Agenda (the City's wording)
The City's agenda for this meeting is on file (CC_Reg_Packet_04_26_2022), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
547 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 29 voices separated from the audio.
31 short machine repair(s) (32 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 91.0% of 20,904 content words.
Dotted words (381 places) are ordinary wording differences: hover or tap to see the other reading.
547 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Okay. And I'm not opposed to this item at all. It's just, I feel like it really, people need to know that we're doing this. It's a very positive thing. And it'll be an opportunity for the staff to explain it in more detail.

Well, we received an email today in regard to attachments, and I don't know what the policies are on those. If, if there were, um, the email we received, I don't know how many of you read it, but it was in regard to statements people had made or submitted for the record that
I don't know. I don't know the particulars of the exhibits, but generally the, um, you know, what gets put into the minutes is subject to the, you know, city council's discretion and, and the, uh, and the clerk's office. So I don't know, I can't put it in context what, what the question is.
So if somebody speaks within delegations and asks, um, submits, uh, a letter or whatever it is they, they wanted, um, and request that it be put into the minutes, do we honor that request?
what time would you approve that? Because we've had several people come up and, I mean, I witnessed, you know, people coming forward and submitting things for the record.
I, I understand all the municipalities they represent. I mean, they're citizens that come up. I want, they want to present something and they want it included in the minutes. That, that, that's a discretionary decision unless it's an evidentiary hearing, like a quasi-judicial matter that gets put into an evidentiary record. So, I mean, the council's discretion, whether to accept it into the minutes, um, can either be made at the time, at the time

mean, if somebody goes to the time to research some of this stuff, uh, which is pretty boring overall and not a lot of interest in it, um, I would like to see it included. So,
but I would ask that we amend the minutes to include those. At least for these that we are passing today. And then I guess in the future, that decision might be more appropriate to make it at the time the request is made.

to allow the city clerk to go through these particular email that she referring to, give her opportunity, then we can bring it back. I'm just asking because I mean, I think it's,

I'm trying to be great like you, sir. Well, as you can hear by this outstanding proclamation, my father did phenomenal things for the community. And like everybody else, he was just a regular human being as well.
I kind of wish that he was here in person to receive this award. ‸ But God has called him back to home, and I'm glad that he's not suffering no more. That being mentioned, as a community, we all need to reach out as individuals and make a difference for the ones that need it the most. Thank you.

set records there, if I'm not mistaken. Is that correct? Yeah. Yeah, so definitely he's talented. But more so, he was geared toward academics more so than athletics. And that's what we're recognizing, his academic excellence. And providing information to the public so that, you know, knowledge is power. Mr. President, go ahead, sir.

When we went to, at the time he was our area superintendent, ‸ Dr. Mark Mullins. He's our superintendent now for the school board. And he said yes to me and Bob Barnes and Augusta Williams. So if Dr. Mullins wouldn't have said yes, we wouldn't have had a Children's Hunger Project. But thank you guys for giving Gus, because he spent a lot of hours at our annual Children's Hunger Fundraiser.

Really quick, I'm doing a poetry workshop this Thursday in Melbourne just to honor my husband. And we're going to have 50-50 door raffle for the library donation. And it's a public, free event. So anyone's interested, it's going to be at the King Library on University Boulevard, 530 to 730.

Great. This is a happy moment. This is like my favorite time of the year is when we do our Earth Day, Arbor Day ‸ celebration. And it's one of the things that I am most proud of the city of Cocoa for. And because over the last three years we have brought back our tree culture. We had lost our Tree City USA status. And with the help of the tree board and other volunteer leaders we brought it back. And we've been doing this educational event each year so that we can build awareness and educate people about trees and their value to us. And really increase this culture of trees that

And I just wanted to give you five big ideas. The five big takeaways I want you to walk away tonight understanding about trees. The ecosystem services that they provide us that are actually valuable. Even dollar valuable. One is a storm protection. According to the Arbor Day Foundation, one to 4,000 each mature tree gathers one to 4,000 gallons of water per year. That protects us during storms. Trees break wind energy. So even though my neighbor thinks he has to chop down his tree so the limb doesn't fall on his house. If he has a healthy tree, it's more likely that tree will protect him in a storm than harm him. The second thing they do is clean our air. The Arbor Day Foundation reports that each mature tree sucks up 48 pounds of carbon dioxide. And at the same time they're doing that, it emits oxygen. It cleans our air. Number three, the shade. Of course, I don't have to tell you in the Florida sunlight that we need shade, right? 10 degrees.
which is significant, especially with the heat events that we have. Four, the habitat for wildlife. We're going to hear tonight about keystone species and the hundreds of creatures that those trees provide habitat for. And five is simply they're beautiful, they're welcoming, and they're cocoa. So let's bring it on here. First of all, oh, that's right. We had an Arbor Day event last week where we planted a tree at Bracco Pond.

trees. And we're also going to have a little workshop ‸ on how to build a recycled birdhouse. Something that's fun for the kids and bringing you some great visitors.
will be presenting on Keynote Species, Tree Planting, and Best Practices for Pruning. Local businesses will be selling plants and the City of Cocoa Public Works Department will be providing free tree saplings to attendees. We will also be recognizing our tree photo contest winners and celebrating our Tree City USA designation.
Well, the tree designation is fantastic and trees are super important for us. They can protect houses in storms, they give us oxygen, they help with stormwater runoff.

Yes. So Keystone Species, we have 5% of our native plants that provide about 95% of the food. So when we go ahead and take care of migratory birds, we keep the terrestrial food system going, which is important for all of us, by the way.

Well, I remember when we used to be designated as the Tree City USA, and I was very disappointed that it was stopped, and I felt that it would be important that I present it to the Planning and Zoning Board. And when I did, it was very, it was supported and it was unanimous that we started back up again. So when I was able to get that backing is when I realized that Lorraine was interested in trees, and that really allowed it to get to the point where we're at now after we got the Tree USA designation back again.
the Council, I was shocked that it wasn't continued. So without the support of everyone I mentioned, we couldn't have had it come back again now that we've succeeded. Thank you very much.

It is a place that is cherished by those who live here and those who visit. This historic destination located on a beautiful waterfront attracts people because of the family-friendly park, unique shops, eateries, art, music, etc. ‸ Our jewel of a village may cease to exist if certain proposed initiatives go into effect. A proposal was made to extend bar hours until 4 a.m. And will turn the village into
an ideal spot to meet friends for a meal, possibly a beer or two with the breweries, and a walk in a park. This beautiful village will turn into the type of place fraught with all that comes with misguided judgment of drunkenness that occurs during the hours of midnight to 4. We will also consider the monetary cost of destruction done to the village when people are drinking throughout the night, which will add to

I appreciate the opportunity and right to have my comments read into the record by a fellow citizen. I want to talk about parks. Parks provide many positives for the community in which they are placed. They provide a place of respite. They provide an environment for children to play safely and for families to relax. They provide a sense of community. They provide a rare thing in an ever increasing digital world. A place to get to know your neighbors face to face. Having a park or playground in one's neighborhood or close by helps to improve property values.

to do ‸ the strategic planning and talk about priorities and get people together. That's a part of that. There's comments that I made on March 22nd, which include the public hearing for
The next item that I wanted to vote and I did ask to speak on that as an agenda item before the vote and citizens should have the right to comment before the vote. And so that's why I wanted to clarify that before the vote, but now it's taking into my time on delegations. Under the next thing I wanted to mention is the last week's workshop. I sent obviously a lot of comments today.
those comments by far. But what I can do is make just a couple of points about last week's workshop. The first one is that I feel unsettled as a participant and attendee at that workshop that the city policy says that the workshops are for discussion. ‸ And there that's the basis of what the workshops are for and yet the agenda says that action may occur at the workshop. And so as an attendee, you just don't know what's being decided and what could come next. And I knowing and also there's a sense of kind of I gave you guys a lot of information on there. So I don't want to spend too much time on that.
I gave a lot of feedback and I also commented on protocol issues. I noticed numerous protocol issues. I do hope that you will read and consider my feedback on that. And the last thing I want to comment on is is on the consent agenda. So I talked about quite a bit about the consent agenda last time. And today for tonight's meeting, I did do a look over of it just to see how much dollar value is being included on the consent agenda.

And my opinion is is that more items need to be put onto the regular agenda and that citizens need the right to comment on consent agenda. It's very unusual. I have now been going to more and more meetings and I have yet to run across a meeting that does not allow citizens three minutes to comment on consent agenda items. So, you know, I just I feel that the wisdom that citizens have to offer is being averted and that we're doing 80% of our business tonight on the consent agenda rather than the two items that are on the real agenda. Thank you for your time.

to make you aware of a pending sale of the apartment complex that I live in. And I've we don't know the exact details yet because it's supposed to be going through on Thursday and obviously today's Tuesday. So we don't know the result of that yet. So we don't know who our new owners are or what their plans are for us. I did do some research though on sun biz about what number of properties the gentleman owns. Because if he's liquidating his properties as we were told it could affect more than just our community. It could affect other communities around here.

I wanted to make a comment on based on one of the citizens had a, they made a statement dealing with the 4am bar business. I just want to assure you that that is not a proposal that we have on the table at all. What, what actually what it was maybe three or four months ago, a business owner came to us and spoke with myself, city manager, and also the chief of police. And asked us to look into it for maybe down the road. Um, so that's not a proposal that's on the table. So I don't want anyone to leave here to think that that was a proposal that we have been discussing.
And as always, we listen to business owners and citizens who may have ideas to help their business out. So that's all it was. I just want to clear, clear that up.

those species of trees approved by the public works department will be planted. The approved tree shall be a minimum of eight feet in height. Omit and, and stop at,

Uh, yes, this is just to update the policy to bring it from leisure services over to public works. And then just amending the, the one item about having development agency approval. Uh, ‸ there's no other area in the city that it has to go to a tree board or to ‸ council or any other board to get approved. So we felt that was an unnecessary step and just leave it at the city manager level.

Yeah, I just had a couple of questions. I, I didn't know we had a Memorial tree policy. So I'm glad to see we do. Um, is there any reason that we have a limit of five trees? Is that just kind of a number or
like the parks are varying sizes? ‸ That was the original policy from 2006. So it's, it's not necessarily limited at that. So with approval, the city manager. Okay.
Because as you know, Travis Park, uh, just a few ‸ years ago now was declared a low maintenance park and they took down all the landscaping. So what, who's going to water them?
have to whoever's putting in the tree, they have to fund the irrigation and things like that to get it to the tree. Um, and then it'll just fall under our public works department. We'll try to work on locations where we don't need a lot of maintenance, like around sidewalks to where we have to trim for height and things like that though.
So will we be coordinating? So my real question is, I would love to put a tree at Travis Park. Can we, or do we have to go through the county parks and?
No, it's, it's our property, but we'll work with them on it. We don't want to increase their maintenance requirements by, by things we're doing. So ‸ try to work together on areas like that.

We're at the workshop and there was a particular person that I asked. They threw their hands up in there, but I'm not going to identify them. But they know who they are. But we're here. No, I'm not. We're here now. There's three particular items here.
Yes, so this is kind of a continuation from the budget meeting where we're talking about what direction Council wants to go with ‸ the Gilmore and the Carl Anderson parks.
We had some miscommunication with staff. So either way, we're going to have to re bid this. But option two is still really on the table in this in the terms of just combining the funding and then going out to bid for the one park and doing it that way. I talked to the contractor today about it.
They said over over two months, their prices went up already. More than likely, they probably would have came at us with the change order, even if we issued it at the original price. That would have been a ‸ different discussion at that time. But but either way for option two or three, we would need to rebid. Option one is just kind of seeing if the market will settle and sit back for a little bit. We have the plans. The plans aren't going to expire anytime soon. There's no real code requirements that would require any major updates there.
Flag: numbers, amounts, negation or names differ between the machine readings · 01:14:17–01:14:20 · unresolved: the words are not shown (unclear audio); listen to the recording
Go out to bid for whichever location you all choose. You could maybe include certain amenities for for the other location, like utility stub ups. That way, when you are ready to do the second restroom, you at least have the utilities in place for that project. Then the third option, that's also a rebid, but that would be utilizing ARPA funding. And in order to do that, we have to put the federal terms and conditions in the project
because if we're combining ARPA and our general fund dollars, we have to make sure we can track where each dollar is spent. ‸ And so we'll have a little bit more complicated bid sheet on that.

item number two, and you have the right to expound on that one as well, I'll give you the opportunity. All right. All right. What are the wishes of council?
So ‸ I made a phone call to Mr. Smith today and also talked with the city manager about this item. Um, what I was looking forward to was possibly allowing our people through Mr. Walsh to do the, um,

for water and sewer for both projects. Um, and then use the ARPA funds to actually fund the restrooms. Um, I know it had to be, I'm glad it kind of had to go back out for vote. I mean, go out back out for bid again. Um, is that an option that we can look at as far as our Mr. Walsh? Maybe ‸ don't know if you can speak on that. Um, but would that, would that help us lower the cost for the restrooms?
typically, um, and we've done some smaller projects in the past where the public works department funded the materials, uh, and then the utility folks. But that was strictly limited to the, to the sewer side. And I remember we, we haven't never done that. We've never done it for water because when you make water decisions as a

of having water crews dig and make connections, which we currently don't, then you would also have to entertain that same request from Cape Canaveral, Cocoa Beach,
But since you have complete control and jurisdiction over sewer, um, we don't have a dedicated sewer crew that constructs water on our sewer mains. Um, but I'm so I'm sure we could at least, you know, I could certainly work with supervisor and talk about, I mean, I, I,

They're not overwhelming, but they're not short either when it comes to digging new lines and then so on. So we could certainly look at that on the sewer side.

putting the water and sewer in there? Are they, in other words, do you just charge, you have a certain impact fee? And then, you know, if there's any overage for this. Yeah.
Flag: numbers, amounts, negation or names differ between the machine readings · 01:18:36–01:18:36 · unresolved: the words are not shown (unclear audio); listen to the recording
Yeah. That's just the cost for our project to come in and, and be a new customer on the utility. So just like if someone's building a home and they connect to the water system, they pay an impact fee just, just to become a customer. But it doesn't cover their cost of constructing those lines.

we also, ‸ as was mentioned earlier, we have a couple of very serious park deserts that include Cocoa Hills, include Pine Ridge, include Cocoa College Manor that both, uh, Deputy Mayor Hearn and myself, uh, those are our constituents. I mean, is it also available for that or?
Flag: numbers, amounts, negation or names differ between the machine readings · 01:20:00–01:20:01 · unresolved: the words are not shown (unclear audio); listen to the recording
And we, we discussed the, the, the, uh, the flexibility now that, uh, you gain the opera ARPA funds are now the local government something funds there. We can give you, uh, we'll give you that, um, the, uh, PowerPoint slide that we, when we talked about the reallocation of the ARPA funds there. So
It was for local projects. It was for, uh, ‸ general government services. It's for water, uh, projects there, water quality projects there. So we had some discussion about reallocating them to some of the storm water needs there, but we'll give you that discussion again. Okay,
so my concern is that when we do have these park deserts and the perception, you know, we're putting a lot of money into a bathroom, that would be one concern.
city, because what I've come to understand is that the PUDs, you know, that are developing throughout. So, well, in particular in district three, maybe a couple in district one, but they come to us with a plan for recreation. So when you go down, ‸ not in all the neighborhoods, but in a lot of the neighborhoods in district three, they have pools or they'll have, um, they have recreation equipment. In fact, they'll come to us and even, uh, you know, ask for concessions. Like when Adams Creek came and said, no, we're not going to do a basketball court.
or when the Integra project came and said, well, you know, we don't put in the boardwalk, but we'll give you the cocoa conservation land. So there are parts. So it's not kind of a quid pro quo. Like you have to treat every part of the city equally because in fact, there are real differences with the types of development. So, um, my concern in voting for that, for this is that we're doing this at the expense of ignoring areas that are in fact park deserts. So, I mean, I would love to use ARPA funds wherever we can. Certainly. Um, and I would hope that that would make other funds available to at least start to make plans to resolve some of those park deserts. And that's, that's what I have to say. Thank you.

so that's something I did notice, the park desert there. I'm even thinking about, well, I know I'm going to bring up in the next budget meeting us actually directing staff to start looking at locations potentially for a park. But at the same time, ‸ it's kind of an insult as well if we're building new parks and not bringing other parks up to a standard as all our other parks or surrounding parks around the city.
birthday parties are picking up at that park. The participation since we've put new equipment out there, I'm sending a lot of kids out there. So I think it's a point of equality that kids and even parents should have a restroom to utilize when they're at those parks.
off the table. But I think if we got the funds to bring one park up to standards, let's do it. How we get there, that would be decided on the vote that we take. And that's it.

This is, well, I guess this is the lowest bid now, maybe higher. Spending that on a bathroom in a neighborhood park. The only thing is I don't think our standard is to have bathrooms at all neighborhood parks. There are bathrooms in the parks by my house. Maybe that's something we aspire to. I can understand that. I can tell you, you know, there are a couple ‸ places where, as we know, bathrooms in the park have been a problem. But a neighborhood park again is a park that, you know, people within five to 10 minutes are walking to. At any rate, my concern is with the perception that used to be enough money to buy a house.

I just know how ‸ sometimes things can get on budgets moving forward the next three or four years where this might not ever happen. We may not ever get a bathroom in that restroom in that area. So the reason I brought that up because at that budget meeting was I wanted to do my due diligence, which is talk to the community around that park. And also talk to the police chief as well about some of my concerns that I had that not just myself, but other citizens who live in that area had an issue with dealing with just hanging out and loitering in certain ‸ areas. So inside of my budget line

But that's why I brought it up because I know it was, you know, constituents asking about it, you know, just making sure that we have infrastructure in place to make sure it's going to be a safe. ‸ And
that he's going to make sure that that area is going to be safe. And I believe when he tells me he's going to do something, he's going to do it. So that's, that's why I brought that up. I think Councilman costs once again brought up the 2.7 million dollars in ARPA funding and there was a slide that was presented by staff about the 2.7 million dollars and it was presented as if it was all decided, you know, and it did include a 900.

not further broken out. So I think that that whole 2.7 million dollars should be considered by council one by one by one to make sure that you understand how you're spending the money. As far as not having the money later and needing to do it now. I mean, even if it was put on hold and tabled for 2 weeks, ‸ the funding, you know, not even a dime would have been spent just to make sure that this is the right thing. There have been some pushback on parks and the even in the draft parks plan. It does say that neighborhood parks do not always have restrooms. So it's not a given that all parks have restrooms. I'm not against restrooms and parks. I have been listening. I've asked several people since this was funded last year, not against it. But I do like the idea of being more deliberative when you're spending on these kinds of dollars. And I do support the review of the ARPA funding of the 2.7 million dollars and

that those needs are also considered and not just the funding that was submitted by staff. And that is my comment on that. And the other one you want me to come back on the. Yes. Okay.

list. The waiting list is currently closed and our staff are working to try to reduce the waiting list. So we contact all of the applicants that are on the list to make sure that number one, they're still living in the home. Number two, that they are still eligible and still interested. And ‸ as of a year ago, we had 135. So we've been able to reduce that number down to 100, mostly because either the applicant has made those repairs or they've moved out of the home. So we're down to about 100 at this point. So Mary Scott is eligible and we're asking for approval for for this project. Staff have worked very hard trying to communicate with each of those eligible applicants. In addition to the housing rehabilitation program, we also have a housing replacement program, which funds are available when a home is is substandard and not suitable for rehabilitation.

lot, um, for the surrounding citizens that we're going to keep investing in that park. We want people to enjoy and visit it. Um, that was one of many tree plantings to come. I hope. Uh,

And, uh, secondly, I got it. I had a chance to take my kids out to Cocoa high and we got a chance to see some of the progress on the, uh, the new rubber track that's being implemented out there. And I just want to say that I'm, I'm so thankful for the people that, uh,

at other schools and not being able to do it there. Now Cocoa high will be probably one of the destination spots in the county to run track. So I'm thankful for that. And again, uh, the piggy

uh, chief of police, but if you have overgrowth in your yard, uh, say for residents, that is a code violation, correct? You have over 12, 12, uh, inches. So does that same code pertain to our commercial, uh, properties in the area?

that to y'all attention, bring it to council's attention. Uh, I have faith that we can get that done. Um, using all the necessary means we have, um, next up, uh, district 2 and partial district 1. Now we have three streets.

but I would like to make a motion to, uh, direct staff to, uh, to see where we can put on those three streets in a safe manner where it doesn't interrupt police, fire, uh, speed humps on those three streets. We have students that walk every day from school in that area. There's no sidewalks. Um, just tonight, as soon as council meeting started, I got a text message from someone on Georgia Avenue where a car ran off the road and hit a parked car in a yard.

If you look at, if you look at some of the neighborhoods, some of the streets, Mitchell Street, they have speed humps that was put there. I know, in my opinion, being in that area for a long time, I know Mitchell doesn't have the speeding problems that those three streets see. Uh, I think we've done it in other areas as well.

I think if we come to an issue where there's another neighborhood that need to be addressed, we should address it. But for a year now, I've been talking about this and it's only getting worse. And this is what my constituents keep coming. This is one of the main issues. Believe it or not, my constituents keep coming to me about.

‸ They have been concerned about speed bumps. My concern is when you open it up. I mean, if there's more of a police presence, then that would suppress the high speed driving. And yes, we've all seen that. Now the question that they're going to ask you is do I forsake and put speed bumps? And when you get this emergency call that the vehicles have to slow down? Sometimes time is of the essence. That's that's and I'm just trying to make sure we get the ‸ fullest impact from it.

concerns. So those are good concerns and I've actually looked into it for one on those streets. It shouldn't be high speed in the fire service. We don't speed at the max. We go 10 over if necessary. Those neighborhoods don't require us to speed at all to any emergency. Secondly, I drive fire trucks. I drive West Cocoa, Tucker Lane, all those areas. We have huge speed humps. Uh, and our trucks are minimally affected when responding because once again, we're not speeding in those neighborhoods. Um, we

show you in the past four or six months. I got videos, cars running into the houses, cars running up, taking out fences in the yard, cars taking out trees. I can say I'm going to actually submit this to Council because I want you all to see this. This is in ‸ past six months. Today, just before we start this meeting, I got pictures on my phone of a car is almost total in the front.

was just going to say I came in today and spoke with Chief Collier. The first thing I had to speak with him about was the calls I got from Duke Way in regard to, you know, speeding over there. And as we know, it's now your area, Cocoa Hills, but Pine Ridge where Duke Way is lines up with that. And it's probably even the same people that are speeding. This has always been such a big issue. And I think if my concern is that I've had so many requests for speed humps that this whole city would be full of speed humps. On Michigan Avenue, we determined that we could not do the speed humps. And instead we did what was called, well, it's called traffic quieting. So we put a couple of stop signs in. We created pedestrian crosswalks, clearly painted pedestrian crosswalks and narrowed the streets. In that case, it was a wide street. So narrowed the streets with these little bike lanes, which I don't know how good they are, but they narrowed the streets and didn't slow down everyone, but slowed it down some that I'm not getting calls every week on it. You know, I want to support you and serving that community. But

your car. I don't know. I'm hoping that someday some way or even now there are models of ways that you can slow down traffic without putting a speed bump on every street. I don't think we'll like the end result.

And they were irritating. You have to go real slow. And I had antique cars. It caused a little bit of misfit. But overall, it did slow down the traffic off of Westminster going to the back to James Road because it's a straight shot.

All right. This is my last one. Um, Esquire Garganese. Yes, sir. In 45 words or less, can you give me the brief history of McFarland Park? Mr. Brunette met me at Sam's last night, too. That's where I love to shop. I mean shop at, and he asked me these questions just briefly.

and maintenance role for McFarland Park. It was brought to the city's attention about four years ago that the city likely does not own the park. We spent an enormous amount of time researching that issue. The park is a private park. The city council relinquished whatever rights they may have to McFarland Park, which were none other than a reserved prescriptive easement for drainage.
