Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
292 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 18 voices separated from the audio.
33 short machine repair(s) (38 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 92.4% of 12,077 content words.
Dotted words (327 places) are ordinary wording differences: hover or tap to see the other reading.
292 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

We have speeders to the point they come around the corners, they see that traffic light, they see it's green, and it's off to the tracks. Just around me, just four houses around me, there are 15 children. The boys love to play basketball. Oh, heavens, do they? And they're always in the street, as they should be. Okay. Recently, the police department has put up a sign warning everybody what the appropriate speed is. It won't do any good. The ducks are being killed on the street because they're just speeding. Is it young people? Various ages? It doesn't make a difference. You've got stop sites there. Okay. The only cure I see is a speed bump. And that's what I'm asking the council to look into, to save the children before they're hit. God knows I don't walk that fast across the street anymore. Okay. So I certainly wouldn't be able to get out of a speeding car's way. So I'm asking the council to look into the fact if we can't get a speed bump. And I'm requesting it between Westview and Kensington. Because that's the biggest straightaway. And like I said, they don't slow down.

pages found in a typical preliminary subdivision application. This is part because the original PUD is still in effect and that approval included all the relevant engineering detail customary to such a project. City staff have inspected the site work completed and have given approvals. In addition, because the site work is completed, the applicant is requesting approval of the final subdivision along with this preliminary subdivision application. wetland and track P as well as the stormwater pond and track E. 3.47 acres of open space credit towards the minimum 25% requirement for the PUD. ‸ Unlike phase 1, the roads created in phase 1B will be private roads maintained by the Adamson Creek Homeowners Association with an easement reported on the plat towards the city of Coco. The plans have been reviewed by the city staff for consistency with Chapter 18 subdivisions and with Appendix A zoning of the city of Coco Code and found to be in substantial compliance. The majority of the lots created by the subdivision are 50 in width by 120 feet in depth which equates to 6,000 square feet of lot area. Lots on roadway curbs are allowed at a minimum width of 25 feet and corner lots required to be 15% larger than the interior lots. This subdivision plat meets these requirements. There is no minimum lot size under PUD zoning and minimum setbacks and distance separation between the structures ‸ will be addressed when a building permit is applied for. So we're waiting on just a few more comments. The city's floodplain reviewer, he provided his draft comments today and then also the

PNZ Board recommended approval with conditions. There is one property owner that spoke before, Planning and Zoning Board. He is actually kind of landlocked in between Phase 1B and 1C and he expressed some drainage concerns. So in talking with D.R. Horton earlier today, we're requesting to add another condition that they provide solutions, a solution that can demonstrate that the drainage would not impact his property.

Mr. Mayor, members of council, the item before you is a request to approve a settlement implementation agreement between Virgin Trains, U.S., Florida, the LLC, and the City of Cocoa to approve conceptual plans and an amenity schedule and the construction timeline for a residential subdivision consistent with the RU-17 zoning and their authorized city manager to execute an excavation permit on the following property, commonly known as the former space needle property,
the stipulated settlement agreement made and entered into December 11, 2007. I recorded ‸ Brevard County official records and that agreement was between the City of Cocoa and Brevard County. Just by way of background, the property is ‸ located at the northeast corner of State Road 528 and I-95. It's 246 acres. It was annexed many years ago and it was subject to litigation both on the annexation, future land use, and the zoning. The City prevailed in the future land use as well as prevailed in the annexation lawsuit and only but for the- we entered into a stipulated settlement

to avoid unnecessary legal expenses if the county wanted to proceed with appealing it to the Supreme Court. And the stipulated settlement agreement provides some conditions related to the development of property, most notably as it relates to access and then also gross permitted density. So the stipulated settlement agreement does provide that

depicted in the conceptual plan, the excavation permit would be subject to our Chapter 12.5 of the City Code, and will be in the form of an excavation permit agreement, which will be executed by both parties. Uh, in Section 11, it does provide for the, the,

So, the overall density proposed at the 320 units, uh, it's in the agenda item and I think it's important to note in light of the fact that there was public concern regarding over development of the property. Uh, it's, again, it's 2.03 that's provided in the stipulated settlement agreement. Uh, ‸ yes,
with the rear yard having at least a 15, uh, natural, 15 foot natural buffer. And, and what they're proposing is 75 by 140. So they are larger, uh, than what it was, uh, contemplated in the stipulated settlement agreement. And then the interior lots,
PUD with it being an RU 17, you're looking at 75 by 100 lots. Uh, so with that, I would share with you that, uh, it is consistent, um, in terms of with the city's comprehensive plan. The, the future land use is very low density residential, which provides up to four dwelling units per acre. This is the 1.3 and the stipulated settlement agreement provides for 2.03. Uh, and the, uh, the concurrency, uh, the, the staff will ‸ conduct a, a concurrency review of services required prior to the project, uh, for the project. At such time, the applicant applies for the preliminary subdivision. Uh, final review will be completed with the final subdivision site plan.
And the recommended motion is to approve a settlement implementation agreement between Virgin Trains USA Florida LLC. And the city of Cocoa to approve conceptual plans and amenities schedule and a construction timeline for a residential subdivision. Consistent with the RU 17 zoning and to authorize the city manager to execute an excavation permit on the following properties. Commonly known as a former commonly known as the former space needle to implement the stipulated settlement agreement made and enter into December 11th, 2007.

think this is where it'd be most appropriate. Alex and I just got back from the, uh, IEMO training and that was very helpful. Uh, one of the things they talked about was the agenda and, uh, how we bring up new items, how we bring up, um, things, items for future consideration, things that we want to vet.
can we, um, pass something. And it's really helpful to have us develop those ideas together. So typically we have had our time to speak at the very end of the meeting, the informational items. And, uh, many times this is the last meeting,
was such a long meeting, it hardly gives you the opportunity to bring up any, any new items. I mean, an example of this was, um, a deputy Warner, deputy mayor Warner had brought up about the marijuana citations several weeks ago. And
thought that was a good idea and I guess we're going to be doing a workshop on it. But it's those kind of ideas and agenda things that you want to promote as a council person ‸ that we don't really have the opportunity to do that at a point in the meeting where there are more people here. And where we have enough energy left to really, uh, debate it. So I was hoping to get a consensus from the council that we start to include an items for future consideration agenda item. Uh, more toward the front of the meeting, probably after, uh, we have
but at least it would give us the opportunity to put things out there so that we can, well, so that we offer it to the public so that they could come back and help us develop it as well before it actually comes up as resolution or,
a lot of, sometimes there's a lot of important stuff in there and people have the tendency to ‸ leave after, after a little while. So yeah, it's something that we can, we can look into, but, um,

maybe some followup, but. Well, the simplest thing may be to do, just remove our, move our reports up. I mean, there was a time when I don't know, the mayor may remember, we used to do delegations at the end of the meeting. And we moved it up because so many members of the public would have to sit here sometimes, I mean.
And sometimes the meetings didn't last until after, or didn't get over until after midnight. Um, and delegations was at the end of the meeting. So we moved that up so the public could have more participation in the delegation. So maybe if we move our reports up, because like you're right, usually by the time we're doing reports, because

was just going to comment, and I mean, I talked with John about this, but it was interesting. So we actually send out an RFP to 356 people, and we got back three responses from 15 plan holders. So, and that's typical?
and that's why you get three or 400, sometimes even more. The 15 plan holders, that means people in the area who are really interested, they're going to take a look at the plans and start probably doing their homework. And at that point, they decide whether they think the bid is worth going after, probably not knowing it because sometimes the description and demand star is not enough. They got to see the plans, and then decide whether or not they want to bid on it, and hence the three bidders.

Thank you, Mayor. This agenda item is a request to increase the ‸ full-time head count within the budget in the utility customer service division for the finance department. Of note, since 1999, the number of utility customers has increased by 24,000, and we've added virtually one employee to handle that increase in volume of the employees. As you observe, when you come into City Hall, there's often long lines,
the customer service window out front. And so we're requesting another employee to be added so that person can potentially just take the cash-only customers to try and handle them more quickly. And then in addition, they're going to provide relief to the other customer service representatives on the windows that are handling when they go out on break. You know, they have paid breaks a couple times a day, they take lunch, they go on vacation, and right now when that happens, then we're short one more additional person. So staff is requesting approval of adding one more employee to that customer service division.

The use of the general fund balance on Budget Amendment Form 2019-101 is necessary because the CDBG funds does not have ‸ any cash yet as the funds are reimbursement basis. In addition, a portion of the funding is pledged CDBG future revenues. ‸ When these funds are received by CDBG, the advance will be repaid to the general fund.

I have two items. The first one is a more of an informational report related to this past Saturday's concert event for your reading. If you have any questions related to it, you can reach out to me. The second item is related to the upcoming City of Cocoa Hurricane Preparedness Expo. This is being offered for the community. It's June 27th from 4 to 6 p.m. at Cocoa City Hall. And essentially what it is is an awareness workshop for the community. We'll have a number of departments at the city participating as well as some other vendors to include the Brevard County EOC 211 Brevard.
citizen home preparedness kit. So within that, there's a number of items that gets you started on your way to establishing a kit for this upcoming season. You can also, at each of those stations, ask questions for the respective departments on what they're doing and what actions they're taking to prepare the city overall for the upcoming season. Thank you.
Yes, Mr. Mayor. Actually, we have been in contact with. I spoke with Kim Prosser, the Brevard County Emergency Manager about there is a, I think it's a G402, which is Incident Command System training for senior elected officials.
we asked if, if they can't do that, can they do something short of that? But on July 10th from 8 to noon, city staff will be, we had to work with schedule or facilitators and ‸ all the people that are in the EOC, be having a EOC drill, an exercise with an outside facilitator. And we'll get more information to you and
so in the event that we can't get something coordinated with the county, we will do a presentation to go over the whole national incident management system framework, the incident command system structure, kind of roles, responsibilities, what we can do, you know, what we do, what you, what you,‸ each of you as ‸ council can do in terms of helping and assisting as we go through the recovery component. And you can,
meeting yesterday, uh, in terms of the, what the minimum requirements are, uh, in terms of what we know essentially what the recommended are for staff, but it's our understanding at this point,

Legislative Policy Conference in Orlando. Uh, not the conference, but the committee meetings in Orlando. Uh, it's Friday evening. I may be going over a Thursday evening, uh, my own, to meet with some other, the Florida City County managers that participate in those committee meetings. Um, so I'm not, I'm not certain of that yet, trying to get confirmation, but just want to advise counsel that I'll be traveling that day, obviously, to the committee meeting. So, uh, I don't think I have anything else to report.

be at the service for Barbara Jenkins to be a part of that. She was such a, a legend in Cocoa and I thought Reverend Watson, he gave such an inspiring commemoration.
you know, you really felt him channel her and give us all strength. And that's something I've needed a lot of lately, that kind of courage and strength, because this is not an easy job I'm finding. Public service is not easy. It's, um, but I'm committed.

civic life. His perspective will serve this community well. It expands the diversity of life experience to help reflect the entire scope of our community. And I think we should be proud of the police advisory committee and all its members.
in our city and I'm referring to Reverend Walsh and to Esquire Alton Edmond. We're very fortunate that they have chosen to step up and serve. The police advisory committee as it is currently composed will have credibility with all citizens in Cocoa. The only thing that threatens that credibility are those that would choose to defame, embarrass and intimidate its members for the purpose of undermining the committee's legitimacy. This is a step toward more public trust in our police department and better community relationships. And I'm hoping

To know that, that not only that one child, it was multiple kids that was there that haven't been to that park in a long time. So we're going to commit to doing things more consistent. I'm
a lot of things that we have been working very hard as a police department, been working hard. And it's a very, it's a very tough area to police. It's been going on for a long time. But I feel the more positive we bring to that area, the better it would be for all of us. So, you know, it kind of bothers me when you got beehives on a slide that lets me know kids are not there. That, that, that bothered me. I've talked to Matt about some of the amenities in that park. Well, we have taxpayers that pay money into all of our parks that we own now. You know, lights are not working in some spots. You know, there are
