Agenda (the City's wording)
The City's agenda for this meeting is on file (CC_Reg_Packet_10-09-2019), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
320 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 21 voices separated from the audio.
34 short machine repair(s) (41 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 93.1% of 13,688 content words.
Dotted words (433 places) are ordinary wording differences: hover or tap to see the other reading.
320 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:13:07 (30 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Thank you, ma'am. Next up, we've got to approve our agenda. And we have item number 65. That needs to be removed from consent agenda. And it's going to be on the October 23rd meeting. As well as item number 91, which is 19-483. Needs to be moved to item number 2 under City Business. And then the

have two additional amendments. One would be to move the reports, as we had discussed, after delegations. So that would make reports 5. And the other would be to take item 6-2 out of the consent agenda. And I believe then it goes to council business.

It was when it came down to ‸ this individual, I felt was the right person to receive this right here award. And his name is Mr. Ed Jones. And Mr. Jones was an original member of the Diamond Square CRA and original appointed in March of 1998.

me had accomplished so much in this community and during that time. And I was so proud. And I'm still proud of him today because he continues to do the things that he's been doing for many years.
up. I'm a firm believer of giving roses while you're alive. Mr. Jones, I appreciate you for just being a man, taking care of your family, being a great businessman, allowing us to see you ‸ in a different kind of light, man. I mean, you don't know how much you mean to a lot of us in the community. Seriously, I know sometimes, you know, it's kind of hard going from day to day, getting up and going to work. But us ‸ young men, when you see you do this every day, you give us encouragement. So I appreciate you.
Washington Street, and you walking around and picking up trash every week is something I see pretty much every time I go in the morning, I see you walking. And so you are an encouragement to me and my family for sure. So I appreciate you.
And I will just say that I don't know you, Mr. Jones. We haven't met personally, but I can attest, I can testify that there was some stiff competition and you have a lot of fans.

I just want to say thank you to Mr. Jones for all the years he's given to the Diamond Square RDA. When the Diamond Square RDA was formed, the work that that core group of people did was so vitally important to where we are today. And it was a labor of love because we all know there was no money and there were a lot of dreams and a lot of plans and no clear way to accomplish them. So people like Mr. Jones who stuck with the Diamond Square CRA, even when there wasn't a lot of hope to get anything accomplished or what makes this city great. I appreciate it. I appreciate the influence that you've had over the other people in this community. And I'd also like to say that Mr. Jones is one of those people who just goes out and does what needs to be done and never asks for any attention or any accolades for doing it. He's one of our silent citizens who does the hard work and never expects anything in return. He just does it because it's the right thing to do and it needs to be done. And he definitely deserves this honor. Thank you.

dedication to the Diamond Square community has never wavered. And he's always been somebody that's advocated it in the best interest of the residents of Diamond Square.
continued to move, you know, the Diamond Square agency forward with his participation and leadership on that board. So it's been a pleasure to work with you, Mr. Jones. I always appreciate and respect you.

send I'm sorry, thank you. To send a message to the city manager that it's an issue that the board feels that we should not be enforcing anymore uh until it gets corrected and better suited for the purpose that meant was meant to be. ‸ This is something that's only been started only a year or so ago, and
day for gravel he had already. uh In addition to that, there is a very young person that has a house that's up for sale, and he will not be able to sell it with clear title
but it's not clear It's more commercial than residential. There is a solution that was brought up. Maybe we can avoid one item, but this is something that you can see examples of all over the city of Cocoa. and that includes homes in the 200,000 range and up including other homes that are in a less expensive area I really feel that this is something that needs to be addressed as soon as possible

a piece of property that's existing and they have a dirt driveway, that looks like what the city wants you to do instead of making ‸ any upgrades at all, including including the lime rock gravel. It just does not make sense. ‸ It just needs to be addressed as soon as possible because people are being charged on a per day basis, and it's really getting worse. I'm hoping there's a consensus here because it definitely was with a planning zoning board to try to get this resolved I don't know if the city manager was able to get that information yet but that was another reason why I brought it to everybody's attention
I just Mr. Mayor it's uh I think there's only one person right now that's subject to enforcement in terms of uh an order being issued against them but uh you know I've spoken ‸ with the city you know the chief of police and the code enforcement uh manager, and uh
and And in terms of, you know, we have the comp plan, the sustainability plan, various projects. We have, it's beginning of the fiscal year and uh at this point in time I mean we will work and use that administrative discretion But uh you'll look at the medical marijuana, the utilities workshop, the strategic planning. So there's so many other things that are right there that are probably more pressing, you know, from for the long term aspect of the city. uh Not that the city doesn't want to address this issue, but
are important and uh this as well as I mean I think the the pnz board spent spent a better part of a year on the the new tree ordinance and that you know I've had some calls from members and others that feel that that's kind of creeped back in and dominating conversations. so I think both of these issues uh we want to put on the back burner one the sustainability advisory committee is working, and one of their components is about, you know, the street tree canopies and how street trees and trees in of itself, you know, have a, how they benefit the community. And so within that plan, will be discussed. So thatit would be premature to bring that issue up. But in terms of this one,
Flag: words were replaced by a machine repair · 00:18:38–00:18:39 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
just there's so many other issues that you've uh kind of put on the table and I just think to divert staff at this point in time, you know, uh we will kind of, again, exercise the administrative discretion in terms of not, you know, um enforcing at this point in time. And, you know,

it is that it won't be enforced until you have time to review the proper gravel issue right so that's good to know so I can tell people now if some of them have been grandfathered in

yeah I can I work with the city attorney to discuss this it just I mean it's very commercial like is there is there consensus from council with regards to the level of priorities given the number of issues that we have that in terms of revisiting the tree ordinance that we just spent well over a year? Well,
costing people money. Well, but it's it's it's it's consuming staff time that's taking away from undertaking other projects projects and reviewing projects. and and And as one board member explained, delaying the meetings, you know, more than they need to be.
Well, they were ignored, if you remember. The tree ordinance was something not enforced. And that was only recently reactivated. So we're trying to play we have to

that the police calls were handled and um resulting in some citizens having facing charges when they uh really shouldn't have been. If the policies and procedures for the uh police department were different and were followed. And. I. That was taken away from me by the city manager because the city manager told

the chief of police. It wasn't what the city manager keeps redirecting you, and we don't even get to what I'm here for. So I'm back here again asking you to please reread that. Please see that it's about uh policies and procedures that possibly could help not only the citizens that are incorrectly charged with these charges that they shouldn't be, but also it would help the police department too, and especially in the situation where I am living. But it also can apply to other people too. So I would ask that you look at that again. I would ask that you would look at that again. And maybe uh address the issue that I'm talking about, not what the city manager keeps redirecting you to.
on a small scale. And he won't let code enforcement enforce the code there. In the site plans, the Florida room is for the residents, for the residents but he's allowing them to run a business, this little group, to run a business and calling it a
in the Florida room. And they're not even like, you know, they don't have a business tax receipt. They don't have any of this. This is going on. So that's what I'm addressing. And I ask that you not listen to the city manager because he has taken ‸ away from me three or four times. Listen to me. This is my issue. It's not his issue. He wants to make ‸ into something because he doesn't want to spend the time. But this is important.

but uh we should be getting that completed soon. And uh also an update on the planting. We've got approximately 4 000 plants in place, and they're making progress on that. so Thank you, sir.

which is that trees grow in colonies. They need, they're almost social. They have much better chance of survival if there are other trees in the area rather than just one tree. So any landscape designer would have, you know, not done just one tree like that. So for that reason, I hope they'll understand.
You done? Yep. Okay, this time I'm going to, because there's a public here and I'm going to close it to the council at this time and open it up to the public for public comments. And I do have one card here, Mr. Greenwood. Alex Greenwood.

Been here long-term resident and realtor. These are people that not only supported the original idea, but they realized that because of maintenance, it was better to just go ahead and do the signage. They're happy with that. But also,
who own a lot of property here, and they were the people that bought land here in the downtown area that nobody wanted to go to, and merchants were able to finally come together. They all are supportive of enlarging the steamboat to where it is easily visible. And I was also under the opinion

but from talking to the board members that there was still a chance of tweaking it a little bit. This is not anything that we take and drag it out to the point where it takes forever. The engineering or architect with this, there were long, drawn-out time periods before this item came to the board. It's almost like it's a rush thing. Oh, just make a decision and get it over with.
God, the mayor was able to allow me out of turn to come up and say, wait a minute. And I'm glad that that was tabled to review and added in the budget to have that reconsidered. Point being, this is something that's going to be there for ‸ many, many years. It's not something that should be rushed or quickly done, but we're at the point we're on the verge of finalizing it. And that is the only suggestion that was made by the PNZ board, nine out of ten. The one person that voted no against it was under the opinion that the design was a done deal unless I'm mistaken. I'd like to see if I'm totally wrong so I can report to the people that ask me to be here.

project, this is the second modification, as we said, to the mining development agreement between the city and the villas of Cocoa Village, LLC, ‸ and it is also authorized the city manager to execute.
And just to sort of summarize it for you, the previous development agreement modification had required that lots one, two, and three and four, and there's a drive entry between those lots, be shifted to the east a bit to move lots one and two out of a 10-foot FPL easement that runs down the west side of the property.

up against that entry drive and utilize it. So the modification would be to allow lots one and two to encroach into that FPL easement a distance of three feet. The buildings are not allowed to be built in there. The model homes are actually going up now on those two lots. However, the lot itself can be in the easement. You just can't build on it
Item two is also this project. And this is two actions. It's a final subdivision for the Cottages of Cocoa Village. And it is also approval of a security agreement and authorizing city manager to execute.
the final plan. There's been, the project has a long history. It started a year ago in October of 2018 with a development agreement between the city and the developer at the time. There was a modification to that development agreement in November of 2018. The planning board heard the preliminary subdivision in December of 2018. Then the city council approved the preliminary subdivision with some conditions. And that was December 12th of 2019. I'm sorry.

really from the former developer to the Villas of Cocoa Village, LLC. ‸ Council then approved a revision to the preliminary subdivision plat, which had to do with lot widths for lots 5 through 14. That was also
And then, of course, tonight's second modification, which you've just approved, affecting lots 1 and 2. So city staff certainly looked at all of those assorted approvals and conditions and variances that were granted through the development agreements. And the final plat before you tonight meets all of those conditions. It should be noted that the plat only authorizes the subdivider to install all the required subdivision improvements in accordance with the engineering plans. That's the preliminary subdivision plat.
lots on the plat, council, of course, has to approve this final plat. However, as a part of that process, the improvements that have not yet been completed would either be handled by filing of a performance bond or providing, depositing an escrow, a check or cash in some form, either of which would mean 110% of the estimated costs. So in your agenda, you have a letter from the engineer with an estimate of what that would be.
applicant, yeah, the applicant is promising to complete at its expense all these remaining subdivision improvements within one year, unless an extension is granted by the council. And should the applicant fail to do so, then the city is authorized to complete the improvements,

been very helpful in moving this along I noticed you mentioned something about rumors before on some other subject. And you know there have been numerous rumors that have been circulating about our project. And we wanted to put a couple of those to rest with this approval that you've just granted. The process of preparing a project like this is not an easy one. Just a brief brief bit of background starts with the fact that we were not the original owners of the property. We were asked by the previous owner to step in and put our product which had been selected by

So months into working with him, his group decided that they were no longer interested in pursuing the project, and then we stepped up to the plate and purchased the property from them to continue it. We were committed to the vision of the city of Cocoa, the vision that the city has for the village. Having said this, we had some times where things had to be adjusted and assignments made in order for us to take over the project, which took a bit of time. Rumors have circulated that the project ran out of money or that the city was blocking attempts for things to move forward. Needless to say, just the fact that we purchased the property should be enough evidence that neither of this was true. And we want to make clear that the city has been working with us as well to make this possible. What the general public may not be aware of is that this is a unique type of project for which
in order to work through codes and ordinances. Many things that current codes don't really provide for a project like this. So, and also it's the norm that buildings don't start going up until your final plat is approved. Well, the city gave us permission to start
start our model. so this way it might seem to some that the project is taking a long time or that nothing is going up when in fact lots of work has been done and lots of money and time has been spent and committed. For those who don't know, there was an old building on the property that had to be demolished

due to an old railroad track that used to be down there that had to be dealt with. And we wanted to be sure at this point to thank everyone involved in working with us to get this approved. And now we're going to get to work and continue building this amazing project, which will only enhance and

ongoing program. I know it's an opportunity for us to have more professional engineering staff on board and you know those are folks that absorb institutional knowledge and can you know cross train in other areas
much going out to a contractor that um the actual program itself is we're just bringing it up to speed and it's going to be shrinking or are we going to be still? Yeah
I think our hope is to um by the time their contract uh is over basically another year and a half uh that the majority of that work would be in house. uh Really but ‸ quite honestly Ii still foresee it as a mutual agreement at this point because what we what we're finding now is um our staff is doing um uh the new installs for backflows of course and um a lot of the or all of the repair work and the contractor is doing the new surveys which is required by by DEP. So when a new residence that has a high hazard or a medium hazard a physical survey of the property has to be done ‸ logged in uh that process is currently being done although I mean we had to do something like 30 000 plus surveys over and that was over that couple year period.
so that water can never get pushed back into the system and maybe harm potentially somebody else downstream. So that's what this program is is kind of all about. um
Okay well I'm glad to hear my main concern was that you know we just look at opportunities. ‸ to bring staff in-house I know it's been said before that it's cheaper to hire a consultant but
own work experience, that that's not always necessarily true. That there can be advantages to having certain staff, you know, under our umbrella so that they can fit in and take over, you know, if you walk out tonight ‸ get hit by a beer truck. Okay. Just kidding. That won't happen. I
efficiently, there there is, we would have some great challenges in order to test the backflows that they test, because it's a two-year requirement for the, um or one-year requirement for the commercial. So

be tested on a on an annual basis. And then the residential ones that fall into a high hazard about every two years is required, or is the guideline. uh
something that we have not yet been able to really understand. But there's a certain amount of motivation, I think, and and a unit costing that they do as a private organization that's driven towards uh keeping a business open. That's hard for us to mimic. uh We've looked at it when we're we're still trying to come up with fair numbers, but
eight or nine more people to do the equivalent of what they have a much smaller contingent doing. uh But for right now, like I said, we have four full-time uh and then a supervisor that we, I think, just did last year. And so that that program is working working
