The City's minutes for this meeting are not on file in this archive. This briefing states only what the City's agenda lists. Nothing here is taken from the machine transcription.
No agenda file for this meeting is held in this archive. The agenda packet button on this page opens the City's meetings-portal page for it, where the City may or may not have posted one.
The recording's machine transcription is below. It is unverified: words and names may be misheard, and it cannot establish who acted or how anyone voted.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
127 suspect passage(s) marked in place; insufficient transcript coverage: most of the recognized text is suspect; inspection incomplete: language review; 6 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 4 voices separated from the audio.
8 short machine repair(s) (9 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 26.8% of 10,012 content words.
Dotted words (48 places) are ordinary wording differences: hover or tap to see the other reading.
127 passages (82% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (6 stretches). Something may have been said here that the transcript does not have:
00:00:04 (11 s) — neither reading has words
00:17:14 (1 s) — neither reading has words
00:34:31 (0 s) — neither reading has words
00:51:12 (7 s) — neither reading has words
00:55:13 (12 s) — neither reading has words
01:03:36 (3 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

And theoretically, the city's cost ‸ have fluctuated a lot from one year to the next. One year dropping way down ‸ the following year, going way up. With smoothing, though, We just phase in investment gains and losses.
more retiree mortality, more retirees passing away than we had expected, really in total over the last decade, has put the plan in an overfunded status. We feed the assumptions for investment return and life expectancy in total over the last decade. So that's why we're in a position now of only having to reimburse the administrative expenses. I do think that this will stay the course, probably for the next two valuations because of the smoothing. My hunch is three years from now, let's fast forward to May of 2026 when I'm here, and I do expect the city will have a contribution greater than the administrative expense.

Okay, who's making the motion? Okay, Sherry? Okay, thank you, Sherry. Okay, and then the next motion, just so I'm clear, is going to be to incrementally reduce the assumed rate of return from 6.7 to 6.6 in the 23 valuation and 6.5 in the 24 valuation.

Okay, good. Very, very good. So you have some memos in your packet. The first is that Secure Act 2 memo. And there's really one main takeaway on that. And that has to do with regard to the age

specific age for required minimum distributions is not in the code, then I do not see the need for any revised ordinance at this time. So that is the takeaway on that Secure Act 2 memo. Don't know if you have any questions. Take a brief pause and then proceed forward. Any questions? Hearing none. You

the pension fund administrator was actually embezzling from the pension fund. And the way that he did it was he was pretty much responsible for ‸ the total administration of the planning, including making the benefit payments through the city software, which is not something that we do. And what he was doing in North Miami was rather than when members died, rather than shutting off the benefits, he diverted those benefits to one of six bank accounts that he had established in his own name. So he's basically not reporting the debts. He was doing the death checks, but he was not reporting the results of the death checks to to the trustees. So really, we're not in that situation. As you know, we have regions, they make payments, you know, Sheila provides them the information and you

he was hired in house by the pension fund as the administrator. And he was really the sole individual responsible for the entire operation of the pension fund. So I went over the internal controls that we have with Sheila and we are comfortable with how we conduct business and, you know, administrate the pension fund. So
regard to internal controls at this point in time. It's really just, as I said, a cautionary tale and memo that we distributed to all of our clients. Any questions or comments on,
controls? Very, okay. Very good. Not hearing any legislative update. Briefly, with regard to our ‸ legislative session, House Bill 3 was passed, actually passed and signed by the governor about two weeks ago. And Brad may have some comments on it.
provides that with regard to investments, you cannot take into account any environmental, social or governance issues when determining what to invest in. And, you know,

how we've operated. So there's going to be no working, no impact to how we operate or any of the investments that we have. And I think Stu will talk about, you're going to have more paperwork that you have to submit along this. And I think

going to have to file some sort of report with the State Division of Retirement just attesting that we are complying with this new law. We are, as a law firm, in the process of drafting a memo for distribution to all of our clients. I think it's actually going out today, if not tomorrow. So Sheila will get that and distribute it to all of you. We do not yet know what the actual report is going to look like. The Division of Retirement has to engage in what's called rulemaking, and they will basically provide further information in the next several months as to what needs to be in that report. So
every other year, you're going to have to file that same report, probably in December, probably like December 15th of every other year. But, you know, it
a statement to the effect that ‸ we're complying with the law, baked into the investment manager agreement. So we are all over what needs to be done, and we'll get you that memo in the next couple of days. And then the next meeting will provide further guidance as to the report and any other requirements that we have to comply with. So that's really the only pension-related bill that came out of the legislative session in Florida this year. So
Florida. But again, just some more administrative reporting that we're going to have to do in the future, as if we don't have enough yet to report. It's another compliance issue we need to deal with. But other than that, everything pretty much quiet on the plan side, no legal issues pending that you need to be made aware of. So unless you have any further questions or comments, that would conclude the attorney report for this afternoon.
