Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
382 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 25 voices separated from the audio.
43 short machine repair(s) (53 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 92.7% of 17,048 content words.
Dotted words (430 places) are ordinary wording differences: hover or tap to see the other reading.
382 passages (19% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Been there for 113 years and counting, and we're excited about what God is doing in our church. But one thing that we encountered last weekend that was a hindrance to our church was getting to church, especially for Sunday school at

we would have been able to get to our south parking lots and just walk across the street there, get to church. We wouldn't have even had to have driven across the running route. But because that road was still closed and our

setbacks of five feet. And that was with a new ordinance that has been passed. So the eight foot turned into five feet. Now the biggest challenge is I'm stuck in a hard rock and a hard spot because there's no wiggle room to move two feet further forward. I have a drain field for a septic area. And there's very little room to be in compliance to this violation apparently of this permit. Oh,
shed situation that we've done in the past. I don't want to get into it too much except that I just need like maybe a foot and nine inches to be able to get this permit. And I've, I ‸ really would hope to get this

year. So if we could add any grace and mercy on here, or I don't know, everything. It's only it. The whole Carlton Terrace is uniquely platted. Every lot is different. So it's not just my neighbor. My neighbors are all waiting to see what else is going to happen so they can put up a shed or update their things.

Yeah, I was just going to say that Ms. Pasquale's situation is, you know, one that we've heard several times since I've been on council and is characteristic of that particular neighborhood,
every decade from the 1920s on up. So I think most of our codes work really well on developments where there are standard plaits. But when you get into a development like this, and I think we have a couple of other neighborhoods where all of the lots are, well, they're small lots for the most part, and
it, and basically, you know, they ended up developing a house in between two houses that have been there for decades. And it's a problem that we continue to have also because the neighborhood is on septic, and in this case, in Monica's case, they have very limited real estate because you
So that leaves limited options. She can't even, in this case, cannot bring any heavy equipment into the yard because all of that space would be over a drain field. So any kind of heavy equipment to move that storage shed wouldn't work. It would have to be disassembled. You couldn't just bring a new one in or take an old one out. So ‸ she really is stuck between a rock and a hard place. And on top of that, her neighbors built a fence that is actually within her property, so ‸ she's kind of cut off from access to that. So the question was going to Board of Adjustment, or is this something that could be handled otherwise?
and they need to make adjustments, versus somebody with a shed that needs a foot and six inches or whatever it is, ‸ $600 seems a bit... It doesn't seem reasonable. So when this came up before, I'd
Flag: words were replaced by a machine repair · 00:16:03–00:16:04 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
but that didn't address the overall problem of when people have these little issues. To charge them $600 to even have them addressed doesn't seem fair. So, and at that time, I had asked for that to be addressed, but I guess that hasn't really been addressed.
Well, we ‸ addressed the fee schedule. I think we came back with some fee schedule changes there. The real issue was the corner lots, and we fixed that issue. And the ‸ fee is for variance requests, or was this a waiver
Flag: words were replaced by a machine repair · 00:16:53–00:16:53 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
Yeah, so ‸ it's a variance. It's actually anybody who needs a variance going to the Board of Adjustment, the staff time involved in that, and so the time to actually review the matter. So it's a fee schedule that's applicable to all. But the general issue, that was addressed by
addressed that, and I think we did make some changes to the fee schedule there. This ‸ obviously wasn't one of those, but I don't think this was ‸ the primary issue.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:17:36–00:17:38 · unresolved: the words are not shown (unclear audio); listen to the recording
their issue was addressed with the change. The issue, this is ‸ what I'm bringing to everyone's attention. This is something that was actually just ‸ discovered, okay? So, right? This was really recently discovered, and you're asking them to pay $600 for a variance when they had no option where they put that shed to begin with. Right? Yeah. I mean, you gave me the detailed history, and I can go
Flag: numbers, amounts, negation or names differ between the machine readings · 00:18:33–00:18:34 · unresolved: the words are not shown (unclear audio); listen to the recording
goes from here. She... ‸ You don't have an ability, ma'am, tonight to... ‸ Her issue is a board of adjustment issue. She... There was an existing shed. I think that

without a permit. And so, if she had come in for the permit, she would have been advised of the fee schedule and the requirements. And so, ‸ this has to go to the board of adjustment. Now, I don't know about the ability to waive the fee, but ‸ it's the fee schedule for anybody who's in that predicament, whether they're in Carlton Terrace ‸ or some other place in the city. Okay. And so,
Not negotiation, but when we meet here in the front and we talk about... Yes. Our budgeting issue. ‸ As we have done in the past when we made adjustments as well.

fees and that was for residential and or commercials. So, ‸ I guess I'm asking you ‸ what are you looking for? Are you looking to try to add in a way to waive certain fees depending on the situation?
has a minor, is making a minor change such as this. $600 is not a reasonable fee. When we were presented those fees, I think all of us understood that this is when there are big changes being suggested that really require a lot of staff time. versus this is a lot, if you look at this lot, it's so irregular. It's so irregular.
And again, they have drain fields. They have really limited capacity in their yards. So, yeah, I just I don't know you know, how do we make that more reasonable?
I'm sure those neighbors are being made aware of this scenario so that through collaboration and communication they're being educated. We will proceed in this order
Flag: numbers, amounts, negation or names differ between the machine readings · 00:23:31–00:23:33 · unresolved: the words are not shown (unclear audio); listen to the recording
mean, it's not just meeting. but I also understand that trying to figure out things that would be, you know, reasonable to our citizens and so on and so on.
one, if it is the amount to cover the cost of putting the meeting together and the work that has to go into it to cover staff time, because it is a change to a potential change, there is costs associated to that and so I understand how we get there, even when it may be perceived as a simple change, there is a process that goes along with that. That being said, you know, I would be open to just looking at different fee schedules from surrounding communities and you know, but if this was already hashed out and discussed for this year with that consideration then I would probably let it rest until we move forward at the time when we would usually do that. Just doing homework on my own end first.
Okay, sir. All right. This concludes this portion of delegations. We will proceed on to the next agenda item. Item number five, the consent agenda item. What are the wishes of council? community development district is an independent special district that has certain powers to raise revenues through Avalon taxes or special assessments for purposes of funding certain improvements for future development project. In this case, the developer is seeking the council's authorization to proceed with the creation of a community development district for purposes of ‸ constructing some of the improvements that will be necessary for this particular project.

So the applicant has submitted the petition, affidavits of their supporting experts to support their petition, and the six statutory criteria ‸ for creating a community development district. Staff is not in opposition and supports this request, Mr. Mayor, in accordance with the preceding development agreement that was entered some 20, almost 20 years ago now. This project, as you know, is a long time in coming from the early days, 20 years ago when it was annexed. ‸ Yes, sir. I support this project. Let me say this up front. And this is a public hearing. And I would like to make a motion. I'm looking for a second for a discussion.
have a motion on the floor based on staff recommendation and a second by Deputy Mayor Hearns. Is there, I would like to, do we have any questions for Esquire Garganese council members?
then the other question is, are there, I mean, there seems like it's all pros, are there any cons to doing this? So, I guess I'm asking staff. Or I can ask. I don't think that, are there any cons?
mean, a community development district is a local governmental entity that has the ability to raise revenues like at the loan taxes and special assessments.
So, community development districts tend to fund bigger aspects of larger development projects. And they're ‸ also used ‸ by developers as a funding mechanism because of their ability to impose
So, it's like a mini local governmental entity, but it's ‸ a specific purpose local governmental entity. They only have limited statutory powers ‸ related to the design, permitting, construction, and maintenance of the infrastructure that they are responsible, the CDD is responsible for.
Eventually, the developer is the one that creates the CDD, and then over time as the project gets built out and homeowners start moving in, homeowners then have the ability to elect members to serve on the CDD. So, once the project gets built out, there's self-governance from the property owners within the geographical boundaries of the community development district.
mean, CDDs, again, they're going to be a ‸ local purpose, form of ‸ local government within the geographical boundaries. So, ‸ the city would have to be accustomed to on occasion having to deal with ‸ a CDD entity. In addition to, like, ‸ we've dealt with homeowners associations from time to time. So, ‸ the city was going to have to get accustomed to that. I don't anticipate a lot of ‸ major issues coming up with CDDs, but they are going to be a ‸ limited purpose local government operating within your geographical boundaries. So, ‸ relationships may have to be developed.

I'll leave that for the professionals. Sir, and I, ‸ this has to do with the, the, making sure that I'm following kind of the understanding of the logic of the code enforcement meeting or the, the code enforcement board meeting. And so, what, it, it seemed like there was some discrepancy from the current owner about being notified or not notified or something like this. So, it was, was that the understanding that was being offered for, from the code enforcement meeting? Meaning, ‸ I know, we, we send out to addresses, we send out to, these things, right? We have, We have a process for notifying people, but it looks through, just through the minutes that, the, the argument was that I wasn't notified or something along those lines.
Correct. Our policy, when we do any hearings, we send a certified letter to the address on the property appraiser, and we post the property that's in violation. In this particular case, Mr. Silver said he wasn't notified, but staff has photographs of the posting on the property for the noncompliance hearing, and we also sent

letter that was on the property appraiser back at that time. So, staff contends that he was notified either through primary service as certified mail or secondary service of posting the property in violation.
just to clarify and thank you, so there'll be opportunity, but to clarify to make sure I got it, is it here, it's another tax deed we bought, right, well, let me rephrase this. This is a tax deed that was bought, There was a lien already on the property, right, new owner comes in.

that it would be running this whole time. Would there have been a point in time where we would have notified him or not would have? Was there a point in time where he was notified that that amount of money was being billed or accruing while he was making those attempts?
That's what the noncompliance hearing is for. So, the first hearing finds the violation, the second hearing actually imposes the fine and sets the date of when the fine would start,

Yeah. So thank you for asking those questions. I bought the property with violations on it. It had the violations that Mr. Bond just read, ‸ but there was no lien running. There was no fines running. And so I assume that I will meet with the court enforcement right away after I

her back again for a re-inspection now that I was ‸ cleaned up the property. ‸ And the more things were pointed out and more meetings were required, more meetings were required. Flag: numbers, amounts, negation or names differ between the machine readings; a language review questioned the wording · 00:58:31–00:58:34 · unresolved: the words are not shown (unclear audio); listen to the recording
And I think the thing is that this is a previous address that I had at some point. And either it was my fault not to correct it at the moment that they sent out this letter, This is the only thing they had. But I'm just being honest with you. And I'm trying to say I never lived here. All I'm saying is maybe I did not, I had not corrected the address.
it. ‸ And I walked in there once a week. My guys were working there every day. Is it possible that one of my own guys had removed it thinking it was who knows why because he couldn't understand or whatever?
that could be possible. So I'm not lying or I'm not saying you didn't post the property. I never saw the posting. And so that's my, and so the biggest argument I have is I've been in communications with the court enforcement agents. I've been in communications with building department all during that same time that my lien was running.
oh yeah, you're trying to do what we're asking you to do. Yeah, you're pulling permits. Yeah, you're meeting with us. And so that was the idea that I got from Mrs.

So the idea was if you work with me, I will report back to my hires and I will make sure that they know you're working on the property. That was all the communication I had always. So had I known this was running, I would have been stopped a week later because I would have come to you and say, look, here are my permits. Here's what I'm doing.
So that's my argument. That I'm being punished for something that I never did. It wasn't like I left the property abandoned and I never answered to the letters and I decided now to show up and say, hey, forgive me. That's not what happened here. I was 100% present at all times.

I didn't get a chance to last time report on the redevelopment conference and the big takeaways. So I wanted to share that. And ‸ I can also, I will also do that at the CRA. But it was really somewhat of a reiteration of what I learned at the Florida League of Cities conference, but a lot of it has to do with, you know, really doing that placekeeping, identifying those place opportunities. And, you know, we saw this. This was not only in the ‸ presentations, but also in the tour of St. Augustine and Lincolnville, which is a historic African American community. And,
whatever, building on that and creating that sense of place is ‸ going to be ‸ the true recipe for our success. So, and they also, one speaker after the next, push back. And push back is not a negative to development coming in, but push back for those things that will really help that development fit in with the culture of the community, with the other things that you have going for yourself. In St. Augustine, of course, as well as in Lincolnville Historic District,
and then in the expanded area, they become voluntary. Although they said more often than not, people coming in are quite willing to look at those and abide by those guidelines, just to, so there's some congruency, some consistency throughout the area. We also have architectural guidelines that were started.

It's a document that has, really gives you an appreciation for, if you haven't had a chance to look at it, some of the features we have in our historic architecture. The Lincolnville Historic District tour
this point, they are not majority African American. And one of the things she emphasized, ‸ that we may want to consider, you know, in Diamond Square or whatever, but as the properties became, ‸ you know, start to develop and the values go up, doing, and this is the, the CRA director is now doing that within the community, reaching out to members, writing letters, talking about the future values of the property, and the significance of the historic events that took place there. And they

that, and this is, you know, all about building a sense of a place, that in some areas they don't even have the building still standing. But they, you know, put up signs, or, you know, they incorporated that history, those important points, to create that sense of place, to, you know, create that common sense of historical understanding. And that, of course, helps us, contributes to a more unified community.
attended, along with our city manager and our public works director, the kickoff for the long-range master plan for the Space Coast Transportation Planning Organization. This is, it's, it's the plan that prioritizes the projects for the next 10 years.

The process is beginning now, and it'll be completed in 25. I think there are going to be a lot of community outreach events, and I would encourage everyone to participate.
Are you familiar with that, that's going up on Pineda? That is really going to increase the, make our transportation system much more high-tech. So, yeah, it's very high-tech. They're going to be able to control traffic lights. They will immediately see when there are problems in one place or another. And, so, that's exciting. We also, as you know, the ‸ Clear Lake 524, of course, you know, we've pushed our project on 524 up that list. But we're still looking at, ‸ and of course you know about the project from 520 up to Michigan,
Michigan on Clear Lake to industry, is still looking for it, and still, we're still at the point of the, getting the 24 million for the right-of-way, because they have to, they're going to take that first line of houses as they expand that. Thank
phase in 25. We're widening 528. That was interesting that it's actually in ‸ the 17th year is being listed as a priority. So, again, transportation projects are, you know, multi-million dollar ventures, and they take a long time. So, you've got to be able to look up the long route. As you know, I sit on the Save Our Indian ‸ River Lagoon Citizen Oversight Committee, and we, this was our meeting a couple ‸ weeks ago, to determine where the additional 10 million that came in this year, where that will go to, and to look at some of the projects that are going, and to do a little realignment if needed.
But I just wanted to give everyone a perspective, because I think people see these figures, and myself as well, and it's just, wow, that is ridiculous.

total nitrogen. No, 1.3 million pounds of total nitrogen. Um, that nitrogen and phosphorus are the nutrients that create the pollution, that, um, bring on the algae.
okay. And then I just wanted to point, I, you have in front of you an article, is an opinion piece that, uh, Virginia Barker, the director of that department, um, of our county natural resources, that she wrote, um, in regard to sticking to the science. Because, you know, this is, as you, something like this with this much money, of course, uh, attracts a lot of controversy. And there's always someone, you know, with a better idea. And of course, any idea once we want to look at it, but we've got to stick to the science. And right now the plan that was written is based on, and all of the controversy about taking muck out and how expensive that is. The ‸ reality is the muck, as that is going back to the 2050s when we were, you know, dumping wastewater right into the lagoon.

it is, and, and now all of the municipalities within Brevard have, and it is, it's a collaboration to reduce the traffic accidents. You know, our roads to a large degree are dangerous by design.
when we were all, it was very car centric. Um, versus go to other cities with older communities that, you know, maybe had different forms of transportation.
there are ways to bring it down and, um, being more cautious, but also just making our roads more safe by design. And then again, um, we will have the, the train exhibit every Saturday at the museum. Thank you.

a good one. Yes. Thank you very much. I appreciate it. It's team Coco, man. ‸ We're being recognized for, you know, what we do in this great city of ours.
I'm proud. I'm tickled pink, proud. I want to say to staff, it is because of you, our rise, and city manager and city attorney and council. It is because of you, the citizens of Coco. I'm a product of Coco. I'm a proud product of Coco. So I'm writing off your shirt tails, coat tails, pony tails, dress tails. It's not about me. It's about we, the people. And that's why I appreciate council acknowledging the accomplishments of staff because we can't do it by ourselves. And I wouldn't want it any other way. So we all pay an intricate part. And people challenge us as we did our community walk yesterday. Um, there were certain individuals pleased and not so pleased. But guess what? We work through it. And we deal with it.
the top. We're going to get there with or without you. Teamwork is dream work. So welcome to Team Coco. So on that note, happy post Thanksgiving. I'm a southern gentleman from the great state of Florida. Glad to be from hot chocolate, baby. Go Coco Hot Tigers. We defeated Fort Sumter. Not Fort Sumter. South Sumter. Fort Sumter is where the Civil War started, y'all, for who don't know.
but nothing like partnership and friendship and stewardship. And I just want to say thank you to you all. Even if we can agree to disagree, but that's all right. That's life.
