Agenda (the City's wording)
The City's agenda for this meeting is on file (CC_Reg_Packet_05_23_2023), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
824 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 35 voices separated from the audio.
62 short machine repair(s) (77 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 89.1% of 30,750 content words.
Dotted words (702 places) are ordinary wording differences: hover or tap to see the other reading.
824 passages (27% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
02:48:41 (8 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

requested that the construction be held off until after football season. ‸ They're worried about the impact ‸ to the teams and the overlapping construction and having to possibly be in two places at once, kind of splitting the teams up. So, would that be an issue as far as financing? We would roll the funding.

please let's give them a round of applause. I present this to the president and members of the Rotarians. As always, you are a pleasant presence to the eye.
not as eloquent in verbiage as the mayor is, but just want to first of all acknowledge and recognize all of my fellow members. Number one for being here. Those that aren't here. I appreciate everything that everyone's done. My year is up July 1. What? And I'm smiling because it's right around the corner. It was a good year, but it's time for change and a new present

everybody's probably heard of it, but don't know what the heck we do. We are pretty much we're a membership organization that does service projects. So we help out the communities that we all live in as well as things globally, internationally. Our organization helped to eradicate polio. That was the biggest thing that they set out to put in place years and years ago. Bill Gates is a Rotarian. I know many of y'all out there are Rotarians. You just aren't in a club. We're businessmen and women in your neighborhood. We are leaders. We are neighbors. We're men, women, wives, husbands, whatever it is. But we're people that want to make our community better. And there's no better way to help your community than being a Rotarian because we can touch every place in this world.
So we're looking to do some recognition at that point in time. Some of the things that we've done. There you go. I see some of the recipients of some monies out there. Mr. Rashad out there. So we've spoken to and we'll be

So I implore all of you all to look within yourselves. And if you want to make a difference, there's many ways, but there's a really good way by way of Rotary. So I want to thank the city for everything. Mayor Blake, Councilmen and Women. Um, everybody else that's in here.

that in 2022, we had zero murders. And it's been several decades where the city has not experienced that. So that is a big deal. And I can tell you that these officers out here are working very hard every day, day in and day out. They're motivated on making sure our community is safe. And that is a big deal.

So continue to support us.

Read into this, proclaiming the week of May 7th through the 13th as Drinking Water Week. Let's bring them on with a round of applause for Mr. Walsh.
A proclamation, whereas water is our most valuable natural resource, and whereas drinking water serves a vital role in daily life, serving an essential purpose to health, hydration, and hygiene needs for the quality of life of our citizens, or the quality of life our citizens enjoy, and whereas tap water delivers public health protection, fire protection, support of our ‸ economy, and the quality of life we enjoy, and the hard work performed by the entire water sector designating or designing capital projects, operators ensuring the safety and quality of drinking water, or a member of a pipe crew maintaining the infrastructure,
communities rely on to transport high quality drinking water from its source to consumers taps. And whereas the coronavirus pandemic has shown a light on the importance of drinking water for health, hydration, and hygiene needs, and whereas we are all stewards of water infrastructure upon which current and future generations depend, and whereas the citizens of our city are called upon to protect our source

What I'd like to say about the museum is, first, ‸ when that lease with the Historical Society was terminated, it would have been very easy to just shut the doors. So, first off, kudos to our council for not doing that. ‸ Second, understand that there is a group of people, volunteers, that keep that place going.

So we also held a photo contest, a tree photo contest, to also help celebrate our designation as a Tree City USA, and show the many benefits that trees have in our community. Okay, well, uh, we got a lot to cover and probably gonna have questions at the end. So, in an effort to talk fast, I drank two cups of coffee before I came in.
Mr. Mayor, Council members, thank you. And a special thank you to all the people that work in the various branches of the city that have helped out so far. So, with today's goal being ‸ stated, facts are, Dog Friendly Cocoa Village is known for being dog friendly. It's one of the friendliest dog places in Brevard County and is a contributor to our growing success. Currently, there are approximately 75 of our businesses that list themselves as being dog friendly. And just so you know, there are about 340 dog parks in the state of Florida.
add ourselves to that list of dog parks? Right now, the closest one is in Rockledge, about two and a half miles away. It's kind of a rural setting and a very basic dog park. So, this isn't a new idea. It made it onto the 2018 CRA Waterfront Master Plan update. And there are numerous benefits to having a dog park here. It would be a great place for neighbors and residents to gather and bring their animals. It would attract visitors from near and far for the same purpose.
the boating community, for intercoastal waterway cruisers and day dockers to come. Another interesting aspect of this would be that right now, the east end of Lee Winter Park is grossly underutilized. Dog parks historically develop a following. A community develops. It becomes a regular daily use item. And we can anticipate that if we had a dog park down at the end there, that we would see a lot of daily repetitive traffic and it would take on a whole new field into what it currently has.
on the doorstep of Cocoa Village. Plenty of parking for both cars and boats. You can see the yellow outline. ‸ Just to be clear, the parking lot is my bad artwork and not the intended area for the dog park. We'll show you a little bit more as we go. There is a north area and a south area. One for small dogs, one for large dogs.
Also, please note that the sidewalk from the parking lot to the restrooms by the pavilion and down to the waterfront sidewalk remains fully open at this time for people to bypass without going through the dog park itself. And if there was any interest, the pavilion could be included inside the confines of the dog park. Initial funding. Here's the big news. Here's where things have changed. This has been in progress and being looked into for quite a while. We had a very generous benefactor come forward and make a very generous offer.

to additional annual expenses for dog park. Things that were related to the dog. That takes the burden off the city to go forward. We've been talking about this and looking at this. Many of these things we have basic information on, but these are things that need to be discussed in more detail. Dog specific infrastructure improvements. Beyond just the basic dog park. Legal liability considerations. Rules of use and enforcement thereof. Breakdown of maintenance responsibilities and expenses and who's going to do what. And fundraising opportunities. Okay. Do understand this is a community project. hopefully sometime soon as well. And we don't want to have unintended consequences. We make a decision now and then, you know, we, we move forward because we get the funding for the pier. And now we have a dog park,
Well, as, as for the pavilion, uh, the main drawing that we did for that north area runs the fence, uh, alongside the pavilion and not blocking it. So the entire pavilion would be open on both ends and the entirety of it. So that's, that was our initial plan. And that's, that's our main plan. So that, that is, uh, accomplished as you, uh, suggest the idea of access to a fishing pier. If it's in the same place, that sidewalk that runs along the north side would be fully open. There would be nothing obstructing that. And then to the area, just to the north of the sidewalk is, I believe
So there would be full, full open access. The people would be walking along beside a fence. If it proved to be a problem, you could put up a, uh, the barrier to where the dogs couldn't see the people walking by. I don't think it would impede the, uh, access or the use of a fishing pier, which I would love to see happen. Because when we had one, it was one of the most highly utilized things in the city, as far as I could tell.
here? Do you want this? So absolutely coordinate with the city the whole way along on this for, for everything. And we would value and appreciate input, uh, to get it right the first time out. Okay. Thank you.

Uh, when we started, we used to do it every, uh, Friday night in the summer. I was crazy. I don't know what I was thinking about. Uh, ‸ now we do it for one particular, uh, month. So that's five Fridays in a row. Um, it's, there is, uh, there's a letter in front of you. I'll read it. There's a, uh,
says, starting June 2nd through June 30th, my community cares ‸ be kicking off our annual juvenile crime prevention summer basketball tournament spot. Every year,
we anticipate 500 or better attendees each night, which includes community and local leaders, organizations, ‸ businesses, and ministries who have partnered with us. As you know, this event brings our community together, along with giving our kids something positive and constructive to do during the summer months. The spot will be held Friday nights from seven to 11 for five weeks at the Jolie community center. The spot consists of the basketball turns. Like I said,

So I guess this question is really for the city manager as well, dealing with, um, because I brought up before the cost that Brevard County Parks and Rec's, um, give my community cares for the Friday night.
Because, you know, again, I, I've said this multiple times that activities like this, uh, helps our police department through the summer. Um, because it's, it's another crime prevention, uh, tactic that I'm glad that he does because on Friday nights, kids have nothing to do. You already know what's going to happen. Um, and, and that's one ‸ particular night that we know that if we do the statistics since he's been doing this 11, 12 years ago, I guarantee you those Fridays or those Saturdays crime, it definitely is down for juveniles in the city of Coco.

to come before you tonight. Rolling Thunder. Sounds like a storm. It was actually a term that was coined by the troops on the ground in Vietnam when the B-52 would fly over. The B-52 is specific to the Rolling Thunder organization that's national, nonprofit, assisting veterans in need, and the search for ‸ missing in action, like my relative, who took off over Italy in World War II, and he and the plane have yet to be found. Our biggest event every year was to go on Memorial Day weekend to Washington, D.C. 32 years of that occurred until 2019, when, as I have been informed, the FBI aerial surveillance estimated 1.7 million motorcycles showed up. People sat in city buses for hours. They requested we make this state run ever since. The next year, COVID, COVID, nothing happened in 2020. 2021 occurred, and a couple other chapters in our state wanted to run it. But with only a month to go, Rolling Thunder Florida Chapter One out of the Veterans Memorial Center in Merritt Island said we'd run it. Our president took it over and then made me chairman.
With only one month to go, we had 1,000 motorcycles and numbers of participants. Last year it was held with the infield of Daytona, and this year three months of planning in Jacksonville was canceled

And I'll let you know that in just a couple of days, we here in Brevard hold this again for the state of Florida. We are duplicating events that occurred in Washington, D.C., to the T. On Friday night, since I do not know how big this is going to get, because I have people communicating with me from as far away as Tennessee, we're going to meet out at Fishlips, one of our sponsors, and the port's parking lot's big enough, ride into the Veterans Memorial Center at 7 p.m.,

up. Gold Star families will carry the flame of freedom in front of the rolling Vietnam wall that night. If we have any Gold Star families under the sound of my voice, please go to the Rolling Thunder Florida Chapter 1 website and register because we're using our sponsorship money to feed them a dinner where they will break bread among their own with their family's name etched on the wall right next to them. Saturday is our festival in Space Coast Harley-Davidson where someone is going to own an Ultra Classic for a $10 donation. I see I'm out of time. Thank you.
is our ride for freedom. We're going to leave the Veterans Memorial Center at 10 a.m. A B-52 would fly over the Pentagon parking lot. I've described why that plane is specific. I flew in those for almost 1,500 hours. We are proud to say we have the only B-52 available in the United States, coming over our heads hopefully at 500 feet. And, of course, they're heading in from the coast. And if you ever try to turn one, Mayor Blake, I'd tell you they take a while to turn. So the folks here on the riverfront may see it. We're coming across 520, heading south on US-1, east on Pineda, and north on A-1A, ‸ encircling the base where it may be doing touch-and-goes, where networks would be videoing this. I ask all the patriots in this area to come down to the curb that day, Sunday, May 28th, as we'll be out there approximately 10 a.m. I also respectfully request that that rolling Vietnam wall comes in on 520 from I-95 at 1 p.m. on Friday. And if we may have a little law enforcement assistance with getting it to the Veterans Memorial Center in your city and with getting through your city, we would greatly thank you for that.

here hoping that this item that is up for a vote, that it is not a repeat of when it was first presented, when it was at the first reading. It was not a unanimous vote for this item it passed and we're here now for the second vote and I just hope that it's unanimous like the previous, because basically it's the same issues of going from commercial to residential, multi-family To me, if there is any negativity on this idea, which is almost a repeat for the from the previous two other points that was just passed already, it makes no sense to say that someone does not support ‸ going from commercial, which is a very high use, intensity use, to a much lesser use, which is multi-family It makes no sense at all for this not to be unanimous vote, like you all did earlier tonight on the other very similar situation. brief background on it. Previously a DA was approved by council back in 2005 as part of the rezoning of this ‸ parcel to require 50% to be single-family detached homes and the other 50% to be attached single-family homes or townhomes.

also a requirement for the minimum square footage of each unit to be 1,600 square feet. A new development team has come forward and they've proposed a couple changes to that DA, one being removing the requirement for the detached single-family home, which would allow for attached single-family. It'd still be platted, fee simple, own similar to any other townhome type neighborhood where you actually own the property that

your townhome is on. And they've also requested to reduce the the minimum living area from 1,600 to 1,248 square feet per unit. That still exceeds the minimum requirement for the RU 215. And ‸ then they've also included within the DA to offer two different exterior elevations for to promote some of the diversity within the community, the

Question. Seeing that it's not an ordinance, but it's a public hearing. Just to clear the record with the individuals in the audience. Will this come back again?
‸ No. If council approves the modifications to the DA, then that would be the new DA that rides with the land. And ‸ then the developer would probably proceed with their site plan application and subdivision plot.

When they were born it through the coquina, it collapsed, and they had to go ahead and put a brand new, get all the loose coquina out, put the pipe in, new base, new compaction, the whole nine yards about 2.2 million dollars a mile i talked to va pavement i breakfast with them all the time. The 88 homes, if you actually sold them right this very minute with the value of the house is you're looking at 123 million.

the city attorney about this, and I said, I'm gonna ‸ make a motion. And this is my motion, that the 88 homeowners will be responsible for 100% of the funding shortfalls that may be foreseen ‸ for the septic to sewer project. So those 88 homes pay for any difference. I will vote for that as long as they pay the difference because you're looking at $20 million for this project.
And I've talked to Mr. Walsh about this, and he was about $18 million. But prices have changed since then. And I believe when you start boring to that coquina, there's going to be other obstacles that the road's going to collapse, and you're going to have to put a new road in.

The motion is that the 8-8 homeowners will be responsible for 100% of the funding shortfalls that may be for the septic to sewer project. That means they're responsible for paying all the shortfalls. Because

Okay. ‸ It's my concern. Let's be feasible and understanding about this. We know for a fact, in order to help me out, just in case if I miss anything, Mr. Wall, city manager, city attorney, for them, for us to get the entire funding from ‸ the Indian River Lagoon, the IRL, we need 100% participants.
Whether or not we can get 100% participation is another issue. But at a minimum, in order to qualify for the Sabar Indian River Lagoon portion, they require the mandatory ordinance. So that is step one. Then I think as a secondary that's outlined in option two in the agenda is simply to identify if there is a shortfall, which is what Councilman Dial was ‸ talking about, if there's a shortfall, then how would that be dealt with? Meaning a shortfall above and

That's why we're here tonight. This option is determined. If option two goes forward, there are some details that need to be laid out. And one of them is who pays for the shortfalls. So it's either the utility or the ‸ customers.

And I just point to our own comprehensive plan as well as some of the legislative actions that took place in this session, including $100 million more for the Indian River Lagoon, an endangered water body where we know septic systems are a big cause of the problem. They also determined that local governments will have to consider the feasibility of providing sanitary sewer services for those developments with more than 50 residential lots.
excess nutrients? And then lastly, that it will be required, those that have conventional septic systems will be required to either hook up to a sanitary sewer or get enhanced
So, there is definitely some direction from a lot of places here. And I just want you to be aware that we are moving to protect the lagoon and the state legislature has supported that as well.

then the J&K, because of the Save Our Indian River Lagoon issue and the state mandate to try to clean up the river, ‸ the city would mandate for at least those 88 homes and then likely, in ‸ my view, ‸ other properties that are on septic that are east of US 1 that also contribute to the same health issue that's been identified

the sewer maybe out there. So that there's a way to get ‸ to work with that. But the folks who are on the east side, I guess definitely gets a little trickier.
And just one other point of clarification is that ‸ the sewer actually has to be available. Okay, so you can ‸ the law can mandate and the law is it's mandated once the sewer is available. And depending on the type of property, it depends on the distance from the from the available utility line.

lost here. That's page three or five. There's ‸ the option to and we have a and B. So ‸ we went with B and the homeowners were responsible. Are we saying responsible for the hookup onto this to the system, the sewer system?
think what we're saying is, is or I think what was stated by Councilman Dial originally proposed was simply if the costs turn out to be 12 million and we can only fund 11, then the million dollars or half of whatever the overage would be, would be would be the responsibility of ‸ the homeowners collectively and divided, I guess, equally in some way.
So, so just just so you understand. So ‸ if you didn't, if you didn't look at the agenda item with the two attachments that were in there, one of them was just kind of a cost breakdown. Showing the Sabre, I mean, Lagoon funding and what we would anticipate would be the best grant funding available, the best match, which was come from DEP right now and
just based on on distance ‸ and whatnot, trying to make an estimate as to how much impact would be on the person's property. That was estimated about 2.9.

understable and for one thing we have to go for a grant So we have to come up with a number and then we have to stick with it And we have to go and once we go with those numbers if the construction would exceed that Very very difficult to get another grant
So so you're looking at okay Well who pays the over just should the utility step up and pay those fees or should the homeowners have some responsibility? That's what that's what's before you tonight So it's really about you know the option a is a very easy option if you will because it's simply Allocating ‸ the the dollars for the advanced septic B is complicated
have a policy in a way to enforce that and really action on council is is an addition is simply If it's if it's a you know ‸ overage How do we recoup those overages? ‸ That's even a deeper question which we don't have a policy for meaning On average, it's about seventy thousand dollars per lot like every all these calculations that I did a SAR for a hundred percent Participation I'm just assuming that everybody's going to connect if we do

to go into the river So I don't see that as a great plan But for those areas where it's certainly infeasible to have an advanced septic system Then that makes sense Finally I would change it up a little bit And I would offer you guys a different opportunity to vote on I would have you vote and say that If the public infrastructure project comes in overbid Then that should be the ratepayers expense They all benefit from a beautiful lagoon You've used actually loan funds in the past And not even increased sewer rates Or water rates basically So divide it up Make the public infrastructure the responsibility of the ratepayers And make the private lateral line expenses The homeowners if they come over Divide it up equally

Thank you, Mr. Mayor. This item has several actions that are being requested within this. One of this is to approve increasing the city manager's purchasing authority to $75,000 from $35,000. Of note, that level has been at $50,000 since 2010. Also, to request to change the formal sealed solicitation threshold from $35,000 to $75,000.
And that, excuse me, will impact approximately 4% of the city's annual purchases within the bid thresholds. So that's just exempting an additional 4%. Also, to request the city manager's approval authority for

So staff needs to respond quickly. Also, to request to allow the city manager to issue purchase orders and pay invoices for utility services such as electric, gas, fuel, solid waste, telephone, water, sewer and stormwater services. Because currently every year we have to go to council and request because it's over the city manager signing authority citywide to allow us to pay bills that we need to pay right away like our power bills.
operational procedures related to purchasing and contract policies and approve financial policies as deemed necessary. And this would be any kind of financial related policies would be following GFOA best practices to come to council. Large things like the investment policy and the fund balance policy. So
policies would certainly come to council. However, if city council decided that some other policy wanted to be adopted through a formal resolution, we would certainly come back with that. And that would allow us to make some changes in the farm that need to be made without having to go through a resolution process and an agenda item process to make operational changes that we need to do, such as switching our platform for bidding from demand star to vendor link.
with a resolution. And there's a lot of operational changes that we need to change and adapt to oftentimes very quickly. And so it's kind of cumbersome to be able to make the change to the farm because
but because of your impeccable track record. Every time we've been applied, it comes back unblemished. So I close to you, this is voting union staff now for the finance department, but it's teamwork and teamwork. Yes, sir.
