Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
418 suspect passage(s) marked in place; inspection incomplete: language review; 3 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 12 voices separated from the audio.
43 short machine repair(s) (46 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 93.6% of 18,469 content words.
Dotted words (509 places) are ordinary wording differences: hover or tap to see the other reading.
418 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (3 stretches). Something may have been said here that the transcript does not have:
00:10:47 (2 s) — neither reading has words
00:41:43 (7 s) — neither reading has words
02:05:41 (29 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

‸ It's not a big deal. Usually, paper copies are provided so that we can review it if anyone hasn't reviewed it before we vote on it. So we'll just table it and we'll vote ‸ on the approval of those minutes with the approval of the minutes from this meeting at our next meeting.
Yeah. So we'll waive the reading of those minutes since we don't have them at the moment. And we'll move on to number three on our agenda of the committee discussion of our
I open the ‸ discussion? Excellent. Hearing none, we'll move forward. Our first case, case 21-10-IA. The date of the incident was March 20th of last year. Does anyone have any, I'll now open the discussion to the committee on this particular item.
Having read the complaint, we have discussed this in the past and I don't see any new information that would give rise to anything that we need to pay attention to as a committee. So I would motion if there's no further discussion that we accept the findings.
I hear a motion. I hear a second from Mr. Thomas. All in favor, please signify by saying aye. Aye. Any opposed? The motion to accept the findings. Thank you.

staff about, not this item specifically, but I guess a general thought that came up as I was reviewing it. Something that I've noticed just in my profession is that there are officers sometimes who participate in misconduct, they resign before they can be disciplined, and then they just go apply and work for other departments.
when someone participates in acts that are certainly open to disciplinary action and that are likely to result in disciplinary action, is there any safeguard such that any agencies that want to hire that person in the future is ‸ made aware of the fact that there was an open investigation and what it's about or anything like that?

there's one question that comes out of this and I'm gonna ‸ direct that to the chief ‸ that's okay chief we noticed in here the the type of chemical agent that was used in that training ‸ exercise inadvertently. Has your department gone through their inventory on all of this and made sure that this type of thing wouldn't happen again?
makes a lot of sense because I do understand that there are issues with potentially disciplining an officer for actions that don't violate any existing policy and if, in fact, the policy doesn't exist.

And it was, uh, related to a technological or scrivener's error. And so, uh, the agency wasn't, or the officer wasn't really at fault. It was just a technological, uh, error. Uh, we know that smart technology sometimes isn't so smart.

wanted to say it was, like you said, it was a technical error. The officer put the actual date of birth incorrect, but the way it came up on the computer, it was wrong, and the sheriff's office didn't recognize it, and the officer didn't recognize it.

That's why I was just looking for Sergeant Bradshaw, because he's the one who did the investigation. No, it's actually Lieutenant Bobay who did the investigation. He no longer works for the agency either. I can read the case and try to provide any input that you have or you may want on it.
observations were different than the complainant's observation. And they supported the victim's observations. And so based on two witnesses, one of them being an independent and uninterested witness, law enforcement or at least leadership determined that the complaint was not sustained and was, as a result, ‸ the officers were exonerated. ‸ So ‸ I didn't see ‸ or read anything that I saw as suspect. And so I don't have any further discussion as it relates to that. But that's my recollection of what I read.
Yeah, as I'm reading and I'm remembering the case now. So the incident happened in 2021. I think the victim at the time weren't very cooperative. And then if you see the difference, he came back next year and wanted to file a complaint that the officers didn't didn't do what they had. They should have done.
the beginning. And he wanted us to change what occurred the day of. And that was his original complaint. And I believe it was because of some medical bills that that showed up that he was trying now to get compensation for.
I remember reading one thing in this complaint that jumped out at me. It said that body cam footage was not available because of the lapse in time that it passed.

So, you know, there are certain things that are five years or, you know, traffic crash, things like that are up to five years. So we have different designations when an officer is done with a case that they assign it to the specific folder that that is set up for that retention period.
I'm just curious. When you have someone that's being a little, say, aggressive or resistant or hard to get information out of, do you have policies or training to deal with that kind of person? I'm sure you do.
We deal with those people every day. Every day. But if you're a victim, we can't, you have to be a cooperative victim. And ‸ a lot of times when you have a situation like this, mutual combatants, it's a he said, she said. So sometimes one side doesn't like to hear that there's nothing we can do outside of an independent witness or video or some other evidence to prove who the primary aggressor was. It's really just a documentation issue.
Well, I'm just thinking, seeing as how you deal with these people on an everyday level, and I'm just wondering if maybe there could be more trainings and ways to even spot if there's elevation in, say, the police officer that you're working with.
So, yeah, there's a lot of training on it. The officers get a lot of training. There's retraining on it. So that's definitely, you know, a high priority in the police field at this point.

And just as a reference point for those seated here, we have about, we have ten items on the agenda. And after we, after we go through those ten items and discuss them as a committee,
have comments and concerns. I've only received three cards at this point. Uh, and those comments will be limited, um, to two minutes. Um, particularly for these three, normally we give, normally we give three minutes, but for these three matters, we're giving two. And the reason why I've, I've decided that myself is because
settled and voted on as a committee and have already been discussed in a prior meeting. And so we're going to limit the time, uh, to discuss an issue that is already closed to this committee, uh, but you will have an opportunity to be heard. Item number seven.

the complainant again at the police department. At one point, officer Nolan raises arms and slammed them against the desk, scaring the complainant. The complainant stated that she was afraid and left the police department. The investigation was conducted by Sergeant Anthony Colombo and the, the complaint was sustained, um, as to that, um, officer and there was a disciplinary action taken at this time. I'll open the floor for discussion from the committee as it relates to item number seven.

Yeah. So this officer is a very conscientious officer and, uh, he basically said he made a mistake and look, and looked at this as a learning opportunity for him. Uh,
mandated by the state. Then there's training that we do in order to ensure that our office stay pretty proficient in their, uh, knowledge and, and with their weapons and things of that nature. So we have to make sure we strategically budget the appropriate training. Now, when it, when we see other training that's out there that may not cost us where it's not infringing upon our budget, we'll allow officers to take those trainings. So we look for,
a positive way. So we're not looking at just necessarily disciplining them. We want to make sure they're trained so they continue to stay competent in their field.
Yeah. I'm, I'm also wondering if there's like a way to just have discussions about when these issues come up to talk about them and, um, use each other's experience for the newer officers and just have a kind of a, uh, more of an open discussion time that people can actually learn from each other.
somewhere in the country, anywhere in the country. So we have roll call training where we just sit now talking about these issues and what we can gain from that to make us better. So that happens all the time. So let's say, for example, um, we have seen where an officer may have could have done something a little bit different, but yet, and we had a different type of intervention. Like we did this, um, this training here, we would talk with other officers that kind of talk about the case without necessarily identifying the officer.
other question as far as, um, using, um, time in the community where you're not necessarily in those high, um, conflict type of situations, like things like a community garden or, you know, using parks and rec and having police, you know, being able to have time to just make the park safe and, and spend time outside.
So on a nightly basis, our officers do what they call park walk and talk. So when, when they're not handling calls and time permits, they're in the different neighborhoods and different parks, walk and checking those parks.
a time for them to have, you know, uh, exercise outside, just being away from some of the tensions that you would get normally on a, you know, when you're, when you're on duty is, does you, do you look at it like that at all? I'm just curious.
think that's, that's, uh, what we can have more discussions aside and kind of talk about some of that to see how we can better improve boxes, health and wellbeing.

hand, but I can tell you before I, before I got here, uh, the, the training budget was very, very minimal. And since we've, uh, been here now, we have increased that training budget astronomically, thanks to the city manager. So our officers have a much more training they've ever had in years since we've been here. Okay.
Thank you. Any further follow up from the committee as it relates to item number seven? At this time, I'll entertain a motion as it relates to that item.

So I understand that both complaints were found to be unfounded or exonerated. But in situations where an officer has repeated complaints and brushes ‸ with citizens of our community, is there some extra training done in situations like that? Because ‸ I understand that it may be exonerated and this specific facts may lend that they're unsupported. But if multiple people from the community keep complaining about the same officer in completely unrelated incidents, is that an opportunity for training or follow-up?
I know it may be the same officer, but you ‸ have an officer that's a little bit busier than others. It's more likely that people have an opportunity to actually complain. But the facts speak for itself.

additional training, we're going to make sure we give it when it's necessary. But in this case here, ‸ it just happened to be the same officer, but he didn't do anything wrong in the two cases. anything wrong with it. It just gives you, you might want to look at these response to resistance because this officer has a lot more than other officers. And it also captures sick leave, discipline.
see an early warning system, if they're an officer that you need to start looking a little closer. So if a specific officer is getting constant complaints, it would show up for us ‸ to look at that like you were just saying. And make sure there's nothing else there. Thank you, Commander.
Correct. So if there's an officer that has, you know, a little bit more response to resistance. And when I say response to resistance, that can be, you know, firearms, pointing firearms.

It might have been that the woman was walking down the in the dark and the lady that hit her couldn't see her. The goal of a police officer is not to make judgments. It's to collect the evidence, which is what this gentleman did. And as the victim told you,
when he told her that the there was nothing he could do to speed up the medical examiner's autopsy. And there's nothing he could do to get the state attorney to arrest the lady until the medical examiner did the autopsy. That's what your police chief should have done. Because if there are people who profit from racism, and if they can split us apart, there's money to be made. And there are people who cry racism because it's good for them. But in this case, if we could go through step by step by step, you would see that the investigation that this police officer did was perfect. slap on the wrist. It was the seasoned prosecutors at the state attorney's office that had been prosecuting cases for decades that made the decision. But all of the evidence they needed was there. The the shots, I mean,
the woman taking the shots in the timeout sports bar that that man captured and preserved and brought into the case file was powerful, powerful evidence. The voluntary blood draw. He was polite to her because he got her to incriminate herself. And if you can be polite to someone and get them to confess, that's a lot better than than coming forward with a quick arrest. see if we can speed the process up. He then told me when I called to make ‸ sure that I informed him that he's been waiting on cases since February when I make the call. And that was his response to me. um He also said that um it was his well training is why he got a confession out of her and even for her to do a blood alcohol level.
