The City's record
What the City's record shows

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
587 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 22 voices separated from the audio.
85 short machine repair(s) (115 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 89.5% of 24,020 content words.
Dotted words (570 places) are ordinary wording differences: hover or tap to see the other reading.
587 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

And just for the board, I'm not sure if you guys are aware, Ms. Acosta is having a baby. So congratulations to her. All right, we'll have the swearing in of our officers.
All right, item number two on our agenda has complied. Item number six is tabled. Under our noncompliance, item number one is tabled. And with that, I'll take a motion to approve.
Those opposed? Motion passes unanimously. All right, we'll have the approval of our meeting from May 16th. Are there any amendments? Anyone? Okay, with that, I'll take a motion to approve.

And it means a lot to us. I first received notification from the building department with photographs indicating that what I needed to do to be in compliance was to remove a couple of feet from either end. I responded back with a question of, will I receive something formal in writing so that I could take action on this? I was assured that I would. I never did. They dispatched somebody to measure the site, to inspect it in person and to talk with me about their findings. And their findings were actually that I didn't need to worry about the east end. That was fine. I only needed to remove about three or four feet from the west end. I asked if I would be given something in writing, which I think is a reasonable request. ‸ I was once again assured that I would. So I waited and I received another citation. I contacted the authorities again, explained the situation, reassured them that I'm anxious to be in compliance and not to cause problems.

And in fact, I understand from talking to previous owners that it was in fact installed to solve the drainage problem, which it did. I understand that there is a component of the law that indicates the pay services are not allowed. There are at least nine other properties within a few blocks of my home that have all done the exact same thing. So my question to you is, why me and not them?

Because the goal is you originally stated that you're lower body citizens. You follow this, you follow that. But again, when we get a ‸ notice, we want to be proactive opposed to reactive. Yes. So
Flag: words were replaced by a machine repair · 00:14:46–00:14:47 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
The issue is we're a lot of times we are reactive opposed to proactive. So you were told this from the start and you want to get things done by the letter of the law. But right now what you're doing is you're nitpicking, but you said you did not disagree with anything he said. So now my thing is, um, when you're waiting, but you want to get this done, just like, I'm not saying it's your fault. I'm not saying it's their fault. But when we sit there and wait and we want to get this done, um, the longer we wait, things go up higher. But essentially you have to worry about your property because we're not going to talk about any other property because there are things that go on with other properties that you don't know about.

um, at this point, we should have had some kind of resolution. And I know you said that you got no one out, but I'm sure at some point in time, if you would have contacted them and said, Hey, I need someone to meet me out here and tell me exactly.
They should have been able to put something on paper for you that day. But my, my, still my thought process ‸ going right back to you got this notice and you want to be within the letter of ‸ law.
but there are codes that we have to go by. Everybody has to go by. So again, why are we not being proactive in trying to ensure that we get this done? It's been 463 days.

first of all, I do have documentation in writing, which stipulates what the first instructions were, which was to remove a few feet from either end, not the entire thing. The only reason that I have delayed in taking action is because my request to get formal ‸ notification in writing of what I needed to do to be in compliance was never received. I don't think that's an unreasonable request to ask when I'm being asked to undertake an expense that's likely going to be in the thousands of dollars to fix something that I never had anything to do with in the first place and isn't causing a problem. My ask is that the city think outside ‸ the box.

This is an old condition that has been ignored for years prior to my buying the property. the thing is, again, go by the letter of the law. The code says, if the code says it has to be five feet, it has to be five feet. ‸ I mean, we can't go and change everything for one person, but it says this. Mr. Folger, now, is there any reason or rhyme
A variance could be applied for. I can't guarantee what the outcome of that would be. Speaking with the city engineer, she has determined that all of the

‸ that's one of those things that you have to ensure you deal with the city engineers. So now they can get you to, because that it's like layers. Code enforcement is the top layer that the only thing you see, but

at the bottom, there's the engineers. So they have to, okay, everything before you go ahead and just do something, because we've had people that go do things and nobody knows what they're doing, but they go do all this, put this money into it. And it hasn't been signed off on by the engineers. So I think if I'm not mistaken, that would be one of your, um, first stops because again, you've been given these notices and you said you asked for this and, um, when did you get this? I'm sorry, hold on. Just one minute.
We've received emails back and forth. And I, I'm pretty sure Mr. Rogan was copied on those emails as well from not only a city engineer, but also public works, um, throughout the life of the case. Um, he is correct. They did start off saying to remove two feet.

I do have a site survey. Yes. And, uh, from all of the, um, authorities that I've spoken with, uh, the consensus is, is that this is in fact city, a city easement. It's city property.
your property and the city has an easement. There's, there's a difference. Okay. Is it your property or is it the city's property?
[00:22:08]Speaker 8 (introduced as “David Rogan” — machine-transcribed, not verified)
Uh, I would have to take a look at the survey. Um, my understanding has always been that this is. So I am not, um, a surveyor, but from what I can tell from this survey, uh, the property line ends on the house side of the sidewalk. I'm willing to share this if anybody would like to see it.
Uh, help me understand from this picture. Yes, sir. You're saying so on the side where the grass is, that's where your property ends. That's my interpretation of this survey. Yes. So in other words, it's your interpretation that all these, uh, these pavers belong to the city. Yes, sir. So in other words, they should be able to just go tear that up. Yes, sir. That would be up to
And in regard to their concern in terms of percolation and why this probably needs to be removed, and you can see here, um, where the pavers are a little bit below the sidewalk. I mean, that does present some issues for discharge or just, uh, percolation in general.

This is why I reported the buckling in the sidewalk in the first place because it posed a tripping hazard. And we have elderly people in the neighborhood. My intent was that once the sidewalk was repaired, that the pavers would be reseeded in that location to ensure that there's, uh, no tripping hazard or ponding.
um, for some property that does not belong to you. Because if this was not your property, um, if it's maybe I'm just thinking just with common sense, because if this wasn't your property, I feel like, okay, you should

listen, this is not my property. And you guys discuss that and decide, okay, if it is your property and if it's not, because you're saying that it's not your property. Because if it's not your property, we shouldn't even be here.
So I would just comment that regardless of whether or not, so it seems somewhat from the evidence that this property or where the pavers are is part of the right of way, but it is still not permitted for a property owner to place items in the right of way. Without the proper permits, regardless of whether they own that or not.
because if this is not his property, this is the right of way. We shouldn't even be hearing this and we shouldn't, we should not have even gotten to this far with this case.

this out. Check this out. If this paper belongs to the city and over here belongs to me. And I'm worried about stuff on this property, which is mine. And this belongs to the city. The city does what they want to with their property. Yes or no. So if, again, if that's the case, we are in here for this case for no reason, because the city should be able to do what they need to do with that property, remove that or whatever ‸ the case may be.
the city didn't place those papers there or the work. There's not going to be a cost associated to remove those for by the city, not having placed them there. A property owner that owned that property, place them there. If that helps clarify.

know swales have been installed in the neighborhood as well to address drainage, but I've lived there now for a year and a half. We've had heavy rain since then, and the water does run pretty much right down the road along that concrete strip. It does not cause drainage problems on that easement.

That's, that's what it appears to be. I can tell you what happened with this case was I first noticed that the roof was being installed and there was no permit for the roof. So I posted a stop work order on that portion of it. Um, he did get a permit for the roof and when the building department came out to inspect the roof, that's when they determined that the windows had been replaced as well and asked me to issue a violation for no permit for the windows. All of the citations that I sent out notice of violations were sent to the address on record, which is 3700 crossbow drive.
Okay. Now you could have the building inspector look at the work and he should be able to either pass or find out what it takes to fix it and he can get the permits.
Because there was no inspection done during the process of the window installation. They have to show how they were installed. Um, that everything meets city code. There's a lot of, um, hurricane guidelines that need to be met with window installation nowadays.

for the decayed wood on the exterior surfaces and the trim and oxidation stains. And then for the disrepair of the roof. So the roof is going to have to be either repaired or replaced as well.
And as this is why this case has gone on with extensions for so long, the information that I've given to both parties in regards to this case and ‸ these violations was to... There needs to be probate action in order to essentially cure some of these violations like the roof particularly. You're not going to be able to pull a permit without being able to show property ownership. So, before that gets done, the civil matter needs to be resolved in the courts. That hasn't been done yet, which is why we're here, sir.
All right. I just wanted to be clear on that. So, it looks like you have a bit of work, but again, what he's saying has to be with the probate needs to be established. Sir The property is currently held by title by Fannie Mae or Federal National Mortgage Association It stems from a foreclosure case that began in 2018 We're requesting a reduction that stems from the prior owner Obviously not residing there and having unauthorized tenants As to the violation their violations This began I believe during the height of the covid pandemic There were several homeless people and people that were trespassing within the property Some of the repairs were delayed due to needing police escort as there was a murder that occurred in front of the home back in december of 2021 Original notice was sent to
us to fix the code violations. I appeared before the board back in March of 2023 requesting additional time. At that point, I was informed that I guess there had been a prior hearing that we had missed and that no additional

appealing the amount of the abatement Um that they were charged um and so What they're asking for I believe is for you to reduce the amount that will be charged to them as a lien for the abatement But I would recommend to the board that I
I don't think you have much choice other than to continue it Because you need to have the appellant here to give testimony you can't you know hear their Their appeal without them here So I would suggest that you that you continue it

to to appeal the cost after they tried to appeal the abatement as a whole I provided them with education Um, so when they submitted the letter officially I also told them that same date and time especially because of their evasive behavior, The hearing will be this date and this time now. I also believe I have an email But at the minimum that conversation was had when that letter was submitted Um, and I reiterate date time location So

I have one just one question because I just kind of want to I guess expand on the recommendation from the city attorney Is this is do you know from your experience are they the first people to ever do this is it normal?
well, I mean for an appeal you would typically want you want the the appellant here to provide testimony to you to explain Why they believe they should the font or the abatement costs should be either reduced or waived So without them present, you know, I think it'd be very difficult for you to make a decision
And again, that's why I said if you they said this and we didn't So this my thing is they said this in is this is what they were asking And then they didn't even have the courtesy to say hey, leave a message

gonna keep tabling until they do decide to show up or I mean because this is is Is it our responsibility that we got to hunt them down and track them down to come to the meeting?
but I mean I If you want to Hear the case and hear what they you know what they have to say Then I would recommend that you continue it if not you could just dismiss it just dismiss the appeal
