Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
360 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 23 voices separated from the audio.
41 short machine repair(s) (61 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 88.3% of 13,427 content words.
Dotted words (297 places) are ordinary wording differences: hover or tap to see the other reading.
360 passages (30% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:39:23 (16 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Alright, ‸ good evening. Angela Essing. So, tonight before us we have the consideration of a comprehensive plan minor map amendment to change the future land use map designation of mixed use to commercial on 1.38 acres at the southwest corner of State Road 520 and US 1. This application before you is to change the future land use from mixed use to commercial to allow for the redevelopment of the site into a car wash.
map. You can see the proposed commercial future land use on the lower map. The city is broken into 7 future land use elements. Every piece of property in the city has 1 of these 7 elements identified within the future land use map to narrow down the information for this evening. I have condensed the chart ‸ to show you just the commercial and just the future land use elements together. You can. You can see that.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:01:59–00:02:00 · unresolved: the words are not shown (unclear audio); listen to the recording
You can see on the chart on the left that the commercial and the mixed use future land use elements have different categories that are broken down from maximum density all the way through maximum pervious surface discusses the zones that are allowed transportation allowable uses.
property today is that there is a mixed use future land use designation. With that mixed use designation, the allowed zones are categorized here on this map and the current zone of the property is CP. So you will see

received its future land use and then it received a future land use of mixed use. So there's one of two errors here either the CP zoning designation needs to be added to the mixed use chart.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:03:53–00:03:59 · unresolved: the words are not shown (unclear audio); listen to the recording
that is the reason we are here today. The applicants would like to construct a car wash on the site. So they are proposing that we change, um, the future land use to commercial, which then has a different set of allowable zones. They are then proposing to rezone the property to CG, which does allow for a car wash.
use. However, the applications build upon each other. And so one thing that should be considered as we look at this application for the future land use is that ultimately the uses allowed in the CP zone can ‸ be seen on the right hand side of your screens under permitted uses. The change of the future land use to commercial would allow the property to be rezoned to CG and thus in turn allows for different properties to be permitted on that property on that particular parcel. And in making this slide for you, we tried to put identical uses across from each other. So when looking at this, you can see retail stores are allowed in both.
additional uses are allowed in the CG, CG zone that are not currently allowed in the CP zone. Some of these uses are automotive. Automotive well, obviously the automotive laundry

which is why they are asking for that zone. You have liquor stores, you have storage garages, public and ‸ private parking repair services, medical financial institutions, pharmacies, etc. Then as you work your way down to the bottom of the chart, you can also see that there are some differences in the special exceptions that are allowed. These special exceptions need to be reviewed for the surrounding land uses to make sure that those are appropriate uses on the site.
we have before us today, the State Road 520 and US 1. Now, it does note that you can also are allowed to have a single use on the site, even if you fall under the future land use mixed use designation. The proposal today is to change that to commercial and the rhetoric for the commercial land use category states that is intended for areas that serve several neighborhoods, sub regional and regional areas and provide an array of retail,
And so when you are reviewing an application like this, you need to consider the eight items that can determine whether or not a change should be made to that future land use. And there is no, they, when you consider these eight items, there is no magic number as far as the number of items that need to be a mat or unmet. It is simply a review of those items and a belief that we are following, um, the city's desires as the comprehensive plan has established. So I'm going to go through several of those with you, um, at this point. So one of those is that does the, um, does the application have a favorable impact on the city's tax revenue? Obviously there are different levels of businesses that generate different levels of taxes for the city, but any redevelopment on this site, uh, would be an advantage to the city's tax revenue. Then the next item is, um, the evaluation and appraisal report. So this is a report that is required by the state, um, and there are varying state statutes that require us to maintain our comprehensive plan in a particular way.

does meet those goals that were set back in 2010. And then we're recognized again in 2020 when we did another ear amendment, these amendments are required every 10 years. And when we did a second one, we did not change any of those items to the mixed use at that time because the city still believes that it was the correct designation for this particular property. Another one of the, um, eight considerations is that the impacts on the environment or the natural or historical resources, uh, of the city or the region. Obviously on this site, there are no, um, environmental considerations as I think there's only two or three trees and,

the land at this intersection as far back as 2002. And I found this one, um, piece from the minutes that I felt was important to share. It says it is important that this prominent corner announcing the entrance to downtown Coco be developed consistently with the city's express long-term land use goals. And vision for the corridor, which is a mixed use center. It should also be noted that this intersection is also a prominent entrance to our diamond square CRA. Although I was not able to identify any, um, discussion in the minutes and things like that.
So, uh, the, one of the considerations is the impact on the environment with it being with the current proposal of trying to get all the land designation being changed over to the commercial. And applying a car wash here.
significant types of chemicals and everything else used at car washes. And if I'm need a little bit of clarification, as far as are they going to be draining into us, into the, our sewer system, or is there going ‸ to be separate storage tanks for those? Uh, because I know. Uh,
Flag: words were replaced by a machine repair · 00:12:29–00:12:30 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
If I could respond to that question a little bit also, um, just to keep in mind that the. Use of a car wash, although that is what is precipitating the, the application,
So, um, really, I think when you're looking at the factor of impacts to the environment, you're looking at what are the overall impacts based on the two policies that we're looking at, which is commercial and mixed use.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:13:49–00:13:51 · unresolved: the words are not shown (unclear audio); listen to the recording
So the state does put particular, um, requirements on the comprehensive plan, um, that the city does need to, um, follow. And the city believes the acknowledgement of the land use pattern at the, at the intersection really is the most important, um, item for. The future land use in this area. Um, again, just basing that on the historical data, um, back to 2010. One of the other requirements, is it compatible with the surrounding neighborhoods? Um, and again, not to, um, say this too much, but again, the, the thought of the mixed use corridor ‸ specifically at 520 and us one, um, was to promote the mixed use. And all the benefits of having mixed use in that area, um, along the corridor as an entrance to both the, um, Cocoa village and to the diamond square CRA. Um, um,
with another map. So sorry, I'm getting a little bit ahead of myself, but okay. Okay. One of the other items is adequate housing. And as, as I noted that with the, um, mixed mixed use, um, future land use, you can have 5 additional units on that site. If you were to do a mixed use project. So if you had retail below residential above, you could do up to 30 dwelling units for per acre.
Uh, is, is the best site for housing on the site because of the train, the major intersection, those type of things, um, that there is, um, probably there are better areas within the city where housing could be provided.
elements is, is this consistent with all the elements of the comprehensive plan, which is a little bit of a hard one to answer because obviously we're proposing a change to the comprehensive plan. So in that case, it is not, um, consistent with all the elements of the comprehensive plan that therefore the request to
was specific specifically identified at this intersection. The request for the commercial future land use designation does not satisfy the compliant compliant amendment standards and is not compatible with

the future land use map designation of mixed use to commercial on the 1.38 acres at the southwest corner of state road 520 and us one to the reasons described above.
Anybody on the board have any questions for staff? All right. Moving on. We'll have the developer. You have the floor. And your name and address for the record.

again, we, we agree that, uh, this property is not right for residential. I mean, wedged between US-1 and, and the trade tracks, and mixed use, with access, there's some, there's some,

some good locations I'm sure that they can find. But I believe it's essential to look at the city's vision for this location, basically with the goal of supporting the quality of life for our neighbors in Diamond Square and the heart of Cocoa. In other words, looking at the comprehensive plan and the future land use. Simply, a car wash, a single-use commercial business, does not enrich these communities. A mixed-use center brings ‸ more value. In my humble opinion, there are better options for this property. So I thought I would just mention this and like to go on record is on accepting the staff recommendations and denying these applications.

It was most recently, apparently, a used car dealership according to Google. My husband, who grew up here, remembers this thing ‸ a diner 30 years ago. That wouldn't even be allowed in the zoning code anymore. And you might want a restaurant there, but you can't have it right now. The building, the Erdman building, was built in 1961. That sign says it was 1927.
This use, generally, the best uses for the businesses go where there's the clients. So while the vision may be mixed use, which, again, I think you do have a mix of uses there, and it is a mixed use center. If the vision is to make this a town center,
This is the uses that have been there for a long time. So other similar uses should be considered compatible. The oversight in 2010 is what has caused this problem.

I spoke on this last month. I still feel the same. I sent you my comments last month. I sent you my comments this month. The position hasn't changed. I did review the materials, and I wanted to give the applicant a chance and say in their material, talk about the tax base, the contextually appropriateness of the proposed project, saying that there won't be any increase in traffic, that it will be aesthetically improving. And I want to acknowledge what they've said, but I want to say that I

It says under policies where it's encouraging the land use and the mixed use land use has a lot of great language in this, by the way, that's in the agenda documentation. But under policies it says to promote and encourage communities to engage in a redesign step to include public participation of members of the community in envisioning redevelopment goals

And up above it talks about developing a bicycle pedestrian master plan to provide interconnectivity of residential and commercial areas, to promote the bicycle and pedestrian. traffic as an alternative to the automobile and promotion of lead design and new construction. What do you see as a potential viable business wanting to go into that location? That would ‸ enhance the community. That would bring the two communities together.
what do they vision would be a good fit for that corner? That would be somewhat like a partnership for your community. So, I was a little disappointed we didn't hear that, but I do hear their concerns.
location. So, with that being said, even though I can't envision anything else actually going in that property, we have the economy changing at this time. Interest rates are rising. Inflation is rising. That property may sit there for many, many years in this current condition it's in without any interest at all. And that's a risk that I think at this time, it looks like we're going to have to take. Because it's clear the residents are not in favor of this particular business being in that location.
I'd like to make a motion and deny it and accept the guidelines that the staff has provided for the development of this property, which is to deny the application.
Yes. We've already noticed that the CP designation under the mixed use plan is, does not fall ‸ under the mixed use. I would like to make discussion on, if anything, if we do deny that we still make some type of change to at least make it current with the code, ‸ if that's applicable.
um, this has discussed a couple of those that might be, um, adding CP that's commercial parkway to the list of uses that are, uh, or list of, um, zoning districts that are allowed. Uh, that could also be rezoning it to a different, um, zoning district that is, is allowed already in mixed use.
Aye. All opposed. Motion carries unanimous. Moving on to the second item. Which is kind of moot at this point, I would think it would be inappropriate to, to, um, to vote on that. What, what's your discretion on the second item? Okay.
