Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube; on this page it moves the player above the transcript.
699 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 24 voices separated from the audio.
69 short machine repair(s) (83 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 88.7% of 25,214 content words.
Dotted words (939 places) are ordinary wording differences: hover or tap to see the other reading.
699 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:05:51 (6 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Council business to add an item to discuss on the November 24, 2015 City Council meeting. And we're going to discuss that under the number five. And we recommend that we cancel the meeting for the pressing city business of which staff is aware of since it's Thanksgiving week, two days before Thanksgiving. And we'll discuss it at that time.

And some of our council and mayors have been involved in the past. And we're going to invite everybody to come again. This year, it's November 12th through the 15th. We have several Grammy winners. We have some NAMI winners, which are Native American Music Award recipients. Literally, probably 20 of the best flute players on the planet will be at this event.
And we have several, maybe 60-plus vendors and crafts and art people there. So it's also a Native American art show as well. It will be held at the Wickham Park, which is in Melbourne. Everybody, I'm sure, here knows where it's at.

There's a band shell. Bring a blanket and a chair. Long hours, I think we're doing 10 to 9. Friday, Saturday night, half day, Thursday, and then 10 to 5 on Sunday, if I'm not mistaken. If you want to check the schedule, you can go to natalrhythmsfestival.com.
are traveling, the musicians. ‸ Most of them are coming from across the country to be at this event. Like I said, it is free. It's our gift to the community. All our people that work, our volunteers, our committee members put this on every year. It takes a lot of time and energy and money. And we've been lucky over the years to have good sponsors.
This is one of the reasons we put this event together. And like I said, it's a ‸ free event and it's a gift to our community. So at this time, what I would like to do is, thanks to the city, they put a proclamation together.

‸ A lot of kids come out to this event. It's cool. We have teepees out there. Sometimes we have horses out there, birds of prey. One year we had some cougars out there. Right. Big cats and stuff. So ‸ it's a pretty cool event that we bring to Brevard County. I think it's been one of the better ones that I've been to and I've been doing and going and dancing at some of these events.

pretty prestigious. So at this time, what I'd like to do is read the proclamation. And if you guys can bear with me, I'm trying to fight off a cold. So proclamation, whereas throughout our history, American Indian peoples have been an integral part of American character.

our citizens to come out and celebrate this event. It's very spiritual. It's a spiritual event. It's four days of music, beautiful music, flute music, and drumming, dancing. And there's some really beautiful artwork, Native American artwork as well. So please come as our guest. And what's...
They gave us five digital billboards in Orlando. So we're getting traffic from all over the... All over... Actually, all over the country, but we're getting a lot of people in Florida now, especially in Brevard County. And they're traveling ‸ long distances to be with us. The other cool thing is the park is giving special rates if you want to come camp.

It's beautiful out there with facilities. It is. So I'd recommend coming and bring your family. The other thing is this time of year is it's just absolutely gorgeous.
So you're sleeping under the stars, hear beautiful music. ‸ There's actually a lot of natural Native American food that will be there too. So they have fried burgers and Indian tacos and buffalo burgers and on a dog and corn chowder, stuff that you cannot get anywhere else, anytime ‸ other than this time of year at these events. So these are real Native American people cooking Native food, all ‸ very healthy food too. So anyways, thank you for your time. We're going to perform. Yeah, please do. Introduce yourself.

I'm Zeta Gibbs. I do the registering for the workshops. We have people coming from British Columbia, Washington, New York State, Pennsylvania, Arizona. It's amazing. One is coming 3,500 miles just to be at our workshops. And any of you that would like to learn to play a flute, we can teach you to play in five minutes. You might not be good, but we will be playing.
That's one other point. Last year, this is kind of funny, I'll share something with you. ‸ We have a big number of people following us on Facebook through Sundancer
I actually had people that wrote to me, and they were from England and France and Germany and Paris. And they all said they were coming to this event. And, of course, you go, yeah, okay. I said, well, if ‸ and when you

that was completed, actually, through August. We don't have the September bills yet, which is the end of the year, which will make these totals even higher. But this was work that my staff did. We got complete. And let me go through these one by one. Peachtree Street. Obviously, the ‸ total cost of the project is $2.6 million. It's not done yet. Obviously, it's 30% complete, but includes utilities, new sidewalks, bike paths, and the diamond in the square. So that's what it will look like without the traffic signal on the bottom. So... We also identified, through our sidewalk and pavement plan, over 600 sidewalk deficiencies. And you can see some of those. We used an innovative method where instead of replacing the whole slab, we used a diamond cutter, a contractor, and cut them within a few hours. So instead of impacting homes, they were in and out. Sometimes people didn't even realize they were there. So we corrected about half of our deficiencies within a few weeks. Michigan and Range Road.

in trying to get this together in Broadmoor, Acres. I've discovered some other issues that I think need to be addressed. Mr. Belden's department, code enforcement, is trying to do their job in Broadmoor, Acres. It gets kind of difficult, and I'm trying to understand why we're expending resources ‸ to enforce a code, but we don't have the enforcement mechanism behind it. And what I mean by that is currently on Belafonte, where 99% of the properties are actually rentals that the city's not getting, you know, their rental certificate fees on. We've got four houses that have been coded and condemned as unsafe and unsanitary by code enforcement.

Point number two, to create an RFP is a pain. It's a lot of work. It's a lot of man hours. Mr. City Manager, I understand that. Association, of which I am a board member. Believe it or not, I'm going to talk about waterfront issues a little bit. I do have some exciting new good news to share with everybody. As we all know,
citizens, and this includes for recreation and commerce as well. Now, we've talked about this enough. The Cocoa Waterfront Master Plan of 2008 is slowly being implemented. It looks like We're starting to get a little momentum there. Progress is very slow, but at least it's happening. And this will benefit the citizens and business, but when you think about it, there are bigger fish to catch out in the ICW that we haven't talked about. So what I'm addressing specifically is there's a decades-long migration that is well-established, a seasonal migration of snowbirds that bring their boats down for the winter and go back in the spring. It happens twice a year on a daily basis. ‸ A lot of these vessels sell for, in the seven-figure price range. The people that are on them are not just captains of boats, they're captains of industry and commerce. This is a group that we would like to attract not only to spend money in Cocoa Village, but perhaps to come here and show them a good enough time and wow them that they go, you know,

Chapman, Historic Cocoa Village Association, 12 Stone Street Suite 5. And thank you for the opportunity to speak with you or before you this evening. We had an event or two a week and a half or so ago. We had the Fall Art and Craft Festival and Chili Cook-Off on Saturday night. And let me start with Chili Cook-Off, if I may. First of all, I want to thank the city staff for all the help they gave us putting it on. And I want to congratulate Deputy Mayor Warner and

Coming up Art and Craft Holiday Bazaar. This is the one where we allow the merchants to actually sell some of their wares in the streets along with our Artisan Crafters. It's the only time of the year we do allow by sell in the the show. We are expecting the same number of Artisan Crafters. Our reservations are running exactly where they were for fall so we hope it will be a big event again with booths running right down Harrison Street as they did and that was an arrangement that seemed to work very, very well. she could be here, but she's in rehearsal with our Chitty Chitty Bang Bang cast this evening. And they're getting ready. We open on November 20th. I'm skipping ahead of myself. This Friday night we have our Stars of Tomorrow Youth Program kickoff party. This is for our older stars and they ‸ have a haunted sleepover. And this is the kickoff that we have brought back because we had done away with it for a couple of years. And all of the stars were saying that they missed it. And so
very first inaugural concert of the Space Coast Singers Chorus Group. And we are really excited for them to put their first concert together for us and see what they have. As I mentioned, November 20th through December 6th, Chitty Chitty Bang Bang. And the car comes to life on stage. So that's going to be a great time coming up in November. On December 12th, my birthday, we have Hot Pink. This is going to be a great group. They perform here at some of the local restaurants, bars and all that. And they are doing a Night of Motown for us on stage. It's going to be kind of more of a concert thing.
great time. And it's already selling out, or not selling out yet, but selling quickly. So if you want to come to the Night of Motown, go on linecokervillageplayhouse.com to get the tape.
Then back to the stars of tomorrow on December 15th. They have their holiday pageant. And so we'll have our youth doing a holiday pageant, kicking off the holiday season. And then we ‸ kind of wrap up our holiday season with the Galmont Ballet, the American Nutcracker, December 18th through the 20th. That's in collaboration with Galmont Ballet. We've done that.

The recommended motion is to approve staff recommendation to implement the unoccupied property policy effective january 1st 2016. Hopefully the fourth time's the charm. Base rates. Sometimes referred to as readiness to serve rates is a fixed rate designed to cover fixed costs, overhead costs that the city must maintain to meet the potential demands that the customer represents to the system. Base fees include portions of the fixed costs. ‸ example, debt service, infrastructure repair, maintenance, capacity ‸ of the system, which must be incurred whether or not the customer uses any water or discharges any wastewater into the system. The city must maintain over 1300 miles of buried pipe,

certified employees to operate and maintain its plan and system, and the number of employees and pay of those employees and cost of maintaining the infrastructure the
does not decrease when the accounts are inactive. Our current policy basically has an inadequacy. For unoccupied properties that are vacant for over 30 days over the billing period, seasonal seasonal customers must pay the base rate for all services billed to the city, whereas unoccupied property owners, landlords who own vacant property, do not have to pay any of the base rates. ‸ council basically has three options. They can implement the unoccupied property policy. And basically what that is, is as of January 1st, all unoccupied property owners would be charged the base rate for all services

include vacant property. The second option is implementing the vacant status policy. Basically that is when you are vacant, when a property is vacant for over a billing

And basically, if we implemented this, there's a possibility that we could lower the base rate. The vac the vacation status policy, on the other hand, there all although it would have um equity to the all on unoccupied property, it may result in a higher base rate after we do an analysis of of the of the rates. And then we could keep status quo where unoccupied seasonal customers pay base rate, it

They oppose the vacation policy because it is cost a loss of revenue for them. But they would support the status quo. Now, how many how many customers does this affect? If we implemented the um unoccupied property, there's about 2600 customers that we would be billing that are we do not bill now.

which is about 6600 customers. And we have a total of about 83 000 connections at this point. Now, let's talk about the financial impact. If we implemented the unoccupied property policy and did nothing else, there would be increase in revenue for

year. So there there may be a possibility that by implementing this, we could decrease the base rate. On the other hand, if we implemented the vacation status policy and nothing is done, it's a decrease in revenue. Again, or if you could do a rate study, and it may result in a base rate increase to compensate to compensate the difference. By doing status quo, there's no financial impact.

we're talking about the 2600 customers, are will come into, not all 2600 but a number of them will come in. And the issue for staff, as you know, um and I know some people have said, well, if I'm not, if I have vacant property, you know, it's unoccupied, I'm not paying anything. So, you know, if the city's not, you know, if you're not providing me any service, so why should I pay for it? Well, I guess I would say that private property owner whose property is vacant and unoccupied, they still have the responsibility responsibility, personally, for their own investment, and as well as to ensure adherence to code, that they maintain that property. So
fixed monthly fee that is designed to cover fixed costs associated with the state of readiness that the city must maintain to meet the potential demands that a customer represents to the system. This is no different than what we're doing with the fire assessment, in terms of, you know, you have already they are there, and they're ready to serve if the ‸ time, if the situation dictates. uh And then, he and Mr. Burton, ‸ again goes through, and
throughout the year, whether the account is active or not. Because at the end of the day, ifif you bifurcate and have two different policies, or you have two different treat people differently, because we think you should either do one or the other. You should either not charge, you know, the vacation, you know, the seasonal people, or you should charge the unoccupied. uh Because there is an inequity there, but the other inequity, if you don't charge either, is that all those, as Mr. Burton points out, all those fixed costs included in the current base fee continue to be incurred by not just the city, but the rate payers. Because they're going to have to pick up those fixed costs, they're bearing those fixed costs, and it's going to be spread out.

Right. Absolutely. And I know they're coming, but I'm just trying to say, yes, we need something that is fair and equitable, but how do we bring in those other 2,600 customers? That's the question.
and you mentioned that if you don't under the bond covenants, you have to treat everybody the same. So you really can't make two classes or three classes or whatever, and I think if that's the truth, we have the answer already.

but I recall they allow the city to establish classes of customers. And within the class, everybody needs to be treated fairly and without discrimination, and there's a provision in the bond covenants about the city not providing free water service. The purpose of the bond covenants is, of course, to secure the revenue necessary to pay the debt. So when you look at establishing classes of customers, you've got to ask generally ask yourself and this is just, you know, general comment
you have these two customers, these unoccupied properties and seasonal customers. Is there really any distinction? And I think the councilwoman ‸ maybe kind of hinted to or alluded to that. And you need to ask yourself if they're similarly situated enough, should they be ‸ treated the same? In this case, at least paying a base rate, ‸ a readiness to serve fee, which is common in the utility practice. And as you know, readiness to serve is a charge that the city imposes with a fire assessment. And, you know, is the utility any different than that for all the reasons John expressed and having that service ready, willing, and able to be provided?

Yeah. And it's hard to miss because it's right in the middle of the road. So um that and also, right there north of Dixon, um there's a place there where the sidewalk stays wet. ‸ we went 10 days with no rain and never dried up there. And one of the homeless people who lives in the woods there told me that the reason it doesn't is because there's a spring on that vacant property there. And
that that spring water is now just running down and that's what's keeping our sidewalk wet. So if somebody could maybe take a look. Because yeah, 10 days of no rain and that water never went away.
