The City's agenda for this meeting is on file (PZ_Reg_Agenda_04_06_2022), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
291 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 19 voices separated from the audio.
25 short machine repair(s) (30 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 94.7% of 13,337 content words.
Dotted words (199 places) are ordinary wording differences: hover or tap to see the other reading.
291 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

All in favor say aye. Aye. Opposed? Okay. And then we have the minutes of the March meeting. We're short to the point again. Do we have a motion to accept?
I'm going to stand up here. Chairman has that right. I've served on the, as president for many years, more than I attended, probably six or seven years. It's not a lifetime appointment. So I'm going

I just would like to make sure everybody understands. I looked into it and I guess time does fly. I've been on this board for almost nine years. And with the ‸ new ordinance ‸ in effect, I can only serve until I have to be removed in November. So I assume that I would just, my last meeting would be in October. So I'm going to chair about five meetings. So
Mr. Chair, if I may, it's my understanding with the ordinance though, that the council does have the discretion. Of reappointing a member. Even after they've served the, um, a lot of time. If no other qualified participant. Okay. Puts in an application.

‸ Yeah, I understand, but we also have alternates that are waiting in line to get in there and we'll, I guess we'll cross that bridge when we get there.

I've been on this board for about 15 years. Uh, spent a lot of time and it's getting to where when it's time to come down here for the meeting, I'm starting to wonder why. So, uh, I, I,

While you're switching chairs, I just want to say, uh, on behalf of the planning and zoning board staff, um, my second tour here in Cocoa, this has been a very nice board to serve. And Mr. Dobrin, you've always been a very pleasant chair, and you've always done a very good job. Cindy

Um, I wasn't quite prepared. Um, I'd like to say that I'm going to do better with names because I haven't been the chair. I know I've worked with you all, so bear with me as we get through the procedural parts in case I make any mistakes. Feel free to step in if I do. Okay, so we're going to go ahead and move forward with the agenda.
were so many attachments, but somewhere in there, there was a letter from the ModWash, uh, applicant requesting tabling to your May 4th agenda. So you can, if it's appropriate, uh, request tabling on both of those items to the May 4th agenda in one motion.
However, we are not discussing that item tonight. It will be brought back to your May 4th meeting. And at that time you can discuss that or it is at the board's pleasure.

So I appreciate that. And I would like to have it, uh, read into the record and I'm willing to do that myself on this item for the car wash. So the statement that I made that I would like to present to the board is, is that the current future land use for this project is mixed use. And which would be a more desirable use for this very visible location. The commercial use of a car wash does not appear to add a long term enhancement to this location. And

that there is a community meeting, there was a community meeting that was canceled. I think that the community should be able to hear about it. And this is really a central location. I mean, how many times a week do we stop at that ‸ intersection? So ‸ I think it's definitely worth ‸ further review before allowing a car wash to go at that location.

Tonight you are here to consider the large scale site plan for the 603 Brevard Avenue property. The subject property is comprised of three parcels as you can see on the location map that you see above.

rooftop bar architecturally integrated with a multi-level parking garage in central Cocoa Village. I don't want to launch into all the details of the project just yet, but I do want to go over the evolution of the timeline of this project and kind of how this all came about to give you a little bit of history. This has been very protracted and I intend to be eloquent, but brief. ‸ So the development, there are two different types of development agreements on this property. ‸ The reason why is because this property is partially owned by the Cocoa Community Redevelopment Agency.
of 603 Brevard Avenue, tax parcels two and three. And there's a third parcel that's owned by a separate entity. The CRA acquired this property for the purposes of redevelopment under the Redevelopment Act in 1969. And

approximately an 87,000 square foot hotel, a mixed use hotel project with public access to retail space fronting down Brevard on the first floor and a parking garage. After examining the site plan, I can tell you that that is what the developer has provided us. It is a seven story hotel with 107 rooms with an eight story rooftop bar. The development agreement also says that the project at a minimum shall consist of at least 100 hotel rooms with no more than 112. As I said, it's 107 rooms with ‸ ancillary meeting space, hotel office ‸ space, a retail shop, breakfast area and lounge for the hotel, kitchen, swimming pool and a rooftop bar and lounge. The public access for the retail space, which is to be distinct from the hotel shop, consists of a minimum of 3600 square feet with pedestrian access from

onto Brevard Avenue. That is again what they provided us in their site plan. And again, in their conceptual architectures that they provided. Again, the development agreement was very, very clear to provide that the parking garage shall be incorporated into the hotel building on floors one through four. And it is, as you can see in the conceptual, there is no parking garage visible, but it is incorporated in floors one through four. 100 parking spaces in the

this. So other aspects of the building facade roof lines, color scheme, architectural features depicted on the building, which you can see again here in the conceptual, may have to be adjusted during the city's formal review and approval procedures to satisfy the requirements of city code. All elements included in the development agreement.

I know it's hard to describe, but there's some access easements that we're doing so that. There's a parking lot provided. That's open and we have an access easement in the drive aisle. We provided special things like that. There's been no detail not provided for the city to make sure that all of the infrastructure and all utilities constructed on the property.

for the site plan requirements. So those are the big heavy lifting items. The majority of these items in the development agreement have been met and satisfied with the review of the site plan that they have turned in. So the rest of the items that we have, I just want to go over a couple things with you.
a, sorry, get away from the mic. Asking for a seven, almost eight story hotel was going to require an amendment to height. And so that was something that was taken on.
were many conceptuals and renderings shown across the village with different height elevations, you know, examples. It was determined that an effective and ‸ maximum ‸ height for large scale commercial buildings in the village, particularly in this area would be able to go up to 104. But this height of this building is not going to exceed a maximum of 85 feet. And we can have the engineer confirm that for us.

Okay. Question. Another question I have on this is just, you know, when you have conference rooms and you have different parties that are using the facilities there.
yeah, sometimes you'll have a conference and you get people from, you know, somebody locally might rent it for whatever. Yeah, and I know it kind of works itself out because sometimes when those are happening, the people aren't really there. They're gone.

doing what they're supposed to do. So, and I don't even know what the occupancy level is going to be expected for this because it's never really full all the time when something like that happens. But I mean, it could, I think that's, I would think that you'd want to attract those conferences to this area so they can enjoy, you know, the downtown area of the shops and the restaurants and the bars that you do have. You know, in any downtown parking is always, you know, an issue when
to get on Christmas Day. You know, there's always going to be a peak time where you're going to have more parking. They're going to need more parking than they have. You know, obviously you have, you know, on street parking throughout the downtown. So, you know, we meet the requirement of the, of the code and what we think we need. Will there be ‸ times that we might have need more parking than we provide? It's possible.

required to be for the actual number of rooms. So the rest of that facility is pretty much open to the public to park in. ‸ It's not, you know, only those only those rooms, the number of rooms have, you know, available parking for, you know, like reserved parking because you have a room. Other than that,
drive in and park wherever they may but I think that the answer is going to be that at some point in time we'll have to have, not just for ‸ hotel I mean the city has its problem not just the hotel we need to develop some off-site parking for a lot of the places as well as the hotel.

So the first level parking, second level will be public and that'll have 100 parking spaces. From there up will be hotel and that'll be controlled by the elevators that we have for the hotel. I feel like as a resident, I have concerns about the comments that have been made about having a high rise structure in the middle of a low rise village. And at the same time, there was a lot of discourse that happened a few years ago. So I want to respect that and say that, you know, that was decided at that time. But I do have a comment about the process itself and the access to the information about the project. So I would like to read a portion of my statement pertaining to the hotel itself. So regarding the agenda item, I have been checking the city website and requesting agenda information from the city starting last Friday.
and I attached that short agenda. The city website was updated with the current agenda with the site plan and the supporting materials less than 48 hours prior to the meeting. Over 300 pages of documentation has recently been uploaded to the city website. And that's available for anybody who's listening who doesn't know that there's agenda information placed on the city website. And there are hyperlinks within that that are very helpful for the public to access the supporting documentation. There is inadequate time for public review of meeting agenda documentation prior to today's meeting. There's a substantial amount of information that was just uploaded. ‸ While the planning and zoning board stated in December, they were eager to approve this project. Backup information was not made available to the public and at the, as of this date with adequate time for review prior to today's meeting.
So I want to express that I think that the public should have more time to review all of the documentation. ‸ And I'd like to add to what my email statement was, was the answer to, well, then what might someone recommend? And this is what would have helped me. What would have helped me is if the documentation had been uploaded seven days prior.
types of alerts of alerts that could be ‸ helpful. One is, is the city does have alerts for certain topics, topical alerts, and to follow the planning and zoning. It would be nice if citizens could sign up for an alert system so that I could be alerted exactly when the information has been posted. And then the second thing that would have helped me is, is the Facebook

public to have adequate time to review the information, to reach out if we have questions. To board members or to place our comments and to be adequately prepared for the meeting.
the documentation itself for that reason. So my statement pertains to the encouragement that materials are made are provided in advance of the meeting. Well, in advance of the meeting, and that I feel it's premature to approve it with that reasonable request for public accommodation.
I'm not disagreeing with the speaker here tonight. There was actually 388 pages, but five of them were four pages or less. So two of them were duplicates. One was the conceptual plan and then there was the revised conceptual plan. And then there was an 88 page traffic study, which was very detailed and very lengthy. So I don't know how much of the public would have the interest to sit there and read through an 88 page study done on traffic for this particular project.

Caribbean. I can tell you my experience of surviving because when I came here, it was it was pretty sad. I lived in the village. I've been living in the village for. As long as I've had my business here, which is 40 years. And there was a time that I can go back and tell you about the prostitution and the drugs and all of that. We've come a long way. I've invested my money and ‸ my hard work in this downtown. I've established a clientele. I'm shaking because I care about the downtown. That lot is where our old city hall used to stand. And I am all for development, but it is going to be a skyscraper in a tiny little village. You're going to little by little chisel it away so it's just like any other place. Do you want to be like just any other place or do you want to be unique? Do you want to make people stop here and and buy here and live here? Well, you're going to attract a transient base of people. And I was in tourism. I was a social director for cruise ships. So I know a little bit about tourism as well as running a business for 40 years.

I live in a historical home that was built in 1920 by ‸ one of the founders of Coco. And it was the Ford family. You know, you say you're giving us parking. Are you? We have 80 spaces. You're giving us how many more? And is there going to be security? And what about the garbage and the dumpsters and the crime that goes on when there's not security in a parking garage at night? You need security right now in the village. There was vandalism outside my store two weeks ago. There's been crime that you don't hear about. I live here. I walk those those cobblestone streets and I love it here. And I have cared and taken care of the properties that I've owned in this village. And I know you all think that this is the right way to go, but you could do a four story building there and make it a five star. If you have the vision. I don't want to be a Walmart.

I have customers from all over this country that come to me year after year after year because I am providing a service and a product that they can't get anywhere else. So it takes me a lot to come up because it's upsetting to me that people do not have the vision to see what a charming, beautiful downtown we have. I care about what happens down here. I want growth. I want people to be able to work, live and be prosperous. These people aren't going to be living in this village like me and all my neighbors. downtown? Think about it long and hard, really and truly. What are we gaining? How many parking spaces are we gaining? Biggest complaint every single day from my customers? There's no parking. When are we as a community going to to address that ‸ there's no parking in this downtown? We're going to allow a hotel before a parking garage and I will probably be dead and gone. It's not broke. We're making it better. Now, some of the statements that we don't need a skyscraper. I don't know where they're getting a skyscraper from.
Does the public know the height of this building? We're talking a floor or two more than the hotel. ‸ Seriously, think about it. The tallest structure we have is a condominium on the water. I think it's 12 stories. So it's not a skyscraper. And if you saw the elevation views, it is tiered like a wedding cake. It's not one big wall going up. It's been tiered to cut down. There's the picture. It's been tiered to cut down on that image when you walk through here. The other thing that we have to our advantage is the oak trees. And the oak trees, you don't really notice the hotel until you're almost on it. And that's another thing I wanted to bring up. I'm showing my age now. I was the only one on the board to see about a steering committee for the downtown Cocoa Village area to see if we could have it recognized as a blighted area because of the things I mentioned a few seconds ago. And because
the council at the time, I was asked to go and make the request and presentation to the Brevard County commissioners and we did. So that's when we created the downtown Cocoa Village CRA group because this was the area designated as blighted area. What that meant was and we had no idea that it was going to be as successful as it became.
built the percentage of taxes since we got approved for that your property taxes did not go any longer to the Brevard County commission Brevard County.
Those taxes now stayed with us to help put in lighting landscaping to helping enhance people to come here. And that's about the time where a lot of people started coming in here to open their businesses. One of them I remember vividly was the Bath College with Jan Stewart who's passed away by now since then. But the thing is is that she was one of the first people that moved from the mall and decided to locate in the village. So my point is the the questions and the concerns that are being brought up now. It's a little late. It's already been discussed.

We do have codes for noise if it's too loud or things like that. I mean, this is not going to be something that's going to hurt the downtown area is going to enhance it. at 430 Brevard where the old bank building is now. And I was very shaken up by that proposal. I'm a recent resident here, but I've been coming here visiting family for years. And I've been enchanted by the small town historic feel of the village. My friends come and visit and they say, and I'm, by the way, I was 40 years on Cape Cod. I'm no stranger to villages. And
is like Cape Cod. Cape Cod has height restrictions. Cape Cod has very tight zoning within ‸ its villages. If things want to be built, they're built outside the villages. those small villages started disappearing. And the very reason that people are drawn here is, in my opinion, needs to stay intact in some vision, as was said earlier, some vision of a future that says, okay, well, we're going to move the line in the sand and we're going to allow a seven story hotel, which again, I'm not opposed to. But where do we stop? But where
does that line in the sand ‸ stop? And we say, that's enough. We're destroying ourselves. We're destroying the very reason that tourists want to come here and want to remain here and also want to give up

I don't like to do this, because most people think I talk too much. But I can't really sit by and not respond to a few of these things. So anyway, my name is Jack Brown, by the way, and I'm the developer of the hotel. Some of the things that have been said are very, very correct. First of all, there are some languages in the lodging industry that most of you probably aren't familiar with and probably don't care about, but they have something to do with the overall industry and maybe a couple of things that you might like to know. But first of all, a comment was made that this is a high rise and it is not a high rise. Today, if you go to build a hotel and you go to a franchisor, you ask them about what you want to build, whatever it is, and if you want it to be franchised, which nobody wants to build an unfranchised hotel unless they're crazy, you can't build a hotel that's not four stories because that's their prototype. So you're at four stories and going up. So at the very least, we are no more than a mid-rise. And that's stretching it. High rises start like 20, 30 stories and go up to 100 and some stories. So we're not even talking about high rise hotels here. I consider us being on the periphery and not even in the village. So I don't see what we are damaging in the way of the beautiful downtown area, which I think is beautiful too. I'm here. I mean, I love it here. My wife is crazy about it. Actually,
That building is not a massive square hunk of a building. That is a boutique hotel that the city wanted. We went out of our way to make it the way that they wanted it.
to build where the old bank is, but that's not what we're building. We're protecting like Alex said. He's absolutely right. He was right on today. We're saving the trees. We're redoing the roads. You know, first they were going to make them one way streets. Then they came back and wanted to make them two way streets. So we made them two way streets again. That means move the building back a little bit and encroach on the back lot that we're going to use later on, hopefully for an expansion of the hotel or some mixed juice, at least into the hotel. ‸ But anyway, I wanted to add a few things that I thought were important. And one last thing that nobody seems to care about and some of these people that have shops and things, we're going to add to this community, someone in
I don't understand why all these shops close at five o'clock. They're not open on Monday. They're not open on Tuesday. And I keep hearing people say that these guys are struggling with their shops. ‸ I would think they'd be wanting to love me up.

in the eye of the beholder. I personally reviewed all the documents. I felt that I had adequate time. You know, your mileage may vary, but adequate is not a fixed thing. So that's subject to discussion. But I would

That's not what we're here to talk about. It's a very good discussion, but it's not appropriate for hearing for tonight. So I'll just be presumptuous and I will remind the board that the reason we're here tonight is for you to review the submission that was made in accordance with the developer's agreement

determine whether the submission is sufficient. Nothing else. That's the only question that's before you tonight. So I urge you to ignore the distractions and focus on whether the presentation that was made tells you that the submission is sufficient under the rules that were set forth.

No. Okay. I just have one basic question as a business owner here in the village and I agree. One of the things that I have adored about this village and that drew us here to purchase a business and start running it just over three

make our community vibrant. So it may not necessarily have anything to do with what's being weighed on and decided upon this evening. But my hope is that the developers are understanding of the nature of our village from a retail perspective. And I asked the same question at the other meeting about the other building that's not part of tonight. But my only concern is please God don't bring in Walmart or

And my only complaint is it's not big enough. So I wanted to see kind of a grand hotel. And this ‸ will do. This is good. But I'm excited for the development. ‸ I think it's going to revitalize the south end of the Cocoa Village area. I'll keep my comments brief. But I'm all for it as a business owner. And I know a lot of businesses are. So thank you very much.

of people just like that last speaker that came up that have retail businesses in the downtown area that just was so excited that this is going to bring prosperity to their business. So I'm hoping that's what's going to happen here as well. ‸ I believe it will. And it is at that southwest corner of the village. So I hope everybody's looking towards the water. So this won't get in their way as far as the visual, but it will bring, I think, nothing but good, good things for the village. So I don't really want to dispute what anybody else said. I just think it's a good thing for the city. And what the last ‸ gentleman said, I think that we've met all the technical requirements of what we're talking about today too,

ratio of 2.5 that cannot be exceeded in this area due to the zoning classification, its location of it being in the central business district and the location of the property I'm sorry. which instead of the calculation for floor error ratio reading as 1.74 is actually 1.79 this is still consistent with the mixed use land policy land use policies it doesn't change anything about the application I just wanted to correct that for the record also we were talking about retail space I just wanted to let everybody know that the retail space on the site plan the total retail space which is fronting on Brevard Avenue which is required as part ‸ of the development agreement I'm not sure if anyone had the ability or took the time to do a total

areas uh clean, uh signs. uh Is it going to be clear that they're public parking or hotel parking? Are we concerned about whether or not um someone is going to park their car and then go on a cruise? um
is responsible for maintaining the public parking. And we, the city, have reserved the ability to maintain signage and to make sure that that is very, very clear. So that is reserved in‸ development agreement, probably very late in ‸ development agreement language probably it's in there

one is, is I also share, um the fact that this hotel is definitely going to be a change. Do I know whether it's going to be a positive or negative change? I can't see the future.
