Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
434 suspect passage(s) marked in place; inspection incomplete: language review; 5 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 23 voices separated from the audio.
37 short machine repair(s) (49 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 76.2% of 19,652 content words.
Dotted words (383 places) are ordinary wording differences: hover or tap to see the other reading.
434 passages (38% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (5 stretches). Something may have been said here that the transcript does not have:
00:12:46 (7 s) — neither reading has words
00:12:53 (7 s) — neither reading has words
00:18:56 (2 s) — neither reading has words
00:38:21 (1 s) — neither reading has words
01:25:46 (9 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
While they're testing things out, I'm going to go ahead and ask if you have a cell phone or any type of, you know, digital device that you communicate on, please either put it on vibrate, silent, turn it off, whatever you need to do. If you need to make or receive phone calls, please step out into the lobby. And then once you're done with it, you can come back in.

Has everybody had a opportunity to look over tonight's agenda for the July 12th special planning and zoning agenda? Yes. Yes. Okay. Do I have a motion to approve the minutes for tonight's agenda?

I was able to review the minutes online yesterday, but I know we don't have a hard copy. Would it be appropriate and allowable to wait to approve the minutes of that particular meeting at our next meeting? Would that be allowable to do that? So that would give the board a chance to really, um, I mean, our hands are full tonight. I think, uh, since we do not have a hard copy.

is Steve noto. I'm the ‸ director of planning with RBI planning and landscape architecture based out of Orlando. We've been helping staff here the last couple of months with day to day operations of the planning department. And as she said, I'll be presenting this item this evening. Uh, on the overhead, we have, uh, the location map of the item in question, uh, for this request. It's two parcels that total 19.23 acres. Uh,

future land use category allows a maximum of seven dwelling units per acre. Um, so if maxed out completely over just over 19 acres, um, if someone were to develop the two parcels to the max, you're looking at just under 140 dwelling units. That is not the request this evening. However, I want to make that clear. The applicant, um, who is present this evening is requesting to rezone the two parcels from the
Flag: numbers, amounts, negation or names differ between the machine readings · 00:11:02–00:11:09 · unresolved: the words are not shown (unclear audio); listen to the recording
Um, as I said, the future land use category is seven, uh, sorry, LDR, which is seven units per acre. Their intent is to construct 122 townhomes. Um, however, this just being the rezoning portion of their request, what we look at are the 16 findings of fact in the code of ordinances and then consistency with the comprehensive plan.
‸ the 16 findings of fact, um, that detail the requirements of the city in order to make a recommendation on a rezoning. Um, and then also in there is a quick analysis on the consistency with the comprehensive plan. Of course, one of the, uh, very important things when reviewing a rezoning is does the request that zoning district comply with the comprehensive plan and the overlaying future land is category.
that mainly have to do with the housing element that just, we just wanted to bring attention to some of the policies that the city has, um, that encourage. Infill and redevelopment for housing.
So we tied our analysis to the findings of fact outline your staff report. I'll be happy to take any questions you may have. And again, the applicant is here this evening. If you have specific questions for their team, thank you.
Okay. When I call your name, I'd like you to please stand so that way we can go ahead and swear, swear you in. Um, Sue Lindeman. Jerry Grove. James Tidwell.

Steve. Sure. No, thank you. I think a lot of the comments, first of all, thanks for bringing a lot of those to our attention. Clearly, public hearings have a purpose, and this is exactly one of them. I think a lot of these issues are types of issues that get resolved if and when a project gets to subdivision review, site plan analysis, things of that nature. At a rezoning stage, some information, a lot of information may not be known, and so staff in general is put in a position where they have to make recommendations purely on some information or findings that are in the code. The developer, the applicant may be able to touch on some of these issues, specifically the drainage or some of the traffic issues questions. At
I can't really comment on many of the questions that were brought up tonight. Other than in the event we get a submittal for a site plan, subdivision, whatever it may be, that's when RBI would be reviewing it, other consultants and city staff. And those types of ‸ reviews would come back before this board.

I'd make an observation. I've heard many of the residents speak tonight. They have all expressed problems with what you're planning. And what you're saying is, trust me, the
How many times have we heard this? I would not feel comfortable if I were arrested in accepting your promise to look at it in the future. Once you start that ball rolling,
Flag: the recognized words and the detected speech do not line up · 00:46:30–00:46:33 · unresolved: the words are not shown (unclear audio); listen to the recording
very difficult to stop it. I think a lot more planning has to go into this before we move forward because for us on the board, that's fine. We don't live there. But for those who do,

My concern is density. I've been on this board now for almost 20 years. ‸ There's a reason these boards are made up of citizens that live here and have a vested interest in our community. My perception of the Range Road, Cox Road

Mr. Chairman, if I can address something. I just want to clarify and make sure everyone's clear on the board. This proposal will not increase the maximum density because the future land use of low density residential remains the same. So it still will be a seven dwelling unit an acre max. That's what it currently is. However, ‸ the RU 215 zoning district does allow for townhomes as a product, right? So that
something for clarification? Thank you, Mr. Chair. The property across the street, I think the doctor had mentioned that that's zoned multifamily. Is that correct?
Yeah, Mr. Chair, the thing that sticks out for me with this whole item is the wetlands environmental. I may have missed it, but I didn't see anything from the Department of Fish and Wildlife, ‸ which generally something's generated through the state and federal when it comes to those kind of areas that are zoned because of that reason. I don't see anything or have anything that confirms the zoning because they're wetlands, and I think that should be addressed. I
yes. When you get to the subdivision site plan, that's when the studies are required. In my experience, if a board or a council or slash commission wishes to see those types of studies earlier on, that's typically a request directed to staff to bring
question with the attorney. Is this something that the issues that's been brought up during the meeting tonight, is this something that the developer could bring back additional information and table this with more information about the questions of the mitigation that might be needed, if it's a wetland area? I mean, I understand their intent, but it's true. We need to clarify the issues of drainage. Now, the codes are a lot different now than they were back in the days when these houses were built. I
they were built then, which could have prevented some of the drainage problems they're having now. So I feel that everyone really needs more information, and it's mainly the drainage issue as well. And I think that that's probably the way that we need to look at this.
Flag: words were replaced by a machine repair · 00:52:56–00:52:56 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
all the facts that were brought up. Very intense, but we just need more information on top of that. Since we really don't know if they're wetlands or not, you know.
I just wanted to add an air of comment in regards to what it is that we are positioned and tasked with to look at and examine. I think the sentiment in the regard of
Flag: numbers, amounts, negation or names differ between the machine readings · 00:53:34–00:53:38 · unresolved: the words are not shown (unclear audio); listen to the recording
and hold those in trust. But at the end of the day, the mitigating factor that resonates for me at this point is when we talk about intended land use, whether it was a single family dwelling or whether it was a multi unit dwelling, you're still going to have the encumbrance of issue that still arises from these secondary things that we're now discussing. So I think I'm at a position where I now understand and know that these things are addressed in the aftermath beyond planning and zoning. Once these things are presented to the building department, am
Yes, so that is correct. So at that time, we would have full and full access and availability to review it for its for its thorough content as to what is being presented. What
canvas, if you ‸ look and you have you have what is considered to be a comparable. The comparable is where whether you like it or not, the comparable is across the street. So for sake of definition, there is a comparable. So
Flag: numbers, amounts, negation or names differ between the machine readings; a language review questioned the wording · 00:55:09–00:55:12 · unresolved: the words are not shown (unclear audio); listen to the recording
It affects that gentleman's pocket. So ‸ that's what he intends to do. When I say that you're misconstruing what I'm saying, he has to present the binding information back to us at that time. I'm
position here today is still going to be the same. We have to review it for what it is, not for what it is intended to be when it's ‸ when it's at its intention. Then that's when you can make a sound and reasonable decision about the intention. Like you said, I don't know if he's going to put based off of the notes that said that the maximum land use for that particular unit was I wrote it over here. Was 140 units was max. But if the proposal is 122 that fits within legal definition. Now,
That's not my position today. My position today is is purely to speak towards what is the intended use. So I just wanted to bring that forward because I think sometimes when we table we're tabling why.
Well, I can answer that because it's exactly the information that you're saying that you need to make a legitimate decision. And that's why I thought it might be a good idea that we ask the developer to address this concern about drainage. That's very important. And
I think once you do go to the St. John's River water management department and the other departments in reference to the water, the number of ‸ units also plays into that. They might be told they cannot build that many units. That's my other point. That's
Talk some coverage and density based on what they discover, whether that is a mitigation requirement for the drainage issue. Right. And right now the builders are completely at
risk for that. Right. So, I mean, no matter what we decide, that's a table or to approve. They're still going to be at risk for those decisions. So I mean, that I think it's why I'm leaning in this direction here is
Okay, so I can't exactly compare that, but I do have some area and other property that I couldn't imagine someone built right behind me. We can make motions now to not pursue this any further right to or to defer it until ‸ later time to table it. Right. And I, and I respect that, but my, when does it come back? And then these folks are still coming back again. If, if we were to approve this, that gives them the financial stability to do those studies. Because right now we're putting on more risk. I'm

the place where they've shown what they can build. Right. And at that point, they'll be under the scrutiny of the city to provide, you know, water effects of the, of the nearby residents and things like that. So, uh, I,
I would recommend that if you, if the board is considering a motion to deny, um, uh, for the benefit of the city council, if you have any specific, if you're pointing to any specific criteria. That

I'll try to take you through this item. This item is a text amendment to the transportation element in the capital improvement element of the comprehensive plan. It proposes to remove minimum level of service standards for State Road 524. As you all are aware, 524 is located in the city of Cocoa, but under the jurisdiction of the state of Florida, specifically Florida Department of Transportation. I'm going to talk about some transportation terms and again, as Lucy said, Abigail Morgan is the city's public works director and city engineer. And so if you have questions with regards to those specific traffic, traffic related issues, Abby is here to help. And so as we look at this, we basically talk about the maximum allowable volumes and levels of services that are particularly specific to this roadway. This roadway is divided into three segments, I-95
the roadway type, the roadway characteristics, traffic characteristics, traffic control, multimodal considerations, And generally, the higher the level of service, the more efficient those operating conditions are, the more efficient the roadway is considered to be. And

this change, the projected level of service is E. I'll note for you in the ordinance that's contained in your packet that if you note just by comparison the various levels of service within the city, you'll

city are minimum level of service E and D. And so when you look at our roadway system, you don't see any C's or higher, which again was sort of surprising to me. But again, that's the current level of service standards that we have within the city of Cocoa. And
specifically into the issue at hand, when you look at the latest traffic counts and the maximum allowable volumes, these counts are actually conducted by the Space Coast Transportation Planning Organization. And again, the new term that you haven't seen, which is on the chart, the last column on this chart is the average annual daily traffic. And

I-95 to Cox Road, the average annual daily traffic counts were 12,870. And then from Cox Road to Industry Road, 14,380. And so again, to sort of home in on the issue, when you when you throw those counts against the approved projects already on the roadway, again, south of south of I-95 running I-95 to 520, you can see and I'm just going to draw your attention to the last column. You can see that there are plenty of remaining trips on that segment of the road. When you look at I-95 to Cox Road, you can see that that number gets smaller and there are only 4,142 remaining trips on the road. From Cox Road to Industry Road really is where the issue is. And you can see that when you throw those numbers against the projects that are currently approved, again, the Arbors, Sears Apartment, Dollar General. Dollar
so there the Arbors is not currently CO'd, right? Yeah. That's the one that's told, right? And so you can see that there is a deficit there. That deficit is 896 trips. And this gives you sort of a graphic look at those different segments. This one shows you from 520 to I-95. The vested projects are in green. The projects that are under review are denoted by the orange sort of boxes there. You can see in this section we have two projects that are under review and we have no vested projects. Again, if you refer back to the previous slide, you can see that there's plenty of capacity on that side, on that section of the roadway. If

unique about that is that that is coming to us as a result of not only, obviously, the developer wants to develop single-family homes there, but what's unique about that circumstance is that the
But ‸ there are a number of trips that are going to be associated with that particular project that, again, by agreement, the city has already committed to at least review that development proposal as a result of a court settlement with the county.
I'll let Kristen add anything if she ‸ cares to add on to that. From Cox to Industry Road, again, where we have the issue, there are currently two projects under review, and there are four vested projects. And
Flag: numbers, amounts, negation or names differ between the machine readings · 01:12:47–01:12:50 · unresolved: the words are not shown (unclear audio); listen to the recording
You know, obviously, roadway improvements lead to economic development and growth ‸ of the tax base. And so this is just simply giving you a very simple sort of, you know, one plus one equals two. And again, you
the roadway improvements will allow the city to continue to grow. It will increase its tax base, obviously, tax base funds, those core services of government, such as police and
and here we go. So section 163.3180 of Florida Statutes renders transportation concurrency optional. And so per the state transportation concurrency, the need to have those minimum level of service is optional. And it's been optional since, I think, 2011 or before that point in time. Again, 524 is a state road, and the city has no authority, no ability to control the schedule and construction of capital projects to increase the capacity of the road. And so we're sort of handcuffed by the state's ability or willingness or financial ability or willingness to actually improve that roadway. And
‸ the stipulated settlement agreement that is associated with that project. Most of these projects are going to take some time, and they're not going to come online at the same time. And
and so we don't anticipate that all of the traffic associated or the traffic volume or the numbers associated with these projects are going to come on the roadway at one particular point in time. And
tax amendment with a plan going forward, let me talk a little bit about that. And so the city gets impact fees from developments that can be ‸ utilized to accelerate the

Again, it's a state road, and so it's kind of, if you will, perhaps out of the box to actually say we're going to participate as a sort of smaller entity with a larger entity to provide some financial assistance in moving that project ‸ along. That's because of the critical nature of actually addressing this issue. Again, that's our growth area. And again, if we don't address this problem, then we are not able to approve projects. We're not able to, again, grow the tax base and all of those things that I've previously advised. And so once the improvement project is complete, the roadway capacity will grow beyond what is currently needed. And I think in your package, you actually have one PDF that actually talks about what those remaining trips will be after the project, after the roadway is widened. And
segments that I've highlighted previously. The city is actually working with the Space Coast Transportation Planning Organization, the Florida Department of Transportation, and the county to leverage funds and apply for grants to accelerate the project. So let me just talk about where the state is with regards to that project. The
week, just as of this week. The design is estimated to be $6.5 million. The right-of-way acquisition is estimated to be $17.3 million. And the construction is $54.5 million. Again, those numbers include a section from, not from a 520 to I-95, but from, are we calling that South Friday Road? Yes. So from South Friday Road to I-95. Well, that's only a couple of hundred feet, but that includes an interchange, a redesign, and reconstruction there. And
And then from I-95 to Cox Road is a basic widening project. And then from Cox to Industry is a basic widening project also. And so, again, to bring you a plan that addresses the facilitation or the hastening of the project, I want to talk a little bit about our sort of fiscal plan, our plan to at least engage the FDOT in terms of what the city can do to move the project along. The city currently has approximately $4 to $5 million in impact fee revenues. Those projects that were listed on the maps will bring in

that 524 is the number four ranked project on the ‸ Space Coast Transportation Planning Organization's overall project ranking. Last year, it was ranked number 11. And so it's moved from number 11 to number four. State
project listing or the project ranking. Last year, that was number six or seven. And so we've engaged Space Coast TPO with regards to the urgency of this project. And you can see that the rankings have moved up. Generally, if you are within those sort of the top tier, the top five, then we're looking at do we get into the five-year ‸ planning horizon and five-year project horizon. And so we will be looking at ‸ fiscal year or project plan year 2029. That is, ‸ those rankings come out in September or sometime this fall. And
they're submitted to the Florida Department of Transportation. Generally, the Florida Department of Transportation relies heavily on what's submitted through

also the state TPO are applying for and have ‸ benefit of the governor's new initiative, which is moving Florida forward funding. And so that may be a potential opportunity for funding that seeks to or can facilitate acceleration of the project. And again, as you all are aware, and we heard a lot about the federal infrastructure bill. And so, again, it's our intent through the partnerships with Space Coast Transportation and with FDOT to actually seek funding there. And
for some period of time, perhaps. But also that we have a plan going forward in terms of we're going to utilize the $8 to $10 million to either assist in funding the design or assist in funding the second phase, which is right-of-way acquisition. The right-of-way acquisition really is primarily associated with stormwater retention. And
state in doing that. We think there's sufficient right-of-way to do that. And so optimistic that, again, the $17.3 million that they listed for the right-of-way acquisition is an
I appreciate staff being proactive on this. I think it's a fantastic answer to a looming problem, looming question that we have here. And we've always known for many, many years that 524 was going to blow up. And

But, you know, what I presented to you is aspirational. And so, you know, we're going to be at the table with FDOT, a transportation planning organization, has promised to be there with us. Again, trying to push them to accept some city dollars to actually accelerate the design of the project. And so, we're there pushing. But, again, this is their state road. And ultimately, the ball is in their court with regards to this particular project. So, I just wanted to make that clear.
one question for the city manager. And I don't want to run down a rabbit hole and I want to get off on track here. But most people don't realize that 524 ends at Industry Road at the post office. When

‸ And again, I know you guys don't want to be here all night, but you also reminded me that, you know, as we ‸ look towards perhaps a Brightline station, I've been told that 524 used to run

Well, it ran all the way to the port. Okay. ‸ And so I know that at one particular point in time in discussions with Brightline engineer, he was excited, at least for the moment, about the possibility of that roadway doing that again.

Yeah. And so if you if you if you look at your ordinance, we would strike it from that roadway from the transportation element, and we would strike it from the capital improvements element. Okay.
So maybe maybe this just to put it plainly. Currently, the level of service means that the any projects that come before the board would need to meet that minimum. And so what will happen if we remove the level of service is that that will no longer be a basis to deny a project. Right. If the if State Road 524 would fall below a level of service D

designed to to to slow traffic down through the village. But again, that that written in the agenda report was just to illustrate that there are sections that have no level of service. Uh, minimum standard currently. And that's one of the sections. Yeah.
Yeah, I just want to say that I do support taking this away, but I find it interesting that those of us who scrutinize. The level of freedom we're giving those others like the city. Are willing to give the freedom back to the city to build. Carb launch. We'll just say
taking away this restriction. Uh, again, I, I, I support it, but I mean, uh, should we not send it back to them and ask for how to impact the citizens? If we, uh, if we do this and. Whether there's going to be flooding involved if, uh, they expand the roadway. All right.
I have it myself. So, uh, yeah, I just like us to think about that when we, when we make these approvals and things like that. So that's all I have to say. Thank you.
Yeah, because, uh, I know, especially from earlier when we talked about E, one of the considerations was traffic on range road. And now we're essentially taking that away from one of the items that they have to.

It is it is not within the app. Well, that's what I'm getting my maps. It's not within the outline maps, but this Aurora I'm very familiar with this area. Aurora runs when you're coming off of King Street 520 and you take Aurora down. I live in Pine Grove Park, which is going to be and forgive me north, south, east and west is like telling me which way the sun rose. But I live in Pine Grove Park, which is literally single family residence that is coming off of that. So that's where I reside. So I have a question more than anything in regards to the intended use. So I think it's fear for me to ask that. But I just wanted to put that out there right up front. So it would be no questions about what I what I was what I am thinking.

is David Brubaker. I am the president and CEO of the central Brevard sharing center incorporated ‸ located at 113 Aurora street in Cocoa. Our purpose for this particular property is to expand our existing services. Our services consist of basic needs services, such
‸ We have a shower facility, so we have a lot of different basic needs that have gone on for more than 33 years at the Aurora street location. This particular property, as was stated, butts up to our current property itself. And, um, we look to expand our current services. For example, our food pantry. Uh, we literally work out of a closet. It's an amazing program. We distribute more than 50,000 pounds of food through that, uh, little food pantry, but we would like to do a better job and we can do ‸ even better job and serve more people through this project. So

Um, so with that being said, where my, where my question lies for you on, on the big, the quest of what you're looking to do in your application, you're looking to have this property

had that discussion in regards to traffic flow. Okay. But we are considering that flow from Aurora to Ruth, but that hasn't been established there. We've really just had some preliminary meetings of planning meetings. It's still the pie in the sky right now for us. It's gonna ‸ take several million dollars for us and we have to raise that money. So we're not talking about doing this within the next year or even two years, because we realize we have to raise the money in order to build this state-of-the-art ‸ facility that we're considering.
‸ add that ‸ this particular property as the other properties that surround it, they don't have a zoning assigned and this is just an application for rezoning. The applicant would have to submit for a special reception that has to be approved by the Board of Adjustments and when they are ready for development, when they have the conceptual plan, wherever they're trying to propose, that is gonna ‸ be submitted as part of the special reception. So I just wanna ‸ highlight that what we discussed in here is just assigning a zoning to this parcel.

Well, um, as the attorney, I guess I can't speak for staff necessarily, but I can say that, um, you know, there are multiple, uh, zoning districts that do allow for some type of what we would call social service centers or community centers. Usually they're addressed through a special exception, like as was described here. So
Flag: numbers, amounts, negation or names differ between the machine readings · 02:21:48–02:21:50 · unresolved: the words are not shown (unclear audio); listen to the recording
Um, but you know, for like in this case, you already have a low density residential future land use. So those risk that restricts, you know, the range of, um, zoning districts that are an option for them, um, without asking for future land use amendments as well. So, um, but I mean, I, I'm sure that it's something that, um, you know, we'll, we'll discuss internally, um, and consider, but again, there are, there are other options as well under the code.
As I said, we just seen it a couple of times where folks have wanted it for a very respectable reason. And, but the, but the zones a little bit broader than it needs to be for what they need. And so
them where they're quite lengthy. So I think that that saves, uh, time and trouble and paperwork. And at least they discovered something under the zoning they're asking for that satisfies their needs for their property. Yeah, exactly. And that's what happened.
Yeah, that's it. And I support it. I mean, if I just think, I don't know, you know, I, here I am ‸ just a regular old citizen, but, uh, in my world of software, you just add a dash to something, right? So you'd say, you know, are you whatever dash? And he added dash for social services.

So here you can see you can have a better view of ‸ the portion of the parcel that we're discussing today. Here we have our future land use for the parcel. So the staff recommends that the planning zoning board recommends approval to the city council of the zoning map amendment from
