Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
392 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 22 voices separated from the audio.
35 short machine repair(s) (47 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 93.0% of 16,127 content words.
Dotted words (376 places) are ordinary wording differences: hover or tap to see the other reading.
392 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
01:54:24 (5 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

celebration celebration. Finally going through a man. Puberty. Riverfront Park for 2021. um I enjoyed this. There was quite some concerns about making sure the perimeter was secured. So without further ado,
Thank you so much. So I did bring forward uh the last meeting under reports um asking direction from council on the future of the July 4th event. I'll quickly recap what we discussed. um So this picture, as you can see
This is one of our largest, probably the largest event that we do in Riverfront Park. It attracts probably approximately 10 000 people. um They are packed into the location as many people as can fit. um what we would like to propose what staff is proposing there's actually three options for you on this agenda item um but we have found and researched some other options to incorporate the CDC recommendations for social distancing. um And so what we are proposing is similar to what is seen here at the Dr. Phillips Center in Orlando.
pod system and what we would do is we would fence off Riverfront Park to control the people. I'll start with that ‸ this time we're going to fence off Riverfront Park
could reserve this pod and your family could enjoy the event in the pod um and we could then require and control better the amount of people that are in attendance the face coverings um and social distancing. um So we had thanks to Alan and Kathy over at Main Street have created us a little diagram to show you what we're talking about. um So we would have, even though these look like boxes, um there actually would be three-sided pods that we would make out of barricades that would be designated areas that people could reserve ahead of time to come out and enjoy the concert on the stage

Our city would be one of the first to offer such a lifestyle and would attract potential buyers from other locations in the county. The city has so much potential and for years, and this is just my opinion as a resident, as someone who has invested a lot of time into the city, serving as a volunteer and a short term as a council member, that we have never really utilized the potential this city has. So my sincere hope is that the action taken tonight does not undermine that potential, but instead helps propel the city in the direction that it needs to aim for. And we need to aim for that in order to compete with our neighbors to the north and to the south who are developing properties just for this purpose. They're looking at attracting the type of residents that we need to attract as well. Young professionals, retirees, and everyone in between.

I really don't have ‸ anything to add to what the city attorney has said there. Obviously, we're here because there is no agreement in place after years of negotiating to actually bring something to the council, but nothing has ever been presented to the council that was acceptable to staff and acceptable to the developer.
you know, which has been proposed. So that makes sense to me. I am a property owner in the area and have purchased property specifically based on what I see happening both at the villas and in the general area. So that's where I plan to make my final stand on my property. And I'd like to see development continue forward. I guess I'm also a little confused by, you know, this ‸ discussion plan, the development has been under discussion. I know I've been involved in it for a couple of years, you know, as a,
study something and talk about something and kick it around the council and have staff look at it. And no decision's ever made. So if you want to study it again for another six months or another two years, we can come back to this point. And again, nothing will have gotten done. I don't know whose fault that is. I'm not here to blame anybody. But what gets planned and signed gets done. And what doesn't, doesn't. So here we are two years into this process plus. And no, you do not have a signed agreement apparently.

sign that agreement. So if you want a signed agreement, get to it. I mean, make it happen. And, you know, push the developer to get whatever you need from them, whatever it takes. But we just keep standing around and talking about this. And two years from now we could be doing the very same thing again. That seems like a waste of everybody's time.
either like a flat surface parking or if you have a condo, one of the bottom floors could be utilized as free public parking. It's optional. I just want to see what's the best usage for that. Now, I don't have a card. Do you have a card?

State your name and your address. My name is Michael Deere. I'm ‸ attorney for the villas. A lot of things have been said tonight. One thing that is concerning is that the city would consider terminating negotiations at this point. My involvement is less than two months on this case. But in that time, I've learned quite a bit. I've learned that on April 24th of 2018, my client's bid to improve the property was accepted. And that a draft agreement was not authorized by the city until October of 2018. From October of 2018 until February 22nd of 2021, based on changes discussed between the city and the developer, my client anticipated changes, which were never provided. On the 22nd of February, we received changes, which was 21 days after the meeting on February 1st to discuss this issue.

some terms that were in the agreement, the draft agreement, which are not consistent with the original RFP and, frankly, are not fair to my client. I do not have a response. We do not feel that good faith negotiations have terminated. And

as the agenda for this item, I believe the only option for tonight, if there is a motion at all, is to continue negotiations, to discuss with us the development of the property, and to negotiate terms which are consistent with what the city has done in the past with other developers, specifically with regard to zoning, ‸ the city has provided authority within developer agreements for prior developers.

authority was not given. In fact, the agreement says that if at the city's sole discretion, the city does not approve a zoning change within 90 days, that the ‸ developer agreement shall terminate immediately and be of no effect. My client would have no control over that. And so ‸ we are here in good faith to negotiate a developer agreement based on the bid that was awarded April 24th of 2018. We have provided changes to the most recent draft, and we do not feel that good faith negotiations have been exhausted.

to allocate funds for the temporary operation of the museum to maintain public access now there's uh as I just read there's a number of actions within this item and I'll kind of take those apart step by step the first one is to approve a lease termination with the florida historical society and uh that's in accordance with the uh existing uh museum uh
lease agreement that we have with the florida historical society actually section 10.2 outlines the termination by mutual consent uh that was issued to the city uh in january from the board of the florida historical society where they voted unanimously to uh terminate uh their the agreement and their operation of that museum uh effective march 1st uh uh

requesting the acceptance of uh those donated items. uh The third is to uh direct staff and the City Attorney to review those uh museum exhibit uh agreements of the artifacts and exhibits that are on loan from various universities or archaeological uh societies that are within the museum
to explore those leases and then negotiate the potential extension if necessary of those leases. And then the final item is to approve a BAF allocating $27,000 to continue the temporary operation of that museum, just as the Florida Historical Society was operating it up until March 1st to the end of the fiscal year, September 30th. I'd be happy

ordinance related to term limits for board members. So that's normally your CRA boards. ‸ your pension boards are covered by that, but whatever boards that are not otherwise term limits are not otherwise set by some other pronouncement of law, this would be covered. Okay, what I'm gonna do is call people from the audience, let them expound, let you all discuss it, and then Chair's gonna call the question. Lawrence Sinclair, come to the podium.
This is an extremely confusing Council, the way things are being done tonight. Question. You want term limits, but yet in the very ordinance you just submitted, if you read deeper in, it says ‸ that Council can decide not to impose those term limits, that you can override them. So why are we actually even trying to establish a term limit ordinance for board members? Other than maybe it gives Council members the ability to, you know,
to fit their needs. But why are you proposing a term limit ordinance that in the very ordinance it says that you guys can ignore it? It makes no sense. Why are we wasting the taxpayers' time and money with this crap? Either it's term limits and they stick, or don't do it. But your ordinance, if you read it, I don't know how many people in the audience actually went online and read the full description of the ordinance. But it clearly says that Council can disregard the term limits on any member on any board for any reason. So why are we doing this? Except that maybe people think that they get to personally Jimmy-rig

Okay. Um, again, the purpose of this is to increase civic engagement, increase the dynacism within our committees, and give the, um, the folks that are coming up through the Citizens Academy the opportunity to serve in different capacities. We certainly encourage all committee members, if they were termed out, to try another committee, to wait a year to come back, but the issue of being able to override that term limit is important, because we recognize that in certain cases, we have certain specific expertise that is
and if it's not available through, uh, a new applicant, we would certainly want to keep it. So, um, as it stands now, that ‸ yes, the Council does appoint and reappoint, but we have the opportunity here to increase civic engagement and still maintain expertise where we need it.

both sides of this argument. um You know, we do have a lot of dedicated residents in the city who have given years to volunteer for boards. And it's not an easy task. And a lot of times what happens is they get on a board because they feel like, no, I want to contribute. I want to be a part of what happens in my city. But they don't realize the commitment and the work that has to go into serving on that board. So I agree with Councilwoman Costa's point that it's good to have new individuals that have interest in wanting to serve. And there may not be an opening at a particular time when a new citizen or citizen who has gone through the academy and all of a sudden they decide, wow, you know, I really want to get involved now, but there's not an opening. So, I mean, I would like if there was some way we could have compromised on this a little bit better. I mean, you already made your vote and I understand that, but I just feel

because I'm tired now, right? I went through sets and sets. I think I'm on the third set of kids graduating right now. So my goal this year was to step back and try to recruit a younger coach that can take over the things that I've done. And
And I'm not saying that people who've been there 25 years are tired. ‸ All of them are great people. I was on advisory board, the Board of ‸ Adjustments. You know, some of the members have been on there for 32 years. ‸ So it's still an opportunity. We're not saying, people are not running, knocking on the door, trying to jump on these boards. So
But if there's someone else that's there willing to step up, then I think we need to allow them the opportunity to do that. That's just my opinion on that. Okay.

All right. Just to give you a quick update on where we're at with COVID, uh... Florida had 2,016,513 positive cases. Brevard County had 36,438 cases with 790 deaths. City of Cocoa proper had 3,317, and we currently did not get the updated data from the Department of Health for what we had in the city limits, but ‸ they did confirm that we did see an uptick in the number of cases within the city itself. So, as far as vaccines are concerned, ‸ currently Florida has given out 5,057,939 vaccines. That means complete vaccines. They've received both shots. Brevard County has issued out 132,630 vaccines. Out of that, only 76,881 have completed both vaccinations. So, just to give you some data and some things to think about, our current U.S. Census track shows Brevard County's population at 615,000 residents.
If you looked at the news just the other day, the Department of Health, Florida Department of Health actually reported that what they're seeing is out of the individuals that have started the either Moderna or Pfizer vaccination,
So, just food for thought as we start moving down that path, and currently where we're at with vaccines and moving forward. A lot of questions have been asked and raised with the current situation on where we're at and where we're going with vaccines and why there's so many different eligibility requirements in different areas. So, basically all I can tell you is the governor

and firefighters, teachers who meet that age range and demographics along with ‸ our police department. That is the only approved changes that the governor has made.
That's way above my pay grade. So, I will say this. We've been in some serious talks with Brevard County and they will stick to the governor's requirements. So, anyone that is giving vaccines that are receiving vaccines from Brevard County Emergency Management must stick to what the current requirements are that the governor

given whenever he changes those. As you know, those change here pretty rapidly ‸ weekly. If they are not, then Brevard County will not allow them to issue any more vaccines, nor will they give them vaccinations to be given or issued. So, that's kind of where we're at with the vaccines. We continue to work with Emergency Management and Brevard to do our best to start getting vaccines so we can start vaccinating our residents

it's going to start on March 29th, and the value of this, that it's a certified nursing assistant program, but also they do, um, believe they call them home health assistants or workers.

and I'm not even sure what that stands for, but this is the first ‸ of those projects, um, that's being launched in Cocoa. And, um, it's family promise of Brevard that is acting as, uh, kind of the backbone organization. So, um, I wish her the best of luck, and I'm really happy to be able to make that announcement. She's also looking for a more permanent location in Cocoa. But thank you to Pastor Rich. I also want to say, Space Coast TPO, um, wasn't mentioned, but Samantha, um, Samantha Senger and, and Rachel Horst, right?

Yeah, right, Florida Avenue. So, that's highly appreciated by the larger community. Then I also wanted to commend Greg Stoll, and Wesley Parks, who serves on the TPO, uh, trails. I believe it's trails and pathways committee or whatever stuff. But at any rate, both of them had perfect attendance, which is a great thing because I had seen the roster before and it
Then the last thing is that we had our community, community meeting this last Saturday. And it, we had 50 to 60 people there. Uh, it was really a tremendous turnout, very positive energy. And it really warmed my heart to see so many people care about that community. And specifically there,
um, is, is, uh, a sense in that college green estates ‸ of spiraling downwards. So the community coming together, a lot of positive energy, uh, people there that have written grants, a lot of talk. And I think the direction of that group was forming a friends of Clear Lake that would really look at some sort of partnership, bringing someone online, whether it be the YMCA or the museum, but at least, um, there's definitely a longing there to elevate and lift up that community for the whole, that's our whole educational hub

And we know how important that is to the future of Coco. So, um, just kudos to everybody in that neighborhood. And I hope we can continue on, potentially find a solution through, a nonprofit partnership or whatever, but, um, there are a lot of people that have passion for doing that. So thank you to them. And particularly Marlene Weiss, um, and Jennifer Riggs, um, for helping to organize that.

And, and as the mayor always says, the city is open for business. I just want people, you know, to say on record, people should keep in mind, it is an honor to do business

And, um, and I want to say kudos to the staff that keep the city running and open for business. Um, ‸ I know a lot of times we get bombarded, uh, with a lot of negative, uh, comments and energy, but I'm very thankful to staff for the work you all do and, uh, encourage everyone council, keep it up and just keep pushing for it, uh, through this year, thinking positive.
We're planning on providing an update to the Coco CRA at the next meeting in April. Um, so they are on target as far as the deadline they need to submit to April.
Yeah. Can I, can I jump in on that? Cause there, this is part of the, the rumors that are out there. And if you juxtapose the two projects, which, which started basically at two projects being the five acres and the hotel, which you actually started at the same time, There is a redevelopment agreement that is in place between the redevelopment agency agency and Mr. Brown's company. And there is a developers agreement that's in place. You all, you all acting either as the redevelopment agency or as the council set certain milestones for him in this agreement. So you've, you've obligated yourself to allow him the time to meet those milestones. He is actually progressing towards those, ‸ toward, uh,
milestones. The city attorney and I were in a meeting last week or the week before last with a, uh, market development representative of one of the, uh, largest international hotel chains.
towards the milestones that you all have in place, uh, in the agreement. The other project, there is no agreement there, there, there, there was no progress on actually, um, um, coming to agreement between city staff and the developer. And so those are the differences there.
that he's responsible for. And all of those have due dates. Again, he's progressing towards those, uh, those milestones there. So I'm comfortable at this point in saying that project is on track per the agreements or the other benchmarks that you have laid out in those two agreements.

And I think just because the city involvement and also the council being so involved, so I appreciate the council for pushing and also city staff as well for definitely pushing out to the community. March 12th, St. Mark's was a bang. Those kids really had a really, really good time. I appreciate the staff along with the city manager for handing out water to all the students. They really appreciate you guys being out there for them. That was the one day before spring break, so they really was ready to go home. But I appreciate y'all for doing that. Saturday was another mayor challenge at the pond off of Bernard. I mean, Barbara Jenkins, sorry about

do that. That's not a day that, you know, that's a part of work. But I appreciate him for just being a part of the community, showing that he cares as well. ‸ I had a question for Tammy dealing with the questions for the chief ‸ for Monday. As we know, there's a lot of people in our community, especially in that community by around Jolie Smith Center, don't really have access to computers and have just access at all to get information to us as far as questions. So will people still be allowed to ask questions if they don't submit those questions? Also, one more question is the number of questions per person. What is that?
Yeah, we talked about it. Okay. We're also trying to one reason why we asked them to be submitted in advance because we were afraid we were going to get duplicate questions. Okay. And
and we were trying to group some things together. So if you know, if that way, we can try to group them. And then if we get so many questions, because there's two meetings,
the questions where we have some asked the second meeting. And you know, not at the first meeting, but we're as far as you're concerned with not being able to, to go online.

there may be a concern that individuals could submit multiple questions and could take up, you know, more time allotted. Um, that is something we could consider. Um, you know,

gonna, I mean, we don't, obviously, we don't want, uh, duplicate questions, but, you know, so they'll, they'll take a look at the questions. And if they, if we have, you know, same questions from five different people, obviously we're gonna ‸ only ask that once, you know, we don't want,
have walk up questions there, but. You know, it's really an opportunity hopefully for a cross section of the community to ask questions there. And so I'm hopeful that, um, we won't get 10, 15 questions from one individual and, and they'll understand that, you know, they're, it's a, we're a large community and, and, and we want everybody to come out and, and get their questions in because we really want to, we really want to put them to the test. And so, you know, again, hopefully people won't haul questions if you will. Okay.

Mr. Deputy Mayor. Go on, sir. And final conclusion, man, I'll tell you, you guys are tough to follow behind. First and foremost, ‸ I'm ‸ asking everyone to, you know, say a special prayer for the city of Boulder, Colorado, please. Colorado. I mean, they're facing some tough times there. So in your time, uh, moment of spiritual intervention, please pray for that city.

excuse me, at a funeral? You can, because you talk about the great works that they accomplished, and passing the torch on. So that's the reason why, and that was a collaboration with the, the city of Coco and the city of Rockledge.
prior to us having spring break, we had Coco High special night, social studies night. Mrs. Bunt, Mrs. Howell, and Mr. Walsh attended that event. They made some well-informative statements, um, and that was a great thing.
Okay. And I want to say thank you very much. The kids talked about it, and we really enjoyed it. And also did the staff. And last but not least, at least, please continue to collaborate and communicate with staff. Please. They're here to work with us. We work together as a team. ‸ I concur with Councilman Hearn. Listen to them.
But the conviction is based on your own vote. So please make sure you collaborate with them. And last but not least, buy local, spend local, keep it local. God bless America and all the men and women that serve and protect the United States. Chair waits for a motion to conclude.
