Agenda (the City's wording)
No agenda for this meeting was found in the City records this site holds. That does not mean the City published none.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
91 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 14 voices separated from the audio.
5 short machine repair(s) (8 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 86.1% of 4,281 content words.
Dotted words (81 places) are ordinary wording differences: hover or tap to see the other reading.
91 passages (26% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
My name is Bryant Smith. I'm the Public Works Director and City Engineer. I'm also the Interim Growth and Economic Development Director right now, so I'll be presenting this item before you. What you have is a consideration of a special exception within the CBD zoning district to allow a bar or lounge use without a package store. One thing I do want to note within the agenda item, ‸ it does say CBD,

Those are two different districts. Similar uses. That's just a typo. It is the CBD district that this is within. And that's what you can see here on this first sheet up here, the exhibit. It's showing the location. This is at 226 King Street. So it's

there. And then, Joanna, if you want to go to the next slide as well. Within the agenda packet, there's ‸ a number of criteria that staff reviews as part of the application from the applicant, a number of items including ‸ safety, ingress, egress, trash services, and things like that. Through that review, staff felt ‸ that this application met all of the requirements for those. And that's one of the items that I wanted to show up here just because

And so most of these crosswalks are all at signalized intersections with actual pedestrian signals. So people who are coming to and from this establishment will have the ability to park south of 520 and safely use these crosswalks to get to and from. That along with the State Road 520 improvements that are going to be coming up here within the next 12 months, we're going to see increased lighting through this corridor as well, which will further enhance those crosswalks and ‸ pedestrian mobility through the area.

There's a number of bar lounge uses that are immediately surrounding this as well. And that's another reason why staff feels that this would be appropriate to grant this special exception here as well as it's been granted in other locations. The applicant is here as well to answer any questions related to the project. But with that, staff is ‸ seeking approval or recommending approval to the board for this special exception with the conditions that are listed at the end of the report.
So it's a permitted use. It's the way it works is you have principal permitted uses. And I know Kristen can elaborate more on this. But you have principal permitted uses where they don't need to come to the board. And then you have permitted uses that are only granted through special exception. And the reason for that is to be able to review the criteria that's in the package, whether it be a safety item or any of that criteria that's within that. And it allows the board to kind of make that decision if they feel maybe something's in an inappropriate location due to ‸ some concern that's within that criteria that's stated.

open up around 4 for happy hour for people that get off work, want to come in for a drink because it will be beer, wine, and soft drinks as well up until 11, 12. And then the weekend, it'll be around from 2 p.m. to 2 a.m. typically because you have people that come out early during the day for activities.
Are there any other questions? If you would like to take a seat, I'm sure we'll be talking to you more. We will listen to anyone from the audience that wants to speak to the issue. And let's take the pros first or the cons first or does it make a bit of difference? It doesn't make a difference. Okay. Um, we have a, we have two emails from people who were not able to be in attendance and they are proponents of the business.

Because the parking, in my opinion, if it's a bar, the parking spaces required are much greater than if it was just a retail or a service store. So, how

Yeah. I was right in front of the truck that nearly slammed into me and veered around. Coming in and out of this area, the sight lines are very poor. So, my concern is for safety. If you're pulling out and you nearly have to be in, if you're going to go west on 520, you nearly have to be in that lane that's coming at you. So, I am concerned that your ability to have good judgment when you're in that kind of situation is quite concerning. So, I think we need to consider that we don't violate another code where there is a church

to a lot of different locations, you know. I've also actually been to that specific area before, and I've never had an issue with traffic or anything else. So I think it's with the parking that's there, it's very ample parking. And I do believe that this particular location and lounge that's coming will bring about good vibes, good energy, and it's something good and relaxing. I wouldn't necessarily consider it a place where people are going to sit there and drink uncontrollably because that's not the type of function that it is. It's not your typical bar where people go to get drunk. It's going to go in, ‸ you're going to have hookah, ‸ you're going to be able to order a drink.
And then you'll probably sit there for maybe like 30 minutes or an hour, socialize with your friends. If there's a game that's on, you're going to watch the game, and then you're going to leave. It's not going to be the type of place where you're just going to sit there all day and get drunk to where you're going to be impaired.

know completely what you're referring to. We have our landscape crew actually takes care of that city parking lot to maintain visibility and make sure that everyone coming, ‸ going out of ‸ parking lot can clearly see. We also have a maintenance and trash crew that come in and clean up that public parking lot every other day and make sure that it appears neat and tidy. And mostly because we want to be good neighbors.
overgrown landscaping. So, we're really proud of what we've done at this building and what we're improving. We've worked very, very hard to find the best quality tenants we can, and we are so excited to have Jimmy and Simone as part of our building

but I do a lot of this type of work, so I was like, hmm, that doesn't sound right. And then also, too, on 520, if you're familiar with all the improvements, we've met with the project managers out there because it will affect the portions of our right-of-way in front of the building, and they are incorporating a lot of traffic calming, and the improvements to 520 is really going to enhance this area and the walkability of the overall downtown and connectivity, which is important to us, back to the core of the village. And so I am available to approve property owners with any other questions.
I have a question, if you don't mind. Looking at the picture that's on the screen, and I don't know if you can see it very well, my personal crusade is trash management in the village. And I read in your application that there is an existing dumpster on the property, and I was looking at the photo, and I can't see it. And can you describe to me where it is off of this photograph?

Chairman? Motion? I have a question to throw out there for the board. The petitioner or ‸ the city is recommending that we allow a bar and lounge, which is kind of a... Open door to many types of bars and lounges. I would recommend that a motion would specify... This is for a hookah lounge... Serving beer and wine.
evolving into something that we didn't really approve of. And that could happen very easily because the blanket is a bar and lounge. Well, there's many different ways you can have a bar and lounge.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:24:42–00:24:44 · unresolved: the words are not shown (unclear audio); listen to the recording
Because I believe everything they said is pretty clear. If at some point they were to switch over and decide to get a liquor license, I think that still doesn't change the overall atmosphere of the bar and lounge very much based off of... They said this is an upscale establishment. They said that it's going to be a... You stay for a certain amount of time. I just want to see through your eyes. What are you wanting to negate or not happen in that building?
Well, actually, I'm not trying to negate anything. What I'm trying to do is that the information we are being provided with the staff report describes a hookah lounge. We are approving a hookah lounge that serves beer and wine. I'm not excluding anything or anybody. But the only information we have is limited to a hookah lounge that serves beer and wine.
Do you have to create a use? So the bar and lounge use is specific to alcoholic beverages, and that's what's being considered here. In terms of hookah, cigar shops, smoke shops, you know, whatever type of shop or ‸ lounge that may ‸ be, our code doesn't consider those separately. It doesn't carry it within bar lounge. It's really carried, in our opinion, under personal services or professional services. And ‸ that's how other municipalities, ‸ they go back and forth, how ‸ they separate that out. But there's not a specific zoning category within the city ‸ for a smoke lounge or anything like that.
a question. I have a question, probably for our attorney. Can we make a motion, make that this motion is specifically for this application, these owners and this specified usage?
Yes, I think you could do that. Based on the fact that they have applied in a certain ‸ way, they have provided you certain information. So I think ‸ you could do that as a condition if you like.
Flag: numbers, amounts, negation or names differ between the machine readings; a language review questioned the wording · 00:27:19–00:27:24 · unresolved: the words are not shown (unclear audio); listen to the recording
It does. Special exceptions do run ‸ with the land. So if it was a different owner, that wouldn't change the fact the special exception was granted. However, one of the conditions that was recommended by staff and that was included in the motion is that if it were to be discontinued for a period of six months or more, the special exception would automatically terminate. So if it were to sit vacant, for example, ‸ the special exception would terminate in that circumstance.
and then the next, uh, owner would then be bound to do the same type of, of business that they've, they've submitted. Um, if you like to do that, but ‸ again, the, the focus here is on alcoholic beverage consumption, because that's how we've defined borrow lounge in the code.
it was recommended by the, by the, um, staff. I don't see a need personally to try and put more restrictions on it, especially because it goes, you know, if it sits empty for six months, uh, then the special exception goes away. And so for me, I think, uh, that it's, they're serving beer and wine. You know, if they wanted to expand it, they're going to have to go through a process to get a liquor license and all the other stuff. So I say, leave it as is and, uh, let these people, you know, do their business.
