Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
427 suspect passage(s) marked in place; inspection incomplete: language review; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 26 voices separated from the audio.
38 short machine repair(s) (44 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 90.6% of 17,477 content words.
Dotted words (446 places) are ordinary wording differences: hover or tap to see the other reading.
427 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
00:16:54 (3 s) — neither reading has words
00:28:12 (7 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

We're here today to present our service awards to honor our employees on their tenure with their employment here with the City of Cocoa. We're going to be calling our directors per department to come up front and assist us with delivering this award. For administrative services, City Clerk's office, we have Colleen O'Donnell, record statement with five years. Colleen, if you can come up front.
Yes, absolutely. If we can have council members and mayor just to join us at the end, just to have a group picture with all of the employees, that would be great. For our finance department, Terry Butler, if you would like to come up.

Good evening, members of the council and staff. Last time we spoke on the 22nd of August about the flooding at Dade and McLeod. Since then, I've talked to Mr.
twice, Assistant City Manager, and Mr. Giorgino. Since last we spoke, we've had three flooding events in September, two of which were during the hurricane, another one on 1 October. I've got invoices here the last two months, materials and services rendered, no labor, almost $3,000. This city continues to charge ‸ myself and my neighbors stormwater. I assume that's getting rid of the stormwater, not bringing it in. This has got to stop. Work order 11371 issued 31 July. I've not had one call from anyone as to an update to that work order. Mr. Weigraff agreed something needs to be done. I volunteered to do the work at my own expense and cost. No, I can't do that unless I go down there with a shovel, one shovel loaded a ton. I'm not in that good of health, and my neighbors are not going to do it either. I'll go down there with a mini excavator, and I'll take care of business. But I need your permission. But if you're not going to do anything, at least reimburse myself and my neighbors for the expenses they're going through. That's all I'm asking. I'm going to give it until the end of this month. If we can't have some recourse in mitigation of this, and it's not a big deal. It's not that much work involved. I'm going to seek legal counsel. I don't have any other choice. My home, Mr. Yancey's home, are imminent danger of flooding. Gone out, I bought a trash pump, 300 foot of hose, evacuating the water from down at Dade Court all the way to US 1. Brought in sand to berm up two of the houses. 60 sandbags still in place, preventing the water damage to 2603 Dade Court. Come on, guys. When you asked me to go serve, I didn't say, well, wait a minute. I'll get back with you in a couple, three months. They

349 Lucas Lane. My issue is the drain issue on Lucas Lane, D Street, and Washington Street. We have been having floods since the hurricane. Me and my mom just purchased a place over there, and we moved into a flood zone, but we were told it wasn't a flood zone. Our neighbor has told us that he lost a vehicle because

specifically to do the one nearby the house, and they did not do it. And by that, he lost his vehicle. The water was so high, it shortened his electronics in his car. The water also exceeded toward my mother's ‸ garage, almost toward the front door, and we just moved into place.

a handicapped to walk through. But how can a handicapped person use it when there's so much water? It's, I, like I said again, I don't know how this works with you guys.
But usually where I come from, when we see problems like this, when we call someone, they should be able to assist and help. And that's, I believe that's the reason why I'm here. Hoping that someone will assist and help us. Because, like I said again, those are new homes. No one

However, specifically for this area, in the mid-late 2000s, the city, the county, the Diamond Square Community Redevelopment Agency undertook, following a drainage study, undertook a number of improvements to improve the drainage. And it has, we've gone through several storms since then where we haven't experienced, although this last storm, followed by the ‸ weekend storm that just laid a ton of rain on everybody, caused it. But I know the county, the city, the Redevelopment Agency has done that.

Wilma. The improvements that we made, and for those that were aware of Wilma, how much rain it dumped, we didn't have any of the issues that, because we addressed some of them, you know, with, you know, a collaborative effort with county money, city money, as well as the Diamond Square. That's

And ‸ when the St. Johns backs up so much, that's why you're seeing, actually it's at a flood stage right now. ‸ Well, that's something we'll follow up with. But I know for this last rainstorm, especially when we anticipated it to come this past weekend, one of the things that the city did, because, you know, obviously that first rainstorm and all those gusty winds well after the hurricane, I think caught a lot of people by surprise to the amount of rain that, that fell.
six inches and the city went out and, and, and purchased. And the city historically has not done that, but about, I think it was about 3,000 sandbags and had them at station one to try to help cut, you know, residents that were facing issues like yourself. And we're fortunate it didn't rain this weekend because they were expecting, you know, some heavy rain this past weekend.

me taking on the stormwater since my yard's always underwater. At that time, it was a joke. But look, guys, we're fixing to get hit with a tropical system on Saturday and Sunday that is predicted to dump another 10 inches of rain in central Florida. Now, I give John all the credit in the world because last Sunday he saw my email and he called me to let me know he was out in the street. Ed's done the same thing. We can keep saying we're going to look into it. We can keep saying we're planning for it. But it gets old. There has to be an interim solution. If it means digging those drainage ditches out in Broadmoor Acres and cleaning them out and making them deeper and putting a pipe because I'm at the point to where I'm honestly prepared to go in and raise my fence up, ‸ and I told Ed this, I'm prepared to fill that ditch in on my property anyway. Put a pipe underneath there, fill it in, and put my fence line all the way up to the property line. Because I don't feel right calling him, telling you guys, look, we need to clean this. All right? So that's pretty much where I'm at. I'll update you guys on back wrap next time.

that's workable, uh, sounds like a very desirable goal, unless we can come up with somewhere else to put hundreds of cars. Uh, what I really want to talk about beyond that is,
visit from the Sail to the Sun rally is coming to town. Uh, in conjunction with that, I introduced the idea of a pay-to-attend cruiser seminar that's getting some national advertising. Uh, the idea behind that is to put COCO's best foot forward to be one step towards making us a waterfront destination for cruisers. Unfortunately,
but with the amount of time we've had to prepare for the event and what we think we're going to be able to offer. The more we thought about it, the more worried we've become. We,
there's nowhere to bring people ashore. Whereas historically, we've had the use of the T-Doc, T-Doc's gone. Okay, we'll anchor everybody ‸ out. And we're talking 30 boats, maybe 40 boats, and bring everybody in in dinghies. So we don't have a good way to bring people into dinghies unless, A, the park is open, and B, there's a place to put them. What I thought of initially was rent a, uh, a small barge or a float, anchor it kind of in the ramp area where we may have a floating dinghy dock someday and have a gangplank going up to the land where these boats could come in, tie up, and go about their business. If the park's not going to be open for use, that's not going to work.
help the community. Part of the proceeds from what we're doing with this, uh, cruiser seminar would be directed towards waterfront improvements. That's, uh, that's earmarked for that purpose. If we can't do that, a, a potentially viable alternative would be if we could

couple of day period, we could bring dinghies in there, tie them up, they could raft off to each other, climb through each other's boats, which cruisers do all the time, and walk into the park from there. So there's viability that we may be able to keep this thing going, although at this time we're, we're somewhat, uh, walking in shaky boots about whether we can put our best foot forward. And the idea of, well, we're not the pristine, beautiful
that we were, had gotten to where we were getting to be. Cruisers by nature are kind of adventuresome. Uh, they can roll with things a little bit, and there's maybe, maybe even a little fascination with, look at what happened here, this is terrible, uh, and grow from there. So it's kind of a before and after situation on that. Um, I am talking with new information being produced this evening, so I'm,

situation for us. If it truly is not available to us, in my mind, the, the, the humane thing to do is pull the plug on this event. This year and advise the people that have signed up that it's just not gonna ‸ happen and it's because of the hurricane. Hopefully we,
don't have to do that, but there, we, we know that there's that potential and we'll need to make that decision fairly soon. Because we need to advise everybody and pull the advertising that's, uh, starting to go out and so on and so forth. Um, other than that, that's about all I had.

I think what we're looking here for is information. I mean, we know that we can't expect miracles and this is not a priority when it comes to community. We've got homes flooded and things like that. So what we're looking for is some information.
Well, the, the current challenge is obviously, uh, the damage that's taking place around it, which is being cleaned up currently. There's a couple of contractors, one from, uh, Florida Department of Environmental Protection that's cleaning up the surface materials.

to find out what their timetable is. Uh, I don't know what kind of regional area they're pulling debris from as far as their timetable, but I know what ours is. And, uh, it should meet your timeframe.
That's encouraging. If it sounds like there's a good chance that there will be at least limited access to Lee Winter Park for the first weekend in December, that's a huge step towards us being able to say we can go forward.

‸ moratorium with respect to medical marijuana dispensaries. Since the enactment of that moratorium, which is going to be expiring soon, the Florida legislature has adopted a legislative scheme for local governments to regulate the location of medical marijuana dispensaries.
choice. One, municipalities can ban medical marijuana dispensaries outright, or alternatively, medical marijuana dispensaries will be treated as a matter of law just like pharmacies. So, the choice to the council and the direction that we need from council this evening before the moratorium expires is what direction the council wants to do, whether it wants to ban medical marijuana dispensaries at this time or let the moratorium lapse, in which case medical marijuana dispensaries will be treated just like pharmacies, and under the current zoning regulations, they would be permitted in a variety of zoning designations, which are listed in paragraph eight of your agenda item, including but not limited to several residential areas, commercial neighborhood,
Well I mean the Florida legislature has provided that choice. So municipalities have the right currently under Florida law to ban medical marijuana dispensaries within its jurisdictional limits.
do where we want them. And that's just wrong. We should be able to make that decision, not the Florida legislature. They'll live here. It'll pay our taxes. And they shouldn't get to decide where we put a business in our city. It should be our job, not theirs. I just don't see that they've really given us any choice until they change the law or until somebody sues them. Right. I mean to let it go anywhere a pharmacy would go is is really I don't think what our residents would want.

Yes, but since it is a mandate now from the state, I agree with Councilwoman Warner that we should have a home ‸ should rule, but I do believe that we should allow the city manager to come up with the ordinance to ban the medical marijuana treatment centers at this time. We can always revisit it. So I think the smart thing for us to do would be to go ahead and devise the ordinance to ban it and readdress it if the need arises. And I'd like to make a motion to do just that.

I haven't seen any communities yet, but another approach, but which would take study planning and planning time, would be to determine if there's any way you can regulate medical marijuana dispensaries under a new regulation for pharmacies.
you're accustomed to and a medical marijuana dispensary and have the best of both worlds with a whole new regulatory scheme. I'm not sure if that is feasible, but that's an option, but would take a lot of planning, study, and time, which you don't have right now because your moratorium is about to expire. So I thought that was greatly appreciated internally and externally. have just one item to update you with. Last time we were together, I spent quite a bit of time talking about what happened during the hurricane, and most of that was focused on the water system, but I wanted to kind of share with you a few, just a couple of statistics on the sewer side. to last year. So we've had way higher peaks and average day flows. ‸ Through all of this, we had three minor violations. Two were at the Bracco Pond where we had overflows between the pond and the ditch that feeds the pond. ‸ That was reported. ‸ We had one minor 15-minute period where we had a dip in chlorine residual at the plant. ‸ Other than that,
all discharges into the river. And so I just thought that I would mention at the council, it's a big accomplishment. A lot's been going on there. And not only was it, you know, double and triple the capacity of the plant, but there are portions of the plant that were down for different maintenance reasons. And so they even were able to overcome those restrictions and they were able to successfully do the job. So I just want to applaud their efforts. That's all. Thank you.

Just a couple of items. of which I don't know that she's ever researched or worked on that area, so she certainly knows a fair amount about it now. And we've come to an agreement that will essentially provide fiber optic connectivity to fire stations one and two at
And so it should provide a much more resilient infrastructure for us as well as in the future. There's some significant benefits to it as well. And, you know, I just want to thank all of them for their work on that. And, you know, it's not something that we'll see, but it's something that we'll certainly know and hopefully our residents will benefit from in the future. And, uh, uh, uh, the second item, uh, everyone seems to be calling and asking if it's not the water, it's the debris. And so I just wanted to kind of ‸ provide an update. Uh, I've been,
last several weeks, almost daily, maybe more than daily communication with the county, uh, as they are managing the contractors that are within Brevard County. Uh, we entered into that contract with them and, uh, they have contractors serving both the unincorporated areas and, uh,
Uh, the landfill area where they were dumping around cocoa, uh, was waterlogged and their trucks weren't able to operate in it. Uh, and so we asked, well, what, what can we do? That's our first priority is getting the stuff out of people's front yards. That's a lot of stuff that we've put there or some friendly neighbors have made some drop-offs. We hope to come back with some information for you that will be instrumental in helping us be better representatives to our constituents. And also, I wanted to mention that I would love to attend, uh, attend the, um, workshop,
sustainability workshop, but unfortunately that's going to be on October 19th and I will be in Daytona. So, I wouldn't be able to attend that, but, uh, I think that this is something that is vital to our community and that we, we do need to get involved in and be proactive. And,

issues and, and I just want to mention that, um, ‸ as parents and as neighbors, we need to remind young people that the drainage ditches in your neighborhood are not trash cans. Um, they seem to forget that they're not for their trash.
little, a little work on behalf of us adults might save some of these flooding issues that we're having. And if we see children throwing stuff in our drainage ditches or drainage storm drains, we really do need to say something to them. uh, where the, um, occupant is, um, someone who works, uh, out of the area frequently. And there seems to be just water rushing down the driveway into the street. And that drain right there on the north side of Indian River is just, water is literally rushing across the road right there. And I don't think it should be like that this many days after the event. So there may be something else going on in there. Um, we
Right. He had to move out of his house because of all the water coming out of the ground. The apartment was shut down before the sanitary sewer was put in. So it, it happens, you know, it's on the side of the hill and it's, it's just water that's collected up at the top of the hill and it's oozing out of the ground. So.
house there that's, that I know is not always occupied because the owner works, um, in another part of the state. Um, there was a tree that went down in the yard. So I don't know

what there's not maybe a busted water line that's producing all of that water out into the road. So it just, you can see it just, just literally rolling down his driveway like somebody's left a hose on. Right. Yeah.
And I, like I said, when I look at the apartments and I see it rushing out of their driveway, I, I figure it's just in that 15 acres that's right there by the apartment. Somebody had said there was like a, a spring or a well or.
Something on there. So I figure a lot of it has to do with that. Yeah. I was just concerned that we might have a broken line somewhere around there. There

there's, uh, I don't know, a lot of termites in it. And she wanted me to tell the city tonight, you know, and I was wondering if you could go look at that tree. It might be about time to, you know, get rid of it. It's, it's been

so when we did get an event like this, uh, it was easily, uh, repaired. Um, I'm gonna, I just want to throw a question to the council here. Um, if the water, if we get hit again by another hurricane, a strong hurricane, can we ever guarantee that we wouldn't have a main, main break or we lose pressure?

And, uh, I just want to thank you and everybody for doing, ‸ for doing your job so well. Um, it's, it's a pleasure. If they want to go to war, we're going to war. And
So, thank you very much. And we're gonna continue, uh, you know, moving forward and, and being positive. Um, you know, when you're, when you're the best, everybody takes their shots at you. And so, bring it on. It's what I say. And,

Uh, still windy out there. He took his bike out and he found a, uh, a canoe that's probably, well, ‸ the first round of, um,
testing on it says it's 350 years old. It looks like a, probably an Indian made canoe. Maybe a Seminole. Maybe a, uh, another tribe. But it is unbelievable. And I had the honor last weekend of being just one of
