Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
274 suspect passage(s) marked in place; inspection incomplete: language review; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 22 voices separated from the audio.
16 short machine repair(s) (21 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 94.6% of 12,027 content words.
Dotted words (198 places) are ordinary wording differences: hover or tap to see the other reading.
274 passages (20% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
00:15:49 (7 s) — neither reading has words
01:33:38 (10 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
I have one thing to say before we start. That this board is a quasi-judicial entity. And anyone who is in attendance, when they come up to the podium, will have to be sworn in. So that means that our reporting secretary will swear you in when you come up and speak. So we'll have that on record.

of the City of Cocoa Code to allow for a self-service storage facility used in the General Commercial Zoning District. The current land use is vacant land. It has 11.35 acres. The current land is general commercial with a future land use of commercial. The general commercial allows for self-service storage with special exception. We have a slide here showing what the proposed storage will look like. What is highlighted in yellow is the landscaping buffer around the building and the surrounding area. And what you see highlighted in red is the fenced area around the pond. This is the elevation of what it would look like. This is the location of where it is along State Road 524 and Friday Road. Recommendation. Staff recommends approval of the special exception in accordance with Appendix A, Zoning Article 11, Section 12,

one minor question. At the end of the presentation, they were saying that there possibly might be some changes with the county and other governmental entities.
Not back to Board of Adjustments, but staff could clarify that. Any minor changes would be only related to requirements by water management or county requirements at the site and would be very minor.
more question. Are there any items that you're seeking approval of this project, but it's only a blanket approval. There aren't any violations of our city code that you're seeking. Is that correct? That
We probably would be good to limit our input from those in attendance to that. That we're not trying to prove something that's not allowed in ‸ city code.
I strongly oppose the approval of the special exception to allow for a self-storage facility. In an analysis of 359 zip codes in the central Florida area, the placement of storage facilities

communities leads to statistically significant increases in total ‸ crime, personal crime, property crime, and motor vehicle theft. This facility would also reduce the median home value and population growth rates.
the expected change in key community and economic health indicators. If this request is approved, if approved, the addition of the storage facility in our community will likely result in additional policing costs to mitigate the increases in crime associated with
the communities they're sited in. So, according to the 359 zip codes that I analyzed, we can expect the median home value in our community to drop by $3,000. So, if you multiply this drop by the 10,110 homes and condos in our zip code, that is

zip codes that I analyzed, we can expect the total crime index to increase by 1.59 points. For every one storage facility, we can expect the personal crime index to increase by 2.26 points. For every one storage facility,
can expect the motor vehicle index or motor vehicle theft index to increase by 1.39 points. For every one storage facility, we can expect the burglary index to increase by 1.59 points. For every one storage facility,
crime index to increase by 1.47 points. So, for every one storage facility, as I said before, the median home value will decrease by $3,075. That is a 2% loss in median home value for all homes in 32926 zip code.

the median home value, the $3,000 that I cited earlier, that is a reduction of 2%. And for the annual population growth, it is a reduction of 5%. So we should be doing things in our community that deters crime and increases overall health and wellness in our community.

the board I want to make sure that you have the opportunity to actually read it. But I was also going to say that as a reminder when we're making our quasi-judicial decisions we have to base that on competent and substantial evidence. That means that you would have to perhaps look at the qualifications of the person that's providing the information. If it's discussing things like property values, things like that, you would have to have an expert testify as to those types of statements.
Okay. So all of those sources are from publicly available data. And so, I mean, I would be happy to provide any additional material needed. I mean, in terms of my credential, I'm an assistant professor at Embry-Riddle Aeronautical University. I have a PhD from Northeastern University.
Flag: words were replaced by a machine repair · 00:21:07–00:21:08 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
relates to what you prepared. I think that would be helpful. Okay. ‸ Well, I, like I said, I have a PhD from Northeastern University in Boston, Massachusetts. My areas of specialty are public policy and international relations. My subject matter expertise is in community resilience. And so I have more than 12 peer reviewed publications published just in the last two years alone on subjects of community health and resilience.
So it has the total number of zip codes included in the analysis and the map has the actual geographies included. So I would be happy to provide a supplement of all of the zip codes included, including the data that ‸ was also included in the analysis.
All the zip codes were pulled based on the ‸ actual zip code polygons reported. So just like you would look at census data that's often reported in census tracts, ‸ these are zip codes that are reported in the polygons, like in ArcGIS, that just represent the zip code itself.
So when you pull a zip code, let's just say you pull 32953. I'm picking on a zip code. Just threw it out of hat, people. So when you pulled that zip code, you pulled that zip code and you associated the crime rate with the
So if you look at a zip code, like my hand, for example, and then there are three different sites on that zip code, then the software I use ArcGIS Pro, I use the sum function to summarize within that zip code, which then calculated three, if we're using the example of three dots within that zip code.
the population growth, that was all reported from Esri business analyst. And then that was reported at the zip code level. So it was spatially joined with the zip code data that I had.
The statistical models that I used included in the printed document that I provided shows there is a statistically significant association between the two. And that there is a 0.005 chance or lower that they are statistically significantly associated with one another. So all of the statistical models that were used and the findings are all based on standard high levels of ‸ statistical practice and methods.
values? I guess I'm trying to understand, because I know of areas that have had storage facilities in and I mean, we've had, you know, some pretty rapid growth and media. And, you know, I mean, how are they, what year were they determining this and how are they, were they doing a certain mile radius of that facility would then drop their property value?
all of the data that's reported is at the zip code level. So again, like imagine, you know, my hand being a zip code geography and there are three homes in that geography. It takes the three different values and then calculates the median between those three values. And so this data was from 2021.
Are we beholden to this fact that we have to wait for the applicant to hear all of the speakers? Or can we get a couple of answers from the applicant based off of what we just heard from Dr. Tan? Okay. Okay.
I would like to wrap this up and I would ask our board if anyone wants to make a motion that you are considered to be an expert witness in the field. If we have no motion, then we should take your information provided to us with a grain of salt.

I mean, what I'm saying is that in an analysis of 359 zip codes in the central Florida area, there are statistically significant associations with an increase in the number of storage facility sightings and the increase in different crime measures, as well as a decrease in median home value and a decrease in population growth.

So the, um, I believe the applicable criteria that you're kind of discussing, it says, um, Um, to look at the economic, well, the, uh, economic noise, glare and odor effects of the special exception. Coco and their project does not meet the best interests of the public. While their project will cause economic damage to the surrounding area in the form of land value depreciation, increased traffic and lost productivity and an opportunity cost. The applicant does not acknowledge, let alone address how it will mitigate any damage done to local community residents. The city of Coco has a duty to ensure that the land is leveraged for its best use when a special exception is requested. A self store service storage facility provides the least amount of employment per square foot of land, less even than the one person part time shifts. The adjoining gas station provides. There's a large amount of community resistance to this intended storage facility and informal survey found that local homeowners are united in their opposition to the project. Area residents are organized and are galvanized to fight this unwanted attack on our local community, a situation that has been played out over and over across the country by large companies like store quest.

you know there's several questions that come into mind This is actually zoned for commercial use. A self storage facility um to take a zip code and analyze that zip code for a self storage building there's been self storage buildings I mean we'll just use City of Cocoa for example for over 50 years so at what point was there a baseline the self storage did or did not increase or decrease property values when they've been part of the community as part of the fabric of the community for 50 years?

acres over the total sum of an entire zip code and some properties I mean I've done gosh I probably I've done hundreds of storage facilities um you know in my career and some of those properties are less than one acre. So at what point does that become a statistic within that grouping? And can that uh statistical analysis show this like

that change the statistics of property value I actually own property I can tell you my property is actually increased it had nothing to do with life storage opening It had everything to do with the amount of jobs that are flowing into this area. um the other question
Flag: numbers, amounts, negation or names differ between the machine readings · 00:41:53–00:41:55 · unresolved: the words are not shown (unclear audio); listen to the recording
jobs? um Both if you can I don't I can't speak to this exact store quest um uh but a normal storage facility has around five employees not all at one time obviously um but I want to get to that
is‸ everything was coming up. um So, inter general commercial, right now this property is zone general commercial. So, what would the statistical um analysis if another truck stop opened there? how What would that do to crime or what would this if a bank opened there if I mean pick anything I mean general commercial is exactly that it is huge and it is broad And it's a self-storage facility that requires a special exception. now within self-storage I would also like to know because I do all the gamut of self-storage there is a vast array of different kind of storage facilities.

c type storage facility So, if you're going to do a statistical and say you're an expert in this exact science, did you analyze a Class A storage building or did you just say all storage is the same? Because it is vastly different. um and then on to traffic um I've done a lot of work in storage facilities and a lot of work with traffic and generation storage facilities. So one of the reasons in a commercial use that uh communities actually like self-storage rather than other possible commute other possible commercial uses is that it is very low in traffic. So for instance,
That's peak travel time, five vehicles. And a peak evening time, you have a little bit more, you have about nine vehicles. Now that's over the entire evening sector at a peak time, nine vehicles. So traffic in ain a storage facility where if you look at like a McDonald's or a

we won't even talk about chick-fil-a but um you look at even a bank I mean most people do online banking but still you're talking into the 20s and 30s at peak times I mean and then you want to get into fast food you're talking even more. So traffic is a very, very, very small nuance of a facility like this. um And then, you know, interesting point um about writing. uh My husband was a 25 year retired uh ‸ government worker and he can write in circles of what we can write you know I draw pictures for a living I have to admit um and so

And so what we do is say we will be in full, complete compliance with what city has already adapted as their landscape.
What assurances are we getting in the community members that are living 500 feet away that you're not going to make those minor adjustments um after you get done talking tonight
certainly well it's not all my choice I I mean I would rather turn that over and let staff answer that because they have I mean the staff is here to make sure that your decisions are protected and carried forward and so I would maybe ‸ perhaps
the uh special exception criteria for a self service storage facility provides that they have to turn in a concept plan or a site plan. And that is binding upon their use of the property if they do develop it as a self-service storage facility. And so in order to ensure that they would not have to come back to this board, if there were slight adjustments, that's why that particular condition was um was suggested. But nevertheless, they would have to during the site plan process, which goes to the planning and zoning board, they would need to comply with the landscaping code um
landscaping for that type of use as well. um the I believe that the concept plan maybe Cindy can speak to this as well or Sandra I believe the concept plan does show andand it was shown above that there is a landscape buffer around the outside. um so, yeah, if that explains it.
um I, I do. I'm going to let Kim get back and address it, but I wanted to address the other comment about, um why that condition is in the staff report about changes. ‸ I think the city puts that in to protect in case something happens. We, we go through site permitting we submit the site permit to the city and St John's and everything. I don't see this happening, but
different way, or you need to move your outfall to this end and so the pond to shift to the east side instead of the north side. I think that's why that's in there. So you're not having to have us come back here. For something as minor as that that goes through final site plan approval, but again, like staff's going to do a thorough review of everything to make sure our landscape plans meet or exceed code. Our engineering plans meet or exceed code and then it goes to the planning and zoning board as well for approval with staffs hopefully support that we're consistent with all the requirements of the city.
Okay, we need to conclude here. Are there any other further questions from the board? uh Just one quick comment. Any changes that may or may not occur, um which is not in our purview as a board, unless it's something that affects the the use of

The issue that nobody's looking at is the traffic. y'all have approved the Flying J. You've got the distribution center. And this woman just brought up that it takes five cars in the morning to get out of her place. Five cars coming off of Friday Road every morning is three traffic lights. So now I just moved back further to four or five traffic lights getting off ‸ Friday Road. I think you guys need to look at this and take an opportunity. And

that you're requesting a zoning change for. The self-storage units would cause a major traffic jam at this intersection and more accidents. This would draw more homeless people sleeping in the units. That's what worries me camping out in these huge storage units and perhaps dealing drugs and other crimes. The flying J truck stop which you approved ‸ years ago
from truckers parked on State Road 524. There were four of them parked like this along the right-of-way where on 524, where they were not supposed to be parked. And it cost a father and daughter their lives because that truck was sticking out, the last one. Now, drainage is bad in this area

and it takes three or more days to drain after the rainstorm. Like I said, I am on 10 acres and have left most of my property native. What will happen when this development goes in? Will all the property owners in this area be flooded even more? Where is the drainage going for this new subdivision that the city of Cocoa is trying to approve
Our ditches cannot handle more water. I have driven around Cocoa and checked out some of the storage units, and they are ghastly. Many of these look like salvage yards with cars and trucks everywhere and businesses being run out of them. This would devastate our property values and make us just another trashy neighborhood. What type of security would you have for these self-storage units? Will it have 10 to 12-foot high walls with security cameras all around? Will it be staffed during the day with an office and a security guard at night? Because I live abut to it, and I'm wooded. There are lots of wooded areas out there.
that have been out there because with the Bright Line going in, they were living next to Walmart, which was a 24-7 store. They could use the facilities there, so instead they've moved west, And they like it there ‸ because the Flying J truck stop is open 24-7. Just today, while we stopped at the intersection coming off the North Friday Road onto 524, we were behind three vehicles at the traffic light there. The second car got so impatient that he whipped around and into the grass to make a right-hand turn ‸ behind the vehicle in front of him. And then I was really shocked because a white vehicle car whipped out into, ‸ went around the left side of the vehicle that was stopped at the traffic light in front of us, whipped around, made a huge loop right out into the intersection under ‸ the traffic light and headed, headed, made a right-hand turn. And another thing that no one has mentioned yet is the noise. So I'm wondering if there's been any kind of study done about the noise. That's a concern for me. I'm very concerned about the property values declining, as everyone has already talked about. and I would be one of the people that would suffer from the drainage issues. My property will probably be flooded. And I'm also concerned that the wildlife that will be displaced from across the street will all come over to my house. So I'm just wondering if anybody has considered that. And that's all I had to say. So thank you.

in the curb or the yard and pick up hypodermic needles from the motel up there. I've been dealing with that for 20 plus years and that's not going away. So ‸ growth is going to happen

staff report they clarified both of those issues. This is not some of the storage and I totally respect ‸ Ms. Scott that drove around and looked at some of the other storage facilities that she's seen and that was part of my point with the crime is
or were they all class A facilities and so I just wanted to point that out. This developer has a proven track. They're actually a national developer. They only develop class A facilities and they maintain their facilities impeccably. And so we're very proud that we work for because not all storage

over the last 10 years especially as people start as ‸ the property values go up you start buying smaller properties ‸ in which case you have a need for that storage.
so the traffic within a storage facility is extremely low. There is traffic and do note and we already said this before so my last point I won't repeat anything else but this does have to go through DOT permitting and DOT can and will frequently require the developer to improve any sort of intersections or
by their developer they deem to be impacted by the developer. So that's certainly something that we still have to go through. And then I'm open for any other questions.

actually I even wrote that really big letters in my notes I wanted to talk about that the overall property is 11.35 acres this developer is only developing half of the property and leaving the other property ‸ as open undeveloped property. There is no future phasing plan and

planners and talk to someone they were only going to plant bushes there. I don't want to deal with homeless people crawling through the bushes and into my property. You know and it would help with sound and it would keep a larger barrier with a concrete block wall and I don't mean one of those walls like I've seen at the storage units here that's about that tall.
To answer that question yes the wall is concrete and the full perimeter of the building will be secured so it's secured in two ways. One with a six foot tall wall which it does have landscaping on the other side of the wall
probably what the city was saying. So it is a wall and then also the buildings back up so in conjunction with the six foot wall the buildings back up to that and

Thank you. Go ahead. Okay. I just had one question. Why couldn't this just get tabled until the biggest issue is traffic? Why can't this just get tabled until the traffic issue is addressed and taken care of and then revisit this? That's all I'm saying. Thank you.

I just wanted to say 524 is slated to be four-laned all the way down. The whole thing is going to be totally redone. And so by the time ‸ their traffic study is done and they're ready to move forward, that could all be in the works anyway. And Friday Road Interchange is going to be redone. So this is kind of a...

the actual, the bulk of the storage facility is not even visible from 524. That's my take. You've got a very narrow path right there. I don't know if everybody can see it. You've got a very narrow path right there.

I don't think anybody's complaining about the commercial or anything like that. Everybody has asked about the traffic in the area. Like you said, 5 more cars is 3 more traffic lights.
Sorry. And Mr. Chair, there's a lot of speaking from the audience. And I'm just concerned that it's not going to get caught in the record. So we can ask people to come up. Okay. Thank you.
Sure. So let me bring this back. So the Board of Adjustment is considering the special exception for the use of a storage facility. This is a special exception is something that you need to consider as a special use as a permitted with special, you know, as a special exception with conditions. Basically, as a use in this zoning classification, that's what we're here for. This property is already. ‸ It's already zoned commercial. It's slated for commercial use. Another flying J, another something or other with very intense uses could already go on this property without coming to this board.
problem. It's not going to be resolved tonight or by tabling this item to consider other conditions for this special exception. So I don't want to miss. I don't want to miss guide anybody or
traffic issues at that intersection. By tabling this item, whether or not this item is going to cause any additional traffic issues at that intersection or whether or not the traffic study that they're going to present to us during the site plan process. As we go further into this project, that is to be determined. We do not know yet at this point.
the first part of this project is to get permission to go forward to have a storage facility in this zoning classification on this property. So this is their first step. From here, we go to a full submittal of them submitting a full engineered site plan with their engineer and their architect. We don't have the owner present. Remember, he's got sick with COVID. So we have just the engineer and the architect here tonight to talk about the project. And so they've done the best they can to represent the ‸ best attributes of the project. So they're here to tell us about the project. And ‸ they're not here to really discuss, you know, ‸ the fact of, you know, the traffic impacts and, you know, the overall plans of the 11.5 acres.
project. So that's what we're here to talk about. But they are here to tell you that they are going to meet the codes. They're going to go through the site plan process. And we're going to have to take this in front of the planning and zoning board from here. So we are going to do a full site plan procedure. They're going to have to meet everything. It's we're just beginning this whole thing.
We have a lot of heavy lifting. Do not, please do not, please don't anybody believe that this is a slam dunk for them. They have a lot of work to do. So this is just the beginning process. So again, I don't want anybody to believe that we are not going to address the traffic issues, that we are not going to address landscaping, that we're not going to address fencing or environmental, any of those issues. All of those are going to be addressed. City staff has a whole process for that. So we are just
this time. You have heard whatever testimony and you've heard from your public, which has also been very, very valuable. I am very, very pleased that the neighborhood turned out tonight. I did not expect as many people to come out tonight, but I'm very, very glad. It does show that this neighborhood very, very much cares about what goes on. And I'm very, very glad. It shows the public process works and it shows ‸ our notification process works because these people did come out. So I love that. So ‸ any questions for us? Can I just ask a
clarifying question about the conditions? Yes. Are these conditions that just have to be agreed upon to start the process or is there like ongoing enforcement? Like three years down the line, if there's a vehicle being used as living quarters, is someone?
Thank you for your expertise and your level of professionalism. Without city staff, we're probably pretty much dead in the water because we are just citizens just like you guys are.

yeah, before we close this out, I would just say to the people in attendance that this is an incremental decision, that this is not the final decision. It still apparently has to go to planning and zoning and go through the process of the development site. So we're just one little step or cog in the wheel in this incremental movement. This project could possibly fall through. There's no guarantees that they're going to be able to do what they want to do. They just have to keep... They've got a lot of work to do, which has just been stated. And
Mr. Chairman, I'd like to move to approve the staff's recommendation of a special exception and included in that all of the conditions that they attached.
