Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
560 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 36 voices separated from the audio.
57 short machine repair(s) (70 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 92.0% of 21,392 content words.
Dotted words (450 places) are ordinary wording differences: hover or tap to see the other reading.
560 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

We pray for every leader. We pray for their influence. We pray for the citizenship of this great town. We pray, Father, that as we lead them and guide them, you would give us the wisdom that comes from ‸ above. We ask that we would always have the best interest of our citizens in mind. And may we continue to improve this city. That it might be a shining light here on the Space Coast, in the state of Florida, and even around the world. So we're thankful tonight for the opportunity to lead in humility. And we pray for your guidance. And you would be praised. We ask all this in your sovereign and powerful name. Amen.
Amen. ‸ Mr. Stoll, would you lead us in the pledge, sir? I pledge allegiance to the flag of the United States of America and to the republic for which it stands.

Chair's going to call the question. All in favor by saying aye. Aye. Any nays? Aye's have it ‸ unanimously. Proceeding on to awards and presentations. The Water Conservation Month in Florida. Okay. I would like to read this into the minutes, please. Whereas, water is a basic and essential need of every living creature. The State of Florida Water Management Districts and the City of Cocoa are working together to increase awareness about the importance of water conservation. City of Cocoa and the State of Florida have designated April typically a dry month when water demands are most acute. Florida's Water Conservation Month to educate citizens about how they can help save Florida's precious water resources. Every business, industry, school, and citizens can make a difference when it comes to conserving ‸ water. Every business, industry, school, and citizens can save water. Thus, promoting a healthy economy and community. Aye. Therefore, yours truly, Michael C. Blake, on behalf

is a vital part of heritage since the first call to prayer in 1775 when the Continental Congress asked the colonies to pray for wisdom, informing a nation that the call to prayer has continued through our history. The National Day of Prayer has great significance for us as a nation as it enables us to recall and teach the way in which our founding fathers sought the wisdom of God when faced with critical decisions for us to humbly come before God, seeking His guidance for our leaders and His grace upon us as a people. The National Day of Prayer belongs to all Americans. It is a day that transcends differences, bringing together citizens from all backgrounds. Now therefore, I, Michael C. Blake, on behalf of the City

Chapter of the National Action Network. I'm here tonight to talk again about police reform. And before I begin, I would like to bring the city's attention and the city manager's attention to the statute 112.533.
the power to investigate and review citizen complaints about the police department. This gives the board teeth to get accountability. Investigators applaud the allows an advisory board to conduct their own investigation because the community has lost confidence in police investigating themselves.
advisory board passed into the city of Cocoa. The duty of an advisory board is to serve as a liaison between the police department and the communities. As defined in resolution ‸ 2018.097, advisory board cannot play a role in civil or criminal litigation. Advisory board ‸ should be open to the public, not the police. It was very distasteful and disgusting and disrespectful. The last advisory board meeting,
advisory board investigative power. Before I came down with COVID, I had a meeting with the city manager. So as of right now, Mr. Whitten, I'd like to know, have you given the police advisory board investigative power to investigate their own cases, not closed cases?
want me to answer that? ‸ Yes. I don't think I, as the city manager, have the power to give that board investigative powers. I don't think that I, as the city manager, have the authority to give that board investigative powers.
Well, we've been talking about this now for about five months. And it's clearly stated in Florida statute 112.533 that every law enforcement agency should have an established system set up. And when an advisory board does handling closed cases where the Cocoa police is withholding evidence, withholding videos, that won't fly. The only way this, a police advisory board can have teeth is

And I just was thinking about a solution. Maybe we can cut some of the limbs from the trees, because that's where they're getting the shade, the rest, you know, hanging out over there. So I do have pictures that I took of the property and I would like to give them to the mayor and also to our district council, Alex Goins. So could you all please consider? I know Mayor Blake and Councilman Goins, I know you all ride that area a lot. So take a look and see what's going on. You all know. Yes, ma'am. So I have the photos.

I know that. I've been there as well as many other council members on multiple occasions about her concerns and other concerns. And we've addressed them and we will address them. Okay, next, Mrs. Joe Shim.
Good evening, Joe Shim, [address] So I'm going to lighten the atmosphere, I hope. I've got something that's fun. So I was very honored last Saturday to be at the Mayor's Fitness Challenge Awards Ceremony with Mayor Blake, who was one of only three mayors who attended. And we got this beautiful certificate for our participation this year in the Mayor's Fitness Challenge. So congratulations to everybody who participated. And ‸ we completed the team,
during the seven weeks that the challenge took place. The team was commended for having the largest total number of participants on the Facebook group. And
which he wore to the event. So thank you to everybody for working to support the Mayor's Fitness Challenge this year. We improved both in the number of participants, almost 200 signed up, and also the number of minutes exercised. Thank you to everyone on the Sustainability Board for getting behind this effort and for helping to promote it. Also, thanks

Finally, thank you to all the participants. It was fun meeting new people. I heard some really good conversations about city issues. And I think that many of us discovered new routes and new places to walk in the city. Most of all, it got us moving and we had fun. It was a very positive thing for the city. And until next year, go Team Coco.

Hi, Jennifer Kenny, [address], Cocoa, Florida. And thank you, Mayor. You do know me as Jenny, so that's okay. ‸ So I just wanted to come tonight and thank the Council for the appointment to the Sustainability Advisory Board. I'm just delighted. And I apologize that I wasn't here for the meeting last month. I actually had to work. The other thing I just wanted to say, because I did watch the, you know, the review on television later, and I did notice

Jennifer Riggs, [address] Thank you. It's nice to see all of you. I have another light and fun and positive thing for our future and our history. On the 24th ‸ of April, the Brevard Heritage Council will be hosting a historic walk through Cocoa Village. And that's from 10 to 2 starting every half hour. I just wanted to fill you in on some activities that I've been involved with lately for the city of Cocoa. This is the Cocoa Conservation Area. Mr. Blake, you'll remember you were mayor when we dedicated this back in January 2011. So, we are at the 10-year anniversary. For those of you who don't know, the Cocoa Conservation Area is located on a sand hill ridge with a picnic pavilion and restrooms.

They've been taking out some Brazilian peppers. Matt and Brian have been very tolerant of my requests. And also, interim police chief, I want to thank Officer Terrell. We did have an incident up there recently. And it really is amazing how close you can be to danger and not even know it. We were about 10 yards away from a person who was apprehended that had a warrant on their arrest. And we didn't even know it until after she left. And then ‸ your team responded very well. Thank you.

And they are also looking to add this as a field trip in the fall. So, Mr. Blake, Mayor Blake, this is giving us some great visibility outside of the community and improving our image. My second idea is that we investigate and try to get a farmer's market as part of the USDA program, fresh from Florida, fresh access bucks, feeding Florida. It's a USDA program that doubles food stamps at a farmer's market. ‸ Titusville has one of these markets.

your food stamps at a farmer's market, you have to drive 40 minutes to get to one to double your food stamps. What this does is provide essentially free organic produce to people who are shopping at the farmer's market.
you hand them in, they give you $80 worth of stuff to spend at the farmer's market. 40 of that must be vegetables and fruits. So, it approves the diets of everybody who uses it. It's a fantastic program. It helps the poor. We need it here in Cocoa. Titusville's got it.

So, I wanted to bring both of those ideas to you. And I also want to, just on a personal note, thank the fire department for coming to our street a couple of times recently. I happen to live on Pyromaniac Drive, otherwise known as South Lakemont Drive in Cocoa. And all my neighbors seem to be very fond of fire. So, thank you to the fire department for coming. know there was a couple of letters that were received that are in the agenda package. ‸ This ordinance just changed the sub paragraph F under the board ordinance expressly states that when when provisions of Florida statutes preempt the local board ordinance, the statutes prevail and apply. So term limits with respect to the pension boards. Right. You know, they're not affected by this by this ordinance because they have statutory terms and that is set forth in the Florida statutes. Mayor.

pointed out, there were two letters attached to the agenda today. One was from the police pension fund trustees, the other from the employee pension fund. Police is under Florida statute 185. Both of those letters pretty much laid out the same ideas that term limits would not be in the best interest of conducting business on those boards, or therefore in the best interest of the city. My interest is code enforcement. Since I've spent so much time there, I understand it pretty well. And I would ask at the outset that you reconsider the passage of this ordinance or exempt the board from the ruling. Term limits, as I just said, wouldn't be in the best interest of our getting things done on the code enforcement board, and therefore not in the best interest of the city. Historically, it's been very difficult to attract and retain members on the code enforcement board. Just since 2017, the board has lost four members. Currently, there are two open positions. If this ordinance were to pass, it would result in three members of the board, current board, being term limited out, including me, obviously.
here. I think it's in the best interest of the city to have the code enforcement board exempt from this ruling, should it pass. And I would also point out that the code board is operated under Florida statute 162, which also defines the ‸ way in which members are appointed and the term in which they serve.
as I said, code enforcement has two open positions right now. So I would ask that you reconsider the passage of this ordinance, or as a minimum, exempt code enforcement at least that one, if not others, as it would be in the best interest of the

I really feel that this is something that should not be looked on lightly. The only part that I didn't really say a lot when it was first read is I heard that the Council can override the term limits if I understand that ‸ properly. I hear that. But there are other aspects of this subject that I've always thought wasn't fair from the time I was on the Council.
on one of the boards, they should be asked to step down immediately. I feel that that's important so there's no nepotism going on. The other thing is alternates. Alternates are created for vacancies that occur. You really, if you're going to step over alternates, then you should not have alternates. Now, it's true, some people have a lot of experience and all that by going to college about a subject. That might be impressive. But again, back to the knowledge and the long-term background of

Those are other issues that we can address later. I don't want to take any more time. But I really feel, I strongly feel, it's ‸ sort of insulting to the people that have been there for multi-years. I'm sorry. This is not fair. He's one example.

That's why I made the amendment to her motion to include we have the discretion, which we do now. We reappoint. That's what we do. So you said it yourself. We have two open positions on code enforcement. So quite naturally, you would not be off the board. You would be reappointed back on the board. So you won't be going anywhere unless you choose to leave the board. So that's what the ordinance reads. You would not be forced out if we have open seats available. It won't happen. The council

be a part of these boards. That's the goal. We love that people are there 30, 40 years ‸ because of that reason, because people just didn't want to be on the board. Some people think it's boring. Some people think they just don't care about city government. But now we have a citizen academy, right, that is encouraging people to learn about government. So you would not be going anywhere at all unless we have 20 people or five people knocking on the door trying to get on code enforcement, and we know that's not happening. So thank you.
But why have the law when you know you don't need it when you have people that want to join? Because I know for a fact, and I'm going to proceed, but I know for a fact several people I've asked to join the code board.
The slots are filled. I think another council member had other individuals to submit an application. I mean, why have it on record when you're asking people to come and volunteer? That's all I'm saying. That's the perception I proceeded as being.
So now we have the option. Say this year there's someone on the code enforcement board that their term is up. I don't know who that may be. It may be somebody. So Mr. Thomas, he puts his application in. Then we have the vote on who replaces that person who term is up. That's the goal of it. But for that reason, right, we want Mr. Thomas to be on a board.
Right. But what I'm saying is why have the law when you want to invite people to come? It's like telling them you shouldn't come. Exactly. That's the perception. ‸ That's all I'm saying. Yeah,

And so to answer the why have the law, let me just say that you have the opportunity to increase civic engagement. We've generated a whole group of people and continue to do so through the success of our Citizen Academy. And when they step up, they've spent the time, they've researched, they've done the classes, they've learned the back story on the city and some of the departments and understand it better to be a stronger collaborator. And they're ready to step up.
Now, we just started advertising positions when they come available. We weren't doing that before. They were automatically coming to council. And then as a council member, you basically feel a lot of pressure to reappoint someone, to reappoint whoever's put in front of you. And not to say because we have some great volunteers.
different way as volunteers. It's not as staff. ‸ And I have a feeling that our boards don't get as much appreciation. Our volunteer leaders don't get as much appreciation as we would like to give them, and they deserve. And I'm hoping that whatever we do, whatever motion is made here, I want ‸ that to be a part of it, that staff come back to us ‸ to look at how to enhance that volunteer appreciation. But again, the reason I brought this forward is to increase civic engagement,

they are subject to Chapter 162 Florida statutes. The statute does provide certain requirements for code enforcement board members in terms. However, in my opinion, I've always had this

to that statutory board, is not preempted from adding a term limit requirement or some other requirements, because the statute allows the city council to adopt supplemental code enforcement ‸ procedures. And, you know, I consider this as part of that. This ‸ would be added to the ordinance. But, you
the code enforcement board is a very special board. It has, it's the ‸ only board the city has that actually imposes fines. I mean, they adjudicate cases, and certain types of experience are very important for that board.

you know, we have, I would hope that we have the good sense to make sure that we keep people with the experience, and, you know, with the depth of character, and, and interest on that board, you know, to make fair decisions. That is an important board. Um, but I am still supportive because we do have the option, and this does open it up to be more dynamic, to make our advisory boards more dynamic, and encourage the civic engagement, so.

sir. That's not, those types of delegated duties are not quasi-judicial, but they just have that site plan ‸ approval, ‸ which is quasi-judicial. The Board of Adjustment, likewise, ‸ has quasi-judicial authority, too, if you were going to ask about the Board of Adjustment quasi-judicial capacity.

I will try to be brief, but I do want to point out some of the significant elements that go into an audit of the city's financial statements. There are several required communications that we're required to make under our professional standards, so I just want to hit those real briefly. The responsibilities that we have as the auditors for the city's financial statements is to report under generally accepted audit standards, which are promulgated by the American Institute of CPAs as well as the Government Accountability Office at the federal level and then at the state level, the Florida Auditor General. And then management's responsibilities, ‸ finance director, city manager, are responsible for the actual financial statements themselves. Our responsibility is to report on those numbers as to whether they are in accordance with generally accepted accounting principles. We also

That's required by Florida statute as well as the federal government as it relates to the Government Accountability Office. I'm pleased to report as it relates to significant matters there were no issues noted in our audit that would be of concern as it relates to internal controls and compliance.
‸ We also received representations from management as it relates to providing us with all information that we requested. There was accepting responsibility again for the financial statements.
department and city staff to complete the audit timely with everything that occurred in 2020 as it relates to the pandemic and its impact on the audit schedule.
briefly our reports, which are in the document. Our first one being a report on the financial statements, and that was an unmodified opinion that we issued, which is a clean opinion that the financial numbers are presented in accordance with generally accepted accounting. accounting principles
you'll find the compliance related reports. The first one being our report on internal controls over financial reporting and on compliance and other matters. And while we don't issue an opinion on internal controls, we do consider the impact of internal controls on the city's financial reporting processes. That involves ‸ significant testing of transactions, as well as looking at bank reconciliations, making sure those are performed timely and accurately. And I'm pleased to report, again, that there were no significant deficiencies or material weaknesses ‸ noted. We did have a finding back in 2018 related to cash, and ‸ that's obviously an area that we look at for corrective action as we move forward.
relates to the completion of bank reconciliations for fiscal year 20. There's also two reports required by the Florida Auditor General, the management letter, as well as the independent accounts report related to investment compliance.
And then for this year, there was a federal single audit required, which resulted in us testing a specific federal program, which was the loan guarantee program. And there we look at compliance as well as internal controls over compliance. And ‸ again, there were no findings to report as the city passed that test with flying colors. Financial highlights. Just briefly want to touch on this. The governmental activities had an improvement. This is looking at the long-term assets and long-term liabilities of the city. So you'll see a positive change in that position of $2.7 million. That was primarily in the net investment in capital assets category of the net position where the city invested in its infrastructure. Business-type activities still has a very healthy net position, as well as a positive change in net position of $14.7 million. A significant portion of that is restricted related to the utility activities. But $8.3 million remained in unrestricted net position at the end of the year.
have on hand in a given year. And then from a budget performance perspective, you can see here, again, the net change in fund balance was a positive $1.8 million. And the city was able to recognize $1 million in revenues over projection, as well as had some cost savings on the expenditure side, due primarily to vacant positions in the budget process. There was $3.1 million in savings on the expenditure side, resulting in a $4.1 million favorable budget variance for fiscal year 20. And just the last slide here, the water and sewer fund,

primary utility fund for the city, again, a positive operating income, consistent with 2019 operations, but a ‸ healthy position at the end of the year. So with that, I do want to express my appreciation to Rebecca and her ‸ team, as well as the entire city staff, for the cooperation we received and the hard work that goes into preparing such a lengthy and detailed document. So with that, I'll be glad to entertain any questions you may have.
want to say thank you for a detailed and concise presentation, certain reference of us being physical sound. Sure. I commend you, Madam, Financial Director,

Yes, this is the establishment of the Roadside Memorial Marker Program. It's similar to what the county and state have with the ‸ white markers that would go within the city right away related to vehicle, pedestrian, or bicycle accidents on our roadways. So we have an application included within this. It's a pretty straightforward process that comes through our department and we'll install ‸ the sign ‸ in the specified location.
Thank you, Mr. Smith, sir. I have three cards with the blessings of council. I would like for us to hear from the audience, please, ma'am, please, sir. Our first

There was nothing that was given to benefit the family. So it's been very difficult for us. We would like to have something there as a reminder to other people to please be careful. It affected our family, but it affected so many more people than that. And then in January of this year, my daughter was killed in a motorcycle accident in Cocoa on 520. And because it was a state road, I was able to have a FDOT memorial road marker placed there. And we also have a cross up there in her memory. I wanted to bring my grandson Connor with me today. His mom was Amber, and he loves to talk about his mom, but because it was so late in the agenda, I had to have somebody watch him. I don't think he would have sat for two hours, but he is, you know, he's her legacy. And he prays for his mom

tonight. So just provide us a little bit more clarity on are we waiting until June ‸ have some sort of official event on site or? Yeah, I know we're going to approve it now, but the, the ceremony, give me some details on that or a thought process on that because we're going to, you're going to approve it tonight. We're going to do press releases on it.
to be so confusing. Let me amend my amendment and just say that, um, when we do the press release, if we mentioned that they, the inspiration or what triggered this is, was the passing of last year. I'm sure the family, when we put up the marker, we'll have some sort of special, uh, commemoration on their own. And I would like to be invited.
Okay. ‸ Okay. We digress. One, we will have a marker there. Two, at the ceremony, ceremonial dedication, you would like to be in attendance. Is that what I'm understanding correctly? In June.

Three, henceforth, God forbid, any other incidents like this that comes after that, will we do a ceremonial for them to as well? That's what I'm asking.
sir? Yes, sir. And just let, let me, let me also be clear. So, um, you submit an application, the family submits an application, the application is ultimately approved.
Public Works will, uh, have the marker created and then Public Works will actually install the marker. So, there's an opportunity for, uh, each family to have an event, a ceremony as we're installing the marker. So, so I, I was probably less than clear on that.

Yes, sir. I did have a report today, tonight. Two items. One, just wanted to report that the Dial water plant had converted its treatment process back to the chloramines, which is our traditional process over the weekend on Saturday. So the normal water has been before it's been going out since Saturday.
So we're, you know, within the next few days, we should be sort of back to where we were. So that's the first item. The second item is that we we had a notice of violation that we posted on our website. I think it went up today or yesterday. It was for a contaminant. It's an organic, a synthetic organic contaminant that is required to be tested for that we missed the test on. So we didn't violate any standard. We just didn't do enough testing. We missed an individual test. We were notified by DEP. Went ahead and made the test. Test came up, you know, with no, nothing to report.

pretty much anything. They're required to report it to the public. So there are notices that have gone out in the bills over the last couple of weeks started going into the cycle. We posted it on the website and we're also required to put it in the newspaper. That's still a requirement for DEP. And so it will be posted on the 15th, which will be the day after tomorrow. But ‸ again, to kind of emphasize, the water was always safe to drink. There was nothing found in the water. We just missed doing the test. And so they require us to notify the public that we didn't follow those guidelines. And so and I'm here to answer any questions you may have on that.
That's right. Thank you, sir. Long live the army. Anyone else on that side of the room? Saying that on this side, yes, vaccine man and Mr. Police. Anyone? Maybe

here in the last couple of months. It's sad to report that Florida is number four in the top states in the United States with a number of variance cases within the state. Within the United States. So, we're continuing to ‸ still battle that and look for solutions and follow CDC guidance and recommendations on how to protect our community. But more importantly, how to protect our employees to ensure

healthy and safe workforce. So, um, one of the ways that we did that was Brevard County and finally started getting some more vaccinations. Uh, I was proud to say last Friday we opened up and started giving vaccinations are giving vaccinations to our city ‸ employees. Uh, in six hours we gave over 100 vaccines to city employees within the city that were still waiting to get vaccinated. So, we'll do round two of that starting May 7th for the Moderna vaccination.
So, that's kind of where we're at. Uh, if you look at the latest CDC reports and the Florida Department of Health reports, we're starting to see an uptick in our younger population. And we certainly saw an uptick during spring break. Spring
group. So, it's certainly, uh, something to be concerned with. And I think we're still continuing to go on the right path by the mask ordinance. I know everybody's getting tired of it. If you really think about it, our EOC, the city's EOC has been at a level two for a little over 396 days. So, uh,
But I think we're headed in the right direction to continue to keep our city healthy, our citizens healthy, and most importantly, our workforce healthy. So, thank you.

I haven't read it closely, but I've read enough to know there's a lot of wisdom in this. And I'm wondering, um, in fact, I'd like to make a motion that, um, if staff could come back and just review and then present the, the, at least the, um, the big points, the overall picture of this plan.
this plan. And I just want to make sure that we're still following, uh, the, the goals and objectives of it. So I'd like to make a motion and ask for a second.

And as everyone knows last year, uh, we became certified again as a tree city USA. And that's an opportunity to not only toot our own horn that we have this beautiful canopy, but also to educate our residents about trees and all the positive things that they do for us. Now we've missed it this year. We, you know, we weren't really planning anything because of the COVID, but that came up in

and they suggested a motion with a campaign with two goals, which one would be to, uh, well, to promote the fact that we have become a tree city USA, and two, to educate our citizens on the value of trees. And I would say that there are really five, keeping it simple, there are really five specifics. And one is that trees absorb stormwater. Um,

more of a homeless issue. In fact, I haven't seen the homeless issue in the same way. And I think, I really hope it's time that we can go back and start using that pavilion again by having some picnic tables there. And especially since we're looking at that pier and thinking about fishing, there's just a lot of opportunities there for our citizens. So, um, I'd like to make a motion that staff, um, look at bringing those picnic tables back. Um, perhaps some signage that would, um, ask people to call leisure services to reserve the area, um, so that it can be made available to the public again.
