Mr. Brown asked how long it would take to get a permit? Community Services Manager Jennifer Justiniano
explained as it is a new construction a person cannot live on the property until a Certificate of Occupancy
has been given. Certificate of Occupancy will not be given until it is in a livable condition. This is new
construction not a renovation. A permit was issued in February 2024. There have been inspections and
there has been progress, but the last inspection was done in August 2025. Manager Justiniano explained
that the permit has expired since no inspections were made within 180 days. Mr. Patterson wanted to
explain why the trailer was on the property and why the property was not completed. The gentleman that
was living in the trailer was supposed to be a night watchman for the property but was not a spokesperson
for Mr. Patterson. Mr. Patterson gave the person living in the trailer 5 days to move his trailer and get off
the property. Manager Justiniano wanted to amend the corrective action. The current corrective action is
to apply for a permit and receive new permits to complete the building. There are 2 different options for the
property owner. The options would be city code 6-900 Sec. B subsection12. Apply for an extension through
the City Council. City Council must approve based on finishing on time. Cause undo hardship or a just
cause for the delay prior to it becoming a nuisance and cannot last more than 5 years of the original permit
issuance which was February 14, 2024. To reinstate the permit the Building Official would have to receive
in writing a just cause why it has been over 180 days since the last inspection. He would either have to
approve or if he denied it then a new building permit would have to be applied for and issued. More
discussion amongst the Board members, staff and property owner.
Motion by Chairman Roberts, seconded by Vice Chair Otero, to table Staff’s recommendation until the
August 20, 2026 (60 days) meeting and find the Property Owner in violation. Vote on the motion carried
unanimously.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
84 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 8 voices separated from the audio.
6 short machine repair(s) (6 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 90.7% of 3,534 content words.
Dotted words (115 places) are ordinary wording differences: hover or tap to see the other reading.
84 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

one of the trailers who said he has permission to live there as the acts of security for the property owner. I've also noted someone had tampered with the water connection running a hose from the meter area. Posted ‸ notice of violation on the property, sent a copied certified mail, posted a copy at City Hall. Pictures have been taken ‸ posted.

two trailers on the property, one of which has been removed. These are pictures of debris that's throughout the property. And then there's the water hookup. um ‸ On May 18th, the certified mail receipt was returned on claim. The property is still in violation as of today. I went past the property today and took some more pictures. that's a picture of the notice of hearing. These are pictures from today. The person living in the trailer got very upset with me for taking these pictures. And as you can see, there's there's mounds of dirt probably two to three feet high with weeds growing on
‸ items scattered throughout the property. The ‸ trailer that this gentleman is living in. And staff recommendation recommends that code enforcement board find the property in violation in order ‸ the owner to bring it into compliance

do what they got to do, and get it fixed up so he can make it permanent instead of having a trailer and all that. That's a beautiful looking home. And maybe a little work here and there would be something he could put some time in, and when it's done, get the occupancy uh title, and he won't need trailers and water hoses and all that.
mr Brown, I can answer that question. um As it is a brand new construction, you are not allowed to live in it without a certificate of occupancy, and that will not be completed and issued until the home is actually in a livable condition. um So, because it is unfinished and it's not available for occupancy, it's not a renovation, is a new construction built They do have a permit from 2024. It was issued February 14th of 2024. They have done inspections on it, so there is progress. Clearly, there's progress um on the home. However, the last inspection was in april or i'm sorry

because kids set the property next door on fire, which um the fire department was called and really um was going to set us back about 250 000 that we've already invested in the property.
um problems since that since that initial heart attack. So we've I'm back and forth with her right now. um our all Every intention is to finish this house off and move in it. um No one puts 250 000 in something and, and you know, and wanted to go into disrepair. um The gentleman that's staying there, um I guess he thought he was speaking as a spokesman for me, which he was not. um He asked to be my night watchman ‸ to keep the place where they didn't burn down my house rather than just burning down the woods next door.

be Count Street that will never go through. In fact, I petitioned to get the 15 feet that was supposed to be a part of my property back from them oh quite a few years ago. And I was told that I could not get that because that street that was designated a street, which will, you know, there's a house at the end of the street that will it will never go through. But that needs a here they're there. um

can't speak for me because I i don't give you authorization to do that. So i I gave him five days to move the trailer. The trailer was supposed to been moved today,
nothing moved. It was it was as if, you know, what I had said didn't matter. But in the meantime, I just my wife and I, we discussed it. I'm going to go down and just get a eviction noted from the county to make sure that he's on notice that that he is a squatter and he needs to move on. So um I did take two days. And as you

um Question. Now, seeing as there's not an actual level structure, and it has not been, please, this gentleman moved that trailer on that property. Is that the case? um Requiring an eviction notice. And what do you see at your timetable um in your estimate in which he can actually get this thing back rolling as far as getting permits to do what needs to be done? Because um if I'm not mistaken, the parking and storage part, that is easily fixed. But
So I would like first to amend the corrective action. um The corrective action for this is to apply for and receive new permits to complete the building. um There are two different options that um ‸ the homeowner can, um the property owner, can do. The uh city city code section 6-900 subsection B, specifically subsection 12, states that he can apply for an extension within city council. City council must approve based on finishing on time would cause undue hardship and there is a cause, a just cause for the delay. This is supposed to be per our code done prior to it being considered a nuisance. So that would stop any of the nuisance declaration. And it cannot last more than five years from
So that would extend that five years before it can be considered a nuisance. That is not going to reinstate the permit, but that would cover the nuisance issue of it.
new building permit would have to be applied for and issued. But he is able to request through the building official whether the approval of the reinstatement can be done. And then that would correct the ‸ expired permit.
um If we table this um for next month to allow that part to happen and see uh where we are in reference to him putting in the proper paperwork to work on getting this thing, uh as she said, um to the city

do have an email from the utility customer service manager, ‸ Lisa McCrory. It is dated on June 17th. um In reference to the hose, she did state that it was connected to the customer side of the meter and was registering active usage. okay So it was not considered an illegal. um The home just doesn't have the piping required. So it was registering usage and connected.

because it's, it's multiple, multiple issues within the one. ‸ Okay. Second, the eviction process can take up to 60 days. So I would be fine with a 60 day on that piece of it. However, I agree on the tabling piece of it because of the permits with the new construction and having to do an explanation. So we can table if you want to.

I'd like to make a motion to table this to August. To give him that time to, if that's required, that the eviction process to get moving. But um hopefully within some point in time, within the next couple ‸ weeks, you could contact them to let them know your progress. um Either you've gone or you've already done the paperwork. Okay. I'm not sure. uh

sure that, you know, that I don't, you know, I know they have such thing as a illegal eviction or whatever. I want to make sure that I cover the basis on that account that when he's, when he's served with paperwork, that he knows that, that he has to go. ‸ you know, I don't want him talking to Mr. burrows like he's speaking for me or talking to the council like he's speaking for me. Okay. Because,
