Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_10_20_2022), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
412 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 16 voices separated from the audio.
51 short machine repair(s) (57 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 92.8% of 18,427 content words.
Dotted words (507 places) are ordinary wording differences: hover or tap to see the other reading.
412 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:56:34 (7 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

They're in every picture that we're showing now, showing the violations. We have buckets and lawn equipment that's dismantled and old barbecue grills and paper cups, gas cans. And you can see where the owner of the property has been trying to cover the license plate so that we can't see the expired tag.

Oh yeah, the roof needs immediate attention. You can see the bows and the sheathing underneath. In the pictures, you can see the numerous tiles that are missing. Areas that have been attempted to be patched.

Now that patch up there, uh, we, we never patched that. We've owned the property for seven years. So that was probably from previous, but we have no leaks at all in the house. Yeah. We ‸ have time to get stuff done. Yes. Okay. So long has been done already so far. I mean, we're on top of that. It's just basically we did come to the hearing and get more information. What needs to get done?
Well, you didn't. The thing about it to be able to be proactive opposed to reactive. So if you would have gotten with them and taken care of this, you probably wouldn't even be here today.

Let's just say in one section. And then now if you're noticing that white spot in the front roof is just ugly. It doesn't even leak. It just needs ‸ some tile put up there and the paint. So we noticed that that board was probably changed out.

we're asking for 30 days. I want to make sure if they say they can do it in 30 days that they understand they may have to go to the building department and speak with them. Okay.
Well, again, what it sounds like he's trying, he's trying to, in a sense, throw your lifeline and which I'm saying, he's trying to get you to do it in a manner that would save you time and money. Because if you get it taken care of now, or opposed to throwing a band-aid fix on it,
bad. Don't get me wrong. I mean, it does need it. It would be wonderful to put a new roof on, of course, but it just doesn't look, you know, it looks like everybody else is in the neighborhood. Let's just put it that way.

All trailers must be parked behind the front setbacks of the house on the rear of the ‸ property. And then, as you can see depicted in the pictures, there's rugs and wood and miscellaneous trash and debris that is pretty standard in the yard in all the photographs. In this picture, you can see a pile of stuff covered with a tarp and some old mowers and gas cans out in front of the house.
Have you, I know you've attempted, but has there been any contact with the owners and where could that trailer be parked for it not to be in violation?
It could be parked on the side. They'd have to open that gate that's covered up by the rug and the wood and then they just have to back it up in there.

So this is rental property. Yeah, they're all duplexes that are for rent. Under the tarp, we surmise that it was a motorcycle of some kind or some kind of riding, which also constituted the storing of junk autos that has been removed.
How do we, because the goal is to get people to clean up so the neighborhood can, I mean, come up in a sense. How do we go, how do we deal with this as far as going down the line?

this particular. Property owner was also brought to the board last month on a house on Polaris for the same issue of protective treatment. And back in March, um, a property that they own on Hillsdale. Um, so they have several rentals. Um, the pictures that were showing this shows that they painted the entire side of the property and along the front fascia and the,
cracks chipping in this picture with some weathering at the bottom. That was the side of the house before it was painted. You can see the fascia needed painting and the book was done. So again, we just have another protective treatment, um, violation and we're bringing it as a repeat because this is technically the third property. Now that we have last month, it was not a repeat because Mr. Gonzalez sent a regular notice of violation. So we did not do a repeat, but we did a repeat on this address.

come to this. He's correct. If he corrects the violation when he gets a notice, it never comes to the co-board, it would be okay. But obviously he's been to the co-board. I gave you the one in March on Hillsdale and then I gave you the one on Polaris last month. There's also been other cases that have been before this board for the ‸ same company. So what we need is a property manager that looks out for that. So the purpose of the repeat is to let them know that, hey, you keep doing this. Don't do it anymore. Be warned.
state statute that way. They can be fined from the time the violation is observed and noticed for each day. The violation stays a violation. Otherwise, you're continuously citing somebody, bringing them to the board, complying the case and they're coming back. And that's what we're actually trying to avoid. It kind of defeats the purpose of what we're doing. So that's why we have repeats in Florida.
could. Our code is for protective treatment to have a protective coating over any raw surface to protect against weathering and raw, etc. So we do not govern colors, what kind of colors, as long as there's a protective coating.

Because when you're given a notice, you have time to get that taken care of before it actually comes before us. Right. So what I'm trying to ask you, if you're getting the notices and you have this time in between, why are you not working with them to not have to come here?
I also understand that on 807 Hillsdale, the house is in compliance. On 116 Polaris, we got cited. The house is in compliance. This house we got cited. This house is in compliance.
Polaris is not in compliance. The main house is painted, but there's still a whole back section that meets that requirement of the violation. He can get with Officer Gonzalez on that. Again, the repeat is the fact that this is a reoccurring issue on a regular basis within a five year period. And you do the repeat because you have to keep continuously noticing ‸ this here. I would suggest that he keeps tabs on his properties and when painting needs to be done, they just do it.

‸ underneath the overhang is a pile of debris. In this picture, again, we have some appliances up by the garage. ‸ We have a refrigerator out in the middle of the yard. So she's actually been here, gotta find got a reduction, and now has reverted back to exactly what you see, resulting in a lot of neighbor complaints for the condition of the property. so Is there
Nobody's here tonight, but she has been before the board and we've spoken to her. ‸ And that's one of the reasons we went ahead and did a repeat on this one is because she's actually been through the entire process, including a lien reduction. And she's spoken with us and it stayed good for a little over a year and now it's went back to what it is today. How
still in violation as of today. She has not come into compliance. So if you find a repeat today, that fine will run until she cleans up the property and it's abated.

Well, you can't ask for a lien reduction until you're in compliance right so if she did come into compliance I think the code, does the code have a limit on when you can ask for another lien reduction? Yes,
So within the same year or within a year from the last lien reduction, she can't ask for another. Typically, if you're a repeat violation, that comes into play with the decision of the board on what they want to reduce to. If they want to reduce it all, you would take that into effect. But she wouldn't be allowed. It would have to be a full year since her last lien reduction. And

this picture, some of that's cleaned up. There's still items up there. You can see this is shows that the refrigerator was moved, but they try to cover some stuff up in the back there that they placed around the corner. so that's the property. It stays like that now. ‸ There we go. that's it
And notice was posted there. Yes, everything we do, we send on a repeat, we send the letter out certified mail and we post the property. Just in case service is not obtained. So we meet both qualifications of the statute by posting the property that's in violation and sending a certified letter.

remove some people from the property that were beginning to come and take items and go again. This is about correcting the violation, but it's about moving forward on a foreclosure. The foreclosure is not done in a week or a day.
um So, as I explained to them, they still have time to begin to clean the property and if doing so prior to the filing of the foreclosure, this could all go away and move through the regular code channels. uh Foreclosure is not easy. um We are trying to enforce the blanket trespass. So anytime Mr. Collins wants to go out there, if he contacts us, we'll have an officer go with him um so that he can make strides in cleaning up the property.

the title examiner determined that the owner of the property is the estate of George Bradley, who was the previous property owner. So, right and then the probate lists about 15, looks like they're all cousins, who are the heirs. So but we would have to name and serve all those people probably have to serve Mr. Collins, who's been residing in the premises and anyone else residing on the premises. So it would be a little bit complicated and costly to go through the process of foreclosure.

I've been, I didn't even know about this violation until I talked to uh code enforcement back in July. um The reason I called, uh I was signing a contract to finally sell this house after owning it for over 17 years. And um I had a bad feeling, um honestly. So I picked up the phone. I don't remember if, actually, I think I talked to Augusto first before I talked to uh Darla in the office. um I won't repeat what he said on the phone when he saw the amount that was attached to my lien, but we were both pretty surprised. Honestly, I was flabbergasted because I didn't even know it existed. um

Well, Mr. Chair, let me let me speak on that. Okay. um I don't know how previously the Code Department worked. What we do is when we have a case before you and it comes to non-compliance hearing, my officers still go out every 30 days and look at those properties. That way, if they come into compliance, we know it. Also, in December, I send out demand letters for the properties to come in compliance and correct their liens, and we actually go through a list of liens um to determine whether or not those liens are still running. That's why his case closed without his knowledge in 2020, because it was on the list of old liens that we pulled up. um So that's how we operate. Based in the ‸ past, it appears that once a case went to a non-compliance hearing, the Code staff didn't do any other um work towards it, and they waited for the violator to contact them to tell them that the property was in compliance. So in Mr. Wagner's case, obviously there was a case. It went to the code board. It went into non-compliance Mr. Wagner didn't contact them, and it just ran. And

case and then what Augusto did, and the paperwork that goes in there. So he's not being fined 600 000 He's being fined for ‸ that. But that's one of the biggest problems with these older cases that we've run into is that they just kind of let it go after the non-compliance hearing and said, it's up to the violator to call us, and we're not going to go back out there.

700 000 because we've weeded through them and taken care of them. um It is possible that this case was brought into compliance before because I had issues with Mr. Wagner back in 2014 when transients were breaking into the house, stealing copper, breaking the plumbing, and it was actually put on the condemnation list for that reason by the building official Scott Davis at the time. But time was given for him to correct the violations, and he did. He got permits, and he corrected the violations, and turned it into um what you're kind of seeing here today. It's been painted, and there's been other things done. So he got it off the condemnation list. So to accurately depict of when he came into compliance, I wasn't here in

can't answer that question because I was not here when that happened. That's why I said what we do now is we do demand letters and we do routine follow-ups. And then every December we go out and look at our fine list to avoid situations like that. I can tell you that that was not done in the past.

I was not aware of this case because it was under a different system um than what they put the cases in now. So I wasn't aware of that. So when I met with him, I couldn't tell him, oh you've got this case from 2009. This all came up when he went to sell the property and a title search was done and the court records were checked.
we take the fine of about 600 grand and then cut it in half and make it 300 grand or if it just say, look it cover the expenses for a thousand. That sounds like a pretty good deal to me.
