The City's record
What the City's record shows

Transcript of Recording of 2016-02-09 (Council Meeting Feb. 9, 2016): 338 passages, 1,447 words
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
58 suspect passage(s) marked in place; insufficient transcript coverage: most of the recognized text is suspect; 4 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 3 voices separated from the audio.
1 short machine repair(s) (2 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 49.2% of 1,244 content words.
Dotted words (37 places) are ordinary wording differences: hover or tap to see the other reading.
58 passages (60% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (4 stretches). Something may have been said here that the transcript does not have:
00:03:57 (9 s) — neither reading has words
00:04:07 (8 s) — neither reading has words
00:04:55 (7 s) — neither reading has words
00:05:23 (6 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Access was $1,038.72. I took the liberty after that to call Florida Today and ask them to come out and help research this, because I wasn't getting any answers from the water department.

meter works. This water was retrieved, according to them, September the 16th at 9 p.m., and on September the 28th at 7 p.m., 90,000 gallons of water. Gentlemen, there's no way I could have used it, and that house would be floating, I think, if that much water had come into the house. ‸ I then, as

had to fight three months. They accused me of filling a pool. I don't have a pool in my residence at all. ‸ I finally admitted, they finally admitted that there was an error, and there was something wrong with the meter, and they corrected it. In most instances, and I could go on and on, I've got 15 comments from people, and I could really leave it with you to read at your leisure to try and see if you could unravel what's happening with the water department in relation to the usage of water

I don't know where I really ‸ go from here with that, sirs, but I think all of you gentlemen know that there seems to be something wrong with how the meters are being read and are the problems with the number of those meters.

Savoy Drive in Melbourne. I'm next-door neighbor to Mr. Connor. I had a similar not similar, not for 900-some dollars. I had a situation like that a year previous ‸ in 2014. I'm also a snowbird, and I was up north from May 1st to October 1st, but on September 24th, this is 2014, my bill tripled from the base of $33.94 to $93.80, I think it was. And, again, I called as soon as I noticed it and said, but we're not home. We don't live there. No one's there. And I was told someone is stealing your water, probably your neighbor's stealing your water, and if that's not the case, you perhaps have somebody, a contractor in the area building a swimming pool, and they're taking your water, or perhaps you have a leak. So I didn't know, and I've investigated all these things, of course. None of those things happened to have been the case. The next month and we still were not there. We had gone nowhere near our home in Florida. The bill reverted to the base of $33.94 and stayed that way for the next two months. So there was only one month when it spiked. Okay. I was told finally when I exhausted the other possibilities and had a plumber and so on and found out we ‸ had no leaks that it would be adjusted in the future.
That never happened. I let that go. And it's only from being a neighbor of this gentleman here and working with him and doing some research on this that I came before you tonight. It's not really for my own specific situation. But in doing this,

water is stolen. I'm sorry. It's stolen or it's leaked or you filled a pool with it or whatever. It seeped into the earth somehow. Those may all sound legitimate, but that's not the case with Mr.

90,000 gallons. I have two engineers who have made comments such as the following. This person is a retired engineer from north of Grumman. And he says, an open faucet will deliver about five gallons per minute. 90,000 gallons would take 12 days running 24-7. Something is not right. He had other comments, too. Another the second engineer, Mr. Page, says, a hose bib connected to a half-inch pipe, which is most common in residences, will flow seven gallons per minute max. ‸ Running wide open 24 hours a day would take almost nine days to flow 90,000 gallons through the water meter. And then someone else said, well, maybe a truck pulled up, a semi, and filled itself up with water. He checked that, too.
It would take almost 28 hours to fill that with a garden hose, assuming no one in the neighborhood noticed. And believe me, in our neighborhood, we get calls if our garage doors open. People notice. They notice the semi. And he also continues, you

You couldn't the whole development would have been flooded. That amount of money or water couldn't have gone through the meter. So I guess that those two comments would be mine. I have, again, all the comments

policy that we would understand. I've never been able to turn water off at the meter when I leave to go up north. I didn't even know you could. To my knowledge, you can't. You have to have someone come and do it for you, someone just said.

And also I'm a neighbor of Mr. Connor. And I just wanted to report to you. I was trying to ‸ do a test to find out if he could what the rate of water coming from his hose spigot would be. And I had a
have a used a six-gallon bucket with one-gallon markers on the inside and turned his faucet on at full throttle with him having a stopwatch telling me when the seconds were going by. And so we measured for 30 seconds and we were able to extract four and a half gallons of water. And at that rate, ‸ to

And when I got my next bill, and I normally paid every month in the 30s 34, 36, whatever and the bill was somewhere between 86 and 92 dollars. So I contacted the Water Department. We went through all the excuses of maybe the toilet running, and I told them I shut off the water completely outside for the house. But anyway, cracked pipes, faulty water meter, all various things. But they wouldn't send anybody out to check it out. And then someone in the Water Department realized that the person who recorded the numbers, the checker, was on vacation at that time. So ‸ they guesstimated.

the water issues. For me, social media, for me, is ‸ people reach out to me all the time on all kinds of different issues for the city. And so I look at this as a heck of an opportunity, even though it's not a great situation for the city. Maybe the city maybe some of this is more true than it's not. And maybe we should have an outside vendor or somebody come in and kind of evaluate our system or evaluate how we measure water. Maybe ‸ it is our meters. ‸ Who knows? You know what

the city should be somewhat thrilled that you're not going to have to demolish or deal with. Barbara and I close on it on Friday at 1 o'clock. first of something that I think is important for the City of Cocoa and Broadmoor Acres. We are going to start reaching out to any property that is distressed and to the point to where the city is contemplating demolition. If we can get the property owners to sell or whatever, we will pick them up. This is not a profit-making venture by any means. It is just something to preserve Broadmoor Acres. We're currently reaching out to some of the vacant lot owners and trying to obtain those lots, not necessarily for building at this point, but for cleaning, landscaping, trying to turn them into basic little neighborhood parks until ‸ something comes along where the city or someone can actually utilize the lot for development for single family homes. Okay? And a shout-out to Chief Mike Cantaloupe! Broadmoor Acres loves you, buddy!

Fine. If we can have a plan for parking? Great. If we can have dumpsters for them to dispose of their garbage? Great. Well, we don't have any dumpsters. They've been removed.
And I don't know ‸ how you can have three restaurants in the downtown and not have a place for them to dump their garbage. They're dumping their garbage right now. I think they're piling up some of it in the trunks of their car and riding it over to
Being a business owner, you have a lot more things to do than taking dumpster rides out of your immediate area to get rid of your garbage. So I feel sorry for them. But I also am glad that I don't have vultures and rats running around the back of my store right now. So I called the
because I said, what happened to the dumpster? Well, I guess maybe he got a citation and instead of cleaning it up, since then, Troy has dug up the driveway so a garbage truck can't back onto that property and dump a dumpster anymore. So they're using the American Bank dumpster. Okay? They've had to change it once so far in maybe the last month and a half. There was so much grease and dirt and stink running out of that garbage ‸ can. It's not dry goods and boxes they're thrown in there. They're throwing waste of food and grease and things like that in these dumpsters. So it stinks. So if you're pulling up to come to the village and you're parking in that bank, you're smelling garbage. Well, you

garbage in the other lot too, to be honest with you. It's been a ‸ problem. Okay? I've been to many other cities around this world. They really spend a lot of time and energy in making sure their cities look clean and crisp and inviting. Are we not marketing a tourism to come to this downtown? It's a disgrace. I shouldn't even have to be here as a business owner coming up to you with this problem that should have been solved 10 years ago before any of these restaurants got their license. It should have been in some kind of ordinance that this is where you dump your garbage. You have to keep it clean. You have to maintain it. Something else about the downtown. Okay. The grease traps. Where have the grease traps gone? I did walk up here one afternoon about a week ago and said, who's emptying the grease traps? ‸ They're tucked behind the bushes on Troy's property. I don't know how anybody would even get there to pump out the grease. So therefore, now they are pouring the grease into the ground behind my business. Okay?
It too attracts rats. Is this so let me see. Has the EPA contacted anybody on this council because I did notify them about the grease? This is something that should not ‸ be done. One other thing. I have a whole bunch of things here.

of my own hard-earned money trying to fix it. We have two vacant properties on our street. One is 27 Derby Street, which has been vacant for five, six years. The owner of that property maintains ‸ the outside but not the inside. It's a haven for rats, cats, and everything else in our neighborhood that's wrong. I also have people behind me on Oak Street that have pigs. There are two farm pigs behind me. My rat control person has come to me and said, these are your issues. The vacant property is a breeding ground. They're overrun. They're leaving there. They're getting fed by the pigs with the slop and the food behind your house. And now they are a fine haven in your house. I have had my house underneath tented off.

I came before this council about four or six months ago with the same problems. I had difficulty the other night when it was real rainy to get in there. There's no light to do those streets. And I'd appreciate if you all were looking to doing something for that, even if you have to put some aluminum reflection light, or either some paint on those curved stones, because it's very difficult, especially for senior citizens, since I am one. I'd appreciate you taking care of this situation. Thank you very much for your time.

‸ for the project. I'm here tonight with several of the other hosts, host families. There were volunteers, the patrons involved. I'm sure I speak for all of them when I say that we appreciate leaders that understand the connection between the health of the Indian River and Cocoa, its environment, its economy, its culture.
like I said, we have 40 people involved. And we'd really like to ask for your support as well. The four host families contributed quite a bit to put on and sponsor this event. And we were able to raise $2,500. We think it's a worthy cause because it can be an important tool to increase the average citizen's understanding about the state of the Indian River Lagoon. The report card, as I said, will debut in 2017. It's being distributed in five counties up and down the river. It's a science-based evaluation defining health indicators and ‸ grading benchmarks ‸ for the lagoon. So we'll update the communities on the health of the lagoon and the actions that ‸ can be taken to restore it. It will also tell ‸ some of the success stories, which Cocoa has a lot to be proud of in terms of our investment in the riverfront park and the stormwater storage there. So

Whenever we make an amendment to our annual action plan by what we're doing now is adding a new project, we have to do a public hearing with a 30-day public comment period.

So we have the city ‸ has contracted with Mark Briggs with W.S.P. Parsons Rinkerhoff to assist us with the application and the HUD review. And once we have the public hearing, submit to HUD for approval on the amendment to the action plan. We'll be able to finish the application process, submit to HUD, and see if we get funding. The funding would go towards the construction of the new Dr. Jolie Smith Center.

Our goal as a program is to provide hot nutritious meals to seniors 60 years old and older that allow them to maintain independence while remaining independent in their homes. Meals on Wheels and seniors at lunch provide a lot more than just a meal. We provide a daily safety check, interaction with ‸ volunteers, transportation to seniors at lunch dining sites, nutrition education information, counseling, nutrition counseling, medication management counseling, American Arthritis Foundation exercise program, and referrals to other services as needed. Volunteers are absolutely essential to our program.

at Lunch dining sites, donated 14,382 hours of ‸ service. Why are nutritious meals important? They help seniors maintain independence. Nutritious meals help seniors remain healthy and therefore they're not hospitalized as often, and it also prevents premature nursing home placements. The cost of one year's worth of home delivered meals is roughly equal to the cost of six days in a nursing home and one day in a hospital, according ‸ to Meals on Wheels Association of America. I'd just like to share a couple of comments from our participants. Meals on Wheels, they say, keep up the good work. Thank you. At 93 years old, no family. I live alone and need all the help I can get. You have wonderful service. I really enjoy my contact with the people who deliver meals. It is important. It's an important part of my life. Therefore, we'd like to thank you very much for partnering with Aging Matters in Brevard, and we look forward to a continued partnership. Thank you very much for your attention. Any questions?

here in the great city of Cocoa. First off, I'd just like to start by saying those two words that we just don't say enough in my business, and that is thank you. Thank you for the continued support of our mission. Thank you for the great food drive that you did this year. If it wasn't for last-minute sandbagging by the city of Rockledge, you surely would have won that. We did

the emergency food that you raised. So ‸ thank you for your continued support. The Sharing Center's mission is to provide emergency assistance to those in our community who simply struggle with basic needs, and I like to explain that simply as the roof over your head, the shirt on your back, and the food on your table.
We provided emergency food to over 11,000 hungry men, women, and children here in our community. That represented over 381,000 pounds of food distributed. We assisted over 14,000 clients with such things as clothing, household goods, hygiene, baby food formula, bicycles, and the list goes on. We provided over 3,000 bags of emergency food to children at local elementary schools to guarantee that they had access to food on the weekends when they went home. We provided over 3,000 showers to our homeless community and those who struggle with that basic need. Tonight, as we speak, before I came here, I was preparing for our whole night shelter. We open our doors when it's 45 degrees or less. We let the homeless come in and stay warm overnight. We'll be doing that this entire week. Last year, we provided 208 persons the opportunity to stay warm overnight. ‸ We provided over 380 full Thanksgiving dinners to families in need here. We provided over 603 stocking gifts for children through local elementary schools and other partners. And we provided over 371 pairs of shoes to kids returning to school whose parents just simply couldn't afford new shoes for them when the school year started. It's those things that really make a difference, and that's what the Sharing Center is, and that's what we've been doing now for 37 years here in our community. This year, the funds that we're requesting help support our community kitchen. 100% of the funds awarded go to purchase food, 100%.

So that's why it's so important for this funding that we get to help support our community kitchen, the only consistent feeding site here in Central Brevard County, offering a meal every day of the week. Thank you very much for your time. Thank you for coming. I appreciate you all very much.

Just wanted to give you a quick update about what's happening in the world of early childhood education, and thank you for your continued support through CDBG funds. The school readiness program, which we apply for, assists families who are working, who are going to school, many times just barely getting by. We have families who are referred to us through the Department of Children and Families or community partners, such as
Referrals come to us from homeless shelters, from domestic violence providers, some of whom ‸ are in the room this evening that you'll hear from as well. And those are families who are doing everything that they can to lead to self-sufficiency, but can need some support for the cost of childcare. If you haven't written a check lately for childcare, you may be a little surprised.
$205, $210 a week for an infant is not near unheard of in our community, and that's for one little one. So you can imagine if you are a low income working family doing everything you can to pay rent and transportation and food and all of those other things, if you have a couple children, it becomes near impossible to pay for the cost of that care. That's where families come to the Early Learning Coalition so we can support them with the cost of childcare. They pay for a piece of that care themselves based on how many are in the home and their income. And we have about
that we're serving through the School Readiness Program in Brevard County. It's a lot of families who are participating in our program, a lot of children who have access to early learning programs who wouldn't otherwise have the opportunity to do so. We provide those services through a network of about 180 childcare centers throughout the county, everything from what you would consider to be a private childcare for-profit center to those who are faith-based, family childcare homes.

One thing that many social service agencies would tell you is that the needs of the community change in the face of those families who need our services change. There isn't one what you would consider a typical family that receives our services. We serve lots, lots of different families who have ‸ those particular needs. In our office two weeks ago, we had an 83-year-old great-grandmother who three days before was given care of her four-year-old great-grandson, came to

office quite frazzled. And two and a half hours later, she left feeling much better about what to do with this four-year-old, everything from getting an email address, how to use her cell phone that was always off, so that she could connect to those other services. For every dollar that we're able to obtain locally through services or support such as CDBG,

So funding that comes through CDBG can go wide and far and serve many more children. So we thank you for your continued support. Early learning is critically important. Helps kids get off to the right start. So we thank you so much.

case management, and a whole range of services. The reason I'm here tonight is that recently we were a couple of years ago we were given 14 donated 14 condo units at Crestview, the development on 800 North Fisk. One of those units, two-bedroom unit, was just a shell with partial sheetrock. And we were asking for,
to tile the floor throughout, to paint, to provide furniture, cabinets, air conditioning, and appliances. We can keep it to 12,000 because we have donated tile, we have donated cabinets, and all the painting will be done by volunteers. Once it's completed, we will be offering priority accommodation to a veteran homeless family. If the family has a disability, we will be able to accommodate them permanently. If they are not disabled, we have a funding for up to two years while we help them rebuild their lives. We are confident that we can keep this property in full operation as over the last five years across the

And so we're trying to keep those folks safe from continued abuse or stalking after they've left. What our request is from CDBG is to assist with our food cost. One of the things to know about domestic violence is ‸ often economic control. And so survivors of domestic violence usually have no income, no ability to get those things themselves.

Actually, John? Mr. Mayor, members of council, if you recall, on January 12th, you heard staff's presentation on this item and also our current ‸ vendor, contractor, you know, presented on this matter, as well as the number of residents. And you asked that the matter be brought back before council until such time that all the council could be here to vote on the matter. And
would just like to remind and clarify a couple points. You've received from the clerk various emails from residents either in favor of renewing the ‸ current ‸ contract and or putting it out to bid. The current contract was adopted on January 9th of 2007. And then it was renewed in July 26 in 2011. When that contract was adopted,
competing bid from another city in the county. So another city had put out a bid. And the city used that bid that was awarded for the purposes of negotiating a contract. So I was asked to make that clarification because there's been comments that the contract hasn't been ‸ looked at for 30 years. Actually, this contract was the one that we have today was initially adopted in January of 2007. ‸ Now, the current provider was the provider prior to that. But the point is that in January 2007, this contract that you're looking at right now was negotiated ‸ based on a competitive ‸ bid with another municipality within Brevard County. And there's the contract which ‸ the decision that
So you could renew ‸ the current contract with ‸ that existing five-year renewal period at the existing rates and terms of which staff ‸ does not recommend. Second option would be to renew the current contract modification to the terms. However, ‸ and again, there's no extension beyond the five-year renewal term.
renewal term. And then the third is to decline the final renewal option and advertise for bids and award prior to the expiration of the current contract
I have been in contact correspondence with one consultant that ‸ provided me some information as it relates to because if you recall, staff had recommended if you were to put it out to bid that you would do so by ‸ virtue of the city retaining an independent consultant to prepare the bid, process it, bring them in, evaluate, rank, and then make a recommendation to council.

correspondence that I received, because one of the questions was, well, how long does that take? It would take approximately five to eight months for that process to run the course to bring on another vendor. And that ‸ includes documenting, ‸ you know,
whole bid, preparing the bid package, having the pre-bid, the vendor area review, the time for the vendors to prepare the proposals, turn the proposals, review the proposal, and a recommendation of award that would have to come before council. The estimated cost, because obviously we would also have to, prior to doing that, we would ‸ have to put out an RFP or solicit, you know, qualifications for a consultant. But ‸ because it's about

And the thought was if you go down that route, ‸ the vendor that was chosen would ultimately pay for those costs of that consultant. So from a timing standpoint, again, it's about five to eight months. That's just from once we select a consultant. So you figure we get about four or six weeks before we probably have that done, ‸ depending on the decision, if you choose option three today, then five to eight months. So it might work kind of tight. ‸ Just advising as we did in ‸ January, the timing is ‸ the backs are starting to kind of up against the wall.

My first meeting that I ever attended here was September 8th. It had to do with the fire assessment fee. And if I remember right, it was either that meeting or ‸ the last meeting in September where Mr. Ed, who I am very glad to know and I think he does a great job in public works, brought to council's attention the fact that the contract with waste management had some issues. There was

wanting to go out to bid. But I think the city really should listen to the staff's recommendations as far as renewing this last renewal period with the addition of the recycle service and put this thing up for bid after that. For one reason. You're going to cost the city money because, to be honest with you, I'm going to be coming up here asking, how are we picking the consultant that's going to be handling the bidding? I'm not too comfortable with what I'm seeing publicly in the community and with these two companies. I know I'm satisfied with waste management.

stuff we've had. And I think that at this particular time, we are on a time crunch. We have to be careful about what we have when we need it in September. And I think that the council should approve the new five-year contract and let the contract go up for bid in five years. You know what you have. We're working tremendously hard at waste management to take care of the issues that Mr. Blake had and the other council people. We realize that yard waste is somewhat of an issue. We're working very diligently at getting that taken care of and working hard every week to get it caught up like it should be.

Commissioners also stated in that same article they were not happy with the residents having to pay more, but there was little that could be done about it. I've been through transition. I've competed against our friends there in the audience, and there's no magic wands out there. I've never seen a transition happen in five days without major detail issues involved. Here's the challenges that you have when you go through transition. Just let me point out a couple of things. Number one, you're going to be switching out 15,000 carts. Number two, you're going to be switching out over 400 containers with casters, locking devices, and that sort of thing. Number three, you're going to have to update your contract. You want your contract to match the
on solid waste. I think that's extremely important, and that doesn't happen overnight. Catching all the details of the current special services provided that may not be in the ‸ contract, These are things that our drivers do on a day-to-day basis that's not in the contract, And when you have that transition and those details don't happen, the phones are going to ring. Route changes and different collection times, that's going to happen. Anytime you have a new company coming in or you have a transition, the routes change, the days change, and the details change. Customers get attached to their drivers, and I can guarantee you, I know the competition says that they're going to hire drivers, but we will keep our best drivers. You can be assured of that. Special needs customers,
easy to do, but there is a lot of detail to be considered. Not all contracts are the same, and a canned RFP that may work for one city may not work for others, and may create unintentional long-term consequences. I just

Well, what keeps being failed to be mentioned is the commercial road You have a huge amount of commercial service here. The current commercial service in Cocoa Beach right now isis 32. percent lower than what it is here in Cocoa. So don't be confused with just residential rates.

Absolutely. Thank you so much, Ed. I'd certainly be happy to, uh council members. um as As you'd heard uh from Captain Ed and some others earlier, we continue to uh pick up vacant lots, and we do this as just a service to the city. um We continue to do this. Right now, we're not paid ‸ to do this. um We will continue to work with the city on that. What uh
if you will, to actually route. We've identified about 20 vacant lots throughout the city that are, for lack of a better word, illegal dumping grounds. We would actually route these these particular um locations and actually put them on a regular route, and then actually also look at some of
Ed and I can certainly explore that further, and we can sit down with him and talk about those different uh uh types of scenarios to put those vacant lots on a particular route. In the meantime, however, um as mister and his team do see the vacant lots out there, we don't want the illegal dumping here as well. We want the city to be clean. We want the city to be beautiful, and uh we certainly want to to um share

trucks that are now running in the city, you're not going to have that problem. They run so clean. They burn so clean. ‸ the demonstration that we saw from Rush Peterbilt, the the manufacturer, uh the gentleman actually put his mouth on the exhaust. These trucks burn so clean and do not leak fluids. So those trucks
but that was what he showed us. uh Those trucks are now running in the city, and as we continue to add to that fleet, all of those issues will be gone.
Yeah, i um I just wanted to say that, I mean, for me, I am not unhappy with the service that waste management provides. I'm perfectly happy. I like my driver.

it something else, but you're ‸ Right. um But, um so, you know, I get great comments from her. Like I said, none of my neighbors have complaints. I don't have any complaints. Waste management has been a great partner with the city for years and years and years. They were the last time I was on the council. For me, it's not about the service that waste management provides. I i think you all have been a wonderful partner with the city. But to me, it has been at least nine years since we have gone out to

time. I don't know. But to me, nine years without looking uh at all of our options and seeing what's out there and how many companies are out there who might want to respond, um I just don't think it's a responsible way to go. I just think it's our responsibility to provide the best service for our residents at the best price. And if that is with waste management, then that's wonderful. But
constituents, um young and old, concerned about the direction in which we're moving. They made the comparison and analogy like the space shuttle over at the Cape, and I know it's not the Cape, but it's business. is that you go out to bid so ever so often, every once every three years, they turn around and put that particular item where

just to see what they can get for the best bang for their dollar. My greatest concern is making sure that we are held stewards of the taxpayers dollars. If we go out to bid, and I know they will tell me that we will not know unless we go out to bid, but then sometimes

am caught up in between this. I mean, we've had some problems with waste management, and they've rectified their mistakes because we're all a human. And I don't have a problem with that. I've never really had a sincere problem. When I've had problems from my constituents, our constituents, um they've called me and they've responded promptly. So now the same constituents are calling me, and I'm getting mixed signals, both go out to bid but stay with what we have, because if it's not broke, why try to fix it? And
to bid, what assurance do we have saying that we're going to get a better price than what we have right now? So I i know a lot of the men and the women that work for waste management. Some of my former students. Some of my parents of my students, um I'm happy to say. So i I really think from
I don't want to repeat anything that Mike just said, because a lot of it applies to me. But I might have to repeat some of it. Gotten some input. Once again, ‸ it's about 50 50 from residents that I've heard from and businesses that I've heard from, so that doesn't help a whole lot.

I really worry about running into a situation like that, changing from one company to another. uh And I fall back upon my ‸ my old uh saying of uh don't change horses in the middle of the stream, but especially when that horse has served you well for years and is able to continue serving you well. I, too,‸ been watching the news reports about what's going on over in Orange County, and that is pretty frightening, uh which is one reason why I called some of um our um mayors, a couple of the mayors here in Brevard County that have gone through this over the last couple of years
um I was assured that they didn't have any issues at all other than a couple of minor, which were no different than you know what went on on a daily basis, the similar complaints, you know, somebody dropped this, somebody didn't get that. But um I was assured that no transitions went smoothly. They were more than satisfied, you know, with the way things went. um I did speak to one um at League of Cities um that ‸ said that uh what was going on over in Orange County had uh um been a huge fear uh for them. This is the request to approve the Clear Lake Isles preliminary subdivision in the final plat with conditions. This property is located on the east side of Clear Lake Road. It's across from Eastern Florida State College. This is a 9.64-acre property. It's proposed to be subdivided into two parcels, one parcel being the residential parcel which the developer is proposing to construct 84 senior low-income housing, multifamily housing units.
and there's a development agreement with the developer, and there was a low-income housing tax credit project that this property, ‸ the developer, applied for. It was awarded the low-income housing tax credit. So as a result of that, we are moving forward with the subdivision of the property. ‸ As I mentioned, the back seven acres approximately will be the multifamily, and the front portion will be commercial. In addition to that, we have

‸ to have one shared driveway that would be across from the college. And the idea would be in the future to hopefully, when it's warranted, to have a traffic signal at that location, potentially. But in order to do this, we have to close the driveway with Longwood and then combine the two driveways. So we have that access agreement. That would be a condition of the approval. The Planning and Zoning Board, they reviewed this at their October 14 meeting, and they unanimously approved the preliminary subdivision. And tomorrow night, actually, the Planning and Zoning Board is going to be reviewing the site plan and acting on approving the site plan. So once this is all accomplished and the plan is recorded, the property will then be transferred over to the Clear Lake Isles Development Company, and they will begin moving on the project.

to give the council ‸ an update on something we've been working on. I think some of you or all of you may be aware we had sent out an annexation survey letter to a couple of areas, ‸ unincorporated areas that we were kind of targeting potentially for annexation. we could proceed to the next step ‸ and potentially have a meeting with some of the property owners. So what we found from those two areas was there was very little ‸ interest in being annexed. The participation rate was probably about 20% for both of those areas, which is about average.

Yes, sir. I have just one item tonight, and with your permission, I'd like to read a prepared statement that I prepared regarding lead and copper. I know it's an issue on a lot of folks' minds, and they have some questions, so I thought it might be beneficial tonight ‸ to read this into the record. We'll go ahead and post ‸ this bulletin on our website, get it out to our folks who are interested, and
and our thoughts are with those who are struggling without ‸ access to safe and reliable water in their homes. In North America, no one should have to question the safety of water at the tap. We do not have firsthand information about what occurred in Flint, but this much seems clear. When Flint switched its water supply source, it did not take the required steps to manage water chemistry. The new water caused lead to leach from service lines and home plumbing. Flint, Michigan, underscores that the first job of the city of Cocoa's utility department is to protect the families we serve and adhere to the drinking water standards. Those of us involved in managing, cleaning, and delivering water share a solemn obligation to protect public health. Lead does not come from the treatment plants and water mains. It comes from lead service lines running between the water main

water with a slightly elevated pH and alkalinity to create a slightly scale-forming, non-aggressive water. This leaves a thin coating of calcium carbonate on the pipes and mains as it is transported to the customers. By maintaining this calcium carbonate layer, the city is preventing lead and copper from leaching into the water. FDEP also requires us to monitor approximately 100 homes for lead and copper every three years. We take water quality samples to verify the water quality isn't corrosive, meaning the pH or total alkalinity is checked.

a property owner, there are steps you can take to address potential risks from lead in water. Lead service lines are typically only present in older homes, but older brass faucets with lead content can be in newer homes. A certified plumber can tell you for sure if you have ‸ lead service

check for lead solder in your internal pipes, and look for fixtures containing ‸ lead. The only way to know with certainty if you have lead at the tap is to have your water tested by a certified laboratory. There are other steps you can take to protect your family, including the purchasing of a certified water filter to remove lead, making sure you flush out water lines after a period of stagnation in order to get fresh water that is coming from the main, and avoid consuming water from the hot water tap where lead is more likely to be present. You can find more guidance on www.drinktap.org for more ‸ information.

And I spoke with Rashad Wilson this morning, and he met with the school district, and they're willing to match what the school has raised as well as the city up to $75,000. And so to complete the project, the city would need to add $10,000 to the $30,000 currently budgeted. Just looking for a consensus among council to do that. As you are aware with the Cocoa Little League, that number is coming far under, and we do have some funding available there to potentially move over and see the project completed this year.

I do have ‸ more than a couple of things, but they're germane. And just, one, I want to thank all of council and those that have wished me well. With the birth of our daughter,
You already won. So, first of all, I just want to remind council, and for those that are not aware ‸ with our city, the city is donating 10 pallets of bottled cocoa water to Flint, Michigan. And so, ‸ I mean, that equates to, I think it was about 17,280 bottles.
So, just to remind our staff over at Utilities has got the bottles down on the pallets. There will be 10 pallets. ‸ We're actually partnering with, after we, you know, we started, and I'd like to acknowledge and thank Angela Warner, a longtime cocoa resident, you know, and I guess seasonal resident at this point. And this year it's going to be delayed. We did receive an email from our auditors that the Auditor General is not going to be releasing certain FRS information related to what portion of the FRS liability that's applying to the city.
That means it's going to push back the audit ‸ schedule. I mean, they're doing everything else, but they need that for the purposes of, you know, the ‸ balance sheets and making sure that they can, you know, provide an accurate, you know, depiction of the city's fiscal condition. It was originally scheduled for the March 8th meeting.
Just want to advise council on that. The CIP, the capital improvement process, programming process, is currently underway. ‸ All the departments are working on their submittals. And just, you know, in past years a little bit of a that's why I'm trying to give you a heads up now.
as city manager prior to ‸ getting to the budget workshops for the formulation. We're going to I've worked with Terry and Matt. We've had a conversation in the budget schedule. We want to move that up some to allow for a greater opportunity for, one, for myself ‸ and Matt ‸ to sit down with each department director, talk about budget priorities, and then we ‸ present that at the meeting. And then, well, ‸ at least about two weeks sooner or three weeks sooner than we normally meet. I don't know how many communities right now can say that they have been actively working and have achieved that realized that savings. So obviously we still have the impact of House Bill 1355 that's looming on the horizon. But I think everything that we did working with, you know, the both chiefs and the unions ‸ and Tammy, this sets us up to the idea was to be able to weather that storm when House Bill 1355 hits from last year that mandates the use of certain mortality rate tables. the would like to let you know this past Wednesday the Economic Development Commission for ‸ Space Coast recognized and recertified the city for ‸ its ‸ SNAP ‸ designation. So they had to submit data related to site planning and building and permitting processes,
Last thing I will share with you, and there is a on February 11th, which is Thursday at 3 o'clock, and I'm going to encourage you, and I've provided you some of the information in the past of the members of the Charter Review Commission. There is a proposal, and it's a revision to a proposal that previously was presented to the Charter Review Commission, and it's about and I'm going to just highlight some of the stuff because, as a city manager, I ‸ believe ‸ there's some concern with regard to this proposal. And I'm certainly glad that we have some members in ‸ the audience that are here today. The municipal ordinance shall supersede county ordinances in the case of dispute except in the area of environmental protection. And then it goes on a little bit further and says,
governing body of each municipality may establish more restrictive standards in the area of procedures, requirements, or regulations within the municipality for the protection of the environment. In the event of a conflict between the municipality and the Board of County Commissioners in the area of environmental protection,
So in the event of a conflict, if you don't have a stricter one, the city has a less stricter ‸ whatever ‸ the standard may be, so then the question goes, well, ‸ how do we define what are potential environmental areas? Where they define not to be considered all-inclusive, that is in the agenda item as tree protection, aquifer protection, stormwater management, wastewater management, river, waterway protection, ‸ hazardous waste disposal, wetlands protection, beach dune protection, air pollution, any items affecting public health. So I know a lot of the backdrop for this proposal is that
and that suggests that you need an overarching environmental policy, or at least if the county adopts a policy that would prevail. But there are so many other components here, such as how we handle stormwater pre- and post-development in terms of discharge.
at the local level, it's a home rule issue. I mean, I really think that this ‸ proposal is overreaching. And ‸ I don't think everything even with the fertilizer debate, we talked about it. Not every ‸ fertilizer proposal
mean, tree protection ordinances. I mean, it's very far-reaching. If the intent is to focus on the lagoon, I ‸ would think that maybe the Charter Review Commission could narrowly, you know, tailor an amendment similar to what the city of Cocoa did to protect Cocoa Riverfront Park rather than making it very broad. There was a charter amendment to protect, you know, the Cocoa Riverfront Park and the waterway out there. So I just want to share that with you. ‸ If you would like to if you would like to reach out, I will send those emails to ‸ I will, again, send you the members of the commission. So maybe you can send them an email.
I think if each of you would reach out, you know, individually to the members of the CRC, that would be helpful, specifically those that are representing the city of Cocoa.

can meet with you individually and go over, ‸ because it's pretty volumes of it. And we've actually, myself and Tammy and Matt have spoken with the we actually had a conversation with the pension board attorney,
And how I think at this point they just feel they'd be violating their fiduciary responsibility to the pensioners to do anything other than what the court ordered. So But

be a good idea for the city manager to sit down with each of you if you want to. I pulled all of the appellate briefs, the court orders regarding the issues that were presented to the court and fully argued before the court. And
exactly what the issues are. Exactly how the court ruled pursuant to the terms and conditions of ‸ the pension plan. Candidly, I think it would be eye-opening for each of you to kind of review that information because I don't believe that's what was presented to you all on a couple of occasions. There's more to the story. You need to fully evaluate it. The pension board, in good faith, applied the ordinance as presented, adopted, and the courts have fully reviewed that decision. And I would encourage you to look at ‸ all of the information that I compiled and gave to the city manager.
This is one of those subjects I really hope never to have to get into, but I feel an obligation to a former employee to understand this and do the best thing. Because this could affect an employee in ‸ the future. And I don't think our employees should have

But can we get the grounds? Because he and his wife have, during the time when it was hard and terrible times over there, off Prospect and Fern Street, at that time, that area was a tough area. And we've cleaned that area. And we are cleaning that area. We are purging that area. And he's homegrown. He was born and reared right here in Hot Chocolate. And I think he deserves that recognition. Just naming a ground after him.

I've never seen Rockledge kind of treat us that nice, but they did. And also, one other thing that got me, they always get up and kind of look at me, and they go, the oldest incorporated city in Brevard County. And, of course, it's a play on words, right? Well, my message back to Rockledge is, my house is older than your whole city. And that's a fact. Okay? So, anyways, it's a play on words. So, ‸ we're a very old community. Also, the 524 port project, any update on that?

not a productive day today. ‸ But, yeah, progressing well, and they're on schedule for the end of next month is what we estimate to be completely done.
