3. Ordinance 13-2026 - A City-initiated ZTA - RU 2-15. (2026-749). (Planner)
City Attorney Garganese announced that this is the First Reading of Ordinance 1 3-
2026 and read the title into the record as follows:
ORDINANCE NO. 13-2026
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COCOA, BREVARD
COUNTY, FLORIDA; AMENDING APPENDIX A, ARTICLE XI, SECTION 5 OF THE
ZONING ORDINANCE OF THE CITY OF COCOA TO MAKE CERTAIN
CLARIFYING AMENDMENTS RELATED TO TOWNHOUSE RESIDENTIAL
SUBDIVISIONS; PRO VIDING FOR THE REPEAL OF PRIOR INCONSISTENT
ORDINANCES AND RESOLUTIONS, INCORPORATION INTO THE CODE,
SEVERABILITY, AND AN EFFECTIVE DATE.
Ms. Ribeiro provided a presentation1. She explained that Ordinance No. 13-2026 is a
City-initiated housekeeping and coordination amendment intended to resolve two
issues affecting townhouse development where the RU-2-25 Multiple-Family Dwelling
District overlaps the Cocoa Waterfront Overlay District. Although this Ordinance does
not amend the RU -2-25 district, Section 6(A)(3) of the RU -2-25 regulations provides
that townhouse residential subdivisions are regulated by the townhouse provisions
contained in Section 5, RU -2-15. Under Section 5, Paragraphs (P) through (BB)
establish the applicable townhous e residential subdivision standards. The proposed
amendment to Section 5 clarifies that these cross -referenced RU -2-15 townhouse
provisions do not apply to townhouses located within the Cocoa Waterfront Overlay
District, where the Overlay's form -based stan dards govern. The amendment also
removes obsolete tree -preservation language that remained in the townhouse
provisions following the City's 2020 consolidation of its landscape and tree regulations.
The second issue concerns the relationship between the RU -2-25 district and the
Cocoa Waterfront Overlay District. RU-2-25, not RU-2-15, is the applicable underlying
zoning district in portions of the Overlay. The Waterfront Overlay separately permits
single-family attached dwellings/townhouses in designated subd istricts and
establishes its own form -based Townhouse building type, including standards for lot
dimensions, building envelope, height, frontage, and parking location. The proposed
amendment eliminates ambiguity and overlapping regulatory direction by clar ifying
directly in the RU-2-15 townhouse provisions that Paragraphs (P) through (BB) do not
apply within the Waterfront Overlay.

The amendment also promotes the redevelopment of smaller and historically platted
parcels by avoiding the imposition of a one-acre conventional townhouse subdivision
requirement in areas where the Waterfront Overlay Regulating Plan already identifies
townhouse development as an appropriate building form. The amendment does not
change the underlying zoning or Future Land Use design ation of any property;
applicable density limitations remain governed by the Comprehensive Plan and other
applicable provisions of the Zoning Ordinance. This distinction reconciles the
underlying RU-2-25 district with the more specific form -based standards adopted for
the Waterfront Overlay.
Ultimately, staff is recommending approval of Ordinance 13-2026 on First Reading.
Mayor Blake opened the Hearing for public comment. There being no questions or

4. Ordinance 14-2026 - Large-Scale Comp Plan Text Amendment to amend Figure FLU-
1. (2026-750). (Planner)
City Attorney Garganese announced that this is the First Reading of Ordinance 14 -
2026 and read the title into the record as follows:
ORDINANCE NO. 14-2026
AN ORDINANCE OF THE CITY COUNCI L OF THE CITY OF COCOA, BREVARD
COUNTY, FLORIDA, ADOPTING A LARGE SCALE COMPREHENSIVE PLAN
TEXT AMENDMENT; AMENDING FIGURE FLU -1 SET FORTH IN THE FUTURE
LAND USE ELEMENT TO PROVIDE THE RU -2-25 ZONING DISTRICT IS AN
ALLOWABLE ZONING DISTRICT IN THE MEDIUM D ENSITY RESIDENTIAL

AND ANALYSIS AND THE LEGAL BASIS SET FORTH IN THE RECITALS TO
SUPPORT THE PROPOSED COMPREHENSIVE AMENDMENT; PROVIDING FOR
THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOL UTIONS,
INCORPORATION INTO THE COMPREHENSIVE PLAN, SEVERABILITY, AND AN
EFFECTIVE DATE AND LEGAL STATUS OF THE PLAN AMENDMENT.
Regular City Council Meeting 09-08-2026
Page | 8
Ms. Ribeiro provided a presentation 2. She explained that t he City has identified an
existing inconsistency between the Future Land Use Element and the zoning/overlay
framework that applies to a portion of the South of the Village neighborhood. The
affected area is designated Medium Density Residential (MDR) on th e Future Land
Use Map, while parcels within the South of the Village Su bdistrict include underlying
RU-2-25 zoning. Figure FLU-1 presently identifies RU-1-7, RU-2-15, RM-4, and PUD
as applicable zoning districts within MDR, but does not list RU -2-25. As a result, the
adopted zoning and the adopted future land use framework do not fully align.
Ordinance 14 -2026 is a targeted text amendment intended to correct that
inconsistency without expanding eligibility for RU -2-25 throughout the City. The
amendment adds RU -2-25 to Figure FLU -1, subject to a new location -specific note
stating that RU-2-25 is an applicable zoning district in MDR only within the South of
the Village Subdistrict of the Cocoa Waterfront Overlay District. The note further states
that the MDR maximum density of 15 dwelling units per acre controls. Therefore, the
amendment does not authorize the 25 dwelling units per acre otherwise associated
with the RU-2-25 zoning district, in which the property remains designated MDR.
Ms. Ribeiro added that staff recommends that the City Council approve Ordinance 14-
2026, adopting a Large-Scale Comprehensive Plan Text Amendment to amend Figure
FLU-1 to recognize RU -2-25 as an applicable zoning district within the Medium
Density Residential Future Land Use category only in the South of the Village
Subdistrict of the Cocoa Waterfro nt Overlay District, subject to the 15 dwelling units
per acre maximum density of the MDR Future Land Use category.

Ms. Ribeiro provided a presentation 3. She explained that t he Michael C. Blake
Subdivision is an affordable residential housing project generally located north of
Barbara Jenkins Street and between Mango Avenue and Blake Avenue in the City of
Cocoa. The project was previously reviewed and approved as a Large-Scale Site Plan
and Preliminary Plat for 30 single -family homes on approximately 2.56 acres. The
approved site plan establishes a compact, small -lot residential development pattern,
with typical lots measuring approximately 37 feet by 95 feet (about 3,515 square feet)
and an overall development density of approximately 12 dwelling units per acre.
This project utilizes the existing Mango, Valencia, and Blake Avenue street network
and inclu des the necessary utility, drainage, sidewalk, driveway, landscaping, and
stormwater improvements to support residential development. The preliminary
subdivision involved 15 existing parcels within the Michael C. Blake Subdivision.
The Final Plat replats Lots 1 through 6 and Lots 9 through 17 of the Michael C. Blake
Subdivision, as recorded in Plat Book 66, Page 69, Public Records of Brevard County,
Florida. The replat reconfigures the 15 existing parcels into 30 residential lots wit hin
Section 32, Townshi p 24 South, Range 36 East, consistent with the previously
approved Large -Scale Site Plan and Preliminary Plat for 30 single -family dwelling
units.
Based on the submitted Final Plat and supporting title documentation, the Final Plat
is presented to City Council for approval and authorization for execution and recording,
subject to completion of all final administrative and recording requirements.

City Attorney Garganese announced that this is the First Reading of Ordinance 15 -
2026 and read the title into the record as follows:
ORDINANCE NO. 15-2026
AN ORDINANCE OF THE CITY OF COCOA, BREVARD COUNTY, FLORIDA,
AMENDING CHAPTER 13.5, NUISANCES; AMENDING ARTICLE I, IN GENERAL,
TO PROVIDE FOR THE GENERAL ABATEMENT OF NUISANCES; CREATING A
NEW ARTICLE IV, ARTIFICIAL LIGHTING NUISANCES; PROVIDING FOR THE
REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS,
INCORPORATION INTO THE CODE, SEVERABILITY, AND AN EFFECTIVE DATE.
The City Council has previously discussed enacting legislation that would modify the
City Code to improve code enforcement's ability to address nuisances that may occur
from artificial lighting sources.
The proposed ordinance amends Chapter 13.5 Nuisances to provide a general
nuisance abatement provision that provides any condition, activity, use of property, or
conduct declared to be a nuisance by this Code or applicable law is prohibited and
shall not be created, maintained, continued, or permitted by any owner, occupant,
tenant, operator, or other person having posses sion or control of the property upon
which the nuisance exists. In addition, the proposed ordinance establishes a new
Article IV that specifically addresses artificial lighting nuisances. That Article generally
prohibits a person from maintaining or operating an artificial light that directly or
substantially projects illumination onto, or creates glare affecting, another property or
public right -of-way in a manner that would cause substantial and unreasonable
illumination, glare, or interference with the reasonable use and enjoyment of property,
as determined from the perspective of an ordinary and reasonable person under the
circumstances, or that materially interferes with the safe use of a public right -of-way.
The ordinance also provides guidelines to determine artificial lighting nuisances.
Further, the ordinance i dentifies a list of several specifically prohibited lighting
nuisance circumstances.
The proposed ordinance should improve code enforcement’s ability to identify and
abate artificial lighting nuisances through use of the code enforcement process or
other legal means if warranted.
Mayor Blake opened the Hearing for public comment.
Josue Otero, Cocoa resident, asked when this ordinance would take effect, and if it is
immediate. In response, Councilmember Koss explained the process for approving

ordinances, noting that it requires two hearings and Council’s approval at those
hearings to take effect.
Llyod Roberts, Cocoa resident, asked if this ordinance is approved, when would it be
presented before the Code Board. In response, Ms. Neuterman reiterated that the
ordinance requires two hearings in order to pass. If that happens, it would be
presented to the Code Board after the Second Reading.
There being no further questions or comments, the public portion of the hearing was
closed.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
565 suspect passage(s) marked in place; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 23 voices separated from the audio.
54 short machine repair(s) (62 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 93.1% of 21,439 content words.
Dotted words (620 places) are ordinary wording differences: hover or tap to see the other reading.
565 passages (21% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
01:06:43 (6 s) — neither reading has words
01:11:17 (9 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
Good evening. Thank you for attending tonight's session, our September the 8th session. We'd like to say happy birthday to one of my fellow college classmate,

Rios Park to tonight. I asked repeatedly for it to get moved to tonight and this is when it should be heard and I would like to move that to tonight's agenda under Council business, please. Second. um For discussion,
Are you asking for additional funds and reference? So your request is not changing? No, sir. Okay. I have lights illuminating. Okay, but let me get the motion squared away. We have a motion on the floor by uh Councilwoman Weeks to change, bring an item. Where would you place your item at

tomorrow night we've already approved 300 and figures came in differently. And in talking uh with Miss Morgan over this, over the different we got several different bids,
I did not get there was some problem with the collective something with the other parts. So uh the um and they decided that the rubber uh substrate was not good and so that we should go to the cheaper to the um to the wood chips instead of the
would reduce the cost under the 300 000 And so I would like to see it get moved forward because we approved the money. It's there. Let's get this work started.

was more than the 300, there's already 300 this year that the board approved for fund balances. There may be additional uh dollars in a signed fund balance, but the the tomorrow night's request was to access those additional dollars, which in my mind could affect what we carry forward into next year's uh fiscal year budget. And so if that request is now different, then it's a it's a different request than what we have on for for
tomorrow night. ‸ Rebecca and our Abby, correct me if I'm wrong there because we have a request to to allocate the additional dollars for additional items beyond the 300. That's the item for tomorrow night.
The uh email that I got from Miss Morgan was three, three options, I think, uh which added up to more than the 300 000 that was approved by city council. There is budget in the this fiscal year that the cost savings would go back into fund balance. um

there is a pavilion, even though it's a small one on the other side, let's do the equipment and the playground and get that ‸ done. So that the park can be improved. And pavilion can be set aside for another time because the price of the pavilion was way high. And um so that would bring it uh
do everything else, uh we come in way under, there's still money there that we can look at for another time. But for now, I would like the equipment because we've, this has sat for years with no improvements whatsoever to

That's why I would like it. That's why I wanted it moved back to, so that we can get this done. The pavilion was always kind of, do we do a pavilion or not? And it was 200 000 for a pavilion. ‸ And there is a small one on the one side. There's a big one on the other. It'd be nice to have a second one. But the main thing is it needs updating. It needs equipment. And there was a thing on there about curbing. And that stuff I would like to all see done and not the pavilion. Take that off the table for now.
uh my vote would be no, I don't know about the rest, but I'm gonna ‸ listen to everyone. um We will proceed in this order. um You made your motion and it was second by Councilwoman

yeah um I saw the agenda late and I was surprised to see this item added to the agenda given it was a special meeting specifically for the budget. These were monies that already existed
So I'm glad to hear you bring it up. uh Because I think it's inappropriate on the budget discussion for fy 27 when the money is already there from previous years
I don't want to cut you off. All right. So, uh City Manager, can you explain why? and You already did this in the beginning anyway, but can you explain why it was put on yeah yeah the meeting for tomorrow? Yeah, I
don't think it's inappropriate or strange. We've had items on the public hearing for the budget. uh It affects, again, the fund balance. I know Mrs. mrs
Flag: numbers, amounts, negation or names differ between the machine readings · 00:12:41–00:12:45 · unresolved: the words are not shown (unclear audio); listen to the recording
consist of fund balances there. And I think it all flows together. But the Florida statutes does not prohibit other items being placed on the public hearing for the budget. The budget has to be heard first. And so the intent was to do that. But it's not inappropriate. It's not strange. And so I'm going to challenge the notion that it is. there And so ‸ my thought process is we're talking about fund balances. We're talking about uh funding in general, whether or not we're going to access additional dollars within the fund balance. That's changed tonight. That's a different request than what was originally presented. And so it all made sense to me. um Again, um if you go back, you'll see other items have been on the agenda with the budget discussion

I think that's, I would have been 100 with that because we all agreed to that already. um So I just, I just wanted to say that, that some people might want to weigh in on other projects that might be able to use some additional funds to take away from Junior Rios to help

just to say that when I saw the item on the agenda, and yes, we have had other budget workshops where different items come up. However, in this case, during our last budget discussion, there were actually threats made that unless council members voted for the tax increase, that

which is something that we have talked about the entire eight years I've been here and have yet to do anything on it. um And have the money, I've already been carrying the money over every year. uh It seemed that it was not, I don't know why it would be put on that agenda versus a regular city council meeting, which is it's appropriately council business, not a budget workshop. Well, budget hearing in this case, as far as, um I, you know, I hope we do

And to hear you say you're not in favor of anything ‸ right now at Juni Rios to me is very hurtful because this has been going on. All of your districts have had their parks enhanced. Mine has not. Now I have reduced it so that we can get some enhancements there that that park deserves. Will there be money left over that then could possibly be used for other parks? Yes. And by my reducing it and taking out the pavilion, that money probably can go towards

the minor enhancements that I'm asking for and that were approved by this council. ‸ Because there will be money, a lot more money left now by my taking the pavilion off and it to me needs to be discussed tonight and voted on those, the equipment, period. And that's why I'm asking for that to come tonight. smart And then we can go from there. But that money has been sitting there, rolled over year after year since before I was on the council. And it has been whittled down and whittled down

a white elephant. Yes, you're right. um The laws changed for my state representatives, or state legislatures and senators, that we had a simple majority on the first two votes. And then the third and final votes pertaining to the millage rate, it required a super majority. Now, when you really break it down to nuts and bolts, um we have in Mrs. Bowman, I think it's 173 000 You all call it a a tax increase, but the millage rate still remains the same because the value of our city increase And if I have 21 000 is that roughly a safe assessment, Mrs. Bowman? If I have 21 000 people divided into 173 000 what does that break down? Just say household as a general. um Would that be individually speaking on a wholesome percentage number, please, ma'am?

sleep on it on it, ponder over it. Everybody in their family knows that property taxes are going to increase um through our even on our county level because our sheriff is going to ask for an increase for protection. Safety is first and foremost.
for our citizens. When we were at the Oleander Point, Councilwoman Cost was there. When we were ‸ at Oleander Point, the citizens spoke up. And they stated clearly beyond a shadow of a doubt, they want safety first and foremost. First responders. So we're just talking

would like to do that and not vote and give us that super majority, that one vote, one of y'all two. And I made it clear. That's right. Since you don't want to be a um you drew the line in the dirt, we have to honor it. So the way I will honor it is just it's political. They do it on the state level. They do it on the county level. And we do it on the closest form of government to the people. That's on a local level, a municipality level. So my thing is, no. You can't have it both ways. i And I'm gonna‸ vote no. um as far as, and you have just stated it again, uh that, uh we're being punished or held to account because of how we are feeling. I just want to point out that
tax incentives to businesses because that gets them to come here. Tax decrease, which may not be a huge amount, but incentivizes. And it helps people to be able to afford to buy homes because their property taxes will be

is ‸ on not an astronomical, uh house on a brand new house. So this tax decrease does incentivize people to buy in Coco versus looking, because as you know, people look at that, what their tax is going to be. And we are the second highest in the county and they will buy somewhere else where their tax rate is ‸ less because it affords them a
in Cocoa and who doesn't. Tax savings, tax decrease is a good thing for the city. It does not hurt growth. It helps growth. That's why we do it. That's why we do it for businesses. So
to be here tomorrow night. I hope i hope to be able to call in, but that's another reason why I wanted this on tonight was because I may not be here tomorrow night. And I thought everybody was aware of that so i'm apologizing that i did not bring that up but yes i have 8 a.m to get my torn meniscus fixed So consequently, I would like this dealt with hopefully tonight for that reason. And so that's
Flag: words were replaced by a machine repair · 00:28:54–00:28:55 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
that there is a park that the representative that would advocate for that is not going to be here. And ‸ was put on the agenda a day after ‸ could have easily been put on this agenda. So it is concerning, and it is concerning because the last time we were here discussing the budget, there were threats made that those representatives that would vote against ‸ tax increase would have their projects in their districts would be cut. So
um We talk about doing things, you know, appropriately and in order, and it would seem to me there are a couple ‸ reasons here why this isn't. But I think

uh Councilwoman Weeks did talk to me about potentially not being here. She also worked directly with Abby up to a certain point in time on the junior Rios improvements. And so, uh you know, scheduling it um
um was something that I i didn't consider. Now, the item doesn't have to occur tomorrow night. It could occur some other night when she can be here, um which may not be tonight. butBut again, that item was worked until the uh 11th hour. And so just came to um some sort of decision on it. And that decision even changed tonight. ‸ And so so i I get the fact that uh ‸ Councilwoman

is concerned. That's not surprising to me. I'm not doing anything uh underhanded. I'm i'm i am practicing professional administration. And so when you talk about the use of fund balances, that has an effect on the budget. When you talk about uh when you talk about Stradley, that should be talked about within the context of tomorrow night's budget. And I can tell you, um having been in local government for 36 years, it is not 11 to an individual household uh because
The commercial properties actually fund property tax. And so the individual household number is much less than 11 But that's that's the soapbox about property taxes. But i've I've not um um done anything underhanded with regards to scheduling an item that I believe should be talked about within the full context of the budget and fund balances, uh
to amend the agenda for tonight the motion was made by councilwoman weeks and the second was by councilwoman costs those that are in favor say aye aye those are the nays say nay no nay Nay. Nays have it unanimous, excuse me, majority. So, Chair would like to make a motion to, okay, can I just make this motion for the regular agenda meeting for September the 8th, 2026?

Oh, you really want to hear me? Yes. Okay. Um, living there, I can appreciate the families and the children. I have grandchildren too. But have you ever happened to sit and listen to the traffic on Hewlett? It is like a raceway. It doesn't matter if it's motorcycles, cars, in the apartments across from us, there are children. Lots of them. And I love hearing them play. I do. I love my grandchildren coming over. But when these cars and motorcycles, not all of them, but a lot of them, come down Hewlett, they are speed demons. And it really angers me that they're allowed to do that. There is a speed limit. Not that they know it.
‸ Nobody cares. What can we do? What can you do to help us keep the children safe? To keep me safe? What if I'm crossing the road and I don't see them? Anyway, please help us.
Thank you, ma'am. Two things. And I know they don't want to hear this, but I'm just being honest with you. If you're not doing anything wrong, that's why I believe in cameras. That's just Michael's opinion.

But I know I know, ma'am, but sometimes people will abuse that. The second thing, Ms. Jennifer, ma'am, and I get it because my home is not even a stone's throw. So the requested action tonight is a consideration of ordinance 13, 2026, a city initiated zoning tax amendment to appendix 8, article 11, section 5 of the city of Cocoa zoning ordinance to make certain clarifications, amendments related to ‸ townhouse residential subdivision. So why does
There are two issues being addressed tonight. First, the amendment removes obsolete tree preservation language in paragraph BB that remain after the city consolidated its landscaping and tree regulation in 2020. Second, it removes ambiguity caused

to find district cross-reference to the RU215 townhouse provisions when a project is located within the waterfront overlay. the single-family attached dwellings as well as townhomes are permitted. This is important to ordinance 13-2026 because the overlay already contemplates

So under the regulating plan, we also have the architectural standards that are permitted. And as you can see here, this is the sub-districts that do allow the townhouses. So here is just to show our code section. So section 6A3 directs townhouse development back to section 5 of RU215. That cross-reference is why the RU215 townhouse provisions are relevant in RU225.

I just minimize the most important to cross-reference. So under the RU215 townhome standards, you have one acre minimum development area. Typical lots are 2,000 to 2,400 square feet. The rear setback requires 25 feet. The maximum lot coverage

smaller lot for 1,600 square feet developments. And then the rear setback is 15 feet. And then the maximum lot coverage is 60%. So just give you an idea why there is a conflict between the zoning and the overlay. So

zoning board to consider and study. So the need and justification for the change in the relationship of the proposed amendment to the purpose and objections of the comprehensive planning program into the comprehensive plan. We appropriate a consideration as to either the proposed change will further the purpose of the zoning code and other ‸ code regulations and actions designated to implement the comprehensive plan. So under staff analysis we concluded that it removes the obsolete tree preservation language that got left over under paragraph BB. Also eliminates the ambiguity created by our U225 cross-reference to our U215 townhouse ‸ standards. Clarifies that within the

A public nuisance with respect to artificial lighting. The proposed ordinance uh will specifically state that maintaining or operating artificial light that directly or substantially ‸ projects illumination onto or creates glare affecting anotheranother property or public right-of-way in a manner that would cause, and this is a key, substantial and unreasonable illumination, glare, or interference with the reasonable use and enjoyment of property as determined from the perspective of an ordinary and reasonable person under the circumstances or that materially interferes with the safe use of public right-of-way That is the proposed public nuisance standard with respect to artificial lighting that would provide more clear guidance to staff code enforcement as well as the code enforcement board. The ordinance goes on to lay out certain uh factors to consider when determining whether the violation there is a violation under that standard. You'll see in the ordinance there are seven specific that are enumerated under the under the code under the proposed code. In addition, it also the ordinance proposes to specifically state certain prohibited lighting that would be just prohibited in a violation of the of the code based on uh proof that the substantial and unreasonable interference. For ‸ example, number one would be like a floodlight spotlight or a similar directional light whose principal beam is directed onto adjoining residential property or into the window of an occupied dwelling. Most people would consider that on its face uh to be a potential public nuisance to the affected property owner.
um The ordinance also provides that if there is such a violation, violation provides guidance as to what corrective measures could be implemented to abate the nuisance by the property owner. um You know, as well as you know, the city and to the extent it had to enforce take special enforcement action. um And uh

uh any claim nuisance would have to um you know meet so that is the substantial and unreasonable illumination from the perspective of a ordinary and reasonable person so to the extent that
ordinary and reasonable person under this under the such under the circumstances um because um you know it would not Christmas lights in and of themselves that illumination would not constitute a public nuisance and rise to that level in addition you know the ordinance certain certainly lays out seven factors to determine a violation and um it's very unlikely that just traditional Christmas lighting is going to cause such a I
understand traditional Christmas lighting but there are people who go way above and beyond and so that how do you measure that that is a concern on that
I just specifically right you know and there are whole neighborhoods that do lights and then you'll have one house in the middle that doesn't and so you know they under to me under this they could complain and say hey the lights are affecting me so I i just that's my concern with this
‸ yeah ‸ and then there would be fall under just the general nuisance provision under this under the code that would not provide significant and clear guidance to staff as to whether or not it would rise to the level of

nuisance. I think you probably have a far better argument that is not a nuisance when you have clear and definitive guidelines that this ordinance proposes to put in place and again I mean we're trying to establish um you know in the‸ from the perspective of the ordinary and reasonable person under the circumstances um and that and that that's a term of art um it's not the you know the person that has extraordinary sensitivity and just has a dislike uh for uh the illumination it has to rise again to a much higher standard as proposed
it ‸ protects the the Grinch as well as the the person with the lights so there's actually a standard for it um this actually comes from what the county does so you've been in our county there are lots of instances where there is an overabundance of Christmas lights they're basically living under this standard. So, um but, and the place this comes from is from where people have specifically have light

um And the ordinance like I said is um pretty much based on what the county is already doing and pretty commonly across Florida. So um the growing movement to protect against uh glaring light um has a lot to do with uh protecting wildlife as well as humans you know their ability to sleep at night. And um and specifically in terms of wildlife birds. So yeah. But it's not unusual compared to other standards throughout the state.

question she was asking that's that's why she was asking about how can we differentiate between during christmas and regular lighting. idea. And here's why. The ordinance is not directed to the type of event that the light is being used. It goes to the artificial lighting sauce itself. For example, if someone wanted to, as part of their Christmas lighting, use a search light and put it up on their top of their roof and and have it shine in to the neighbor's bedroom window. Just because it's put up during the season of Christmas, why would that want why would that exempt the actual artificial lighting itself, which is what's causing the

Um, presently, it's a notice of violation that they need to, uh, either dim the lights or remove the lights to avoid having that, um, issue with the whoever
there's a complainant across the street who has complained about the lighting the glare in her house or in her windows uh that's again what the ordinance even before that is a nuisance we would go out as a reasonable observation to determine whether or not we feel that it is actually affecting the other uh property owners surrounding it.
would go before code board, and then the code board would determine ‸ if there's a penalty for that um and would give them enough time to uh bring it into compliance, or else a daily fine would be imposed. i
just plus Plus the ordinance proposes and provides additional guidance, not only ‸ the code enforcement but but the code board in addressing the violations. Correct.
Yeah. Because if if a lighting source results in a nuisance, there may be very easy ways to deal with it. And the ordinance proposes the following for corrective action. You could shield the light. You could redirect the light. You could relocate the light. You could lower the light. You could dim the light. You can limit the hours of operation or otherwise modify the light so that the condition causing the violation is eliminated. And that's the nuisance condition as determined by the officer or the board if it rises to the level of the board. the
So, you know, there are ways to to deal with it depending on the circumstances. It may just be, for example, an hour of opera hour hours of operation issue. It could just be, well, one light is just turned, you know, 40 degrees, you know, into somebody's bedroom and and you can just simply turn that light 40 degrees to correct the violation. I mean, there's ‸ unlimited number of circumstances that could cause a nuisance depending upon the impact on the affected property owner. And again, and I'm going to emphasize it again. This is not just the visibility of light causing a nuisance. It, it, it would have to cause substantial and unreasonable illumination glare or interference with the reasonable use and enjoyment of property as determined from the perspective of an ordinary and reasonable person under the circumstances. That is a clearly defined recognized legal standard, which, you know, you know for ‸ light to cross that threshold into a nuisance. It's, it's

want to find out because in reading through uh all of um their proposal as far as everything they do, um and because, um you know, we are discussing budget and I want on these large expenditures, I would like explanations as to what we're spending it on. And um this this particular one, uh you know, um
to water, water quality that occurs at the dial plant, goes through a contract which they won a few years ago, which is up for renewal, actually currently. These three tasks, each one is in a different division. So this one happens to be for
So at a certain threshold, either our project managers take over, our engineers who have on staff, or a combination of the dial plant staff, our engineering staff, and the dial staff, or I'm sorry, the

staff, to help formulate budget, formulate scope, if we're going to be putting it out on the street, because it has to be bid for most things that are done. That's not necessarily something that our folks can do or do accurately. And so
that are needed. but That's just kind of one example, but that's kind of how it broadly applies uh to the three tasks. um This one is also, like I said, it's all related to water, and water treatment and water supply. um There are program, uh the program overall are collectively all ‸ the capital projects. uh
in there. And we also track our water performance there related to our pH, our nitrates and other things that a lot of folks don't really understand. But it really is an indicator of is our water quality healthy? Are we having any trending problems? If we do, are we addressing them? Do we have operational controls, which which we can change? And they help guide us. They have technical experts within their staff that we're really not able to fill those gaps with current staff and certainly are challenged, certainly in many ways to do that. But
what we're paying them and just this comes like to 1.5 million dollars and you said that their their uh contract is up. So then do we put it out for bid again? And how

went ahead and put that out on the street, I think in August, we should get those bids back, I think sometimes the end of September, uh the end of this month, uh the procurement committee would then adjourn score, bring that back to council for ranking and land or award. Okay.

understand. Yeah. So so what we try to do each year at this time of the year is try to get the task orders, at least tentatively approved, which is what this would be a tentative approval, assuming that utilities budget was approved as as presented. If that occurs, well, then we would immediately on October 1st or the first day of the working fiscal year, we start working on those task orders because what we don't want it with there's a quite a bit of chaos with respect to issuing hundreds and even thousands of purchase orders in a in a very quick, you know, time frame for reissuing reoccurring ‸ expenses. These are similar. These are very much like that.
confirmation purchase orders, meaning they're doing work, but we don't have a task in place. So there and then we get a bill and we create another ripple in the finance and the purchasing um requirements.
now assuming the budget gets approved on October 1. Our staff would then begin immediately ‸ creating the requisition and it takes a couple of weeks because all the other thousands of purchase orders that are coming through. In order to get that
water. I would say that uh ‸ our programs and our ability to plan and prepare bids for purchases and things in the future would be jeopardized. Yes. Our operators do the water. We we do water every day.

support. And it falls a lot on the planning and on the, uh I would call the project idea of formation. Like, what is the scope of the project? What is the depth and the breadth of that project? Well, the only way to do that is to figure out, well, what we have, what we can fit, how much we can afford, and so on and so on. And so, again, it's not just Jacobs. It is Jacobs with the leadership of Dial, with the leadership administration, making those choices and making those recommendations and also balancing that with the current budget.
Yeah. Okay. And uh is is there any way that is there any savings that can be done in this? um Obviously, you know, down the road, we don't know what's going to happen with Amendment

right. We'll have some at the next meeting because uh the wastewater stuff wasn't ready for this meeting. Okay. ‸ So when this contract, when this contract is up, because right now it's already out on the streets already. So is, Is lowest bidder the sole thing? What is a part of that?
No. So this falls under what they call the competitive consultants Negotiation Act. So CCNA, if you've heard that term. And it basically is a state law that says that we're not allowed to select engineering services best on based on price. And the reason why is you don't want to take ‸ a cheap engineering design. I
no, but the requirement is is that they need to put together a package, you know, with criteria that was developed by procurement and us, too, because it's again, has to do with, like, the scope of things that we need.
