The City's record

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
700 suspect passage(s) marked in place; inspection incomplete: language review; 4 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 39 voices separated from the audio.
59 short machine repair(s) (70 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 90.0% of 26,594 content words.
Dotted words (907 places) are ordinary wording differences: hover or tap to see the other reading.
700 passages (27% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (4 stretches). Something may have been said here that the transcript does not have:
00:08:11 (20 s) — neither reading has words
00:15:09 (6 s) — neither reading has words
00:20:20 (15 s) — neither reading has words
01:31:40 (8 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

but more so than anything else, our brother of the United States military, who loved this country, dearly, and fought because he surrendered his hard work so we all can stand. So I ask that we stand in recognition of him and all military personnel. Amen? Amen.

Because sometimes these simple two words, thank you, does not go far enough. So we just want to say thank you, Lord, for all the great men and women of this great nation, locally, state, county-wide. We just want to say thank you.

And we ask that we be humble and we ask that you protect us and guide us. And we can't disagree to agree. But we serve the same God. And I'm so glad of that. Because we are all God's children. We may come from different tribes, but we belong to one race. That's the human race.

the boat was on the other side of the river. He immediately responded over to the Marin Island side and observed the boat in the water. He then stripped down out of his clothes. The
thing he was wearing was his pants and his t-shirt. He jumped in the water and started swimming out to the boat. Corporal Worley, hearing the call on the radio, was uptown ‸ on another call in the north end of the city and immediately started heading his way. We talked with his supervisor and immediately called me. I'm the primary boat operator for the department.

So, unfortunately the Coast Guard, they have to trailer their boat because of the locks. They can't get through the locks. It takes them about an hour. It takes everybody about an hour. we thought he was somebody from the boat crash. And he was a good Samaritan who was fishing, saw the boat crash, put on a life jacket, jumped in the water, and started swimming out to help him. So it was a combined effort by a lot of people to enact this rescue. So between the Sheriff's Office, the U.S. Coast Guard came out. They were actually there. They were on scene. We had called the Sheriff's Office for a dive team.

about the issue. And so I'm back here to request, since no one else could give me the approval to do the payment arrangements, I'm in here to request from you guys to prevent let me do payment arrangements. Okay. Mr. City Manager,
provides that an applicant that's requesting lien forgiveness has 30 days to make payment based upon the uh once council approves that request. And it's my understanding, and Steve, correct me ‸ wrong,

after the 30 days, and that's why they it would be staff creating policy that and you have an ordinance that says you have an applicant forfor clean forgiveness has 30 days. Is that correct, Steve? I believe

misunderstanding, and the payment arrangements must be made within that 30 days, and that's what it's referring to, is not that the that the payment arrangements can be made beyond the 30 days, which is what the request was. The
ordinance requires payment of the lien forgiveness within 30 days, whether it be all at once, over a four-week period, but it needs to be within 30 days. So the only way it could be extended at this point is, to be honest, based on the strict interpretation of the code, is the actually, after 30 days, the lien forgiveness goes away, and

I have to agree with Mike. I think, you know, the whole purpose is to bring properties into compliance, to recover the cost for the staff and for the filings and stuff, ‸ and
If payment is not delivered to the Community Development Department, or payment arrangements have not been made within 30 days of the date of this letter, this matter will be forwarded to the city attorney's office for further ‸ action.
See, I would have thought that that meant I can make payment arrangements exactly in the 30 days. Yeah. I would have thought that, too. Yeah. So did I. Yeah.
yeah read it and interpret it. ‸ The way the code actually reads and um is that once the council approves a reduction, you know, typically the condition, the conditions have to be complied with within 30 days. And my recollection of of that hearing, there weren't any conditions placed on the repayment. yeah

and it looked like red sand. So, one of the deacons said it may be rust in a pipe, and I needed to know whether or not the rust is in the pipe where we're responsible, and what could we do about it? Or is it because it's an old building and need new pipes? I don't know that, but maybe you could tell me what it is.
sir. Yeah, we did. We sent out a crew after we had got notice. I think it came through Matt on that day. We sent out a water field operations crew. They went out. They pulled the meter. They did take a sample of the water. It did have a color tint to it, so they let it run for five or so or ten minutes until it ran clear. We tested the water. It had good residual. So, a lot of times, ma'am, it most likely is coming from the transmission lane.
But typically, the buildings are made out of copper, could be galvanized inside the building, which could contribute. But certainly, the water line, ‸ that's a dead end street right there where we serve you. And
The material of the pipe, obviously, it shows as ‸ galvanized right now. It's a two inch galvanized main that runs down the street to the end. And there's about a hundred foot or so service that ‸ goes to the very end to where the building is, where she's talking about. But we did test the water to make sure that it was still safe to drink. It's not, you know, the most appeasing thing because it has a color tint to it that is from the inside of the pipes. While the crew was there, the meter box was low. So, they went ahead and reset the meter and adjusted the box to the correct height. So, that's what we've done at this point.
Yeah, yeah, that's the whole thing. Like, we were sitting, ‸ if there were other complaints from that same street, and I'm not talking about from this week, if there

1. Building a Cumberland farm across Stone Street does nothing for the Diamond Square community because the residents and business owners cannot access the store due to a barricade at the Stone Street Railroad crossing. This store would literally turn its back on this community with no opportunity to access it. Walking and driving to this store is a hardship and impossible for the residents.

already make it hard for residents to leave Diamond Square. ‸ When I stand in my property on Stone Street many times I will see cars drive into the street, realize there's a barricade and circle around out and try to get back out into heavy traffic in order to access US 1. Railroad crossings are reopening across the United States. You can Google it. It depends on how strong and aggressive the city wants to reopen the street or use another entity to do so. Also tearing down three to four businesses to accommodate a Cumberland farms plus a car lot to include this facility does not produce a large number of jobs in Cocoa. Maybe five or six to operate a full-time store. In comparison you'd have much more economic vitality with several businesses on either side of the Stone Street area with numerous employment opportunities and a larger opportunity for community friendly growth. I asked the city of Cocoa to build businesses on either side of the Stone Street from the railroad to the US 1 and keep the street open for residents to exit during a natural disaster. We need this street open to allow children and youth on the east side of town to access Jolie Smith Recreation Center, allow families and people to attend church, visit relatives, pay bills downtown and access downtown properties once again. I am asking the city to develop a plan that includes the people in Diamond Square and the surrounding areas and the city's growth and do not alienate them from the path of progress. I also oppose the city council's efforts to remove

put the people's lives in danger. A fire truck is like insurance. You use it when you need it. And I've just heard a couple of issues come up about lien reductions. That's the reason I said the city's got to address this ordinance. It's not just this lady here with having 30 days or 60 days. It's about having a clear process. You've got a gentleman who spent, hasn't paid his taxes, hasn't paid his fire assessment fees to the city of Cocoa, which you're fixing to increase again. I'm surprised at the number of people that are actually applying for lien reductions

have delinquent taxes, haven't paid fire assessment fees, and we are paying them. This ordinance, as far as lien reductions, has got to be redone. It's got to be clear. Property owners who are living in their property, who have a right, you know,

done what you've asked them to do, that's one thing. A guy who buys a property for $100 on a quick claim deed, spends a year and a half redoing it without a single permit to the city, and not paying his property taxes and fire assessment fees for two years, and comes to you a year later because he wants to sell it. That's different. These things need to be addressed. They've got to be addressed to where they are addressed clear and concise, because you've got two different issues. This young lady here is a completely different issue than what you've got, but yet you turn around and you say, okay, we can revisit it. If this gentleman doesn't pay his reduced liens in four days, he's going to come back after looking at this and say, well, I can pay over time. He's got 30 days. He ain't paid. I'm on top of this one because this is just wrong. This lady is something different. So that's why I wanted to address the lien issue. That's something that the city's really got to look at this ordinance. All right. Real quick, 30 seconds.

I'm not here to talk about the semi-truck speeding down my street, Washington Avenue. We balance the demands uh forfor potable water based on the need. When people call for water, we sense that in a pressure drop. They make adjustments and and we deliver water. But I don't have necessarily the same uh flexibility because my source of reclaim comes from the effluent from from the waste side. And so some days it's high, some days it's low. Sometimes the call for demand is high. Sometimes the call for demand is really low. And so those make really extra challenges in trying to keep steady state operations. Now, since since this incident occurred, we did install uh at our own, you know, at the expense of the utility, we installed a sensor down there on that valve to make sure that we maintain pressure in that neighborhood. So we have corrected that issue. So

And we do we do listen to the customers. ‸ when there's low pressure complaints or water or complaint we send people out there to investigate and try to figure out what's going on. And, like, in this case, we thought that the blowing off of the water was creating the low the low pressure in that area.

approximately 70 by 150, 160 stretch of Stone Street so that my clients can develop the property. I think there's some issue that there's a Cumberland Farms that's going there. That's not what this is about tonight. We're simply requesting that the part of Stone Street that is being vacated would be vacated.
both as an attorney, a former council member for the city of Titusville, and a retired Marine Corps lieutenant colonel, I understand that there are situations where ‸ decisions are made and the public doesn't like it. There's an expression called done is done, and done is done in the sense that
the citizens of the city, they're not reopening that access. Not going to happen. And as a council, you have to weigh your fiduciary responsibility to your citizens. Do we kick against the goads and wound ourselves by spending more money and more time fighting with Florida East Coast Railroad, or do we assist the current situation and the current business owners and citizens on the ground? And that's your duty is an obligation is to those citizens, those business owners, those landowners who are taxpayers, who are participants in the city, who are saying we would like to vacate this road so that we can develop this property. In the audience tonight is also the other property owner, Ms. Crum, and her attorney, Mr. Tim Pickles, who have also consented to the vacation of this Stone Street right away. My clients had nothing to do with Florida East Coast Railroad. They can't influence them. This has nothing to do with them. This has everything to do with them developing this piece of property, and unfortunately, they can't develop it unless that portion of Stone Street right away is vacated.
