The City's record
What the City's record shows
Built only from the City's minutes (1071_CC_Reg_Minutes_05_22_2018.pdf). Page numbers are the minutes' own. Discussion is in the minutes' text; it is not summarised here.
Attendance (the roll call)
Listed present when the roll was taken: Henry Parrish III, Jeri Blanco, Don Boisvert, Brenda Warner, Clarence Whipple Jr.
(Checked against the ballots and the printed roll lines.)
Absences: no absence line could be read from the minutes' text, so none is stated here; the first page of the minutes is the record.
Also listed as present (staff and other roles): Anthony A. Garganese (City Attorney), John Titkanich Jr (City Manager), Matthew Fuhrer (Assistant City Manager), Carie E. Shealy (City Clerk)
Named on at least one ballot later in the meeting: Brenda Warner, Clarence Whipple Jr., Don Boisvert, Henry Parrish III, Jeri Blanco (participation, which can differ from the roll: arrivals and departures are in the minutes' text)

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
545 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 26 voices separated from the audio.
51 short machine repair(s) (63 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 92.1% of 21,934 content words.
Dotted words (513 places) are ordinary wording differences: hover or tap to see the other reading.
545 passages (21% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
02:13:53 (6 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
As we come before you tonight, we are thankful and truly humbled by the magnitude of responsibility that you have afforded to us. We thank you for the many blessings that you have bestowed upon us, the individual blessings as well as the collective ones. We ask that you lead us and guide us along our way here tonight during these processions. We ask that you take care of us, our citizens, and those who are coming before us. We ask these things in your name. Amen.

to offer and why they need to have a seven-story hotel. We, in a two-block area of retail and restaurants, are a day destination. I have customers from Orlando, from Vero Beach, from south of there, from Miami. I have had a continuous clientele that comes back to my store, but they're not staying here. It's a day trip. And I am not for the hotel. And my fear is, number one, is it going ‸ to be booked all week? And then I put some more thought into it. Well, maybe if it's not booked all week, because it would be a one-night stay. And I did a study with all the hotels in Cocoa Beach, but I don't have the time with three minutes. But I'd like to discuss it longer and in full length. Then I said, okay, how can we fill up that parking garage? Well, I went to that meeting, and I didn't know about that meeting. And if you talk about uniting north and south, there's 10 hairdressing salons and a pirate store up there. Okay? We're a small little town. Cherish it. Make it grow in the right direction. There's three other businesses ready to leave that I know of that are putting their businesses up for sale. Talk to people who have worked their bones to make a living down here and to make it a better place to come to. Don't give it away to somebody who's not going to be looking at it from their front porch. I am going to look at that eight-story monstrous thing that's not going to be fitting in with our small downtown here. Please, I beg of you to give this lots of thought and don't give it away. It's ‸ unnecessary.

commit up to $3.7 million to support the project, and then direct the city attorney to draft an interlocal agreement with the Diamond Square CRA to memorialize the city's financial contribution to the new center project and commitments to fund pool improvements or construction, prioritize other park improvements, and fund a feasibility study for repurposing the existing center.
Mayor, members of council, community. Okay. I just want to start off with the current condition for Dr. Jolie Smith Center. As many of you know, it was built in 1963. It's just under 6,000 feet.
also ‸ outdoor basketball court. Okay. Essentially, the center is outdated, functionally obsolescent, and some of the existing conditions that exist. While currently encapsulated, there's asbestos, lead-based paint. In other words, if it's not disturbed, then those issues do not present a problem. But once you make changes and or you disturb, like the roofing or the paint, then you have to abate those environmental conditions. So the restrooms do not meet the ADA requirements. There's plumbing issues. The gym floor needs to be replaced. One of the two AC units is extremely old. There is no heat. The gas system has been shut off due to an undetermined location of a leak. And then as it relates to the outside facilities, the pool and the deck needs to be resurfaced. The restrooms do not meet ADA requirements. The lobby needs to be renovated.

nearly two and a half times larger than the current facility. The center would serve more as a neighborhood community center versus the largely recreational center that we have today. We would offer multi-programmed services for seniors and youth in terms of seniors during the daytime, youth in the evening, the afternoons, post-school programming, as well as the design to include a public health clinic.

that do not have insurance. You know, it's ‸ something that we ‸ identified that was very important ‸ to the community. Larger, more modern, multi-purpose recreational facilities in terms of ‸ the recreational court to be, you know, not just for basketball, but for other uses. And ‸ the county also runs some programs out of there, but there would be more, better management space for the Brevard County Parks and Recreation staff. This is an exterior design of the facility,
regardless of where the location was. But this is what the, generally what the facility would ‸ look like and we would operate off of. As you can see, it's

In 1998, the Diamond Square Community Redevelopment Plan, which was the original redevelopment plan, they did emphasize the need for some additional recreational opportunities to upgrade to both the Dr. Jolie Smith Park and the Provost Park locations. process, and many of you know, that the center needs to be upgraded in order to construct it, as well as potentially Provost Park programming, which could be tied into the community center. It is consistent with the city's 2016 strategic plan. Actually, there's two issues, not just the community development, in terms of the redevelopment of the city's core. And just to remind council, the strategic issue, the question as it relates to that is, how will the city raise the quality of life for all its residents, especially those most vulnerable and disadvantaged? ‸ Obviously, the center at either location would be located in one of the most underserved and disadvantaged areas of the city and bring needed ‸ programs and services to assist the community,
And I'm going to, there's a list later that in the Diamond Square Redevelopment Planning effort identified what those ‸ services were. Additionally, the center would also address the issue of crime awareness and prevention, as the expansion of youth programming activity is

and we kind of advised that we need to wait until the budget workshops. After the budget was adopted, we did send a formal letter to the chairman of the Brevard County Board of County Commissioners and requesting ‸ that they take up the item. And as many members of council know, around that same time, shortly thereafter, several members that were elected to the county commission were expressing concerns about the efficacy,
propriety of CRAs in general, and the fact that money from the CRAs, you know, that would normally go to the county. And as I think we all know, ‸ those are taxes that are generated within the redevelopment area, And that is a strategic partnership between the city and the county foregoing those tax revenues in the area they were generated to facilitate redevelopment. So that's a larger policy issue, but we're still waiting for that. In 2016, the city did identify the project as one of its legislative priorities,

one to a large degree. So, you have a site that exists today, and it shows this diagram, obviously, the existing Dr. Julie Smith Center. It's the pool, basketball courts, and then how
the pavilions. There is ‸ retention up in the left-hand corner. And then right next to the parking lot and the retention area, ‸ there is a lot there that the city does not own. However, there are code enforcement liens that currently exist on that lot. But it's, as you can see, it's not required at this point in time or anything, because there's existing parking at this site and the center, as was one of the proposed ideas in terms of locations in the redevelopment plan update was at the corner of Stone and Washington. So, here you have the aerial provost park. You have the pavilion in the middle, and that was built through federal funds,
You have some basketball courts and tennis courts, which are not used much for community action. A lot of residents expressed concern regarding the condition of some of the facilities there. Again, this park is also maintained by Broad County Parks and Rec.

that. So, just by way of information. It was one of the issues that was brought up at the meeting. So this is the site location, conceptual site plan for Provost Park. Again, retaining the soccer field, also the pavilion and the restrooms, and then adding parking, providing, you know, kind of a drive-through, the site centered, you know, at least, or rather,
with a dry retention area, the basketball courts, another smaller, flexible-use sports field. It does have a fountain and a splash pad, and I think there were a couple comments that a pool was necessary, and I think it's important to note, and I know a number of members,

And then for the purposes of presenting to the joint meeting between the council and the CRA board. the fact that we've had an agreement with the county for all these years. We have an MSTU so that our residents pay a special tax to provide funding for the county to maintain our parks. and
We've had issues with them. If you look at what the county does at the parks that they manage for us versus what we do with our own parks, there's a world of difference And it has nothing to do with what neighborhoods our parks are ‸ in. It has to do with the county is maintaining facilities that

I've been living in this community for six decades and a half plus. I attended after school programs at the Jolie Smith Center. So, I am a part of this community, an intricate part of it. And I feel, as an elected official, what the Councilwoman Warner said makes good sense to me, that we need to place that facility where it would be better utilized in a location to where all of the children will have equal access to it. And not just because it was built in a location where it was predominantly minorities. And if you guys would please respect... Would you please respect... Hold down

I am in total favor of the Jolie Smith Center being rebuilt brand new in its current location, just as you stipulated in the 2014 Diamond Square plan that was approved by the Diamond Square board and the city council. The community center should be accessible so that children and seniors can walk to that location and have all the perfect amenities that you outlined in that plan. That center has served the surrounding community for years. People have come from across US 1, from Fisk North, where the 800 apartments are, all the way down to Jolie Smith Center. It doesn't change. The location is not going to stop crime if you put it in Provost Park. It's not going to stop the crime. The center should remain where it is in the best interest of the community, particularly Diamond Square. But if you want to say the broader community, that's fine, because the folks on the other side of US 1 are going to have to cross over US 1, cross over four lanes of traffic to get to a new center. The children and seniors cannot walk across four lanes of traffic. And they deserve a new center. If you feel like Jolie Smith is run down, build the new center right where it is. Bless the people who have been there for years as seniors, the children. And the community should come first before development. People's lives mean more than just concrete and buildings going up over and over again while people's lives are just being pushed apart. Families are being torn apart. We've heard from mothers who say that Jolie Smith is a central location where their children can go while they're working at night.

is that you have a citizen participation plan that you are a part of. The Section 108 plan, when you apply for that funding, you have to include ‸ the community's input. This plan does not say you have to live in the city of Cocoa in order to participate. I'm not sure if you took other people out of the numbers, but I'm telling you, if you submit an application to HUD, and you have to include the community input, and those meetings that you had are not the meetings that can be listed in that Section 108 loan, because you have not published that for the people to see. So you would have to have another meeting, a community meeting, to address the concerns. And if you send it up showing that the community was not in favor of it, and you send it up anyway, trust me, HUD is not going to look favorably at that. And you need to understand that. The kitchen, and I want to say something that was mentioned at a meeting that I attended. I said, the new center that you're proposing does not have a kitchen.

And my comment was, do ‸ you expect the citizens to have a repass after a funeral service, go under a pavilion and cook, and then take the food up to a building? Surely, surely, surely. But don't knock what we spent all that time working on. Don't knock that. It was okay then. It should be okay now. You know, you talk about crime. When you close, Provost, what happened to the crime? out of work, off work. So I don't need to repeat. You heard everything that I said the last time, and I still stand on those grounds. I, for one, does not want to see the Jolie Smith Center move. I live in Provost Park, and
That's the place that I feel that you need to work on. But removing Jolie Smith Center out there, that's not going to change those people that like to come out there and they do most anything. I know there's a lot of drinking and a lot of other things going on out there because I live out there, and I know I've seen it. I don't want to see Jolie Smith Center move.
if you want to do something with the Jolie Smith Center, is to ‸ renovate it. ‸ And I've heard some of the people that said that they would like to see you maybe expand it.
I would go for, that you would leave it at the center, leave the center where it is, and to enlarge it if ‸ you have that money. So ‸ anyway, I think I've said enough, and you've ‸ heard what I've said,

and along with staff, you have an opportunity to invest in a community. And it's not, it should never be either or. It should be and. Your investment is very important in this community. It's important to me that we recognize, and I need to reiterate, it's already been said. You've got a number of people that ‸ showed up on May 9th in order to let you know what their voice was. And they made that absolutely clear at that time. I know Councilman Whipple,
I didn't see any of the others that are here at that meeting. But that meeting is very important. Because it really was the voice of the community. This room, I was sitting there just thinking about this. This room is deceptive in the way that it's built. The way that this room is built, we are, the people are in, in these chairs. But you all, as city officials, sit in these chairs. And it would make you think that the balance of power, the balance of power is in the front of the room. The balance of power is back here. And this is really important because when you've taken time to have a meeting,
Doesn't need to be moved. Now, I am in favor of work that needs to be done at Provost. You must do that. But right now, while the money has been allocated, don't change this. Don't change this. Because the plan has already been made. I think it's important that you follow through for the trust of the community.

Good evening. Pamela Shell Hooks. 723 Carissa Avenue, Cocoa, Florida. My first concern as an educator for 27 years with Brevard Public Schools, I have a problem with, Mr. Councilman, with all due respect, but the way that you lean back, because posture and everything, it says a lot. If that is the label that you have given us concerned citizens, then ‸ let the record reflect that the troublemakers are here again tonight for the same purpose that we were here for at the meeting May 9th. It has also been stated, Councilman Whipple, that behind closed doors, you said you don't care what the community wants. If that statement is true, and I say if because sometimes people have a tendency of saying things that may not be true, but if you made that statement, I don't want you to get too comfortable behind closed doors because there's always a crack or a leak behind that door and information will get out.

safely to Jolie Smith Center. They would have to walk farther and across four lanes of heavy traffic highway, 5th Boulevard, to get to the center if it was built there. That would create an undue hardship and fear on the parents wondering if their kids is going to dash across four lanes of highway and going in four lanes coming back home. So why would we subject our kids to that? We should not. ‸ Thirdly, relocating to provost will expose our kids in getting hit by cars and killed. And I know as concerned elected officials, you don't want that. I would not. Now, traffic safety is very important. And I know my time is about gone, but 20 seconds if you will.

Yeah, I want to make it clear to the audience and attendance tonight and listening ‸ at home that I attended that meeting on May 9th, and I went there with an open mind, and I wanted to hear firsthand what the residents wanted. That center has been there for many years, and I know it served the community, and it served it well. And what I heard that night overwhelmingly was that the community wants to keep the center where it's at. So I heard some arguments that were in favor of moving it, and I did hear a couple of remarks made about, well, can't we do improvements to
And so I'm not opposed to that either. I think we do need to address Provost. Yeah, and at some point we do need to put some city money into ‸ fixing that park up as well.

as far as usability, feasibility. It's just it needs to be replaced. And so, you know, we are public servants. We're up here, and we are listening to our constituents. We're listening to the voices of the people that we serve. And so what I said earlier, what I heard that night was overwhelmingly that the residents are in favor of leaving the center right where it's at. And we rebuild a new center.
Yes. Thank you, Mr. Mayor. This issue is extremely touching to all of us and important to our community as a whole. Earlier, I stated that I would prefer that the facility be placed in Provost Park. can tell you, to go back to, I mean, the county, city contributes taxpayers $650,000 for the District 4 Rec Fund. $256,000 of that is spent on programming and operating and maintenance expenses for Jolie Smith Center.
Okay. Okay. My reason for asking that question is that I heard something tonight in regards to building the new facility at the Provost Park location and renovating the current Jolie Smith Center. What's the possibility of that?
this is a Diamond Square redevelopment project that the city is taking on. And that they would, whatever site's not selected, you know, prioritize and program their funds to the non-selected site, but also to undertake that feasibility study. Because one member of the public at the community meeting mentioned about what could be done with the existing center. We don't know the full condition. We gave a list of what we do know. So we don't know if it can be repurposed.

I think the intent ‸ behind the feasibility study was as a result of comments made at the public meeting was, you know, build the center and then determine if that existing building, because there was a resident that was, well, what are we going to do with the existing one? So it was like, well, build the center because you're still going to need the existing center while the other one's being built.

If you'd like more information, I can get it for you. Also, we started running on a new fire station number three today. So I'd just like to let you know that-

That completes, you know, a big part of the project, which was to move our stations out and cover more of our area. Yeah. And provide better response to all our citizens. ‸ So it's a big, big opportunity to be out there now and have all that done. We will be moving in new fire station number two on the 30th. So

It's Memorial Day. We attribute to all those who have ‸ given the ultimate sacrifice in defense of our nation. And there's a parade. The parade is from
Mayor. First, I'd like to thank your fellow council members for being here tonight and speaking what was on your heart to do in regards to the very touching issue for Provost Park. And I echo your sentiments in regards to going forward. I also would like to say that Martin Luther King, Jr., he had a phrase that he said that the ultimate measure of a man is not where he stands in times of comfort and convenience, but where he stands in moments of controversy and challenge. Our community has been challenged. We have came together on one accord to do what
So I applaud those who came out and gave their honest opinion about what we need to do going forward. Although when I started, I had a preference of the proposed site, I realized that placing that facility at the proposed site against the will of the people would not be the right thing at this moment. So, therefore, I echo the sentiments of council. We had a unanimous vote to place it where it is. I will probably be off council when it comes into fruition. But

something that we all can utilize and go forward with in a positive way. So, having said that, ‸ I encourage everyone to continue to work together, whether I'm here or whether someone else is here in this position. Because it's not like sometimes

Just a couple things, Mr. Mayor. I had the opportunity to go down to Melbourne Square Mall over the weekend for Superheroes Day. And our police department was represented. It's something they do every year down at Melbourne Square Mall where all the police departments bring out their best toys. And everybody shows off their best stuff, you know. So, yeah, their biggest trucks and their most fancy toys and stuff. So, we always participate in that. So,
And the thing that was getting the most attention, other than Copper, who we all know always gets attention, was Officer Matt Rush's son, who was actually running the show down there. And
But he was making sure everybody tried on the vest and the gas mask and the helmets and all the SWAT gear. And he was passing out the little stickers to all the kids. So, I would just like to say thank you to Officer Rush for bringing such a great

that. Never seen a six-year-old that could put on a SWAT vest in about 15 seconds, but he's really good. And our other officers who participated, some of them I know were on

us well. It was a lot of fun. I do not expect to see any agenda items coming up anytime soon to buy any of the toys that some of the other departments have though,

I just got a couple ‸ things. I'm glad that ‸ we were able to vote and ‸ the wish of the constituents. ‸ We had the petition that was signed by 239 people or whatever. You know, and I'm hoping that in the future we can do something with Provost Park to get somebody on the other side of the city here something to do. But I'm happy that we're going to move forward with the Julie Center up in the area that it's at. And I thank everyone for participating this evening. And that's about all I have to say. Thank you very much. And have a great Memorial Day weekend. And don't forget to remember our veterans. Thank you.

I think that the message that I got ‸ loud and clear was the passion that the members of the community felt that night for keeping the center where it's at. And so, you know, I had to vote true to my conscience and to my heart to keep the center where it's at. Because, you know, you could just feel the passion in the room for what the community wanted. And so, I applaud the community for your passion to turn out that night. We had over 100 people in that room.

And Mr. Principal Cole and Mrs. Cole, I can't say enough, what a wonderful job they're doing at that school. And for the community as well. ‸ So, I really enjoyed the graduation service. They do a little thing with the rose.
but it's the most beautiful, touching part of the graduation ceremony that you'll ever experience. So, I just wanted to thank them again for the invitation of that also. And
You know, again, working together, everybody said it pretty well. The citizens said it best. This is what it's all about. You know, we're not living in Russia. You know, we're living in a... Not yet. Not yet.

And all of our hope it worked out all right. Right? Yep. Yep. And I'm excited. This is something else over there. So, but we have to go through the process to get there.
So, and for everybody. So, thank you, thank you, thank you. Also, let's go back again on Mr. City Manager. Provost Park, obviously, we need to come up with some kind of action plan to give you that corporate word of how we can change the environment over there.

some kind of action plan that we can look at in the coming months. That'd be great. And, you know, again, hearing from Donna earlier about the 30 vacancy signs. Is there anything that community development can, Karen, what's your take on vacancy signs? You know, like things are going backwards. Rentals are, you know, are increasing for commercial.
to share these comments that I heard tonight with Larry Lalo, who's an economic development manager. And we'll, you know, work with the city manager, share ‸ some potential ideas.

month and a half, whatever it is. It's too much. This is what happens, you know? And then, you know, mayor for six. You know? I'm joking. That's it. That's all I have. Thank you, everybody, for participating. And we're going to shut her down for the night.
