The City's record
What the City's record shows
Built only from the City's minutes (613_CC_Sp_Minutes_09_06_2016.pdf). Page numbers are the minutes' own. Discussion is in the minutes' text; it is not summarised here.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
312 suspect passage(s) marked in place; inspection incomplete: language review; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 10 voices separated from the audio.
18 short machine repair(s) (19 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 90.9% of 10,820 content words.
Dotted words (357 places) are ordinary wording differences: hover or tap to see the other reading.
312 passages (26% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
00:57:15 (27 s) — neither reading has words
00:57:45 (58 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

I'll rise. Hi, Jerry. Say yes, sir. Sorry, little brother. Yeah, I guess we can go home. Yeah, man, remember this is for you. That's right. Jerry's here.

Absolutely, sir. Would everyone stand in security? Heavenly Father, once again, ‸ say we come to you as humble servants, ready to serve and protect the people. We ask that your blessings be upon this facility, the structure of this meeting, but most of all, all citizens of this great nation that you have blessed us with. you know, in the individual meetings as well as the budget workshops we've had thus far. Again, I want to thank all the directors and the managers that worked very hard to put together a budget that exercised fiscal responsibility and ensuring that the citizens' needs are being met and services will be provided in the upcoming fiscal year. So, you've seen a lot of this, although we have taken out a lot of the department level because we're at a higher level now, but for the purposes and the benefit of the public that are watching this evening, as well as those in attendance, I'll go through and provide some details that I know many of you have asked either personally or collectively in meetings. I will tell you that we do have our great consultant here this evening, Mike Burton, and Eric, and Malcolm. Yeah.
And I know we received an email regarding the fire assessment, and at a point prior to the public comment, when it comes to the fire assessment, I would ask that, you know, Mr. Burton get up and make comments, you know, so council is assured based on the questions that were raised in the email and some of the statements that you have a level of assurance, you know, moving forward.
and the fire protection final assessment resolution for FY 2017, adopt a tentative military for fiscal year 2017, adopt a tentative budget for fiscal year 2017, and set the second public hearing, and you'll see this date several times throughout there, which is September 14th, eight days from today. Questions have already been asked. Can we do it on the 12th or the 13th, our meeting, or on the 27th? The county and the school board are having their budget hearings on those days, and

rate that you establish as the proposed at the maximum. You can go below, but you can't go higher. That was approved on July 12th, 2016. Then the second part of this evening is adopting the 2017 City of Cocoa tentative budget. So, just again, just to review this, so the members of the public have the benefit of knowing where the city's going ‸ in an effort to continually try to be transparent and accountable with the citizens' tax dollars. One, our focus in this upcoming fiscal year ‸ is community improvements in infrastructure. The two prior years, we spent a lot of focus in assets and resources on public safety. With utilities, we continue to work.
the assets and undertake a fairly massive and continuing renewal and replacement program. While we're mentioning utilities ‸ when we get there, I just want to let everybody know, today we did sign an MOU with LIUNA. You'll receive an informational agenda item addressing the disparities and the inequities as it

So, just that's kind of a sidebar note. And I want to thank Tammy and finance ‸ for all their work and Jack and Ed as we worked with, especially the members of LIUNA, Andy Newsome, the chief steward, and his fellow union stewards. So, then, obviously,
current levels of services that we provide to our businesses' citizens. We want to make sure we maintain control expenditures. And this year, we actually implemented zero-based budgeting for two departments, and we'll rotate that through. So, ‸ they basically start their budget from scratch. They don't look at last year. ‸ They build their budget from scratch, you know. So, it's one way to kind of get around to true up and make sure things aren't just sitting in a line item that carry forward every year, you know.
as well as maintaining employee benefits at reasonable levels. We did experience, you know, higher than anticipated claims this year in our health insurance. But, you know, you'll see later, actually, the numbers are still we're in a better position. If you recall, this fiscal year, we went fully self-funded. And the rate that we're going to ‸ be paying is still less than had we renewed with Cigna last year. So, ‸ I think it was a pretty wise decision on council's part, and I think it will only continue to ‸ grow. We also want to make sure that we fulfill our commitment to our collective bargaining units, the fire union, the LIUNA, and the police ‸ union, PBA.
our strategic plan, which was brought forward, was to put the city on a fiscally ‸ sustainable path. So, we're going to go over some of that, too. A little bit of a background as it relates to that. In 2015, we retained Burton & Associates, worked collaboratively with, you know, with staff and their staff to develop a fiscal sustainability model. It's a proprietary interactive model that Burton & Associates developed, and that was for the general fund. We used Burton & Associates for our utilities. They were for our rate study and also for fire assessment. And when you look at the integration and how that affects the general fund, it made a lot of sense.
enabled us to model our expenditures and revenues over a 10-year period and make decisions today, understanding what decisions we make today, how it's going to impact us, you know, down the road.
prior assumptions, evaluate the current fiscal conditions, and also look at the, you know, where we were in terms of the assumptions and the projections as it relates to the FY17 millage and fire assessment ‸ rates. This is the full screenshot.
their model. Again, the top bar, they originally, this goes back to 2015 when we first started this. And ‸ I'll even just go really right down to the two bottom bars, or the boxes, rather. The green and blue bars, those were our reserves. And as you can see, we were using our reserves to fund, you know, the fund ‸ deficit.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:11:52–00:11:54 · unresolved: the words are not shown (unclear audio); listen to the recording
a deficit out of complete reserves. So we needed a plan for that, as well as go over to the right. You see the red and blue bar, or the graph. The red bar line represents cash out. Those are our expenses. And the blue line represented cash in. You see the variance between the two. So we had a serious structural or financial challenge to overcome. So that was the basis. Now, moving into 17, it's been updated. It does demonstrate, as you recall, at one of the workshops that we held, that the military should remain unchanged over the projection period. It was updated to include the Walmart and the port property phased in 2019 for the Walmart distribution center.
excuse me, developing. It shows that, you know, continuing to use our reserves for catalytic type projects, economic development or, you know, community catalytic type projects and one time non-recurring capital expenses. The projection, and this was done back in May, if I recall correctly, was $5.4 million.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:13:17–00:13:18 · unresolved: the words are not shown (unclear audio); listen to the recording
mark in this budget today. It did demonstrate the 3% increase to the fire assessment annually. If you recall, last year it was recommended at 5% looking at our expenses and
Flag: words were replaced by a machine repair · 00:13:32–00:13:32 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
supposed to be 5% to 3%. And it does provide for the debt ‸ service for the fire stations. You see on the right the cash in, the cash flow model, cash in, cash out. Those red and blue lines are a lot closer.
If you look at the light brown line, that is our O&M costs without capital. So you can see if we had to make some changes due to maybe a recession or, you know, or some other, you know, catastrophic event that, you know, would impact us financially, we would be able to, like we did previously, but maybe in a better position to, you know, be sustainable and not place
Flag: words were replaced by a machine repair · 00:14:25–00:14:25 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
They're spent down strategically over time for a level 10-year period and on catalytic projects that will, ‸ you know, induce capital investment and growth in the city to, one, enhance our tax base. So at the end of the day, we're moving in the right direction, the model showing that. And again, this is the interactive proprietary model that Burton Associates prepared working with staff.
And we thank them for their efforts for that. Just a history in the ad valorem tax base. As you know, FY fiscal year 2008 was our high ‸ mark, our $1.178 billion.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:15:14–00:15:16 · unresolved: the words are not shown (unclear audio); listen to the recording
effect. And you can see to the right the drastic reduction in the tax base. Even nine years later, we are still not, you know, we're not even close. You know, we're getting there.

It's pretty significant for our city. This is tying it together, valuation, millage, revenue, ad valorem revenue. You can see the change over time. In the current fiscal year that we're in, $817 million of valuation, maintaining the millage rate of 5.9790, which is we've maintained for the last two years.

valuation. That would yield, and keep in mind, we have to budget by state law at 95% of that. So that would yield $4.8 million, roughly $221,000 more this year. Staff believes it's critical to maintain course, you know, as we put the city on a fiscally sustainable path. And

You know more than a majority, close to probably, probably over about two-thirds of our homes are less than $50,000. So, you look, if it's at $50,000 less than $25,000 exemption, you might be looking at about $1, $52 or so actual increase in their property taxes for next year. Keep in mind, we are only able,

and I think a lot of citizens want to know, well, where do we compare to other municipalities in terms of our ad alarm taxes or our property taxes? We rank number seventh.
And you can see here, and this is based on these rankings are based on the proposed rates for all of our respective or sister jurisdictions. And you can see there is one community that is actually proposing a ‸ pretty sizable tax increase over its current tax rate, let alone the rollback rate.

Yeah, that's their current proposed rate. They're all going through the same process right now. But as you can see, pretty much every community is going above their rollback rate or maintaining their current rate. So it just I mean, ‸ Melbourne, again, much larger city, much larger tax base. But you can see, you know, even Rockledge ‸ dropping a little bit ‸ but going above the rollback rate. So, ‸ again, as I

correct. So, at this point, it's what I'd like to do before we move to the public comment is I'd like to prior to, you know, engaging or asking city council questions and comments, is to invite Mike Burton to come up because the next order of business would be to approve the final assessment resolution, the non-advalorem assessment rule for the fire protection.

So, it's a pleasure to be here. We had an email that was forwarded by the city manager from a citizen who expressed some concerns. One was about the notices. And
Flag: numbers, amounts, negation or names differ between the machine readings · 00:23:14–00:23:15 · unresolved: the words are not shown (unclear audio); listen to the recording
‸ There are a couple cases that determine when a notice is required to be sent for fire assessments. One is when you go above your currently adopted maximum rate. And your currently adopted maximum rate is well beyond what you're adopting here tonight. The other is if you had a change in methodology or if the property is new annexed into the city. You had a last mail out the prior year, last year, when you adopted an update to your methodology for the entire assessment.
is based upon that study. All the property owners received that notice, including the property owner in question here that had the email. He was not required to be noticed this year because the rates aren't going above his maximum notice assessment. He also was noticed on the water and sewer bill for the rate adoption hearing for that as well. And I believe that was part of the concern.
you notice in the water and sewer bill not a first-class mail notice like the fire assessment is. So that was done. We validated that with your staff. So those two issues are taken care of. He also questioned the special benefit finding for a fire assessment.

validated that ‸ fire service provides a special benefit to real property. So that's been well settled in the courts. And that special benefit is the availability of fire service. It's the ability to get insurance. And it's a number of things that we delineated in the report that he questioned. And all of those for many years have been accepted as special benefits that the fire assessment does receive. It isn't just what we decided here. It's been decided in numerous cases before ‸ us. And I believe that was all that was brought up. So if you have any questions,
Flag: numbers, amounts, negation or names differ between the machine readings · 00:25:40–00:25:43 · unresolved: the words are not shown (unclear audio); listen to the recording
I think part of his confusion came from the fact that he did get a notice one year and didn't get a notice the next year. ‸ And he just assumed it was something that should come out every year. So ‸ I think that was ‸ in a city of 18,000 people, if only one person noticed that they didn't get a notice this year.
To his credit, you had gone through numerous methodology changes in the past few years. So he's probably used to seeing these notices and seeing this, oh, no, a new fire assessment hearing is coming up. So it's just the fact that this year you're finally kind of kicking down the road on ‸ the steady state plan. You didn't have to do the notices. Actually, you
mail notices only go out under certain circumstances, but the publication in the newspaper is published annually. And it's a sizable display ad, too. Yeah,

is. We've adopted a number of years ago an interactive modeling process, ‸ recognizing that it's very difficult for you to assimilate all the data that's coming at you, and particularly in tabular form and spreadsheets. We deal with this every day, and I think if you give either one of us a spreadsheet, our eyes will tend to glaze over, too, a series of schedules. So we developed this interactive technology where we can change things on the fly, and you can see graphically the results as their city manager shows you. Right. And you can
audience could say, well, what if growth was different? Or what if we had a different escalation rate on payroll? ‸ And we can change it, and you can see it right then. So the good thing about it is. For us, it's a huge advantage. It's a huge tool. Yeah. Well, thank you very much. I think it's a big advantage because in the better part of a morning or an afternoon sitting with staff or with you, we can work you towards a solution.

of that full integration. And everywhere we've done it, it's been an incredibly powerful tool for the decision makers to feel confident that they're really seeing what the answers are going to be. And how you need
‸ Well, it not only makes the decision-making easier because we can see how all of our decisions are going to affect not only this year's budget, but what's going to happen 10 years down the road. But for me, that's the biggest thing is that my first

know, Peter Drucker, the management scholar, has a quote that says, long-range planning is not concerned about future decisions, but rather the future of current decisions. And that's just what you described. Yeah,
Yeah, because it was almost impossible to know, you know, 10 years ago, what the decisions we made today, what effect they were going to have this year on the city.
The next five years is really a projection. But what we're looking that far out for is to see, is there anything that's going to be a major issue you're going to have to deal with in that time period, like
bar in the out years was still slightly above the blue bar, and it was capital. But that's a long ways out, and a lot of things can happen differently. Valuations could get better. You don't need to plan for a total solution 10 years out, but it's good to see that you're within the framework of having one.

Well, I think, one, the capital, we were hoping, to be honest, to go to the market in September for the fire assessment bonds. We're going in October. So we were planning on starting that. You've got to have that money before you can issue a purchase order. You have to have the revenue to back it up. There was one change. If you recall, we worked with working with the finance director, also with utilities, the director, and the city attorney. We're changing the way we do some of our contracts because, as I mentioned before, like we did this year, we booked the entire expense for the fire station. We know with some of the utilities large capital projects, they are multi-year, but you have to book the entire expense in year one. So now we're entering in like you did with the fire station contract. It's now a multi-year contract and we identify what the projected expenses are in year one. In that case, it is,
But in some of these capital projects that, you know, Jack's department works on, they are multi-year by nature. And to book that expense all at the one time, you know, kind of, I don't want to say it inflates the budget, but just because it's going to take three years or two years maybe to get those projects done. So now we've structured them so we can ‸ true up what the needs are for ‸ the actual utility. Again, water, sewer, you can see capital and operating, they dominate their budget because in operating, it's tools, it's equipment, it's chemicals, it's the electricity.

general overview of the capital program. I won't go over every item, I'll probably just pick out a couple. If you recall, we had a workshop with the engineers that did the analysis of our pavement conditions, and so we're trying to put some additional funds in there so we can, for, you know, and there is a, that kind of that maintenance and depreciation curve, so we can try to get ahead of it.
