The City's record
What the City's record shows

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
782 suspect passage(s) marked in place; inspection incomplete: language review; 3 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 34 voices separated from the audio.
62 short machine repair(s) (88 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 89.2% of 28,455 content words.
Dotted words (921 places) are ordinary wording differences: hover or tap to see the other reading.
782 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (3 stretches). Something may have been said here that the transcript does not have:
01:25:16 (7 s) — neither reading has words
01:56:57 (7 s) — neither reading has words
02:40:44 (6 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

member this was for anybody and actually all 26 YMCA's throughout Central Florida did this that week. And then we follow that up by our Healthy Kids Day, which was that following Saturday and on that day we had
to let them know not only what the Cocoa YMCA is there to do for the community, but we also open it up to other vendors that were based around health and well-being and spirituality. ‸ to let everybody know we are here to support the community and I want to thank the city of Cocoa for helping us get the word out for our free swim lessons because you did get it on your Facebook page you did spread the word and I think that's why we had such a very successful event so once again I want to thank you
sir even though Florida is the peninsula ‸ surrounded by water, a lot of our students, our children, do not know how to swim. And that speaks volumes and I thank you for investing I mean you're actually saving someone's life because they now can swim. And that makes a difference.

considering locating in. We have so much more going for us. You know we've got we've got Cocoa Village we've got the Indian River Lagoon the most diverse estuary in
the nation we've got NASA we've got the Florida Solar Energy Center we've got the university we have got all the seeds of a really spectacular bigger city and I know I get the jobs and I really we need the jobs absolutely I think I'm probably late to the table to even you know bring up my objections the county has supported it and I suspect will be supported here but I I do want to challenge you and Walmart because Walmart can find a way to be a shining star within our city amongst all these great things we already have going for us they are doing some great things with solar around the country so
could do for us in terms of making this campus a model that could be held up, that we could build on to expand our kind of cluster of attractions here. And one of them I would hope would be high-tech already is and solar since we have the Florida Solar Energy Center here but they also are talking about a large campus and I think that there are a lot of great things going on with green infrastructure which could be very helpful as well and so anyway I'm just ‸ thank you for listening and I hope that we keep in mind how much we've got going for ourselves and they need to understand that we know how great we are thanks thank

up to the back door I just had a new floor put in my back room I it's been since not last Mardi Gras but the Mardi Gras before that mr. Troy Stefan detached the water drainage into the empty lot that he prepares to build new construction on. The water has been coming down into that alleyway, filling up, and it is greasy, filthy, dirty. When you open up my back doors, there
last time I came before you they were pouring grease into the ground. Okay? My concerns are a lot of concerns for this area and for my own investments. Number one, if there's new construction and there's no plans for dumpsters and and I come before the city and say

where is the dumpster going to be off-site we're off-site? Once the bank finds out that the trash that they're throwing in their containers are going to have rats then they're going to think twice about hey
take these restaurants and all their garbage and their fish and their shellfish and their grease and their oil I'm frustrated I don't want to raise my voice but I'm at a dead end here and I don't feel that after 30 years of working as hard as I have to build my business that I have to go get an attorney to deal with every problem I have with the with Troy Stefan who plans on building in the city I hope that somebody will take a good look at what his plans are and see that he's up to code. It's it's a great concern of mine. Please, help me, direct me tell me where to go how to find help here ‸ thank
I saw the plans I'm not a builder I don't understand them I actually went for help the gentleman who built the new construction for Ryan's I met with him this week so he could go over some of the plans so maybe I could understand them better but I'm not a builder so I don't know you know where he thinks he's going to tap into I've already you know had an attorney dispute him on my water drainage off my roof and I've just put a new roof on my roof in my building and he hasn't done anything to any of his property since he bought it.
and they're they're not doing it and it's not their job to do okay I ‸ just want some direction if I can meet with anybody that can help me understand the plans that are going to take place and how he's going to connect to my water drainage off my building

The project is applying for, well, will be applying for workforce training grants through CareerSource Brevard should this project come to fruition. The port is applying for a TIGER grant, which stands for Transportation Investment Generating Economic Recovery. This grant assists with funding to State Road 524. And the city, ‸ again, on behalf of the project, is applying for a State Road fund in the amount of $1.5 million, which is currently pending review by the state.

the city, at least ‸ from a fiscal standpoint, I'd just would like to comment, this is the former Brevard Crossing site. And if you recall the level of intensity and the density that was going to be developed on that property, this subject, at least this portion or even its entirety, if you look at ‸ the proposal and the conceptual with the port project, ‸ it results in a far lesser intense and dense development than is approved and or permitted in the comp plan, the future land use, the development order, and ‸ the zoning district, the UMD zoning district. So that being said, and I would like to just quickly address, we are not at a point where absent you've seen that conceptual site plan, they ‸ have to make their ‸ there's no decision been made yet. Walmart has to make their decision. And if they make their decision, then based on our performance-based agreement that we're proposing to council this evening, is they have a certain time frame ‸ in which to perform in terms of submitting their site plan, ‸ all the requisite permits and everything that they have to comply with. Like right now they're working with the Army Corps of Engineers.

responding they are responding to ‸ I think it was a request for information. ‸ They submitted their stuff. I think they're responding to additional information that was required. So I don't
personally myself, you know. But it's ‸ I think everybody was caught off guard when the Army Corps asserted jurisdiction after there was a DO on the property, and the one developer had done all the mitigation for the wetlands going back in 2002, 2003. So but anyway, so when the site plan comes through, we will address a lot of the development requirements, you know, of which we have been talking, and if you recall, the UMD has much stricter, you know, requirements in large measure, you know, although maybe less to the industrial,
So we'll address those concerns. I did hear the concerns about, you know, the potential for the incorporation of solar and green infrastructure and greening the site, if you will. We certainly will, at the appropriate time, you know, approach them and discuss it with them. ‸ And it's ‸ you know, obviously it's not in our code. This is going to be, you know, as and I'm not their salesman, but this is what they've emphasized to us, a state-of-the-art facility in terms of in the incorporation of high tech and technology, you know, running this facility.
First, we're going to start off with economic impact. We did the EDC did run an economic impact analysis for us. While there's 239 jobs at an average annual wage of $42,000, the total net result for job creation is about 362 when you consider the indirect and induced job that would be included with

to our strategic plan and discussing the importance of the port project, but also in the strategic planning process of which later tonight we're going to, you know, present to you the final the goals, objectives, you know, for the purposes of adoption. But in the community and the economic development committee, it was, you know, specifically discussed the catalytic, you know, importance of the port project ‸ or the port property, if you will, and what that could do in terms of inducing additional economic development.
And then the other focus is working on the areas that have been, you know, are underserved and disadvantaged, you know, and they have some challenges, whether it be through land use or whatever the case might be, you know, working on them. So,
growth corridors. But so we looked at in this model this is our fiscal sustainability model, if you recall how important in terms of placing the city on a path to fiscal sustainability, what ‸ the port project would mean if it opened in 2018. And you can see highlighted there, or at least in the oval, is the increase in property value or the property value adjustment as it relates to both, you know, the natural occurring increase, you know, presuming that there's not any, you know, recession or reduction in value. But the addition of additional property, in this case it was the literally, it was the $100 million. There was $80 million

when we had this discussion both at the budget priorities workshop last year and we talked about it in the strategic plan was to how could we use our resources that we have, some of the reserves that we built up, to financially induce and attract economic development that would have a long-term effect on the city's financial horizon. when we first presented to each of you individually. It's actually with the new package. It's now eight and a half to 12 and a half years. But the point is, under the hybrid approach, you get a return on investment in eight and a half years. And this excludes any other revenues that are associated with the project. This is just based on ad valorem taxes. And under the traditional incentive package,
So, you're one, we're realizing the ad valorem increase to help stabilize the general fund more quickly. We're inducing and accelerating the economic development catalyst projects that we were trying to. And in terms of the impact to ‸ our ad valorem base, the project in of itself represents 10.6 percent of our current tax base, you know, for it going on the ‸ tax rolls. that's offering them the site at no cost. So, but the city, the county, and the city AVT programs, they require annual reporting and validation annually. You get the reports every year for the other projects that we've done. And then with our ED incentive agreement and our ordinance, we have clawback provisions. So, if they do not perform, you know, we invoke the provisions and the obligations in the agreement to induce performance. What's the risk?

Good evening. 2115 North Indian River Drive. Larry Koss. Just a couple comments or questions. I understand new jobs is great for this community and I support it. I just want to expand on what my wife said about solar and green infrastructure. And I heard the city manager say,
don't have anything in place that if a new business comes in our area, we have nothing in place that says, well, we want you to be either silver, bronze, gold, or platinum lead building. Right. Right. It's a practice, you know, for water, electricity, and so forth.

for future. Sure. I was waiting on that. Okay. The second thing I wanted to mention was, like, across the street from Publix on Cocoa Commons, empty building behind McDonald's and CVS for years. And I see land clearing to the west. And I'm like, okay, we're going to put up another strip mall, and
‸ It's always priced. So some communities, in order to give a permit for a new business to put up new buildings, there should be an incentive to remodel existing buildings. So, because the more gray that we put, the more storm water, this is what I'm getting at. We already have gray infrastructure built. So those are the two things I wanted to bring up. Thank you. Any questions?

been to the meetings, and I do have some concerns. And one of the concerns that I have is there has been a history of that building in the last four years just sitting there not being maintained. And what is happening is it is affecting the other properties that are behind it. At 711 Howard Street, that's Tony Hickson. At the last meeting, he came in and he advised that there were no gutters on the building. And when it rained, it would wash the dirt down in his yard, and he had to bring in truckloads of dirt and that kind of thing. And he has written letters to the city complaining about that. And even at the last meeting, he spoke at the last meeting here that we had here, and someone said that they were going to follow up on it.
to a certain degree so it will not affect other people. And one of the problems they had was with the plumbing, and it was because it's an old fixture and stuff. And so it's a history of ‸ not being maintained. And also, there was a discrepancy between what was said by the manager and his abilities to try to fix it up and try to rehab it for a residential.

That's ‸ the owner of 826 Roselle Jones. I've been before you before on code enforcement issues for that property, and you've heard Mr. Beheer describe some of the issues that he ran into when he bought the property. I'm here to you today, though, to express my client's opposition to the proposed rezoning. This is number three and four on the agenda. My client's opposition to the rezoning includes approximately 40 residents that live in his building, as well as there's also essentially all of the surrounding neighbors in the immediate vicinity of this property that I've spoken to also oppose this. ‸ There are several reasons. First, the property is just unsuitable for the commercial purposes that have been put forth. There's been many suggested businesses, churches, doctor's offices, and so forth, but this is essentially an apartment building. It's very similar to the building that was purchased by my client. We've heard some people talk about renovations that have been performed on the property, but I can tell you from a legal standpoint that there's been nothing significant to change the fact that it is an apartment building, nothing that would make it suitable to be a church, for example, which is one of the businesses that was proposed. And I can tell you that because just earlier today I pulled

official record search for the property, and there's been no notice of commencement recorded on the property since 1998. The current property owner purchased in 2012. They've had it for four years. And I don't know if ‸ some of you, I'm sure, are familiar with a notice of commencement. That's required essentially to get a permit, to do anything that's required for permitting, changing windows, anything significant, anything that would include the several hundred thousands of dollars that my client invested in his property, most of which required that. None of that's been done. Despite what Councilman Blake has said, and I take him at his word that he guarantees, but there's only so much that the council can guarantee. Once the proposed zoning is changed, you can't take it back. And there's nothing that would, there was nothing that could be done that would require Mr. Muhammad to complete everything that he's promised. And up to date, he's essentially, hasn't done anything that would require a notice of commencement, which is fairly minimal. There is, without any guarantee that the renovations would be completed to make this property suitable, or that any specific type of occupant or requirements for the occupants would be complied with, there is a significant risk that this property will return to the increased crime rates and the increased problems that we saw previously. If I may continue briefly. Well,
What we're looking at here is a short-term gain, whether to incentivize for the short-term property gain that would be achieved by changing the zoning that would be for the current property owner.
well, thank you. I appreciate it. That was as fair as I could be. I understand. Justin, thank you. Thank you. Anybody else in the audience that can speak on this? Yes. Mohammed, come on up.

You know, granted, I'm there during the daylight, but there doesn't seem to be an issue of any kind going on there. So, I mean, it's better than it used to be. That's for sure. Both buildings. But ‸ the building on the right with the palm trees and everything, I mean, it looks great.
‸ I mean, it's obvious that it's being maintained. It looks good. I'm just confused as to why anybody thinks it would suddenly deteriorate and be a detriment to the community when it hasn't been lately, anyway.
‸ And if I could add, just in order for that building to be converted to a commercial use, there's going to be ‸ quite a bit of interior work that will need to be done.
So, there's a lot of work that they know that they have to do inside of that building to bring it up to commercial standard to use it as office. And this goes back to the ‸ health, safety, and welfare, and the return to the criminal activity. To address one of the questions, it wasn't necessarily the vacancy that would lead to the criminal activity. It's the lack of control over the property. And what ‸ the neighbor, my client, has done has imposed restrictions on the tenants, restrictions on the use, and proven ‸ structural improvements to the property. None of that's been done in this case. So ‸ if the council is going to approve the zoning amendment, I would say at least make it fair for a similar property, similar to my client's property. And I would propose to put those same sort of requirements on the property owner in order

area. The purpose of the overlay district is to establish design standards to perpetuate ‸ positive design elements, and the residential and commercial patterns found within the Cocoa Redevelopment Area. The sub-district, or the overlay is made up of nine ‸ sub-districts, and there is a catch-regulating plan. The regulating plan is the principal tool for implementing the standards contained in the overlay district, and it identifies by sub-districts building types and street setbacks for the overlay district. Building types are allowed in particular sub-districts where indicated on the regulating plan, are allowed throughout the sub-district. Building height is not measured by physical height, but rather it's measured by number of allowable floors. And in this case, the sub-district where the subject properties are located is in the Cocoa Village sub-district, which, when this was developed, and it's primarily based on existing built environment, it required a minimum of two-story structures in the sub-district. So you could have a minimum of two stories, a maximum of five stories. So it's a unique situation. Normally you don't have a height minimum requirement in most

Thank you. Yes. To allow those parcels to construct single-story commercial structures, which they currently do not allow it. You would have to ‸ develop a two-story structure. This is kind of in response
some development proposals, some ideas out there. If somebody wanted to develop now on any of those properties that contain a single-story structure, and they were to demolish one of those buildings, they would have to rebuild a two-story. So it really doesn't give them the flexibility to construct a single-story structure on those properties. So we felt it was appropriate to amend the zoning sub-district with

And with that, I'll go through the actual timeline. May 2014 is when city council came together right here in this room with Dr. Mike Abels, professor there at UCF who facilitated a visioning session at which all members of council agreed to the seven strategic issues, of which one strategic issue was later added civic engagement. and we used that, those issues to proceed forward to formulate committees to develop a work plan that would address those issues over the next five years.
mayor called the Crime Awareness and Prevention Summit in which we drew stakeholders from the regional area as well as the local area to come together and discuss crime in the community and how we were going to address it.
members were identified and confirmed and those meetings began in January to develop the actual action items on how we're going to manage these issues, of which City Council appointed various members on some of the higher profile issues facing the city. From January to May 2015, the committee meetings were ‸ held and discussions to address the issues. May to July 2015, the committees came together and finalized the items that would be used for the work plan. and city council

refined from February to March 2016. City council reviewed the goals, objectives, action items. Those of you with concerns brought those forward. We made changes.
As you all are aware, crime image, both physical and emotional, economic development, employees, fiscal sustainability, community development, focusing on the redevelopment

public safety, and civic engagement being the strategic issues that were identified and then the questions associated with those issues. For the first strategic issue of crime, the committee
to reduce crime within the city of Cocoa ‸ by 50% based on UCR reporting by the year 2020. And what you see is goal, subsequent objectives underneath the goal, and there are numerous action items under each objective. I don't include those in the presentation for purposes of brevity, but once the plan is adopted, you will be receiving a complete book with the ‸ implementation matrix containing all the action items, timeline for implementation. The second goal was to address long-term social issues contributing to crime within the city of Cocoa through community policing. In fact, just today, I came across the
It was a task force that was commissioned after the Ferguson, Missouri crime issues, of which a number of our objectives and action items are consistent with what they're putting out. And so we really are looking at the next level. and essentially the focus of the committee was on how do we engage the citizens in our crime prevention efforts. And a lot of those action items are directly related. I would like to recognize those members from the community that assisted in this.

and Bo West. Next, we have the image, and we're talking about ‸ the physical image side. We had one committee made up of the physical and the emotional and this is dealing with the physical image. And earlier tonight, Mr. Koss spoke about the ‸ gray areas of the community and he's exactly right. That's ‸ what we discussed in our ‸ committee.
there isn't a lot of beautification efforts taking place on both the ‸ private side and then in some areas of the public. And so ‸ the committee has a couple of goals. One, to create a sense of place, a destination.
Flag: numbers, amounts, negation or names differ between the machine readings · 02:22:24–02:22:26 · unresolved: the words are not shown (unclear audio); listen to the recording
The second goal, to build on the success of Cocoa Village, the image, to expand and improve the physical image of the city overall. Take elements of the village, bring them out into the city, including, you know, green space, beautification with the trees. And then ‸ the second side of ‸ the issue was the emotional side. And that's the side, you know, I think Councilman Blake displayed it earlier ‸ in relation to crime in this area. And that's exactly what we had discussed in the committee is that we all need to be champions for our community. If we're ever going to change the perception, we need to speak out when someone, you know, makes a misinformed statement. And so ‸ essentially the crux of this committee was to recognize the issues that we're facing and then also address them as they come out. And the first goal is to manage the perceptions of the city of Cocoa. And I think we're all familiar with,
In fact, on the committee, as you'll find, we did have a member of the media from Florida today. The second goal to ensure city resources are coordinated to best promote the city. With the addition of
clear and succinct way and the way we want it to be heard. And so that's going to require proper coordination of the resources to ensure that as we move forward, we continue to manage our perception. In recognizing the ‸ members of the committee, we had participation on the ‸ physical image side.

The next issue was probably second behind crime as far as importance for the community in addressing. The first goal is to implement a neighborhood improvement plan on a neighborhood-by-neighborhood basis throughout the city of Cocoa, especially those neighborhoods not being served by a community redevelopment area. And in the committee discussions, I can tell you that it was all over the place as far as the physical locations within the city. And some of the challenges with that is, you know, everyone wanted the ‸ village to kind of expand throughout the city and ‸ have the same appearance. ‸ And the reality is there are different issues facing each area or neighborhood within the city.

And so we're working in that area right now on that goal. The second goal is to research the following programs and incentive opportunities and assess ‸ viability in targeted neighborhoods. We're talking about residential development, assisting ‸ the private market, and improving the image and quality of the housing in those areas. The third goal, promote equitable development to achieve and advance social, economic, health, and environmental justice. That's, as we develop within the city, we are hoping to meet those needs of the ‸ community right there,

This committee had a large number of participants. It varied week to week or meeting to meeting based on the specific topic. And I've got to extend a thanks to all of these members as we called on them for those specific items. They were there and they dedicated a lot of time to this. Fiscal sustainability. Essentially, the committee set out on this to develop a way to put the city on ‸ a fiscally sustainable path. And I'd have to say initially we were a little bit lost on how we were going to do that, but the answer was essentially right in front of us with the Burton and Associates model that projects, you know, the future and the anticipation of what we could expect. And then that would guide our decision making. And so the first goal is to maintain long-term fiscal sustainability. The second goal is to promote greater ‸ transparency in budgeting and financial matters. And the third goal is to continuously increase organizational efficiency and effectiveness. Outside of the fiscal sustainability in the decision-making process, it was also noted that fiscal transparency with the public would be a key benefit to long-term fiscal sustainability ‸ and involving them in the process. Members of that committee, Terry Butler, finance director, currently she was the finance manager at the time and the committee chair,

from Jackson Private Wealth Management. Public safety. on this committee. the employees of the city. As we all know, the employees are the ‸ backbone of carrying out the plan, and they were certainly involved. And the biggest things we heard from this committee were regarding recruitment, retention, you know, keeping ‸ employees and keeping them happy, and that being through communication and incentives, because a lot of them do value their work, and ‸ they enjoy working for the city. ‸ The first goal is to recruit a highly qualified workforce that is reflective of the community they represent. was the assistant city clerk at that ‸ time. Frank Palmieri, Tony Jones, Brandon Cox, and Robert Steele. Now, we did have a follow-up this year with a community survey, and that essentially was, we utilized the strategic plan, the point at where it was, to kind of design the community survey,

something of that magnitude that I think that we need to be clearly made aware of it. Myself and a few others went there and patrolled and cleansed the park.
I didn't leave that park until about 1130, picking up trash that people left behind. And I know when my Latino brothers and sisters use it, it's clean. want to get it to you all immediately. The League of Cities, the 90th annual Florida League of Cities Conference, August 18th to the 20th in Hollywood, Florida. If you ‸ just, you know, please let Carrie know. And she'll make, you know, coordinate for those that, you know, are desirous of attending. And then at the last meeting, as you're aware, one of our former firefighters provided a $2 check towards the booster reel. The city did, you know, in its donation policy. It has a donation policy, but it didn't exactly cover that. So absent having a concrete plan and or desire to modify and pursue the booster reels, ‸ we returned the check and we amended the policy to include because we didn't want to take funds under the pretenses that, well, we're going to do this project when at this point in time,
the fire chief and everybody evaluated, there was a committee and a decision was made for, you know, a variety of reasons.
