Transcript of Recording of 2022-10-25 (City Council Meeting 10/25/2022 (1 of 2)): 1,344 passages, 18,350 words
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
437 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 30 voices separated from the audio.
21 short machine repair(s) (23 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 91.9% of 17,609 content words.
Dotted words (338 places) are ordinary wording differences: hover or tap to see the other reading.
437 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:11:10 (7 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Good evening. Good evening, everyone. You getting all right? All right. So as you can see, our property values have gone up, especially in areas where we had a lot of blight, definitely in District 1. So a lot of our homes have, and some of the homeowners have taken upon themselves to fix up their homes, which also in turn encouraged their neighbors ‸ to get out and do the same. I did it myself. When I painted my house, my neighbor turned around and painted their house, and then behind them they painted their house or got a new roof. So we want to show appreciation to the Witherspoons. They live on [address].

by the state legislature to work with the federal government to take care of the Florida part of the Atlantic Intercoastal Waterway, maintaining that as a ribbon of commerce for the state of Florida.
And it became the number one priority of the Florida Chamber of Commerce to get this created because as they said, to run your boats up and down the Internet in the waterway, you needed rubber tires on the boats because there was more land than there was water.
with ‸ the counties and the cities of the eastern part of the eastern coast of the United States of Florida to maintain that waterway as a commerce entity.
and that is to work with cities and counties to do waterway projects that enhance, further enhance the value of the waterway. And the city of Cocoa has been one of those cities that has taken advantage of that for a long time. Some of you may remember the original boardwalk that we had before the storm took it out in front of what was simply a shuffleboard court,

‸ I live, I'm the second house in Rockledge, but I own property in Cocoa. South Cocoa. I understand. ‸ And there's been many projects that we've done together. And Cocoa's a great place. ‸ Cocoa is a great place. It's growing. It's doing all the right things. It's got the right leadership. Leadership is the interest of the city in their hearts. And that's what is important. And it's, you know, I lobbied for almost 50 years. Just recently retired.
Oh, hey, you know, it happens. And I only lobbied for those clients that I wanted to. I didn't take on any clients because somebody said, well, here's some money and go work for these people and do what they want. I only worked for those people that I wanted to work for and the people that I like to work for. And those cities that had sailboats in their logos. Always meant that they were in the right place. But it's a good city.

live at [address]. I've just got some questions that I'd like to get answered tonight, if I could. ‸ My first question I have is why? Why so much hatred and racism in the city? Why? You believe the same color I do. Your skin might be a different color, but we're all the same person. Are we or are we not? Okay? Then why is it so much racism? And I'll be honest with you, it has to do with the police chief. Everybody wants him out because he's a black chief. No, that's wrong. That is totally, 100% wrong. I am not racist at all. My daughter dates a black guy. He lives in my house with me. I have plenty of black friends. So don't bring it up as a racism thing. I really, really get tired of hearing this. You know, what we want in the city, we want unity and equality in the city. And everyone should be treated equal, no

Everybody should be treated equally. And it's not being treated equally. From the fire department to the police department to city hall to wherever, nobody's being treated equally. And it needs to change. And you as the elected officials should be protecting and overseeing the safety and ‸ citizens of our city. But
This one's blaming that one, that one's blaming this one. It's not your fault, it's not my fault. Blame it on him. I'm going to call for right now. I'm going
call for one of the city council members to do an investigation to order an investigation on the police chief. If it can be done. If not, then there's some of us that will take it in our own hands, hire a private attorney. We'll go ahead and do it. It needs to be, it needs to be come out in the open.
man. And a lot of this stuff that's coming out right now that's in pure black and white, no pun intended. It's all in black and white. None of it's been answered. None of his disciplinary actions from Jacksonville were in my folder. And I believe there's a couple other people that were on the committee too. None of it was in their folders. Nothing. He was in a car crash in Jacksonville. Claimed he got hurt. Hit by the same person twice.
Was he drug tested? Okay, me being an ex-police officer, I was in a car crash, I had to get drug tested. Okay, so I don't want to hear that you don't know about any of this because it's all brought out in the open. So would anybody be willing to entertain the idea of doing an investigation? No? Okay. Okay. Like I said, it doesn't have anything to do with racism. It has to do ‸ whether you're capable of doing the job. If I were to lie to my application, getting hired, they would have fired me and thrown me out.
be coming out soon. Believe me. There's a lot more coming out. So it can, people in the city of Cocoa can believe what they want. If you do an investigation, you don't find anything wrong, so be it. Leave it alone. There's something to hide there. You're not wanting to do an investigation. Thank you very much.
Thank you for allowing me to speak. First, I'm asking for a motion to be made to have an independent investigation into the current situation with Chief Evander Collier and the Cocoa Police Department. I am requesting the investigation to be done by an independent agency, since there seems to be an unreported conflict of interest between the city manager and the chief. Excuse me. It is

there appears to be multiple inconsistencies to Collier's resume and application. Why lie? How come the packet that was presented to the committee was not accurate? How come Collier's IA history with Jacksonville Sheriff's Office was not included? Did Evander Collier lie on his pre-employment polygraph regarding these IA reports?

this man firsthand, his passion for kids, his passion for his community. One of the worst things you can ever do to a child is to have an award ceremony and no parents to show up. That's emotional for a child. I witnessed myself with my own eyes when this man came to our award ceremony. He saw a young girl who was sitting there without a parent because her parent was terminally ill and could not make it. He sat there the entire award ceremony and played as if he was the grandfather. Matter of fact, he came up with that particular child and he received the award and said, this is my honorary grandchild today. And I would tell you and everyone that that type of compassion, that type of commitment is not something you teach in the police academy.

an expert there. But what I am speaking of is the fact that if I, within my realm, have a teacher, and that teacher continually does testing, and the test rates of those scholars are going up and up and up, I would never even have a conversation about removing that teacher. Because their goal is to educate children. And if the data is showing them that the children are being educated, why would I remove that teacher? I'm a firm believer in data. I need everyone to truly understand. When I'm observing a teacher, I tell teachers every single day, in God we trust, everybody else bring data. If the data is showing us that the crime rate is down, why are we even having a conversation in that regard?

I know how to do this. Give me one minute. Yeah, there we go. First of all, thank you for allowing me to speak at this moment. We're shifting gears a little bit here, but I wanted to just talk a little bit about this Cocoa Citizens Working Group. ‸ It's a collection of individuals that came together ‸ with a passion for Indian River Lagoon, for the community ‸ that we live in,
and help sort of bring some of the issues to light in a more sort of, I guess, informed way. So I just want to bring that up. And so that brings me to this.
and we're pretty quite, I think a lot of us, taken it back by the fact that if we got this right, ‸ there was an absence of information to help you make a decision. And ‸ this decision was very important to us.
And we saw this absence of information, and I think we heard that you had to go ahead and make a decision anyway. And the absence of the criteria, particular criteria, to support the decision. We saw that, you know, first taken aback, because that is not sound decision making, and it's not in the best interest of COCO. But we wondered what was going on behind the scenes, and we decided we would all get together and start doing some of the research that you said you were missing. So I just wanted to let you know that that's sort of the preface for what's going to come ‸ a little later in the meeting. So very quickly, we've done a lot of homework, and there's a nice-sized group of us, again, a collection of individuals. And what we realized that it wasn't an objective decision about our future, and it wasn't fact-based. It wasn't based on any analysis, in fact. And I've never seen a decision, big decision made that way.
that almost every element of criteria and decision making, it was that we failed. I mean, we looked at the data. It should never have failed, this initiative. So we have all that data for you, and we're going to help. So we also found, like, multiple inconsistencies in the state and county comprehensive plans. And I want to tell you, as you go through the agenda, you're going to see three parts.

And one thing I can speak on, and that is clear and supported by facts, is from my experience. I've never seen a chief, and ‸ I've seen at least one chief, one acting ‸ chief, and then Chief Collier, occupy the leadership for Coco Police Department. I have never seen a chief call into investigation the wrongful conduct of their own officers. And that is something that I have great respect for. Why? Because law enforcement officers are paid to protect us and to serve us. And when they violate the rights of our own citizens, that is a problem. And that is something that

far too often been swept under the rug. As chairman of the board, I've had the opportunity, even in our last meeting, about a week and a half, two weeks ago, to see two opportunities where our chief called into investigation the wrongful acts of several officers that step outside of the line of professionalism and of their duty, and who
our own citizens, taxpaying citizens, in jeopardy. And that is something that we need to see more of, see accountability for our law enforcement in our community, so that we can clean it up from the inside out. Thank you for the opportunity to speak. I concede the rest of my time.

Yeah, there's a couple of provisions in the rules of procedure adopted by the city council regarding time limits. Under oral communications addressing the city council, there's a provision that says all remarks addressed to the council as a body and not to any member thereof,

delegation shall speak for no more than five minutes unless a greater time is afforded by council. council. So there's a five-minute provision specifically for delegations. This is, the items that are coming up are public hearing items. I don't know if there's another section regarding time periods.

website's one thing, but then there's public hearing items in general. On page 14 of the rules of procedure, public debate by individual speakers from the audience on public hearing items ‸ shall be limited to three minutes. Representatives of recognized groups shall be limited to ten minutes. A total debate on single issue shall be limited to 30 minutes. That's under the public hearing section of the rules of procedure. So there are some different times periods, three and five minutes under different circumstances under the rules of procedure. I don't know what the website ‸ says if there's a conflict. Now, with all of that said, obviously you have two items coming up where a lot of people want to speak on the matter. It's up, the council certainly has the authority to afford more time if necessary. The first item that you're going to be considered is a comprehensive plan amendment. That's a legislative matter. The quasi-judicial matter, the rezoning is ‸ a quasi-judicial matter and that's an evidentiary hearing. ‸ The
typically more fluid because it is a real evidentiary hearing. So, I mean, leave that to the council's discretion on time limits. There's also rules about repetitive comments, you know, that the council in its discretion, you know, that doesn't need to hear the same comments over and over again under your rules of procedure.

the other revelation is that when this was presented to the Planning and Zoning Board, it had nothing in it, the item had nothing in it about the coastal high hazard area. They did not have that option to choose from. Do you have the link to our website? And I'm not sure how to operate this with that, because I wanted to go, first of all, I think you're ‸ probably going to see the area map in a little bit since she had flashed that up there. okay, well, I'm just going to say, under the coastal management, the element, right, coastal management element. There are two goals. And the second goal is a coastal high hazard area. The city shall continue to direct population ‸ concentrations ‸ away from the CHHA through implementation of the future land use map. Now, this, the coastal high hazard area is a scientific designation. I heard somebody say the science just wasn't there. Well, there's something called the slosh, which is the sea, lake, and overland ‸ surges from hurricanes. And that is the modeling, the scientific modeling, that all these maps are based on. And it's not only good, it's some of the best in the world. Okay? So that's what our maps were based on.
exactly the way they said it would. And that is the reason that they say, and that the state would encourage us to take, to discourage density from that area, certainly to discourage new density.
private property, and people have the right to develop their property. But they purchase that property based on the zoning and based on the structure that exists. They have the right to ask for an amendment, but the decision to give them, to grant them that amendment, is recommended by Planning and Zoning and approved by this council to be in the best interest of the public.

9.2.1. The city ‸ shell. See that shell? The whole argument that was presented to council, and if you go through this agenda item, you will find that on, in fact, please follow me there. You will find what changed, because when it went to Planning and Zoning, the economic director, ‸ the former economic director, presented it, and it was overlooked. I'm not sure why. But it wasn't until
director, had to present this item, that they caught that the coastal management element, that part of the comprehensive plan, that we have to agree with, right? That we have to, you have to argue, why you would go against that, because it's a big deal to change it. Remember, the state's spending three quarters of a billion dollars on this. It starts out on page five, if anybody's following, under coastal management element, and it's going through each one of these items, and
Flag: words were replaced by a machine repair · 01:08:41–01:08:41 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
coastal management element, and it says, however. However. That's a big switch from the previous five pages. However, the subject property is located within both the coastal planning area and coastal high hazard area. Now, go down to, and this is how, in the presentation, it argues that we should go against 9.2.1. The argument, staff argument, is staff notes, while increases in density in the CHAA shall be generally, and that's in quotation marks, and it comes specifically from 9.2.1.3. That's the fourth one down in that list, right?
any increase of density for properties within the CHHA shall generally be discouraged from the time of this plan's adoption. Generally. That is a policy that is subject to the objective. ‸ In this case, we're arguing, we're arguing that the policy should serve the objective, right? The policy should always serve the objective. But in this case, staff's argument is this generally is somehow trumps the fact that we say in 9.2.1,
Flag: numbers, amounts, negation or names differ between the machine readings · 01:10:20–01:10:23 · unresolved: the words are not shown (unclear audio); listen to the recording
direct population concentrations away from the CHHA. Now we've also done significant work with the Eastern Central Florida, what is it, the Regional Planning Council, to do a resiliency plan. And they provided us with those maps and the science. So this is science-based. And I would just like to say I know a couple of the Councilmen went down there during this period. And I remember hearing, oh, we just have to clean up the storm drain. No, no. The storm drain was clear. The lagoon has expanded and is now including that area. And this will happen when we have storm surge. And this is not going to get better.
So, yeah, we've had eight inches of, you know, call it sea level rise, but lagoon level rise in ‸ most of it in the last 20 years. And we expect at least that much in the next 20. Now, you know, the general rule of thumb is for every one inch of sea level rise, you have the potential for a foot of storm surge. So it's significant. And areas like this are significant. We're putting ourselves, we're creating liabilities. And those liabilities, yes, there's a, I don't know if there's a short-term gain or not. Maybe for the property owner in this case. But the liabilities are going to cost all of us in the future.

Generally, ‸ when we're referring to higher concentrations of populations, it's large high-rises with a large number of people coming into an area. And it's really only an increase of one unit per acre based on some of the other low-density residential areas that are surrounding as well.

Then you will in turn use that change to justify flipping the rest of that entire Dixon property. We have all seen development plans for the entire Dixon IRD corridor.
Do not use this to establish precedent. I am here tonight to establish formal record of there are grounds to reject this proposal on ‸ every one of the nine criteria. Every one. I will begin reading as quickly as I can. Other speakers will follow up where I leave off. Number one. Effect on city budget or city regional economy.

provide services in this area. It will burden sanitary sewer, reduce existing green space infrastructure services, and it will negatively impact traffic on Dixon and the Indian River. The access is also already being made difficult by increasing train traffic getting out onto Route 1. Number three. It is an impact on environmental and natural historical resources of the city. First, this project will establish precedent that will allow follow-on density and zoning changes that will lead to development on the last intact natural land that is connected to the IRL.
Number two. That is eliminating a functional category of land use. Number two. It will degrade the historic character of this area and the character of this area that is defined by low-density and lush green wetlands. Other speakers will follow up for me on the fourth through ninth points. Thank you for listening.

So thank you again for letting me speak and I just want to ‸ carry on the point that Jennifer's made and Ms. Koss. On the right side we know the plans are in place and we know it's right behind this amendment and that's what the our my fellow citizens are quite concerned about.
mentioned it is science backed, it is a fact, and you can see right where Greenwood's property is right smack in the coastal high hazard area. It makes no sense to any of us here that you would allow development here.
I'm going to start weaving in a couple of the pictures real pictures that happened right after we met on the on the 27th. You can also see the objective that Ms. Koss mentioned. It's right there that says direct you know development away from these areas. It's blatant. It's a fact.

I guess the question for this council too and the mayor is, you know, I understand that you're looking for an economic benefit by putting, by building in this area, but I would seriously consider the consequences and the risk to health, life, safety, and property when you do that because I think that hasn't been factored in here yet. Good morning, Mayor. Good afternoon, Mayor. Good evening, Mayor. It's been a long day. I'm going to continue with Ms. Riggs as far as providing the, for the record as to these nine criteria that had been addressed by staff. As to consistent with the goals and policies of the state comprehensive plan set forth in Chapter 187, this fails. The project is not consistent with protecting conserving natural water systems, protecting wetlands, and not developing in high coastal areas.
water management and management of natural groundwater discharges. It also fails. The project introduces a very real risk of exacerbating current flooding issues on nearby properties and increasing pollution of the IRL, putting the city at risk of lawsuits. As to number six, compatible with surrounding neighborhoods and land use, it fails.

1705 North Indian River Drive in Cocoa. I want to remind you about a Southern Living Magazine article that was recently written about the city of Cocoa. Let me quote a few of the passages. They titled it The Quirky Charm of Cocoa, Florida. The article spoke about the many areas of Cocoa that preserved the old charm of Florida. It was a town that has done a good job of preserving the past with unusual, which is unusual for the state of Florida. Relics of the town peppered the 13 square mile town from the restored 1920 playhouse to the stately home sprawling out along the scenic Indian River Drive. You can't buy that kind of publicity for your city gentlemen. Now I fear that we're about to lose some of that charm. I stood before a different city council some years ago to protest this same project by the same developer.
Well, if you look on the south side, you're going to find three single-family homes with multiple acreage around it. The argument also is that some of you have to, we have to increase the tax base for the city. Well, if you raise the taxes on a fourplex on a, just over a half an acre piece of property, what will you do to the revenue of the state size properties around it? Decrease their value to the city and discourage other large estate projects on that side of the road. Another problem is the area is historically been wet. It was wet before there was a Dixon Boulevard. It was wet before there was a US one. You will notice the remaining original Dixon family homes built in the 1800s are on blocks. That was to keep them off getting wet, keep them off the ground. When I was a kid, the Dixons had ‸ a pumping station on the riverside of ‸ River Road to pump the water off their land into the river. There have always been natural springs coming off the higher ground. And once you go to the north, the higher ground gets, as you get

Five seconds. Well, anyway, that's the problem. You don't see where the water's coming because... But you talk to the homeowners that live there. they closed down that apartment complex. People on the river road had to move. They couldn't flush their toilets. It was so wet. So we're about to get into that same project, the same problem you had, and that's why you put the sewer in.

And you see in bright with the outline. Mr. Greenwood's property, and you can see how it sticks out. It's in the midst of a low density residential zone. And I want you to really look at that because it will change the character of our neighborhood.

more facts. Okay, thank you, sir. ‸ What I didn't mention, once you go back up this one, ‸ we're only talking, let's see, the medium density portion of this is only two acres. It's a very small area. ‸ I just want to mention that ‸ and again, mention that anomalous situation we have there. ‸ What I want to talk about is the number of units.

did was enhance them. There's 70 plus 70 units or 71 units laid out on this site plan. With the potential, it's 23 acres of open space, it could go up to 200 units with the medium density increase. So I just wanted to bring that out again, focusing on sound planning. Now what I would like to do is, if you don't mind, ‸ I hate to do this, but really I want to take ‸ you through this ‸ so-called experts report from Greenwood. I just want you to see that he references a report from 2004. It's 18 years old. And he talks about photos. I don't think he's visited the site. There's no mention of actual site visit.
It has ground borings. They went to the site. They would see how wet it was. So I just want to point that out, that perhaps we may want to look at revisiting the engineering reports and maybe getting a different engineering company out there to help us all figure out what's going on with it and get some expertise from it. Because we've all been conjecturing what that property could do and what it's not doing. And I heard Mr. Hearn say the same thing.
at this. So the next slide shows collectively what's going to be happening if the increase in density happens. And we could see it all up and down Indian River Drive.
of units as best as I can calculate coming out. And that's ‸ low, actually, 105 units. So we're going to put some stress on that infrastructure big time and the character of our neighborhood. So real quick, pictures are good. I want you to see the difference in the character. Please have a look at the character of the neighborhood and the consistency issue.

it's important. It needs to be said. All right. We are, I am talking about coastal high hazard areas because this parcel ‸ property that we've been discussing lies within one, as we've already mentioned. The concept of a coastal high hazard area is recognized internationally by governments all over the world. It's recognized by FEMA, by the state of Florida,

Computerized storm surge model. The city of Coco's definition is just about verbatim. Coco's comprehensive plan contains a clearly stated policy in section nine, which is the coastal management section.
that states that the city will evaluate nonconforming land uses within the CHHA and that any increase in density for properties within the coastal high hazard area are generally discouraged in favor of strategies, and I'm quoting,
the effects of flooding, storm surge, and related impacts of sea level rise that protect the long-term financial viability of the city. So the question really is, is there a good reason to allow for an increase in density on this property? This property is one of the most vulnerable properties when it comes to flooding. And if you remember Tropical Storm Ian, you remember that Indian River Drive was closed for several days due to flooding at the intersection of Indian River Drive and Dixon Road, just a few feet away from where this lot lies. Ian was not a major tropical storm by the time it got to us, and it certainly wasn't as harsh as a typical category one hurricane. And yet, there was flooding that was significant enough to close a major artery for the people who live in this neighborhood. ‸ Many locals have commented, everybody knows that area floods, which is kind of the point of the coastal high hazard area designation. The property lies in a flood zone. It doesn't matter really whether the water comes from the river over washing the road or from the fact that rain water flows downhill.
is locally known as the swamp. Now, just in case you guys think that you are not affected by this because this is only a problem that affects all those rich people with their big old fancy schmancy houses along Indian River Drive, consider this. Hazard insurance claims cause all of our insurance premiums to increase.
occurs along Indian River Drive, and the areas just west of it, the more water is going to end up in those flood zones along Indian River Drive. Because water runs down hills. Excuse me? All right. Two sentences. Because water runs down hills and trees suck up a lot more water than buildings and lawns do. And if you've noticed, there have been a lot of trees mowed down along US-1 lately. This really does affect all of us. Thank you.

of pollution reduction. They're a source of flood control and also our natural environment, preserving who we are as Floridians. And so there are many values. Now, when I moved here some 46 years ago,
We followed the Florida code of basically trying to find higher ground for housing and not building in the wetlands. And there wasn't much argument about that until around some times after the 1990s. Then suddenly it became quite common for some people, for people who are as long around as I am.
Some of you may remember. ‸ He was enraged that the wetlands he bought at very low prices were not being allowed by St. John's Management District to be built up into buildings. And he was so angry about it, he threw a smoke bomb at the St. John's Water Management District. And yes, he did end up in court with penalties. So I mean, it's both our laws and nature that will correct us when we're wrong. So we need and depend. We ‸ have taken care as to where we build by and large. Our wetlands ‸ remain very important. And when we violate them, we all pay as taxpayers. How do we do that?
of the road problems that we have and pollution problems. And we end up paying. And I'm frankly not sure. And maybe someone would know. ‸ If this plan went through for building in a wetland area, ‸ the neighbors that are threatened by more flooding might sue. I don't know. But I think you're putting all of us at risk financially as well as physically. So I think the question is simply this. All of us in this community, particularly that we live in, and all the people who come to visit on the River Road and recreate, we count. And ‸ I'd like to hear that zoning is not casually cost aside, because I've seen that happen a number of times since I've been here. And it's been wetland zoning.

Now, the current residents who were close to that property on Dixon, the property in question, they also knew full well what the zoning was when they purchased their property, when they improved upon the property. packed, much like it is today, and the way it was at the last City Council meeting. ‸ The council reversed its decision, saying that their decision had been made in haste and that they could not go against so many. This is two examples of people who purchased property, knew what they were buying, and then complained to try to change existing circumstances to suit themselves, not the majority, nor the norm that existed already, and with little concern of how it affects others. I suggest to you, too, just like the City Council of old, to reverse your first vote from yes to no, and allow this critical area to remain low density and to serve the majority rather than one person.

Thank you all for the opportunity to address you this evening. So most of what I was going to say has already been said. We don't need any more redundancy, but I come here with a little bit of unique perspective. My husband and I own the property that is adjacent to the proposed zoning change right on the river.
we had no idea how much it flooded there. And the one thing that we didn't understand and other people may not understand either is that behind our property, there's a little, we call it a creek, but you know, it's really a drainage ditch that removes water and takes it down into the river, right? There are others along the river.
Flag: numbers, amounts, negation or names differ between the machine readings; a language review questioned the wording · 02:00:41–02:00:45 · unresolved: the words are not shown (unclear audio); listen to the recording
so in this particular storm, yeah, there was flooding in the front of our yard, but there was much more serious flooding in the back of our yard. And that's because the, the place for the water to escape is the river. And this is the same for all along the whole river. But when the river is higher than the outlets, the water can't go out there. And so, yes, the rules are that we need to keep the water. If you build, you need to keep the property water on your property, but it's not really possible to do that. Because the water is going to be put down, probably down Dixon Road into the river, but where it goes into the river, the river, if it's higher, the water can't go there. And so it backs up.

what, ‸ when I was on that commission and you're on this commission, you're here to represent the people and the people's will. Transcript of Recording of 2022-10-25 (City Council Meeting 10/25/2022 (2 of 2)): 834 passages, 9,825 words
A timestamp opens this recording at that passage.
282 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 14 voices separated from the audio.
14 short machine repair(s) (16 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 91.6% of 9,388 content words.
Dotted words (213 places) are ordinary wording differences: hover or tap to see the other reading.
282 passages (27% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

So this is a project that's going to be working in a matter... As soon as they sell one or two of the units. But the information about the flood zone and all that, that means that somebody has to call these people and tell them that they cannot build any of those single family homes on River Road based on the flooding and the surge water and things like that. They also, on page 8, started the misinformation saying that I was going to be putting 15 acres, I mean 15 units, on my property. Wrong. It's only four. Now, the site of where this project is going to be built, the site plan, the building itself is considered minimal invasive. ‸ That means I can build exactly what I've said to you as far as where the project is going to be, what's going to be built there.

And unfortunately, that's another piece of development that nobody was concerned about until my four units. there were several references, I think, directed at me. And one I just want to, this was something that was attached in a package that Mr. Greenwood gave all of us.
that said telling people about the zoning change or about the future land use map change. And what I said was the request is to change the property from very low density to medium density, allowing for 15 dwelling units per acre, which is exactly what medium density does. ‸ Now, he has only applied for a fourplex on his half acre. However, if that is medium density, I can tell you when I spoke with staff, that goes for our former economic development director and our city manager, they will tell you that the most important thing in zoning changes is consistency. Once you've got that medium density, any property attached to it can be made consistent with it. So, yes.
we've got a real crisis with insurance. And we'll see how much development is done in that area. Because, um, Mr. Greenwood kept referring to the flooding. Again, this was not, this was flooding, but it was surge flooding. Doesn't matter how many grids you have down there, how many drains you have. Once the lagoon swells, it's not going anywhere.
as I mentioned earlier, um, yes, we have a good staff, qualified staff. What happened when this was presented to planning and zoning, the coastal management element was not even considered. They were not even given.
Maybe, maybe she wasn't familiar with the area, but it was not in the presentation to the planning and zoning committee. So everybody makes mistakes. You know, that's just, and I, there's been a lot of malignment of the planning and zoning board, but in fact, they spoke to the issues of knowing the area and the flooding that happens there. So they did not name a number, but they also didn't have the most convincing evidence in front of them, even though several people referred to the flooding that exists there.

Well, this particular ordinance doesn't really address the, the footprint. So, this is just the future land use, the zoning ordinance. That's where the setbacks would come into play. And that's where your footprint would be determined.
They're, they're a little bit smaller or more narrow, I guess, with the medium density, or the RU215. But it'd just be hard to say what the, what the exact square footage would be based on that. Yeah,

I'm just wrapping my head around this. So, even if it's a single family home, um, that roughly 4,000 square feet, 5,000, whatever it may be, flooding is not going to change, um, by a single family home which is allowed to make.

So that is the reason why I'm voting nay. I know previous council meeting I voted yes, but I went back and did my due diligence and research. And I still stand on my name. So that's where I stand. Mr. Greenwood has the opportunity to come back, excuse me, come back and appeal it if he decides to do so. And I'm sure he will. would recommend that you do and the reason why is you know it's an application pending but the application fundamentally has to be consistent with the future land use map. Since the council voted to deny the request to amend the comprehensive plan future land use map, the the applicants request, item number four, is inconsistent with the comp plan. is the proceeds from each of the homes will be rolled back into the project to be used on the next construction so that $750,000 will be used over and over again until we have exhausted those costs for instance if the home is constructed at $200,000 by CHI and it sells for 225 ‸ the city remains retains those proceeds and that can be rolled into the next home build so staff is asking and requesting council to authorize the city manager to negotiate and execute an agreement with community housing initiative in the amount not to exceed $750,000 to construct the new homes in the

and so there are some lots that can that can accommodate uh different size homes there. But we we envision that it's uh perhaps largest being four bedroom and some may having to be two bedrooms.

Due to the interim rules for the ARPA funding. We went back out to bid and that low bid increased by about $123,000 to $350,000 for both restrooms. And so that's more than two times the original budget. At this point with the price increases we're seeing, we're seeking direction from council on how they want to proceed with that. The bids do expire tomorrow. So we have to make that decision now on if we are going to proceed. We would suggest at this point to utilize that funding towards a different park initiative. Just because of these prices we're seeing and maybe give them a chance to level off in the future. So we just need that direction. We can just let the bids expire and ‸ not proceed with anything and just have those funds allocated at a different meeting ‸ when we can go through the parks presentation.

attention regarding the potential community garden at Gilmore Park. There is as of right now, no water line for the garden and I definitely want some of those funds to be allocated for maybe just a sprinkler update. I'm not sure if it's a well.
think Mr. Smith said it might be a well on the property. I just kind of just want y'all to kind of think about that. But there's no, as far as I remember, there is no reclaimed water line on the east side of Prospect. So maybe that well is the only way to get water to it.
Currently, there is a well on site. Our staff's working with the county to figure out if it's functional. And so by the time I have that parks update, I'll be able to present that if that's what
There was potable water for the property, but maybe Mr. Walsh might be able to update us on that one. But I remember was having that conversation about the reclaimed water

Thank you. I'll make it brief. As you know, about a year ago, we lost firefighter Mitch Weldon to cancer. We submitted his information to the state of Florida and the State Fire College to have him included on the fallen firefighters memorial. We did get notification he will be inducted into the fallen firefighters memorial this year in Ocala. That memorial service is Friday, October 18th in Ocala.

Great day in the great city of Cocoa, I'm happy to say. The next thing, this past weekend, October the 15th, I had the opportunity to go to the CWC 100th anniversary. As you can see, I'm leading into this picture, and this picture is here for a reason why. The Florida League of Cities, we did a video helping our fallen comrades from Sanibel Island, North Fort Myers Beach, Fort Myers, also Cape Coral. We met the mayor from
like boxes shattered throughout the cities, the various cities. So we showed them love and count our president of the Florida League of Cities, Space Coast League of Cities, President Ferguson, who's also a Red Raider, but also a Gator Man, and myself and the city manager, we participated, not the city manager, but ourselves, participated in this event. Do I hit the red button?
Okay, right it is. ‸ This is a group of charming young ladies here that I met with the CWC 100th anniversary. We had a wonderful time. Matter of fact, I'm happy to say we had this young lady in the middle with the blue,
And also we had Mr. William Hewlett, the first mayor of Coco. That's him there. Yes. So they emulated and duplicated and also talked about the conditions of Coco. If I may digress just a little bit again, the lady in the middle, when she talked about Mrs. Gertrude Alford, she started this organization. This started
