Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
213 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 15 voices separated from the audio.
8 short machine repair(s) (9 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 96.4% of 10,440 content words.
Dotted words (167 places) are ordinary wording differences: hover or tap to see the other reading.
213 passages (19% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

So here's the little button there. Let's see. You got it, sir? Okay. So going to A4-1 and just put that one up. And again, changes are always bracketed in red, and so you can see the changes from one district to the ‸ next. The demographic information and the population information is always at the bottom of the map in the legend.

moved between districts in this map. So you'll see the population associated with those blocks, and you'll see the demographics associated with those blocks. And again, going back to the bottom of the screen, you'll see the population and demographic comparison. Now we'll throw up that spreadsheet that you guys are probably used to seeing now and show you the demographic comparison based on the
So again, current version is the districts as they exist today with the population and the demographics. This is, of course, percentage of African American and black. You'll see that A4 in District 1 goes from the 4257 to the 4273. And I'll let you read on down and tell me, Mr. Chair, when you want me to move on to the next racial category. Yeah,

the population numbers against the ideal numbers, I want to highlight those. Rob, can you just drill down to the legend ‸ on the population section? And so, you can see, based on those changes ‸ for District 1,

If I may, in terms of the deviation percentage, because that number seems huge, I just want to make sure that that's not an issue specifically, what we're talking about.
Yes, I can. Once you the deviation is the deviation from the ideal, which is the average of the population of all the districts. And so, that number comes out to be, if
take all the population, 4751. So, that's the number that you're deviating from. So, each district will have a percentage of whether it's closer or not to 4751.
I don't know that the deviation is maybe just statistical and doesn't mean anything other than a statistical sort of data point. Again, focusing on the percentage of ideal, which is what the where the charter sort of guides you. So, you can see that District 1 is not within the limits that are prescribed by the charter.
Yeah, thank you. I think it is not a standard deviation. That is an actual population deviation from the ideal to this suggested position. So, that's a number of people.

This was an adjustment that we asked for. ‸ This was a jumping off point. And we were going to make final adjustments in this meeting to bring it within compliance. So, I think that we're at least at a good starting point because that means that we need to change 0.43% to bring District 1 within compliance. Correct? That's correct.
regardless of whether they were in compliance with the charter. Now, there is a map where he did what you asked, and he attempted to meet the requirements of the charter.

that is in complete compliance with the requirements and sent that on to staff, a comprehensive that really was in line with all of the discussions that we had
would have to make that map. Remember, we talked about from the first meeting, the direction to staff to the East Central Florida Planning Council was going to come by motion of this commission.

it is because we would have to do another motion. They would have to put the maps together that you generated. I don't think ‸ that we would have the ability to do that right now. But I would be willing to hear you out in terms of how your suggestions are different from what we have here to bring us, bring our numbers a little higher. And then I'd ‸ love to look at the map that is proposed by staff that would bring us within compliance as well.
So having a visual aid in front of me to aid in the discussion would be helpful. I guess if staff can make a copy of that visual aid, then we can go ahead and talk about the staff's recommendation while they do that. Is that acceptable?

continue, please. So I would suggest that rather than, and you know, it's often been said the perfect is the enemy of the good, we have at least two maps, A3 and B3, which are compliant and meet all the requirements that we've been asked to meet.

yet, but we could continue adding different iterations from now until forever. I think that ‸ we have to make a move to decide and move on. That's my input. So
if I may, because we cannot get the visual aids reviewed by consent, then I think it's best at this time to call it to a vote. And at that point, whatever is decided is what we will do and we will move forward in that manner. ‸ Okay.
I have prepared something that moved from A3, which was our plan today. We were going to continue discussing the border of D1 and D2 and then look at D2, D4. And
time. And this approach allows growth room for D2, makes neighborhoods whole, very much takes into all of the concerns about the consent decree and making those neighborhoods whole and making the border ‸ districts intuitive, natural for citizens and voters so that it's not an arcane or obscure division between districts. These were many goals that we talked about. I have done that. I have put the time against it. I'm very frustrated about being obstructed by procedural means when we could take a look at this. I want the time that I ‸ put into this honored.

To make a request for staff to take action that was not in a public forum for consideration by the public. I think that would have been a sunshine violation. And so I think it was prudent of staff not to take action because that was via email between the commission and the city staff. But the public was not able to be a part of that discussion and exchange and have input in it.
And, you know, piggybacking on what you were saying about the Sunshine Law, I chose not to read the reply because that was a violation of the Sunshine Law. Whatever we do here on this commission, we must be authentic

before. We went through this and we did it once and we viewed vote maps, A and B. We asked you to make the changes. The staff completed what we asked them for and now they're making a presentation. I don't think this should be prolonged any longer. So I agree with Mr. Green 100%. Thank you.
Mr. Green. ‸ Yes, Mr. Chair, since you brought up the issue of the email that was circulated prior to this meeting, I'd just like to speak to that briefly. ‸ When I first read that, I was a little bit concerned because
I'm not saying that anything was done out of intent, but I think that the result was that it was not an accurate representation of some of the things we've done. But out of respect for provisions of the Sunshine Law, I chose not to respond to that outside of the bounds of a public meeting. It's one thing to be able to send a message of what your intent is and what your ideas are, but we know that we're not allowed to solicit or receive any feedback from any other members. That's where the violation comes in. ‸ And for the record, some members yourself did indeed request certain materials from staff, but those were individual requests and they weren't voted on by the commission at large. So I don't know that those would be appropriate to act on.
what is a narrow scope of this group as laid out by the city charter. I'm saying this now, and I want to bring it up because I want to make sure ‸ that there's no chance that silence on this issue on my part is construed in any way to be in agreement with the contents. I strongly disagree with what you had written. I don't think that this commission voted to have the city do an in-depth analysis of census blocks. The simple motion was to ask state and federal officials to review census blocks before the next census. What was in that email represented a large expansion of that, and I don't believe that to be true, and I can't remain silent and suggest that I agree through silence. That's what I had to say about that. Thank you. Thank you, Mr. Green.
I would like to clarify our intention on that, especially the census blocks. We found some that just are, we've acknowledged that the way that the census blocks are structured impede our work in getting rational districts because they're very irregular.
999. ‸ I agree with you that those census blocks are not rational and don't make sense. I also agree with you that ‸ we discussed that at our last meeting. Whether they're rational or not, they are what they are, and that's the mandate that we have. And whether we discussed it or not does not constitute this body having voted to sanction and call for a full analysis on the part of the city. So what I'm disagreeing with, not the concept that the blocks are not appropriate or that they don't work for our favor. What I am disagreeing with is the implication in email that this body voted for something that we did not vote for.
the clarification comes from the recording of the meeting, and you can start at minute 49 and listen from there, and you'll know exactly what we voted on.

And all of these different factors would not be able to be considered in that specific suggestion. And as a result, we would either have to push it back and have another meeting to consider those things. And
But because of the time constraints and because of the fact that we have proper channels that we have to go through in order to get the numbers for those suggestions, I simply could not vote in favor. we've talked extensively about the plus and minus 5%, the compact, contiguous nature of the districts. And then, those last two bullet points, equal and effective representation as required by the Constitution. And then, the districts shall comply with the Voting Act and any applicable court orders. I think it was 4.3% of the ideal. This brings it back in line to a negative 2.23% of the ideal. And so you can see that. ‸ And again, the changes, if you compare map to map, you can see the changes are right there in between districts 1 and 2, I think it is.

I understand that there is yet to be discussion as it relates to the border between district 2 and district 4. But I will vote to approve as it relates to the border between district 1 and district 2.
I agree to an extent. I think that as it relates to district 2 and 4, I don't think the borders between 1 and 2 would affect the northern border of district 2 because there's so much space in between.
So I'm not sure how the border between district 1 and 2 would affect the decisions made as it relates to the borders between version of district 2 and 4.

to discussion as it relates to the border between districts 1 and 2. My goal and my intention is to resolve the border between district 1 and 2 and then move up to resolve the border between 2 and 4. And I believe that that would complete our discussion such that we would have a finalized map to submit to council ‸ because in our last meeting, my understanding was those two borders were the only standing issues to be resolved before we can make a final vote of approval. And so my goal is to work one step at a time to resolve each of those issues so that we can reach a point of finality in this meeting.
sir. As I see it right now, we have three maps before us, version A3, version B3, and version A4.2, each of which meets the requirements that are set forth in our charging.
see in A4.2. If I understood correctly, you said that that was contrary to the input that we got from public last week, the only public input we've had in all of these meetings, by the way. So taking the one piece of public input and disregarding that just leaves me a little bit uncomfortable. Honestly, any one of these three choices I could support in the end, they all have their pluses and minuses. My favorite of these is B3, and I will tell you why.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:37:30–00:37:31 · unresolved: the words are not shown (unclear audio); listen to the recording
Okay. So focusing in on that, what I'll call the key way of the yellow section, which dips down into District 1, and that's where we see the differences between the two proposals. We see the 188 block, which has had some public concern.
I could understand, I could make a case to say we shouldn't change that. When you go up into, on the A3, the one to the left, the 415 block, which conveys from District 2 to District 1, that puts a neighborhood more together when you're talking about the section around Broadmoor Acres.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:38:27–00:38:27 · unresolved: the words are not shown (unclear audio); listen to the recording
That does put Broadmoor Acres more intact. What I particularly like about this is moving to the northern end of District 2, where we have the area outlined on B3 of
‸ which is the case on both the A3 and the A4.2. Madam Vice Chair had spoken earlier about the need to unify the neighborhood along Dixon, and B3 does a better job of that. It takes neighborhoods on both sides of Dixon along Pineda and Fisk and brings some of those neighborhoods together where there's quite a bit of commonality. So I just like the idea of doing that. So all things in total, even though the numbers do not bring us as far as we could possibly go towards the
that we were seeking, the numbers are only in the tens difference on a population of over 19,000. So it's really a de minimis change in numbers. I think that B3 does the best to preserve and expand our neighborhoods, and

‸ So, Mr. Chairman, thank you for your acknowledgement as I entered this room. Can we get a laser light? Is that what we're supposed to get a laser light so we can see the adjustments? I mean, I'm looking at the maps, but I'm just trying to comprehend exactly when you're talking about dividing the community right down the middle
And we toiled with this quite a bit. I think the issue was that we established from the very beginning is that District 1 doesn't have space to grow other than north. Since West Cocoa is not included in District 1 and since it borders Rockledge to the south, the only way that District 1 can
Cocoa Hills neighborhood would be divided in some way. And unfortunately, because of the way that the ‸ voting blocks are formed, it's not much we can do, or it appears to be, not much that can be done based off of the options presented to us and the resources that we have to change that potential division of the Cocoa Hills neighborhood.
to better keep Cocoa Hills together while keeping us compliant. But we have voted as a commission not to consider those changes because we don't have the time and resources to do so and still be compliant with our January the 10th deadline that we're facing. ‸ Have I made sense to you, Mr. Blake?
Mr. Chair, if I could, just to piggyback on what you said, I'm not sure that it's accurate to say that the only place District 1 has to grow is ‸ by annexing some of the District 2 space to the north. We know, for instance, that we have 373 units that have been approved and are being built out on King Street in this area. So 373 units translates into probably 700 more residents or something like that. Yes, sir. We know that we have
Flag: numbers, amounts, negation or names differ between the machine readings · 00:45:23–00:45:30 · unresolved: the words are not shown (unclear audio); listen to the recording
some point in the next decade will have some number of residential units which will translate into more people. And we know that there will probably be some kind of activity within Cocoa Village over the next decade which will translate into more people. So there is growth potential. And that doesn't even include some of the infill we have in some of our ‸ disadvantaged neighborhoods where people will infill some of those vacant properties and presumably update and improve some of the older properties that could bring more population. So there is potential for growth in District 1.
in mind that there is future growth and we should at least keep that in the back of our heads when we ‸ do this. So this potential, if any of our current districts are constrained by future growth and you look at where the potential for development is and the potential for more building, District 2 is the one that's constrained. ‸ District 2's only growth will come from annexation. And we can't predict whether that will happen.
Thank you, sir. I believe that we did talk about that in the beginning. And I think the issue I wanted to consider more, I wanted to consider the development more, but I was shot down on that one.
with what we have. Unfortunately, as our city attorney has pointed out, we can't predict the future, but we can do the best we can to make those adjustments. And I think we have made those adjustments, especially considering District 3, where we're looking at 1,800 potential units. Well, 1,800 units that have been approved already that could mean an extra 3,000 residents in District 3.
the proposal as it relates to ‸ these maps, and one of the reasons why I am in favor of the version 4.2, is because 4.2, while just a little bit, is allowing for more of District 2 to remain intact and a higher number for District 2 than would be in District A3 if approved. So we would have a little bit more population in District 2 between versions A4,
But also with that 415 neighborhood that I've received feedback from the community about, we would be leaving that more intact by leaving it alone and just bringing in the area that I didn't want to bring in, but that would be most reasonable to bring in since it is further south and closer to what is already incorporated within District 1.

to make sure that we are, there is, there is a possibility of expanding further from the 415 block and the 188 block to give District 1 its maximum size there. It would require giving the College ‸ Manor neighborhood to District 2 and giving all of the Cocoa Hills neighborhood west of Fisk to District 4, but it is possible these numbers work out.
Okay, looking at what we've been discussing here, I think I, too, can favor A4.2, which puts us in complete compliance with what we need to do. And it is a shame that we will be, you know, rearranging a few of the neighborhoods. There's ‸ nothing we can really do about that. But there is. Time will tell in regards to, you know, future growth. Ten years from now, they'll be talking about that.

But for this map, then the numbers work out so that this is part of District 4. District 2 essentially goes from here over a more natural kind of boundary, and then it extends in here, giving it growth potential again. The numbers work out favorably. It allows everyone to grow.

2. At this time, I will second the motion to allow that motion to get to a vote. And at this time, all in favor, please signify by... Oh, ‸ I'm sorry. Discussion. I apologize. Mr. Green, thank you.
‸ I would say, Mr. Chair, that just for a casual look and without delving into the dashboard, my recollection of what I've seen on the dashboard just tells my gut that those numbers will not work. But even if they would, the only way we would know that is to task ‸ the ‸ people who are doing our work here to develop yet another map for us to talk about at yet another meeting. And I believe that we already voted that we won't do that.
But ‸ I feel it is vital for our future that we see this through, even though it is difficult and even though we are asking, even though it might be harder than we anticipated, we are unlocking possibilities that make more sense for our future.
Mr. City Manager gave us a slide a little bit earlier with bullet points of all the things that we are required to meet in our deliberations. The one requirement that he did not put ‸ on the slide, but which is there and looming large, is timeline and deadline.

from the day we started. This information has to be presented to Council so the Council has enough time to approve or deny so that we have enough time before the next set of elections so that people can plan for it. We are faced with the reality of that timeline and that deadline,
to, and as much as we can come up with a better product, we can't meet that requirement. And again, I said it before that we cannot let the perfect be the enemy of the good. We have good options in front of us. Maybe not the best options that we could hope for, but we have good options, and it's our job to pick one.
I agree with Mr. Green ‸ that we have several options that's been given to us, and we do have to pick the best one at this time that will move the needle on to completion of this task. And I think we have done the best we can do as of what we've been given to look at and what has been provided to us for consideration.
myself and knowing ‸ how districting is formed and how important a mission it is. I hear the fever of our vice chair and her desires, but I also must agree that while we cannot make a perfect map, we can do the best we can with what we have and move forward and giving the council a best representation of the citizens of Cocoa.

In D4. That way you have this, this line stays. This 33 should go over into, into district two. So this keeps Cocoa Hills intact, this, this neighborhood or, or much more intact. This is a natural dividing line that people experience.

I'm not through with discussion, Mr. Chair. I'm sorry. Please. I apologize. Once again. Back to discussion. I'd like to refocus a little bit on the basis of what we're trying to do here. And these maps that we're drawing, let's not forget that they serve one purpose and one purpose only. And that is of the four city council persons who will be elected, they will be elected from one of these four districts. It doesn't affect anybody's vote for mayor. It doesn't affect anybody's vote for any county, state, or federal office.
boundaries are drawn, every citizen in every district will have the same opportunity to vote for mayor who is the only representative that represents the whole city. The district map we are replacing, the old one, the 2010, met all the requirements for the past decade except the outsized growth in population that new development caused in district three. That's the only thing that's changed. Some neighborhoods were split. That's inevitable. There's no practical way to keep every neighborhood together. We don't have any evidence that the splitting of neighborhoods for this purpose has disadvantaged every community and any community because every citizen in every district has the ear of their council person and in my experience although I live in just one of the four districts I have never had any problem picking up a phone or sending an email to any council person in any district and being heard and having my ideas ‸ either advocated or not but I've had representation so even though we're splitting some of these neighborhoods and that's an unfortunate thing the practical effect of that is virtually nothing.
district or that district. ‸ It's just not there and we're affecting I think I said up front maybe 100 people one way or the other when we move these in a city that has a population of over 19,000. So what we're doing now is we're over complicating what is a relatively simple exercise.
I personally am not comfortable looking at a different alternative that doesn't have the same presentation the same graphics the same numbers at the bottom so that I can do a valid side-by-side comparison. We can do some quick math on paper or in our heads and say that looks right but none of that has been validated by people who have the official access to these things and make official maps. So based on that I am making a motion and my motion is that this group accept map A4.2 and submit it to the city council.
Yes, sir. Thank you, Mr. City Attorney, for keeping me on point. At this time, before we make a final vote, or before we make what could be a final vote, I'd like to open ‸ the floor to the public for discussion as it relates to the potential approval of version A4.2, which could be over the objection, which I believe will be over the objection of Madam Vice Chair ‸ Jennifer Riggs. I will call you by your proper name for the record. Any discussion from the public? Yes, sir. Please come forward, state your first and last name as well as your address.

in regards to what we need to do to go forward in a positive way for the citizens. I believe that due diligence in regards to taking a look at the information, staying within the 5% up or down in each one of the communities or districts is the right thing for us to do. As Mr. Green once said today, that each one of the district leaders will come from the district, no matter how the lines are drawn.
