Agenda (the City's wording)
The City's agenda for this meeting is on file (CC_Reg_Packet_08_23_2022), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
382 suspect passage(s) marked in place; 4 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 27 voices separated from the audio.
33 short machine repair(s) (38 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 91.1% of 16,117 content words.
Dotted words (306 places) are ordinary wording differences: hover or tap to see the other reading.
382 passages (26% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (4 stretches). Something may have been said here that the transcript does not have:
00:59:21 (8 s) — neither reading has words
00:59:36 (7 s) — neither reading has words
01:04:22 (8 s) — neither reading has words
01:05:05 (7 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Let's see if I know how to use this thing. Just back and forth, right? All right. So, as a nonprofit, it's our mission to encourage economic development in the Cocoa Village area through revitalization efforts. Without our board of directors,

I'd like to say thank you all for being here today, we could not achieve this. And our staff members, specifically Susan and Carolyn. Each year, we go through a process, an evaluation process through Main Street America and Florida, Florida Main Street to become an accredited Main Street, which you can see we are for 2022. With that being said, part of our evaluation process requires us to track specific data. That is this data up here, which we work in collaboration with the city to achieve. Three of those data statistics up there are for the whole village, and then the volunteer hours are specific to our organization.
volunteers who dedicate their time to our events. The new businesses and jobs, which we had 32 new ‸ businesses enter the village from October of last year to July of this year, which created 305 jobs. That's within the whole district. So, those aren't necessarily all of our members, but some of them are. A good portion of them are.

are design, promotion, organization, and economic vitality. Those four pillars are branched out into committees, which are headed up by our volunteers. ‸ Our first pillar is promotion, and this committee focuses on positioning the district as the center of the community and the hub of economic activity. As you all are hopefully aware that we put on four of these a year,

all of its proceeds to the sharing center. We have a bike parade that is free and family friendly, and then our moonlight music on the promenade, which ‸ acts

this woman is not just looking at what's happening, but she is interacting and hopefully posting and tagging and creating a buzz on social media about the village. And then Brewer's Bash. So our second pillar is design, and our design committee helps create inviting people-centered public spaces through, as you can see, trash cleanups. They do this on their own, as well as collaborating with other environmental nonprofits, like Marine Resources Council for the International Coastal Cleanup. You see a garden project over here. That's

banners that you see throughout the village, and our newest addition, which will be these beautiful directory maps that hopefully will be going in by the end of the year. Our third pillar is economic vitality. This committee enables a supportive environment for small businesses and entrepreneurs in the village. This year we've focused specifically on creating better communication with our existing businesses.
able to provide information to those existing members, whether that's ‸ our general meetings or our events, also the city's initiatives like the back to school drive, whenever we do a sidewalk clean, or you guys do a sidewalk cleaning,
But it's really cool because they also get to act as a community ‸ and talk to each other. If you see the red picture there, that is of one of our members who just redid their logo, so they got to provide that on the Facebook group and get positive feedback. We have also worked on some safety initiatives for our nightlife, such as
And then our fourth pillar is our organization committee, who is the foundation for achieving the sustainable revitalization process. Over the past three months, we've been working with a Texas-based marketing agency called Civic Brand to do a place brand audit, which we hope will construct a consistent and cohesive identity for the village, which will allow us to cultivate ‸ partnerships, community involvement, and resources for ‸ the district.
in which they think we need to work on in the district. And we're going to focus specifically on three of those. So the first one is our brand identity, which is our visual logo, the look and feel of our organization and the social environment, as well as our website. The second topic is the connectivity of the built environment. So in the circle here, you see that this is like the heart of the village, right? But then we have these little dots all around.

well as moving into the future? Are we going to remain a membership organization or focus solely on being a community-based organization? So those are our four pillars. Those are our four committees that drive our organization.
and organizations to give back to the community. Just a couple ‸ examples. The toy drive that the city puts on, the food drive, Matthew's Hope as a new nonprofit ‸ organization.
We don't want to limit ourselves to just Cocoa Village. We want to work together as a community with the city as a whole. And then the back to school drive. And also a fun little picture of us there dressed up in Star Wars for a county-wide event. So with that being said, we have some future projects in mind. Waste management assessment to see how the trash flows through the village. Some shuttle research for potential shuttling of back and forth to parking lots for events and or possibly from the beach to here to bring more visitors to town. Hopefully working closely with the city to create or help. Not create, but better the welcome packets for our businesses in the village and hopefully

And then we're also working on mural guidelines, which our design committee is heading up to make sure that everybody is making a nice environment within the village. So this is, I just wanted to leave this as a list of all of our members and say thank you to them because without them we wouldn't be an organization. And I also wanted to thank the city for all of your support and allowing us to be a part of the growth of Cocoa Village. That's all I got, unless you have questions.

And so we invited them to come here to do a presentation. And so you all could see the wonderful things that happened in the community because of doing this great program. uh The staff and the review committee was very excited to be able to award the funding to these organizations. It was a little bit difficult. A lot of work for them because it was with federal money, but they were successful in doing that. And we're very happy to see the great programs that these people did. ‸ So uh Mrs. erin Harvey and Mr. Jack Mason are going to be doing a presentation for the Boys and Girls Club. we wanted to make sure we were very intentional with the programming that we were going to provide to the kids. And we identified um three areas of opportunity. One was the learning slide that the kids were facing, their social emotional development that they were facing as far as being behind socially and emotionally, and then re-engaging um the kids that we were not able to serve during COVID.

Right. We included some financial literacy in there. It's all all the way to keep them engaged and fun and learning without knowing that they're learning. Literacy was one of our top priorities. So up in the top corner, we had punch cards. So every book that the kids read, they got a punch, a hole punch in their card. And then they could cash those in for prizes at the end of the summer. Some kids actually turned in more than one of those lanyards. We

is more police officers. My number one concern for me and other mothers and families that I speak to, and I say, speak to your issue. Come to the city council and make your voice known. And a lot of them say, why bother? They're not going to do anything or whatever. But that's kind of a nonsense idea to me because, of course, they have their own agenda. But you have to voice and speak what is near and dear to your heart, to your family. Never let them die and be forgotten.

Because I was curious, I spoke to someone today, this morning, about an issue. And I want to know what happens with an evidence locker or evidence room that if there's a murder, how do we keep this evidence for five years, 10 years, 15 minutes?

the food is put in, the silverware, cups, that type of thing. After speaking with some of our vendors, we did have some concerns. We do have a regular vendor that has been a vendor of ours for over 15 years, and he comes out to every event. There was some concern about the actual plastic bags for the cotton candy and the kettle corn, that there ‸ is no alternate solution at this point for that that still keeps the food fresh. So we did add that language in there to make an exception for that type of food, not necessarily just that vendor, but any vendor that would serve that product. And then also water bottles. You know, there's as long as we're going to prefer or ask for our vendors to serve recyclable water bottles. But in order to be able to serve water or sell water at events, we would still need to ‸ allow the water bottles. So ‸ that's the language that we put together. Again, I spoke with some vendors. There is an additional cost associated with these types of products. But there are some vendors who are used to doing this because it is required in other cities as well. And they said it wasn't as it was a minimal cost. But a lot of times that cost will get passed on to the customer. So just keep that in mind as well. So I'm happy to answer any questions that you might have.

was just going to say thank you for doing that research. And, yeah, it's a growing trend. And based on, you know, the evidence that these plastics break down in the environment to such small pieces that they're being ingested by marine life. And, in fact, there are even signs of it showing up in the human bloodstream. So it is in the food web and everything that we can do, along with all of our sister and brother cities, to prevent that will be good. So thank you. I'd like to make a motion to approve.

mean, the city does have a rather extensive ordinance regarding food trucks. I don't know how many have applied for a permit. I don't know how many have been granted a permit. That's an operational data question.

As soon as you apply, you're denied because you have to have a property owner's notarized letter. But it can't be like the tenant that's renting the building or if they're leasing it. It has to be the property owner. And the verbiage that's on it says that the property owner and the mobile vendor unit will both be legally responsible for any violations jointly. ‸ No property owner wants to be responsible for another person's business who's just coming there to serve lunch. The verbiage that's included in there is what's making it very, very difficult for anyone to obtain a license. I have one, but nobody else has been able to obtain one.

No, I've heard the same concern. Not exactly in her words. But I've heard from food truck vendors that they were having trouble within the city. So I would just ask maybe at a later date, maybe review the ordinance and go over it together.
issue is? And so, if you are a food truck owner, vendor, and you want to operate in the city outside of a special event, and you want to park in Murdoch's parking lot ‸ to run your business, you have to have the permission of the owner of Murdoch's. And the owner also has to accept liability associated with you running the food truck business. That's ‸ the issue. Ma'am?

food dispensing units within the entirety of the city. So, you know, I think that's addressed. The city has specific requirements for mobile vending units from a land use perspective and from an operational perspective ‸ on property, like cleaning up trash and things like that. So, the ordinance does require if a mobile food dispensing vehicle is going to operate on private property, then ‸ the dispensing vehicle owner must produce some, an affidavit of the property owner, where the property owner has agreed to allow the vehicle to operate on their property, and that the property owner recognize and acknowledge that there are rules about cleanup and there are other rules that, you know, if their temporary tenant, so to speak, the vehicle doesn't abide by the rules and, for example, do the cleanup, then the property owner could be held responsible for the cleanup. So, you know, there's a little bit more to the story.

major points there. So this is a pre-development tree mitigation agreement that in essence over a 20 year period has the potential to zero out the tree mitigation requirement per the landscaping ordinance. That currently is
there because this is an affordable housing project and because of the need for affordable housing. This item is put before you again as you stated if it if it ceases to become an affordable housing project or community within the first 10 years of the project. Then the total was due. And if it continues to be an affordable housing project years 11 through 20. There's a sliding scale all the way down to zero for each year that they complete as an affordable housing project there and we have that in the in the agenda item. You can see the sliding scale beginning or the sliding contribution or balance amount beginning in ‸ year 11 and zeroing out in year 20.

Yeah, so this item and the one following it, we spent some time, the economic development director and city manager, talking about the weaknesses of our tree ordinance and this mitigation, because we're really not using it doesn't really work in most cases. a lot of those aspects, which are kind of above my pay grade or my expertise with trees. Yes, of course, this is a project that has a big social benefit to us. So we'll be happy to have them. And I understand they're going to be planting a variety of trees.

And this uh is based on the direct costs and reasonable indirect costs that are part of the building plans, the inspections, the re-inspections, permit processing,

There's a lot that goes into a permit application before it becomes issued. Andand so we are using these permit fees to help account for those costs, including the enforcement of those permits and those the issuance of those permits and the inspections associated with any construction. That will ensure that the buildings are up to the standards that they are supposed to be per the Florida Building Code. So as you know, last year we did update our building permit fees when we implemented the new citizen serve system. And
uh Very successfully we have been uh having some great success with the program. the The permit uh applicants are very, uh they seem to, are getting used to the system. Let's just go with that. They, you know, at first it was, ‸ it was a challenge for them and, and now they're becoming more uh used to working in the system. uh With that, we are trying to clean up some of our fees a little bit to make it more clear and understanding. And we're also trying to be consistent with what the county and other cities within Brevard County have to, to make it more consistent for contractors and residents who are applying.

construction value. All commercial permits will be charged ‸ based on valuation for each permit, with the exception of a construction trailer. We have simplified the residential permits, uh putting some permits that we had separated together, such as the fence masonry wall and retaining walls. Those were all separate permits.

permit system. uh Sheds are all in the signs and everything. They're all under one permit system instead of having it under multiple permits. ‸ And we're trying to clean up our uh permit, just the the descriptions of the permits, the
day inspections have been removed, uh mostly because they're not readily used, and when they have been requested, we have not had the ability to honor those inspections. So if we have any special inspection requests, we will have ‸ the building official look into it. One of the things that we did change uh dramatically were the re-inspection fees. They're changed to the following schedule. uh If a building inspector goes out and they fail an inspection, the first re-inspection is free, as is current. After

And if we have continual inspections that are canceled the day of or right when we get out there, it's costing us staff time. So by implementing these additional fees will make the contractor more responsible andand accountable for their actions as far as not being able to have the inspection. they need to have They need to be ready when we show up for the inspection. So other than that, we are just trying to keep it clean um and consistent with what the county has and what the cities have throughout the county.

says the city has the ability to schedule fees and pay only the cost of fire inspections conducted pursuant to the fire code and related to administrative expenses and so forth. One of the biggest things that we noticed was that there really have never been any fees. So anytime a new construction or even old construction came in and they did anything ‸ as far as plans, reviews, any of that, there was no charge on behalf of the city to that building owner or to that construction company. So really they were getting it for free. The only thing that we were charging was $50 for a fire inspection, for annual inspection. So that wasn't even covering administrative cost or your cost of doing business.
money put it to the side to pay these fees. And just seeing the expression on their face when they're like what what do you mean you don't have any fees for the fireside I'm like, yeah. So this basically spells that out.
the fees would look like. We did a comparison with all the other municipalities including Brevard County around us and tried to stay in that median. ‸ We didn't want to be on the high side, but we certainly didn't need to be on the low side either. We did adjust some of our other fees or our fire inspection fee to kind of lower that a little bit more to make it more amicable for maybe some of our home businesses or things like that that have to have fire inspections and maybe they're not a large corporation. But certainly this helps some of those bigger businesses that require a lot of time, a lot of effort, both on the building department side and the fire side to do those plans, reviews, things of that nature to really kind of carry their own weight and pay for those services that they're getting from the city I think I talked about it at the budget committee meeting a while back that when we were outsourcing to a private contractor, they were making big money off of us having them do plans, reviews for us. The workload was just too high. We didn't have a fire inspector at a time, and we paid a lot of money for that, and the taxpayers paid for that. We never recovered any bit of that money so I think it's a it's a fair plan and certainly somewhere where we need to be at to help those services continue within the city.

Uh, well, just a big shout out to the Shaw's for opening the Children's Hunger Project. Um, walking through the inside of that building, they've, um, they've got a really nice space to carry out their mission. Um, and they've done some nice things on the exterior as well.
want to say from the perspective of somebody that's been sitting on the Save Our Indian River Lagoon, on the plan over the five years, septic to sewer has been particularly difficult. Um,
there's been, I would have to say that most, uh, utility directors have had real problems with it at first, because it's a completely different way of doing things than they normally do. ‸ So, fortunately, we've been able to make it over some of those pitfalls. It may speak to, you know, the plan itself that may not be set up the way it should be. I'm not sure that we have the ability to change that. But, um, it certainly, that has been a struggle for most of the municipalities. Um, ‸ and that's too bad because, uh,
the, ‸ on the, the, um, shorelines of Cocoa and Rockledge, particularly bad right now. Uh, ‸ the counts are high. Um, the blooms as a result of the freshwater inundations from the storms. Um, my neighbor across the street had two manatee show up dead on the shore. And had to call a fish and wildlife. So that was just a couple of days ago. So,
So I was really happy to see on our consent agenda, um, that we are applying for and could potentially leverage, uh, grant dollars to do, um, several different stormwater projects that will reduce our excess nutrients going into the lagoon.
