The City's record
What the City's record shows
Built only from the City's minutes (331_PZ_Reg_Minutes_11_01_2023.pdf). Page numbers are the minutes' own. Discussion is in the minutes' text; it is not summarised here.
Attendance (the roll call)
Listed present when the roll was taken: Justin Simpson, Michael Dobrin, Ron Chabot, Aleck Greenwood, Veronica Lopez, Wesley Park, Marcus Wheeler, Katherine Stewart

Agenda (the City's wording)
The City's agenda for this meeting is on file (PZ_Reg_Agenda_11_01_2023), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
152 suspect passage(s) marked in place; inspection incomplete: language review; 3 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 12 voices separated from the audio.
11 short machine repair(s) (13 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 89.4% of 6,378 content words.
Dotted words (147 places) are ordinary wording differences: hover or tap to see the other reading.
152 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (3 stretches). Something may have been said here that the transcript does not have:
00:03:03 (9 s) — neither reading has words
00:09:49 (15 s) — neither reading has words
00:43:35 (14 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

ask ‸ of the board is when we make our motions and we ‸ make our seconds. If we can please raise our hands and state our names when we do that. It's been brought to my attention that it's when we just kind of say it, it's been brought to my attention that it's kind of hard. For people to acknowledge who exactly makes the motion and who makes the second. So if we can just start doing that, please.

Um, Stuart, I'd like clarification. Is there an additional document? My time's been very limited this week, but is there something else that I need to consider to make decisions on this package? I know the email stated a separate 300 page attachment, but I don't know if that's significant.
There was one, uh, attachment. Item number six, the storm water report. That in and of itself was 300 pages and that was not printed. I have a copy here. You want, want it

Right. And then if we go into a deliberation of who exactly votes yay and nay, then we'll get into that. Thank you, sir. Not a problem. Tonight we're not going to approve the minutes. I've already spoken with staff. We will approve at the next meeting. Um, I have no old business here as well.

Also a little, a little bit more history and I apologize. There's a lot of, a lot of background on this one. Um, but it's all detailed in your staff report. Uh, July of this year, the city council approved a pre development agreement and restrictive covenant that

Uh, ‸ there are additional conditions along with the pre development agreement, which is the conveyance to the city of the entirety of tax parcel number 2435 2300775, which is the conveyance parcel that I mentioned to you earlier, which is approximately 11 and a half acres in size. Uh, secondly, they have to maintain the project as an affordable housing project for a period of 30 years.
units of the project will be affordable housing as provided and defined in Florida law. The developer is required to submit copies of tenant income verification and applicable leases to the city yearly to ensure the compliance with the requirement. Additionally, uh, a number of units have to be reserved for one and two bedroom apartments for city law enforcement officers first responders to be rented at a 25% discount rate

the initial leasing. In addition to that ‸ development shall provide a lease preference above other tenants for city law enforcement firefighters along with EMS paramedics and Brevard County school teachers teaching within the city limits on a first come first serve basis as long as it does not violate the federal housing statutes. There is also a tree mitigation waiver, which I'll detail a little later in the presentation. We talk about landscaping. Um, as I mentioned earlier, the site is roughly just under 54 acres, 13 acres of which is developable.

Which are shown on the site plan and 13 handicap parking spaces. There's going to be two different types of apartment buildings. However, each will be three stories tall at ‸ average height of 30 feet, just over 30 feet. The individual garages will be roughly 14 feet tall and the clubhouse will be 17 feet tall. And the building setbacks are shown on the overhead. Um, it's
The pre development agreement that I mentioned previously allows for a specific tree removal and mitigation plan. As a result, 350 replacement trees, which equals out to 993 inches will be provided. 506 being large trees and 379 being medium or small and 108 inches of palm trees.

Um, both of those parameters exceed the requirements outlined in the pre development agreement. Um, there is also additional mitigation that was waived if a dish if, uh, other parameters were met as part of the development. Having to do with conveyance of the 11 and a half acres. The maintenance of a project being affordable, uh, being defined as affordable housing. That the PNZ board approved the site plan within 18 months of the effective date of the pre development agreement. And then that building permits for the project and substantial commencement of vertical construction occur within two years of the effective date of the agreement. Um, and then there is ‸ a catch to not a catch, but there is a additional regulation that if those items do not occur. That, uh, mitigation may be waived and that is detailed in your staff report. I should restate that, that the mitigation. Yeah, would not be waived. Yes, sir. Thank you. The applicant is conveying, uh, ‸ roughly 11 and a half acres of property is noted on sheet C to a one of the site plan. A total of

trees, live Oaks, not laurels. Sure. And that's something that I'm very passionate about. Retaining that reputation that we have. Um, I understand you've got to clear the land and be able to build and all that. But back to the large trees, the identity of it. If you could very seriously, uh, consider. Adding as many, uh, live Oaks as you can. Uh, to, to support what the city's known for.
twofold. Uh, so I'll answer it in two parts. Um, that's kind of the premise behind, uh, the way that the, the parcel, uh, that we're, uh, dedicating. Uh, and then the other, if you will, conservation and open space areas is, is to help, uh, facilitate that. Um, obviously when you do a, a multifamily development, uh, and, and especially if you have to fill, uh, of any significant amount, you're going to kill those trees, even if you claim that you're saving them. So that, that's why we typically go for large preservation areas. Uh, although not all of them are preservation. It, but that, that gives the right context.

is about a 22 month project. So once we start, it takes, it's a large project and there's a lot of dirt work out there that we have to do. So, uh, we're using that 20 to 22 month range on a project of this size. Now we'll be starting renting units before then, probably by month 16, we'll already have people moving in. Well, it, and look, they may be that, that number is going to move around a little bit. But, uh, I mean, if you look at what currently what rent rents are in the area, they're, they're very expensive. And it's just look,
