The City's record

Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_03_21_2024), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
609 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 17 voices separated from the audio.
69 short machine repair(s) (92 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 90.8% of 24,868 content words.
Dotted words (722 places) are ordinary wording differences: hover or tap to see the other reading.
609 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
02:49:30 (14 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
All right, it is 6.03. ‸ We're going to call this meeting to order. We'll have our call to order. We have our Pledge of Allegiance. Everybody please stand.

This is for the record. I'm also Michael Mack. This is case 23-802. I'm submitting a packet of documents and photos associated with this case. The photos actually depict the property during staff visit and show the findings of roof and damage section 6-1003G for the disrepair condition of the roof. Staff visited the site seven times. During the first inspection, staff found the property and violated the above city code sections. Staff has attempted to gain voluntary compliance. As of

I, this case was previously Mr. Gonzalez's and Mr. Bonacore. I took it over. It was, it was redone. So I would not know, but I know it has been there for a while. And I started in November. Sure. Yeah. And it comes and goes,

ever. We've had some contact because it's been cited. I cited it, came to the code board. He was given a chance to correct everything because he stated he had a rehab going on. So we gave him another year and nothing's been done to the property. There is no rehab. I have, we have called them. There's nothing in process.
There's only multiple trailers throughout the life of the case. Sometimes it's a boat trailer. Sometimes it's a utility trailer. Not that there's a business or that we have evidence of, but there's always some sort of trailer on the property that comes and goes and it's always in the yard.

contact with the property owner. Staff has worked this case for 422 days. I brought this case before the code enforcement board due to the violations have not been resolved. I sent a notice of hearing on March 8th, 2024. And it was sent certified and posted on the property in violation.
case 23-63 that the owner is in violation and recommends 30 days be given to come into compliance or a fine of $50 for permit required and $50 for off-street parking and loading.

better. Okay. The permit required is because the driveway was paid without a permit. The offloading, get the exact verbiage here, off-street parking and loading is because the pavers overall, ‸ the percentage is over what's allowed. So they would either need to get a permit for the driveway, which would kind of cure that problem or get a variance for it.

was real bad. The apron that we see there, that used to be all water when it was wet season. It was all flooded. This was my attempt pretty much to avoid getting water into my property, which it did in previous years. And I have pictures to prove it.
given, and I needed, I needed to get a hold with zoning and planning to get pretty much this width. Because like I said, I have proof of pictures with pictures of how it was flooded back then.
So, I'm not, I'm not the expert, but sounds like this is about to be torn up. So it shouldn't be too hard to get with them in reference to that. But you still have the issue of the driveway being done without a permit.

And it, when it gives the solution of how big you want the driveway, it gives you the option of 20, 24 or other. I selected other. That was my second time filling out the application with them. Never heard back from them. The third time I went, it was because I was being cited to this courtroom today. And I got back and I pretty much filled out the application with them again. I told them what was happening. And ‸ they just, that's when they got back with me and told me that I couldn't do it anymore, any bigger than 20 feet.

it, ‸ and I say that in the reference of that happens now, it causes you money. You're doing this. And then now if you have to do something totally different now, it's money kind of wasted. You know what
Yes. But the reason why I did this is because like I said, my room was flooded because of it. I have actually have a speed bump right in front of my property. So
I did. And all they did was pretty much put signage out there to make sure there was signage out there. There is, but that's not doing anything. They're still going around my speed bump and into the driveway and making it worse.
one on each side of the road. ‸ That's all they did pretty much. And then it was at the point where I was getting affected during the wet season and I have pictures of my room being flooded as well.
They sent me a copy of the notes. Thank you. So ‸ the public works permit was denied because of the setup that she has essentially doesn't meet their requirements. But she's going to have to remove, make decisions on what she wants to do.
Flag: words were replaced by a machine repair · 00:20:48–00:20:48 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
to remove that. ‸ The bad one is that we're going to remove that because we can't allow you to have that. The good one is we're going to put a new driveway in.
extended, even whatever they tear up because of the storm drains that they're putting in there, you're still going to need ‸ a permit from them because
Whatever drawings you guys come up with, when, if you guys do remove everything and restore it, then whatever drawing you come up with to address those flooding issues, they'd probably be able to guide you a little bit better, but they're going to have to look at the drawings and the permit for that.
Flag: words were replaced by a machine repair · 00:22:33–00:22:33 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
But it's not refundable from my understanding. So there's more for me to tell you on it. Okay. The easiest route, like I said, would be to remove the pavers and get permits for it. Otherwise, whatever decision you make, you're going to be on time restraints.
She'll have some type of answer or some kind, some kind of correspondence in which she ‸ can bring back to Mr. Gonzalez to say, Hey, this is what's going on between her and public works. Um, so what does, what's the board

she, if she gets a permit and she submits a proper drawing that shows what she's removing to meet their requirements, then she'd be able to get the permit for that. Yes, sir.

the paperwork says, uh, it has the option for 20, 24 or other. I selected other, but when they came back, they told me that the paper was outdated. So they can only go as far as 20 feet. And it's, I feel that the paperwork is just that.
So maybe that would, that's the third option for you is to reduce it, fill out your paperwork. Like he's saying to reduce it to a smaller paper pad. Right. I'm with you on the 90 days. I think she has options.
Flag: words were replaced by a machine repair · 00:26:17–00:26:18 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
No. Given 90 days opposed to 30 days, within that 90 days should have some type of answer if they're continuing to be proactive, which they seem like they would be.
Can, and I, I would like to just make sure that that's with consistent communication with the officers so that if they feel she needs to come back for whatever reason.

Yeah. I have a motion on the floor by Mr. Otero. Second by Ms. Scott. All in favor say aye. Aye. All opposed. Motion passes unanimously. So ma'am, please continue to be, uh, vigilant and proactive and opposed to reactive. Um, try and work on that so you can get things accomplished sooner than later. So now, um,
if that happens, this could be cut off earlier in a sense where now they're not on your back and now it's in the hands of Public Works and going to that hearing for approval.
if you have any questions, please do not hesitate to, um, call these gentlemen or just bug the mess out of public works. They'll get tired of you and they'll decide to answer your call.
Case number 23-649. Uh, I am submitting photos that I took during the re-inspection of the property. They accurately depict the property during my visits. This case was brought to the code board on January 18th, 2024. It was found in violation of accumulation of trash and litter. Storing outdoors.

didn't see him showed up to, um, ‸ to let me know. I know the last time I was here, they were telling me about the roof coming down on the soffit that I take care of. And then they said on the walkway where they got those pavement stone need to remove. I remove those. You know what

all that stuff on the roof. So I don't know what more violation on the property unless someone let me know what and what is the, is the property violation about.

this is, this isn't something that just came up now. So, um, this is what we want you to be able to take care of the property, but, um, you had a compliance date of
but we, he, he, um, he spoke to me and said, I must meet him there within 45 minutes, but I was there waiting and, you know, I mean, somehow, I don't know if he forget about it or what happened. It just never happened.
Uh, once again, I've, I've taken it over and, um, I've checked it out a couple of times. So, to my knowledge, there was, uh, there was a rebuild of the porch, which was, uh, which did not get, uh, permitted for, which, uh, was explained that you need a privilege for that, for that, that particular
the roof on the other side, I don't know if we, uh, have a picture right there where it's, where it slopes in. That's, that's where we are talking about as far as, uh, the roof and dealing with, uh, getting that fixed. And the outdoor storage is, uh, the stuff that's in the back. It's all.
And also the fence needs a permit. There was a, he has a permit for exterior sighting and that doesn't complete. It's a permit, but it doesn't, you know, there's more required to it to have what was done to the, you know, to the, to the structure.
So, sir, I mean, I'm not sure if you're what you worked on or how you worked on it, but when you do something to your structure, you definitely need a permit because what happens is when you don't have a permit,
Flag: words were replaced by a machine repair · 00:37:15–00:37:15 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
is right. You know, the permit I know about the permit, but I didn't do no changes to the front of the porch. If you ‸ look at the whole picture and the new picture, all I do is just put the siding on it and, and, and remove some, some, some rather termite wood.
mean? So if someone could give me a list to let me know what was the problem, because they might say the roof and I go fix something different than what's supposed to be fixed. I might look and see something look bad to me and I fix it. And when you realize that's not the problem, they got, they got a different problem. That's why I was asked. That's why I called and said, can you meet me around here to show me what the problem and what the, what I supposed to be fixed.
Okay. Well, um, I don't know if you'll be able to do it with them after this meeting, but definitely reach out to them tomorrow. I will because, um, at this point, the way it's looking, you're still going to be non-compliant. Yep. So that means you have time to get this stuff worked out, but hopefully be proactive and not reactive.

an, uh, an appointment to meet him, but I could. I mean, that's not a problem in the call to, to point or take a, or take a picture or what was given to him from the notice of violation and point it out. It was just, I mean, it's, you know, the side of the roof, the porch, the fence, clear up the stuff in the back.

Not when it comes to this board. Well, ‸ it ‸ What I'm saying is all that is on you, what you guys agree on, but when it comes to what the code states as far as how your facility is supposed to be, up kept, that's between the owner and the city. So the city does not contact the person that the tenants that are there. They contact the owner. The tenant has no problem with me being there. This case actually started before that tenant arrived. ‸ again, there's no lot lines here in the village. Uh, so not trespassing. It's not a locked alleyway. It's not, there's no locked gates. It's just the back of the building.
The grease hasn't been picked up yet. The current tenants have tried to rake as you've seen here from today. There's still grease on the floor there on the ground, which is going into the soil and the environment. There's grease there on the concrete slab and there's
grease, um, throughout the walkway. Uh, that's eventually when it rains and you can smell it while you're there, you can see it in the photos. It goes into the river and it goes into the storm drain system right behind that alleyway ‸ slopes right down into the, uh, street.
So they now the new tenants, uh, have, I've been working with them to do things correctly and ‸ they actually now have a, uh, grease container. Not that one that you see there that's been permitted and allowed, uh, to be there and to be picked up. Uh, so that actually that interceptor there, uh, according to them is not going to be used. the picture ‸ that that's a grease trap. That's a grease trap interceptor that takes degrees from the, ‸ from the, uh, sinks and stuff separates it. And this company comes out on a quarterly basis and pumps the tank and keeps the area clean. That's been done and that's contracted for now. The tank that somebody was referring to the side tank.
They have to remove that grease and properly dispose of it for pickup. It's two different systems. If you look at the pictures and actually the last picture, that's an old picture before the company went out and cleaned it. But I put the receipt in there as of the date, uh, all service sanitation came out and cleaned it. And when they cleaned it, they cleaned around it. If you look at the first picture, that's the mulch that you see down there, because when it rains, you don't want to be getting muddy feet and such. and I would have never found the lien until we went to try to sell the property and that title company did his appropriate job and found that there was a lien there. And then that's when I approached code enforcement and said, I have a problem. So what do I need to do to fix it?
So what I've been able to find so far is the mortgage foreclosure action was filed in 2010. The city's lien came about ‸ in 2012. Right. So that's what

the case was started ‸ initially when I wasn't getting contact. It was showing her residing at that property and. They confused me at first because it wasn't homestead and it was there for a rental inspection. Uh, throughout the life of the case, I think it was actually right before the non compliance hearing. So I forwarded the notices or I think that was a notices and notice of hearing at the time to those addresses and she responded. So currently it has changed to her Ohio address.

Gonzalez near the end of 2023 is when we started working together to resolve these issues. We cleared the permit issue, but then there was, um, there was a flat roof that was a little bit. It was dirty. And I think Mr. Uh, Gonzalez said, Hey, that needed to be cleaned because there can't be any violations whatsoever for you to be in front of the code board. Um, so we cleaned that issue up right away. And I sent Mr. Gonzalez pictures. That's why he went there today to confirm.
Um, again, we're not, I'm not trying to justify my client's, uh, ‸ actions. I'm simply stating that he wasn't as apprised, uh, of it because the notice of hearing does state on, on its face that it's sent to an Orlando address. And I have copies on the counter for you guys to take a look at.

and that's why I'm not here to make, I'm not trying to justify it. I'm just telling you the issue is that he wasn't properly apprised of the issue. When Mr. Bunt sent the December letter, which I left on there, that's when we came first to know of the issue and it got addressed right away. He hired me to help resolve the issues. I started working with Gonzales. Like I said, Mr. Gonzales has been phenomenal to work with. He's been, ‸ he met me at the property a couple of times to go over what the issues are and we cleared it up. So I'm asking the court to please take some leniency. You know, this is 80 something thousand dollars. He just didn't know about it. There is a clerical basically error at the, at the end of, at the end of the day. That's what happened here. It is an error on his part. Don't get me wrong, but it's a clerical error because he didn't receive notice. When he finally got the notice, we corrected it right away. And that's what the issues.

this case started off as another rental inspection. Um, that there was other violations. So this case ran for the other violation for a lot longer. As I was running that case, I began seeing the unpermitted work, which was already found in violation prior, which is what made it a repeat.

He is out of state and I gave him, uh, we kind of figured out what happened with the work. Uh, that was discussed. It was somebody who shouldn't have been doing it.
I think he hired someone. He tried to save some money and hired someone that probably shouldn't have been hired. But at the end of the day, he thought that they were going to be doing work by code and ‸ getting permits. ‸ And unfortunately, they didn't do it by as much. But being out of state, he's relying on either, you know, other people to

to get, ‸ getting a property management or he's going to probably sell it. That's what he, he doesn't want to deal with headaches like by himself anymore because he lives in Maine. He is an elderly kind of guy. So he's like, either he's going to sell it. So either he's going to sell it or he's going to get a property manager to continue renting it. Uh, but he's not going to be dealing with it on his own because of this issue, because he's, he's far, you know, and, but he, this is an investment for him. But at the end of the day, I, I'm, I think it's an issue of not having proper notice and that's going to be corrected. Now with my help, I'm trying to clear up all these issues with him. Unfortunately, the LLC that
