The nuisance ordinance requires that a condition be offensive annoying or interfering with the comfortable enjoyment of life or property for the general public or the neighborhood. A nuisance does cannot be based on one individual's personal dislike In my situation the only complaints have come from one neighbor across the street These complaints have been repeated for more than a decade and have already been found unfounded by the city of multiple or multiple occasions.

‸ Now with, with lighting, that sounds like a matter for city council, as far as you talking to them about getting, um, a light, um, either something brighter or having one installed now.

your neighbor to one side says, uh, he doesn't feel like it's a nuisance, but that neighbor can't say the same for this person that you have something going on with across the street. Um, but when I say that is that's neither here nor ‸ there.
And based on my interpretation of the code as nuisance references it, that's why I cited under this due to the complaint coming in regarding the lighting itself affecting other properties shining in the homes.
I'd like to discuss a motion. I'd like to see this case dropped because you could have your beautiful home in my neighborhood anytime you'd like. The more the merrier. That looks beautiful. Um, that's something I think, um, it's pretty easy to take care of as long as you're, um, not in the grass, as you say, but this looks like it's going to be something a bit more that we need to possibly take a look at because when we look at ‸ know what you want to do, but, um, when they're telling you these things, I guess you definitely have to work hand to hand with planning and zoning to find out what are your options because you're taking them. Absolutely. I get a question. Um, this is not regarding the, the cars, but the lighting, um, I guess if I understood correctly, we do not have any coordinates for that.

Yes. Because if it was to get, uh, vandalized or, um, anything stolen out of it, that would put our small business out of, out of business. And, you know, we're all trying to do better for our own communities.
That way we would be able to record anybody breaking in and then have the evidence to go against them. Because like I said before, locks only keep honest people honest.

been up for over 11 years. They were saying this, this secure, not just your property, but the two next door, like they, for anything is, is like against their house.
That's why I wanted to show the video because you can see when the lights are on you, if you're standing in the middle of the street, there's nothing. You can't even see the, the, the reflector or the mailbox, our address, because it's really dark. So it's not affecting the neighbor across the street. She just wants to harass me for,
understand you guys want to do it for your safety. You want to do it for lighting. Um, but is there any possibility I'm asking you guys just personally, could you maybe reduce the lighting so that you don't go back and forth and, and argue with your neighbors, uh, do maybe 50%, 30% of that lighting and you can still see out
also the night cameras, are for night vision, there's cameras for, they have night vision. You really don't need lighting if you have cameras recording.
You just plug it in. If there is no dimness or if there, there's just, you just plug it in, you just get, and that's it. But the thing is, I do have cameras on my house and just like a couple months ago, then the neighbor two doors down was asking me,

So it's not just for, to protect our many vehicles that we have. It was one day when my daughters and I came home and it was, I told the officer, it was a wild pig, like right there. And of course, with the neighbor's hive, um, weeds and everything that she got on her side of her home that she should be focusing on that. But with all that, now we get wild pigs. You know, I'm from north, up north. I don't know what a wild pig can do to me or my daughters. So I was terrified if, if we had lighting, it wouldn't happen. So that's why that's the, that urged us to get the lights. And that happened back in 2015.

but I'm not saying to turn off all your lights. I'm just saying to maybe try to put less lights so that you don't disturb your neighbors. That that's it. That's something to think about.
know, let's try to come to the table and have a conversation with each other so that we can both have, I understand you want your safety, have your safety and then she can have her night sleep.
what you can come, uh, come out with some sort of compromise, um, reducing lighting a little bit. You can still have your light. Nobody's clearly, nobody can tell you not to have your light.
So another suggestion, um, many of the other homes in the neighborhood that have similar lighting, um, from what my drive through this morning showed is that instead of it being on the fascia, it's on the soffit underneath facing down, pointing down, but still lights up the entire yard. And so that would be a suggested move for the lighting, which would not impact the, the neighbors next door or across the way as much, but it would still light up her yard and be able to illuminate her food truck and all the vehicles and the cameras would pick up any activity.

So for the last 10, 11 years or so, there's been one interpretation, um, for this community member. And now we have another one. ‸ I'd like to, uh, add just some of the history on the property. Um, that was requested by the property owner. There are eight cases since 2010 on this property. Three of them were for previous owners. Um, mostly just overgrown grass out of the five, since she has owned the property, there are only two citizens, uh, complaints. And those were regarding, um, the vehicles in the yard. The other ones were all officer active patrol through the neighborhood, except for this one that we are actually, um, working on now. That was a complaint that was originated through an email complaint. Um, but all of the other complaints have been just overgrown grass or vehicles in the yard.
My interpretation is that if they're trying to light up their food truck, they're lighting around the whole house, including the accessory structures behind the house, there's lights on every single structure they have.
And when that's, that's my interpretation from the photos. Um, but if they're trying to light up their food truck, the lights around that food truck area would be excess would be acceptable.
I, I want to comment to that because we, my daughter, she lives in the guest house. She walks around in the back. We, we have animals that walk around and it's terrifying. So we want to, not only that, when he goes in, the side here is completely dark. Something could be waiting for him. So it is security is for our security. And we haven't had a problem in 11 years. I'm not understanding how come it's a nuisance now.
So, so, um, what I hear is there's never been a complaint about the lights. A code enforcement officer responded to something else and noticed the lights, right? So
correct. That's not the guy that had it. He said it never came to this stage. He gets the, he gets the complaint. He even called me. He even came to my job on us one.

because the violation is what it is, which is why I asked the question about the history, right? So even though, you know, Steve gave you a heads up to me, that didn't seem like a proper process. And that's why it feels a little bit like, well, why after 11 years, nobody ever said anything, um, because it could possibly be with new people coming into a situation and finding things. Some people follow the standards by the letter and some people don't.
So I think that may be a case, but to me, you got some really great feedback on what to do to keep your lights and to, to find a compromise. I don't know how hard it is to get these types of lights on and off, you know, of a roof.
