The City's record
What the City's record shows
The City's minutes for this meeting are not on file in this archive. This briefing states only what the City's agenda lists. Nothing here is taken from the machine transcription.
The City's agenda: PA_Reg_Notice_05_25_2023 (its items are not yet read into this briefing).
The recording's machine transcription is below. It is unverified: words and names may be misheard, and it cannot establish who acted or how anyone voted.
Agenda (the City's wording)
The City's agenda for this meeting is on file (PA_Reg_Notice_05_25_2023), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
162 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 8 voices separated from the audio.
16 short machine repair(s) (22 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 94.0% of 6,450 content words.
Dotted words (146 places) are ordinary wording differences: hover or tap to see the other reading.
162 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

I guess it's me. Feel free. All right. You don't mind. Bow your heads. Father God, we ask your guidance. We ask your influence in making decisions that affect the good citizens of the city of Cocoa. And we ask that you protect those citizens who have less and are unable to do more themselves, that we give them the opportunity to live well in the city of Cocoa. Amen. ‸ Please be seated.

So at that point, from our perspective, from the police department, we do an administrative review, uh just to make sure that the officer didn't violate any policies and things of ‸ nature, to determine if there's any possible violations, and determine do we need to do an additional training. Yes, sir. And because it's, um not in the brief summary, I asked about it so that it can be a part of the record. because I know that one of the things that we do as a committee, and I understand that the discipline isn't always something that people might want to know about, but I understand for purposes of what we do, um if for whatever reason we believe that that discipline is excessive or, or insufficient, one of the things that we do is make recommendations. So from time to time, we might ask about it, even if it, you know, isn't something that's primarily, or usually

‸ You know, I just want to kind of add to a little bit more about this David audit. So, um when, when they log into the system, it says you will use it for business. So that's pretty clear right there. So, uh we do the, we do those audits, uh regular to police ourselves. um and, uh when we find those violations, we make sure we take the right action. So he was, there's a pretty serious discipline too, for his first defense
This, this is, and the reason why we do it, this has been a, a database that has been widely abused over the years. um years ago, we didn't have independent sign-ons. It used to be one sign-on for the agency. So anybody could run anybody and really not know who ran it. So actually,
got, you know, caught doing the same thing by using it for personal reasons or just being nosy and running famous people. So that's why this is such a restrictive um program because it has a lot of information, private information of anybody in the state of Florida with a driver's license or an ID card. So that's and there's another component to that where you add ‸ emergency contact information. So you put your wife or your child in there to notify them in the event that you were you were involved in a serious accident and we didn't

It's definitely understandable. um Just speaking from the perspective, stepping out of my uh position as chair and stepping into my position as attorney um
you know all u.s citizens have a sixth Amendment right against unreasonable searches and seizures. And uh it's considered a search uh when someone is looking into information that is not available to the public um
if someone is abusing these databases um and misusing information that someone expects to be uh confidential and has an expectation of privacy in that information.
I think that you ought to uh look at also the uh civil actions that you can take uh as as a complainant when you find out that somebody has utilized the system improperly. So that's been my experience that police agencies particularly don't want to have this happen at all. And they utilize their means ‸ of review to determine that somebody is not abusing the system. When a complaint comes forward, they address it such as the chief did in this case. uh And that's important for another reason, because uh

So when we have a situation like that, we have to report it back to, is it FDLE? Yeah, FDLE, that misuse occurred and what actions we took. And they can now in turn decide if they wanna ‸ do something due to the person they violated.
So, right, so in this scenario, there was no, intent on the officer's part to use the system inappropriately. He thought it was okay to run this person to ride along with us, which is not needed. Now, in the instance where it was, you know, someone running their ex-wife's new boyfriend, officers are terminated or suspended severely for that type of violation, or they lose their certification from FDLE. That's how strict this is.

It is further alleged that Officer Kelly battered the victim and loaded several firearms, subsequently discharging those firearms within the residence, such that the victim and Kelly lived in together with no regard for the safety of the victim or their neighbors. The victim alleges that Officer Kelly held her against her will and took her cell phone from her, preventing her from calling 911 to get help and warn law enforcement of his intentions to do harm to them and her.
