The City's record

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
557 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 20 voices separated from the audio.
54 short machine repair(s) (60 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 93.9% of 22,283 content words.
Dotted words (588 places) are ordinary wording differences: hover or tap to see the other reading.
557 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

All right. Let us pray. Well, Father, we just give you thanks today for this gathering, for this time. Thank you that you brought us all here. And let this not be for naught, but for a purpose and a reason in which you have designed. And I thank you for, we're just praying for Cocoa High School.
was a good school for us when we went there. I just pray for the teachers and educators, the students, that you would keep them safe, Father, and keep their focus where it needs to be. And just protect those tigers and keep them. Let them, and not only emphasize tiger pride, but just have a pride in themselves and just learn to love you. And if I can, Father, the last thing, this city of Cocoa, which I grew up in, in my prayers, I call it the city of the gospel. Let it be so.

delegations. Please be mindful. You have three minutes to expound and elaborate about your concerns. State your name for us, please. And first on the list will be Alex. Oh, excuse me. Alec Greenwood. Even though it's Alex, but we know the real big.
like Mike and Michael. Yes, sir. Thank you very much for giving me a few moments to present some clarification to the mayor and the rest of the council. There's some misinformation that was presented at a recent neighborhood meeting that I wanted to correct. You also have in front of you a copy of my resume. So there'd be no question about my level of ‸ experience because that was brought up as a reason to ask for a revote whenever the vacancy came up for the planning and zoning board. And I also want to apologize that a council member asked for it to be reviewed again and wanting to see if it could be a revote on it based on that experience. The other thing I'd like to correct is it's insinuating that I'm in a lawsuit with the city and I highly recommend that that council person start talking to the city manager.
there's a lawsuit that I'm creating against the city. The only other thing is I really don't understand why a neighborhood meeting would involve my project that's not even in your district.
continual positive positions that this board is going to be able to continue to do even though there's been negative issues like for example what I mentioned today even though there was a lot more. Thank you.
Yes, since that community meeting was obviously the district for town hall and it was a citizen that asked about the property and my response was we're not in a position to talk about that.

Brad Whitmore, [address], HCVMS. Good evening, Mr. Mayor, council members, staff. I want to talk about a couple of waterfront things going on. We are so fortunate to have the Atlanta T-Doc still functional. It's seeing a lot of service. Cocoa Basin is getting more activity as the season moves along. The fall southbound migration down the ICW is in full swing. I ‸ have known for a while that we had a shortage of available places to tie dinghies up
Flag: numbers, amounts, negation or names differ between the machine readings · 00:24:17–00:24:19 · unresolved: the words are not shown (unclear audio); listen to the recording
and with using the existing spacing, we could easily have another five. And this might not seem like a big deal, but if you're coming in off of a boat and a dinghy and you don't have a good place to tie it up to, and you end up tying up to one of the cement pilings that holds the dock, that's not ideal because the lines get pinched in the rollers, etc., etc. But, taken to point, what really got me focused on this was, I guess it was last night, maybe the night before, there were a couple of big motor yachts that had anchored in our basin, about 60-foot, I'd say probably Katie Krogan's if I had to guess. The people came in off of those, came to the T-Doc,
So, we could remedy this situation very simply by adding four or five cleats, anyway. These are, you get specific ones that are made for the purpose of dinghies, so you can pass a security chain through them. They're not expensive, 20, 25 bucks, and you put them in with a couple of lag bolts. So, I would like to request that the city address that as soon as they can, because right now, season is building. It's going to be even more traffic than there is now, and

be a very nice, inexpensive addition to make our waterfront more attractive to the transiting boaters that we hope to bring in off of their big boats to spend lots of money. That being said, ‸ update on vessels. You probably already know we had removed the sailboat from over there on the north shoreline. We had the sailboat removed from under the overlook on the walkway. ‸ Last week, there was a barge and a crane looking for a boat that
been authorized to find. I knew where it was. I pointed it out. I had to leave. They said, thank you very much. They got a return on it and said, we're waiting for the divers. We'll get it. We'll be out of here. I don't know if they got it or not. I believe they did. I know it's been hit once by a large sailing vessel, so it's the ‸ really ‸ hazardous ones are the ones you can't see that are submerged. We've got two others out there that fit that category and a couple others that have mass sticking above the water. So we're underway with that project. It's nothing that we're immediately involved in in terms of money or effort. However, it sure makes our waterfront better. Thank you very much. Three, two, one, zero.

Just before you leave the item, I didn't want to interfere with the vote there. We did do a highest and best use, and that came back as multifamily. In terms of infrastructure, the Rockledge project required some sewer upgrades that, again, as a part of their development agreement, they put those costs on the developer. So that happens quite often. And, again, just to, again, reiterate that you don't get height and density as a right. It occurs through the development agreement, and Anthony, correct me if I'm wrong on that.

As there's a significant amount of wetland out there, just as a whole, from infrastructure, from our pump stations, from a flooding standpoint. So, let's say that wherever our 100-year floodplain is in relation to said development, wherever we're locating pump stations to accommodate those additional houses, would those pump stations be subject to being flooded out during a flood? I put over $100,000 in it trying to fix it up. Over the years, I ran into countless problems with contractors and property managers that don't get me appraised of the situation. Sometimes when I need to be appraised. I live in another state. My wife has Alzheimer's. I can't get out here as often as I want to, but I have gotten out here and I've tried.
some of the problems were caused by some tenants that we had to kick out of the property because they were causing problems. But it all happened in kind of a small period of time. But is it dissolved in Minneapolis? Meaning, meaning, because there is a difference in acting as the individual, in my take, or acting as the agent of the corporation. And to my understanding, the corporation is who owns the house. So, with a corporation that was administratively dissolved, and legal, legal can help me out on this, but I don't know. That's what I'm trying to understand. Who

the time, that second, ‸ those second problems, I did get three letters from code enforcement then. And I jumped every time I got them and resolved them. But the tenants kept coming after the fact.
well, then ‸ I was already in the process. I mean, ‸ I tried to renovate these properties about three times. And, I mean, I was already in the process of trying to renovate it for about the third time when ‸ Officer Gonzalez told me this stuff.
He actually applied for a lien reduction quite a while ago. Okay. But he also started renovating the home without permits. So according to city code, we cannot bring a case before the board for reduction while there's still violations present on the property. So he had to go through an entire permit process, get that taken care of. Then when we finished processing his application, we discovered that he was three years behind on his taxes. ‸ And therefore,
I didn't realize that the taxes had to be paid before I could come before the code board. So once I found that out, I dug deep and paid the taxes. Okay.

on ‸ that. We have a more regimented system in place now than we did then where we calculate our fines a little more manageable. But I don't know how bad the house looked in 2012. Usually that's what prompts the price of the lien is the gravity of the violation, how it affects the neighborhood, public safety, all that comes in.
the ‸ maximum of $250 a day at that time. Our violation was for cars that were not registered and auto parts and stuff stored outside. So therefore it was not, the gravity of the violation was not as severe.
Well, that case has been closed. All the cars have been moved. Everything's been cleaned up. So the fine is fixed. It becomes a fixed amount. ‸ There's no longer a daily fine attached to that. ‸ I'm
thank you, ma'am. ‸ I mean, if I was to show up to the code enforcement board today and they were to assess a per diem, is our per diem rate at 50 now? It
on it, but we were fixing it. And so the lien was already in place. The lien I didn't know about was in place. So that $250 was based on the condition of the house when I first got it. And,
Sir. But the entity doesn't exist. In some places, I think that would constitute fraud. Or is it just a humble mistake or error? So where are we at in the state of Florida with that?

can only speak to Florida. Sure. I'm not licensed to practice in Minnesota, but I would presume the laws are similar in that when there's an administrative dissolution of a corporation because they fail to file an annual report or failure to file,
automatically by the state of Florida. Now, with that said, you know, the LLC or the corporation, they can reinstate the corporation by filing the past due annual report and paying the past due annual fees, and then the corporation gets reinstated. ‸ So, you know, to the extent that, you know, you have a problem with, you know, the fact that you do not have a Minneapolis LLC, as I understand it, in good standing,
in terms of agent representation, you know, you tend to look at the corporate structure, and then, you know, in Florida, you can search the corporate information to see whether or not an individual is identified as the president or a member of an LLC, so we can kind of do that due diligence as well.
‸ Thank you, counsel. And so, ‸ ultimately, I think, one of the concerns that I have from a community standpoint is that at that time, folks that would choose to invest, that was, could be a very positive thing. But I also know that there have been significant amounts of investment where investments were weighed. It was cheaper to do business by just doing what you need to do to get a renter in.
So, the depression of property values to the community is, in my take, what, and the blight or the conditions that are associated to or dangers that are added because of unpermitted work, failure to do due diligence on, right? And then we have a renter who, it appears, wasn't the greatest of renters, besides maybe sending rent. The community suffers. And I speak to this because

but to the property owner, if you were so to be granted a reduction in this law, in the lien, I would ask that you make sure you do your due diligence on who you rent your properties to, maintain your property to the best of the code. And this is a lien reduction request. The lien runs in favor of the City Council per stat clear Florida law. So the council can reduce the lien to whatever amount you all think is appropriate. As I understand, Councilman Berenger, he's just using the 50 number to derive a number that he thinks is reasonable. Right? And in essence, the reduction is the difference. Now, keep in mind, and I'll say this for the benefit of the applicant as well, ‸ whatever the amount is that the council determines the lien amount will be, there's a 30-day requirement to meet the conditions of council. And that condition, of course, would be payment. And if payment is not made within the 30 days, then the full amount of the lien remains recorded against the property and there's no release. ‸ So I just want to put that on the record as well. Is it? Sorry.

was cited for two violations, storing outdoors and storing junk orders. There was actually three notices sent to the property and there's an initial warning letter that was sent in April 29th of 2020. Gave him 30 days to come into compliance. He did not. So we sent the notice of violation on May 30th, 2020, giving another 30 days. And he did not come into compliance. We sent our final notice after speaking with Mr. Hansen's son, who was the tenant of the property. We gave an extension and we sent a final notice on September 4th of 2020. The property still did not come into compliance.
That was COVID and we had up and downs in our board so that's what kind of took so long. Board gave 30 days upon re-inspection of the property in February.

I was ‸ going to say those code violations. I just wanted to say something. Maybe you know this already, but they, they were never the same thing. ‸ The first code violation was auto parts. And I told the property manager when I got the first code letter in December, I said, tell them to clean that up and let me know when it's taken care of. And she called me within a week and said, yeah, it's all taken care of,
Flag: numbers, amounts, negation or names differ between the machine readings · 01:38:16–01:38:17 · unresolved: the words are not shown (unclear audio); listen to the recording
And she said, it wouldn't happen again. So then the next code violation letter I got was in May. Well, they were doing something different. Now they were storing parts from the house on the front lawn. Now, you know, I mean doing storage. So yes,
on this time? And she said, there's, they're storing stuff from the house. I said, maybe we should evict these tenants. And she said, if they do anything else, we will. ‸ But I'll tell them to get the stuff out of the front yard.
of. The third code violation came in, The one you're referring to is when the, when the actually property manager herself parked her car in the garage and put a, put a sheet over it. And when the inspectors went up, lifted the sheet and it didn't have the current tabs on it. So they connected the dots and said these were all the same things, but they weren't. And then the final violation came when my contractor was fixing the house up, um, put a dumpster in the driveway And then he drove his truck onto the front yard. and, um, the inspector happened to be coming by. So they connected all these things like they were all one thing, but they were never one thing.
of time to take care of it. And we did, we weren't just letting this stuff slide. We took care of it in every case, but they were different things that I think are dots that shouldn't be connected. And that's, that's, that's what I'm trying to say. I wasn't negligent in being told you should take care of this and you got a letter. I did get a letter and I did take care of it. Then something different and I did get a letter
And then something different. I did get a letter and I replaced the property manager at that point. I'd already replaced the tenants. And these were, these weren't even the same people committing the violations. These were different people. In some cases, two cases it was tenants, but in two, in one case it was the property manager herself.

I'm just telling you that I have never been negligent. ‸ And when I look around the neighborhood, my property's always been in better shape than the neighbors. And so I don't think I've made anybody suffer as far as that part goes. But as far as you saying that this has all gone on and you got to be taught,
Well, yeah, you know, that's it. I mean, I feel like somebody should have notified me too that this stuff was going on so I could have taken care of the liens. If there were lien hearings or something, I should have been told that too and I could have been there and handled that. I mean, you see me here today because I knew it. And that's the only difference between then and now and then.
he received three notices for the same violation. So it wasn't new cases each time. It was all the same. When we go to a hearing, we send a certified letter and we post the property as a secondary measure, posting the property where the violation is. We do that on every case. So he was certified mailed and posted at the location for the first hearing. and then
we come back for a second hearing, which is called the noncompliance hearing, we do the same. We do a certified notice and we post the property. So that way it's notified in both scenarios. So if it doesn't get accepted and certified, we still meet state statute requirements by posting the property of the violation.

mine is pretty simple. Our code enforcement department is very, very good on communication. ‸ If there are issues, this is the consequences of having properties when it's out of state. Right? I own properties in some other locations and
When I purchase that piece of property, it becomes my responsibility. ‸ Is that responsibility difficult? Might be being out of state. Of course. But at the same time, I'm making profit on those particular properties, so it becomes my baby. So ‸ I think when you're having that ‸ communication with our code enforcement, you make a phone call to them and you tell them, hey, I have a tenant that has some issues. Can you please give me some time? I've done it before I got on council and I still got some issues on some properties now that I call. But I communicate with them and let them know about my issues that I have And so they'll give you that leeway but if there's no communication, there's only contact with the manager and then it could be some ‸ conflict in that. ‸ So I'm just, I'm letting you know that they, if you communicate with them, even if you don't talk to Gonzalez, this man's the phone all the time.
send it. We have to send it to what's on the tax rolls and what's in the property appraiser. And then as a secondary method, in case somebody doesn't get it, we also post the property in violation, which is also required under state statute.

that vacant property that will actually sell as much as it would with everything developed around it. that's currently vacant because they have a plan because you know there's going to be a store there because you know there's going to be a school there because they have that in place. uh The value of the property is higher and of course
you know we heard that at the the redevelopment conference as well. this and we don't really know ‸ i mean this list kind of developed probably before we were here and there's some inconsistencies in it and my big issue is that, you know, I work with Dennis quite a bit. When I get calls from people that, you know, there's a vegetation overgrowth or whatever, in fact this happened just a few weeks ago, I

Dennis, he goes out and sites the property owner and they either clean it up or we abate it. In the case of, um you know, in the case of this property, we actually abated it on May 8th of last year.
And so i just out of this, I would just like to ask that it's important, I think it's important for code enforcement, it's important certainly for me that there be some consistency. Because this includes private property as well as public property. So I'd like to ask staff and have consensus of council to have staff look at this and come up with some policy. Because right now, we are citing private property owners, some private ‸ property owners, but not others. And, um you know, I think we ‸ just have a lot more credibility if we come up with more of a policy on this. um So is there, what about the other council members? Do you agree that we can that we can ask staff to bring this back with some recommendations?

the lot, he cuts his ‸ lot. But if we didn't cut that right away area coming around that corner, we will have uh two to three, four foot high grass in that area. they look it'll look absolutely horrible.
look good. To me, it's just my personal opinion. I just, I don't see, um it's but it but it seems like this one particular property is causing all of this, um conversation and
um people in some people in the area ‸ who live in this area don't want this property develop. So ever since someone purchased it and started to actually looking into developing the property, that's when we have all the issues and all the visibility and all the concern about this particular property. And that's, I, I do, I get it. And I think people, iI don't mind opinions about not building because of wetlands or whatever, whatever. But that's the only reason why ‸ the conversation took place
Flag: words were replaced by a machine repair · 02:15:05–02:15:05 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
going into and clearing the whole property. um ‸ I just, I don't, I think this will go on for a long time until somebody actually start building on it probably. But,
several owners over the years, you know, that I'm familiar with and it's never been built on because it is pretty significant wetlands. And maybe this new developer will overcome that. But that really, you know, with the conversation really by revealing this list, I mean, I would think really brought it to a different kind of level and issue because, um
but the overgrown grass over 12 inches or underbrush and weed, I guess there's verbiage to that effect. He can cite that. um I don't think there's anything in, I don't think we have anything on our right-of-way People clearing the right-of-way now in this case
um in that sometimes we've cleared it and other times the property owner has been cited. And then each time he has cleared it, except for last May when they actually just had the city abate it. And from what I understand is then the homeowner, the property owner would get a bill for that abatement. ‸ So what I'm just asking is because there are also when we look at this list, there are additional properties I'd like to see on here. There are a couple that are actually city owned that and I'm just would like to see some consistency or maybe some review of this. I know when I went to the Orange County when I went to their code they have some verbiage in regard to property owners have to maintain their right-of-way
