Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
761 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 42 voices separated from the audio.
64 short machine repair(s) (74 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 94.5% of 36,546 content words.
Dotted words (759 places) are ordinary wording differences: hover or tap to see the other reading.
761 passages (20% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Okay. So, um, I'm going to ask everybody in the audience, including, uh, fellow board members, I ask this all the time. Uh, if you have any cell phones, PDAs, tablets, anything like that, please either put them on silent, vibrate, whatever you need to do. If you do need to take a phone call or anything like that, please step out into the hallway, but also be mindful. Our hallway loves to echo. So if you stand out right in front of the door, everybody in here will know your business. Just be mindful. Um, that's all I ask. Uh,

‸ Yes. Is it possible that one item could be moved to the end of the meeting, which is, uh, voting for the, um, chairman and vice chairman positions? Because the amount of work that we have right now, it wouldn't be fair to whomever might take over once the vote's made for what we have to look at tonight.

since January, we're normally have our actual vote. If I'm not mistaken, that's normally when we do our vote is in January for chair and vice chair. Okay. Do we not normally do that in January? At least that's when, when I've served on the board, that's how we've, we've been doing it.

took the lead on the review of this application. I'll be doing the presentation for you this evening. And hopefully my presentation will be up on the screen in just a minute. ‸ Perfect. Thank you very much. So in terms of my presentation this evening, I'll talk a little bit about the location of the property. I'll run through the existing conditions. We'll talk about the request. Uh, this one's unique because there is a significant amount of history that's, uh, gone into it. Uh, so I'll, I'll really cover a history of a number of development agreements that pertain to the property, talk about our findings and I'll conclude with a recommendation, including some conditions.

uh, which is the beach line expressway. It's east of I-95 and it's just over 212 acres in size. Uh, currently has a very low density residential, uh, slash conservation future land use map designation, which allows for consideration of up to four dwelling units per acre.

it still retains its old Brevard County zoning designation. Uh, if you look at the property surrounding, uh, most of it is within unincorporated Brevard County.
I-95 on the west. So the request here this evening is to rezone, uh, from that historic Brevard County designation. Uh, and they're also requesting a large scale site plan and a preliminary subdivision plan.
Uh, and they're, uh, requesting to split that into two phases. Uh, so phase one would be 185 homes, uh, ‸ recreation area, a pool, dog park, and a portion of a trail network, which they're proposing. Uh,
park, and the remainder of the trail system. Um, so as I mentioned, this one has quite a bit of history, uh, dates all the way back to 2004 when there was a request to bring this one into the city. Uh, that ordinance on the screen, uh, is when this property was originally annexed into the city. Brevard County at the time challenged that annexation, uh, in the two, uh, local governments went into litigation.

proceeding development agreement with a group called Hagen Nicholson properties LLC. Uh, which allowed for the annexation exchange for certain development rights and city services. Uh,

time and I'll get into the individual specifics of these agreements in just a moment. So 2005, 2006 agreements, um, simple agreement to annex into the city and the city would provide, uh, water, wastewater, fire, police protection and public services. Uh, the city agreed to support a future land use map designation consistent with the low and medium density residential districts. Uh, and
acre. And they were permitted a maximum 600 dwelling units. There was a minimum home size in that agreement of 1500 square feet. That's under heat and air. And
along James road. Uh, in 2022, uh, uh, ‸ settlement implementation agreement was approved. Uh, this one was a little bit different because as you can see from the, the previous 2008 agreement to the 2022 agreement,
uh, for the, the bright line project. So you've got a rail line now, uh, that runs on the North and you've got some associated stormwater ponds, which shrunk the size of this site. Uh, the, the development program took a corresponding decrease to 418 units. Um, there's requirements to provide private recreation space. They have to do a walking path, nature trail, a 5.8 acre park, dog park, playground, clubhouse, and pool. Uh, and there were also specific requirements for, uh, the clubhouse and all those amenities. Um, there's ‸ requirement to do some streets, caping, uh, and enhance the entrance features. So when we did our review on this project, we went back and we read all of the previous agreements, looked at the city's comprehensive plan, uh, and the PUD zoning requirements for the city. Um, and as you can see on the screen, the layout is substantially similar to the one that was, uh, approved back in 2022 by the city, uh, on that settlement implementation agreement. The one on the top is, is the agreement version. The one on the bottom is what's being proposed here this evening. Um, the unit count is less than was approved in the settlement agreement. So the settlement agreement had 600 and then the settlement implementation agreement had 418. So they're at 385 now. And then the amenities are consistent with those that were required by those prior agreements approved by the city. As I mentioned,
You can see the elevation of the clubhouse here on the screen. And that's the clubhouse area in the top right. Uh, and then there's a, a secondary park required, which is shown on the bottom right of the slide. They're required to do a dog park and you can see the details from the dog park on the screen as well. Uh, trail network. Um, there was a preference in the agreement to do stone or brick paver or stamp concrete driveways. Um, we discussed that with the applicant and added that as a condition of approval, uh, for a consistent consideration this evening, they have to do underground utilities and they have to use energy efficient materials also has been added as ‸ condition. Uh, so as typical, we went through the 11 findings, uh, that are required for a project of this nature.
finding number one, uh, deals with the character in terms of density. Um, and we noted that it's consistent with the underlying future land use map designation, which allows for up to four dwelling units per acre. Uh,
and open spaces on the south and the east, uh, which was part of those original agreements to provide a little bit of a buffer to those residential, uh, communities to the south and the east. Uh, finding number two is compatibility. Again, uh, the previous agreements, uh, did a really good job of outlining, uh, some of those compatibility measures that have been carried through at this stage. You've got a cap on units. Uh, you've got the minimum home sizes. You've got the location, as I mentioned, of the open spaces, ponds and preservation of wetlands, uh, which are primarily located on the south and the east. Uh, you've got
Flag: words were replaced by a machine repair · 00:16:31–00:16:32 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
that all of the, uh, engineering, final engineering drawings have been signed and sealed by a professional engineer to ensure that, uh, those, uh, local laws will be complied with. Uh, finding ‸ number four deals with the availability of public services. Um, we did receive, uh, correspondence from Brevard County public schools that says there's capacity available to serve this project. Uh, we did a full concurrency analysis in the staff report.
there's capacity available for water and wastewater. Uh, the drainage is going to be consistent with the cities and the water management district's requirements with no deviations. Uh, and the recreation amenities are consistent with those prior agreements and they exceed the city's level of service standards. Uh, and there is transportation capacity available.
finding number five, uh, is the nature intent, uh, of common open space and maintenance. Uh, so the amenities are consistent, as I mentioned with those prior agreements.
Finding six, uh, this addresses, um, uh, phasing. So they are proposing two phases. Both of those phases have sufficient infrastructure to support the proposed residential program. So it's not like, uh, they're proposing all of the units in one phase and all the recreation in the, uh, separate phase. Um,
those phases will be able to stand alone. Uh, the main amenity, as I mentioned, is in the first phase. And then we do have a condition of approval that requires the completion of that amenity prior to the 150th building permit. So,
the surrounding ‸ road network? Um, state road 524, uh, is expected to exceed capacity at build out. Uh, but that roads exempt from concurrency standards within the city. Uh,
Finding number eight, uh, is the adequacy of water and sewer. As I mentioned, there is capacity for both water and sewer to serve this project. Uh, finding number nine, uh, addresses the benefits, uh, to the general public, uh, to, um, deviate from the standard land use requirements and hand inherent to a PUD this one's a little bit different because, you know, there was so much history with
Flag: numbers, amounts, negation or names differ between the machine readings · 00:19:29–00:19:32 · unresolved: the words are not shown (unclear audio); listen to the recording
with all the terms of that agreement. So they are preserving, uh, 34 plus acres of wetlands. They've got amenities that are in excess of city code. Um, and
Flag: words were replaced by a machine repair · 00:19:43–00:19:44 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
Flag: numbers, amounts, negation or names differ between the machine readings · 00:20:03–00:20:07 · unresolved: the words are not shown (unclear audio); listen to the recording
And, uh, finally finding number 11, uh, is addresses open space and compatibility with open space. Uh, they've kind of laid it all out here in their plan. They've got a trail system and many center dog park kind of went through all these a little bit earlier. They're preserving those wetlands and putting trails, uh, within the open space and ponds. So, uh, we are
these are all in your staff report, but I'll cover them quickly. First is just a requirement to comply with the plans. Uh, two is a development schedule, uh, including, uh, the requirement to complete the amenities prior to the 150, uh, certificate of occupancy within each phase. Um, three, there were a few minor outstanding comments that we asked the applicant to address, and those were provided to ‸ under appendix a and b.

requirement to do reclaimed water in the common landscape areas. Eight is energy efficient lighting systems and other, uh, building materials. And that's directly from the settlement agreement. Nine is the requirement to coordinate with Brevard County and construct traffic calming devices and James road. Uh, 10 is going to be the minimum square footage for the buildings. And that's out of the prior agreement. 11 is a requirement to, uh, diversify some of the architectural elevations provided within the community. They provided a, a large sample of the different types of elevations that can be considered. We just want to ensure that you're not going to have a monotonous community with all the same homes.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:22:15–00:22:20 · unresolved: the words are not shown (unclear audio); listen to the recording
with tree protection and preservation requirements. As you know, the city's recently updated standards. So just want to ensure compliance with that. Uh, 13 is going to be, uh, the requirement to address any city survey or comments prior to final plat.

and then 15 is the requirement to produce approvals from the water management district regarding the wetland mitigation and conservation areas. So with that, um, I'll conclude my remarks and, uh, staff's here for any questions.
And one last thing, there are some architectural elevations that have made their way up to the dais and hopefully you'll be able to review those as you consider this project. So thank you again.
since we have so many people that would love to stand at the podium tonight. Uh, when I call your name, I'm just going to have you stand up and then I'm going to have you sworn in so we can go ahead and just do it all at once. Heather Isaacs.

members of the board. I'm Tom Sullivan with the great Robinson law firm on behalf of the applicant on this request. Appreciate your time tonight. First of all, I have some folks here with me tonight. Heather Isaacs, you just mentioned Fred Miller with Taylor Morrison and our civil engineer, David Stokes and some other folks as well. Just first want to briefly thank staff for their presentation. We agree with the 11 findings that Eric went through in detail, as well as the conditions of approval that were laid out in the presentation, as well as in the staff report. And we appreciate their professional recommendation for approval. I know it's already been said, but I do want to emphasize that this request is consistent with the prior settlement agreements regarding this property. And you all saw the slide that kind of covered ‸ the years. Um, the different years that those agreements were approved. And when I say we're consistent with those agreements, I am also including the 2022 settlement implementation agreement. That's the most recent one. There are some important provisions in those agreements regarding the property, uh, and the project, and we have been working closely with your staff and with the city attorney, uh, as well to ensure that we adhere to all applicable requirements, which we are. And I think that's important to point out. So, um, with that said, as I mentioned, we have our whole team here tonight. If you have questions for us, we're happy to answer. Um,

know there's some folks that, um, want to speak as well, and we're happy to respond to their comments as well at the end. So ‸ appreciate your time. And again, happy to answer any questions.

single family residences around the south and the east. James Road borders the property to the south and then on the south side of James Road there's large lot residential and then there's the Brightline facility to the north and I-95 to the west. So as Eric mentioned there's 385 units that would be constructed in two phases within a timeframe of five to seven years just depending on the market. The lot count is reduced from that 2022 settlement implementation agreement by 33 lots as it was previously previously mentioned ‸ another agreement had an allocation of 600 lots so we are.

This is the open space plan up in the upper right hand corner there is the large city park. I'll show some examples of that in the in a couple slides. Kind of in the center near the first entrance off James Road is where the amenity will be with the clubhouse a pool a dog park and an open play field with sports nets. And then you can see the trail system kind of weaving through through the project. So the the park that's in the upper right hand corner at 6.28 acres it's under what will be a preserved tree canopy. It's going to be designed as a nature play space.
with the National Wildlife Foundation where we certify all of our open spaces as wildlife habitat. We also create nature play spaces which is a little bit different than a typical playground. It's meant to activate

As is mentioned there is a condition that this one be air conditioned. Unfortunately I didn't have time to get colored renderings but we did provide an elevation.
streetscape we will come. We'll have one canopy tree every 50 lineal feet along the internal streets. We'll have five foot sidewalks on both sides. Some of the trail system will obviously interconnect with those sidewalks. And then as Eric mentioned we have a monotony condition to prevent the same house elevation from being built adjacent to or across the street or diagonal from that same house elevation. We are proposing to gate this community. And so we've shown what the gates and the entry feature the entry monument sign would look ‸ like.
we offer and this is the number of different elevations that are offered in the community. So we have. Believe we have eight different models and each model will have multiple elevations just based on whichever architectural style it is.

I live in the only curve on Friday road. And I tell you the traffic has picked up tremendously. And ‸ I'm looking at this traffic when I'm out picking up trash, thinking, where are they coming from? We haven't built any new subdivisions out there, but I guarantee you that new development. They're going to use Friday road for their entrance and access. And we're going to have a lot of traffic issues. We were all zoned rural residential out there, one acre and larger. And the idea was it was for horses. We have had issues out there when the counties had to dig up our driveways and culverts and put in larger ones because it was flooding from Grecian estates and whatever. And the only way they could solve it was ‸ to put in larger drainage pipes to run it south. Where are they going to drain to with their runoff with all those houses?

two days before Christmas last year. I moved there to get out of subdivisions, to get out of the traffic, to get out of people piled on one on top of the other, where I can go in my backyard and not have to worry about my neighbor looking out the window and seeing me. That's why I moved out there. And as far as drainage, I know you said not to harp on issues that were already talked about, but that particular property, we have to have flood insurance because it's FEMA zoned flood. And I'm right there on North Pacer right at that little at the end of the little cul-de-sac. And then there's that canal. And
I'm zoned by FEMA flood, where on earth do they think this flood water is going to go to? If my flood water can't even go out to where it protects my neighborhood, where's all this coming from? And then they had Cape Canaveral flooded completely when they were installing ‸ that whole Brightline ridiculousness. ‸ And Cape

There's major concerns ever since these proceedings have been going on from day one when it's been known about the this project and the public hearings and stuff. There's been main concerns. Everybody's got their own little personal concerns, but the two main concerns on Friday Road is the increase in traffic and the infrastructure as a whole. And

I believe that that property that we're discussing was originally zoned RR1. Most of the zoning in that area required that the housing had to be built on at least an acre of land. And so I'd like to just challenge that kind of statement to the other thing I would like more clarification on that was completely news to me is the, the, um, the bullet about, um, I don't know if you encourage people to go James road or you, you block them from going on Friday, but I would like a better understanding of what were you talking about on that,

If you'd like me to respond chair. Go ahead. I think in my PowerPoint, there was a provision in one of the previous agreements that said there will be no access from Friday road. So one of the original proposals had an access point that was actually from Friday on the north side of the site. So
Correct. It all comes through James on the south. There'll be two access points.

Um, there was a question about, um, the trees, whether they would be native, the trees and plant material. We are planning to plant 80% native. Um, and we are also using water wise irrigation. We'll also be dark sky compliant. Um, in terms of stormwater ponds, we've got 77 acres of stormwater ponds that are being built. Um, again, our engineer can, um, address those questions in terms of protected species. We have done, um, a threatened and endangered species analysis. We are aware that there is an Eagle nest on the property. We already have been working on an Eagle monitoring plan and working with fish and wildlife to understand what those restrictions are in terms of when, when areas can be developed around that Eagle nest. Um, this is not our first time working in a community where, um, there's been an Eagle nest. Um, so we're very familiar with that.

All you have to do is drive by during one of their interchanges and you can see how many students are already there. One of the things I wanted to take the time to highlight and I also want within this document that we're uh have presented here in this PowerPoint. There should be another slide that shows the amount of land usage that is being proposed by this development. If we can go back to that slide, please, just for the sake of uh public interest. It showed, um
Yes. So if we go back, so it is within your, so within the staff presentation, there's a slide that designates approximately 30 acres that's going to be set aside. I'm going to reference that really quick and then I'm going to just lean way to another point as we prepare to, um address this particular issue at hand.

Steve Noto, RBI Planning and Landscape Architecture, presenting this item on behalf of city staff. This is a ‸ rezoning request for 5.88 ‸ acres of property located at the intersection of Grimes and Forest and the intersection of US 1 and Hillcrest Drive. Subject property currently operates as Matthew's Hope, the nonprofit faith-based homeless outreach ministry. An

This designation of the subject property was changed on July 22nd to 2023 from commercial to high-density residential. Zoning of the subject property is institutional. It was previously split zoned, RU215 on the eastern side and RU225 on the west. The applicant is requesting a rezone of 1.002 acres of the subject property to RU215. The
This was based on the legal description that was provided by the applicant, and it was cross-referenced by GIS. And again, this is general location, and I'll show some ‸ additional exhibits to show what the intent is of that location. And this is the aerial that shows that general location. I know it's a little zoomed out. The intent is to impact the building area as it ‸ relates to the rezoning request, and I'll get into that. Just a moment.

the rezoning area is more centrally located on the site as opposed to being on the western portion, which was shown in the exhibits. The planned use of the rezoning area,

portion of the existing structure in the space that was previously utilized as classrooms for the former church. So I'll just go back if I'm able to, there we go. Just for reference purposes, you can see the existing building on the overhead. You'll notice the white roof of the structure. That is where the work would be done in order to construct the multifamily units. There would not be new construction on the greenfield space to the north of that. This would only occur within the existing footprint of the building. On July 25th, 2023, the city council adopted ordinance 06 2023, which amended the
the subject property from commercial to high density residential. The purpose of that amendment was to start the first step, which leads to this rezoning request. ‸ As I mentioned before,

‸ However, as I mentioned, only 1.002 acres of the subject property is going to be classified as RU215. While the HDR allows a maximum of 25 units per acre, the RU215 is actually more restrictive, capping out at 15 units per acre. So a maximum of 15 units could only be constructed within that 1.002 acre space. ‸ That's part of the reason for the shape of that 1.002 acres is it's being limited to that area for the subject property. The

The residential uses to the south are zoned RU215 with a commercial feature land use, but they are developed as single family homes. As you know, the proposed to RU215 zoning district is not contrary to that land use pattern. The applicant will be required to comply with the development standards of RU215 multifamily dwelling district of the code of ordinances. The proposed partial rezoning area would encompass plus or minus one acre, which currently includes the daycare center and classroom buildings, which are located on the northern portion of the site and buffered from single family homes to the south on Hillcrest Drive. The

to ‸ the future land use map and would have an adverse effect on the comp plan. The existing future land use designation of the subject property is HDR, as I mentioned. The proposed rezoning is consistent with future land use settlement policy 1123. And

shows that RU215 is an applicable zoning district for the HDR future land use category. In short, that means the proposed zoning district complies with the existing future land use ‸ category. Finding F change or changing conditions make the passage of the proposed amendment necessary. The applicant stated in their application that the needs of the community has changed and that's their words on the application that they have proposed the partial rezoning in order to support the low income housing initiative and to accommodate the low cost daycare facility on site. Any additional uses beyond what are allowed by the existing institutional zoning, which is limited requires a rezoning. The proposed rezoning will accommodate the existing daycare on site and will be consistent with the surrounding zoning districts and a mix of residential commercial ‸ institutional uses. Finding

As I mentioned, the shape of the rezone is ‸ proposed as it is in order to provide that additional buffering and ‸ minimize the impact as that would come from the rezoning request. over the last 65 years, certainly some things have changed, but it gives you an idea. The six, the limit to six units, I think is questionable. We're still figuring out where the unit boundaries would be, but certainly would never exceed the zoning request. So here are some photos of the existing conditions. Um, these were kind of left vacant. They're not being utilized today and we want to give them a new purpose. So we would plan to remove the acoustic ceiling tile, replace the flooring. I also want to walk through a few things and dispel a few rumors. Um, this is what differs about Matthews hope versus potentially some other programs. First, this isn't just open to anyone. This is not going to be advertised publicly. ‸ Matthews hope

So Matthews hope uses great discretion in selecting people who've demonstrated consistency, the interest and ability in moving toward a life of independence. Second, every person who enters this program is full time employed minimum 40 hours a week. In lieu of a lease or a rental agreement, there is a program fee, a portion of which goes into an escrow account as a forced savings. So at the end of the program, typically two years, there's a really nice nest egg for that individual or for that family to put a permit, put

Further, as you see here, participants agree to random ‸ drug testing inspections of the units. So speaking of success, here are some of the faces of the people involved in the moving forward program and a couple graduates. This is the part where I get a little emotional. The people that are featured here and would be a part of this program. They're the dishwasher at your favorite restaurant. They clean hotel rooms at the last place you vacationed. They're in line with you ‸ at Walmart. They're pumping their gas adjacent to you, and you might even you might not even recognize that they're homeless. the loss of a partner's income. These individuals were no different. The line between stability and homelessness is very thin. But these individuals now, having gone through the program, are not only living independently, but they're now able to invest in others. Two of these gentlemen work in the wood shop. of needs. At the foundation of that pyramid, along with air, food, water, is shelter. His theory is without those basic needs being met, one cannot achieve the additional levels of safety, belonging, self-esteem, self-actualization, becoming the best version of oneself. So tonight, I hope that you'll agree that this is an opportunity for the city of Coco in partnership with private organizations to provide for that fundamental human need for shelter. For those who so desperately seek it and give them an opportunity to become the best versions of themselves. I respectfully request your recommendation of this rezoning. I appreciate the opportunity to present and thank you for your consideration. Should I remain here for questions or sit down?
this board when we last were presented with some changes that you guys want to make there under which we played a part in so I find this presentation I'm taking a page from Alex now see find this presentation to be most knowledgeable in regards to what it is that you guys are looking to transition to I know that initially there were some immediate concerns and I will say that this has addressed the concerns that we specifically spoke about at this particular board in terms of zoning when when the zoning was being considered so
is not the most traditional approach, but it preserves some of the things that were of great caution to a few of us that serve here on this board. so I'm

to this item that's being presented to us but the one idea that I liked is that they are limiting this expansion right now to the area that you all presented and what that tells me is that not only are you offering something for people that is going through transition and it's not permanent long term it's until people can get off that's
think you'll get less and less controversy in reference to how Matthew hope offers their services and I think I'm comfortable with what was presented today and I'd like to say

But due to modern medicine, they're now living as long as the rest of us, into their 50s, 60s, 70s, and even 80s. The problem is their caregivers are dying 30 years before they do. And there's no plan. And so they walk our streets. Back in the Reagan administration we shut down all the institutions there was supposed to be a better plan. But instead, the better plan became that this. If you were to go to any one of our jails or prisons, you would see the bulk of the people there I said the

I have a medical team that is that, that has doctors and nurses working there. I have a hair salon. I will do your laundry. I will feed you several times a week. I ‸ will give you jobs to do. I can keep going.
That's not who we are. In fact, one thing that separates us from everybody that I know about across, not just locally, in the country, we do a background check on every single homeless person that walks in. Every single one of them. Not to

we're working with. Now I will say because we run a Montessori preschool that has been rated number one in Orange County for seven of our eight years because our first year wasn't a full year. It's true fact you can look it up. However if you let us know where you're living in the community we will serve you with one of our mobile teams that go out twice a week with food, clothing and hygiene. Now I got to tell you someone who's been molested as a kid I want to paint you orange and put a frickin siren on you. However, however, take us out of the picture and watch what happens. Because they're gonna ‸ have to get that food, clothing, hygiene somewhere. And we're trying to find, we've not ‸ trying, we have successfully done it for 14 years, showing how it can be done. To the point that this past year Orange County approached us and offered us a million dollar contract for Orange County for us to help them. Because you see you can only keep throwing money down a dark hole for so long. And our government is famous for it. I don't take government money I take taxpayer money and I use it wisely. But out

We have had a platinum rating since the very first day we started 14 years ago. We take what we do very seriously and by prideful. I would not walk around with all my people with big Matthews Hope logos if I we're not comfortable with who we are. I'll take it a step further. They're smaller, but they have oil rubbed bronze fixtures. They have nickel plated fixtures. They have the beautiful wood ceilings. They have the whole nine yards. Why? Because people have learned how to live in a box. People live in boxes, cardboard boxes. How much more demeaning can it get? And so my goal is to raise that bar higher and give them an opportunity to dream. What do you want to be when you grow up? Some of these people have degrees, but the wheels fell off. We have had NASA engineers. I've had pastors. I've had nurses. I've had teachers. Half the people we serve are more educated than I'll ever hope to be. I would like to address the question of whether or not there is a need for housing at the Matthews Hope property. And as far as we can understand, talking to the neighbors, collecting this petition and signatures, the neighborhood opinion is no, there is not a need for housing at Matthews Hope. I would say yes. We have identified I believe seven places that are selling this. Now this is not all of them. We just did a quick search. And we're putting them into our GIS system. In addition, the code enforcement gentlemen are notating the ones that they find out there. And we will add those also to the GIS and at that point we'll have a picture of where they are. And then we can overlay the 500 foot and see. But yes, there will be ‸ businesses that are non-conforming uses pending
approval. Will those businesses be grandfathered in or will they be asked to move or will they have their businesses removed from selling the beverages and Kratom? Or have we ‸ established that? ‸ Exactly.
They will be allowed to continue to sell them because they were in existence before the law, before the ordinance. Now if they choose, if they go out of business or something, we will not allow a new business to come in.
Just to clarify that, you mentioned early in the presentation about I'm not familiar with this, but they are doing and selling it for offsite let's say and they are within this 500 and then they decide to do onsite. This will impact them. Is that correct?

I do have a question for staff and in regards to this. I'm just trying to get a greater level of clarification, and so I'm making it more personal so I do see that there has been the recent addition of one of these establishments here on Fisk Boulevard For those that know, I
so I'm when I read this I'm trying to understand the impact of what it has towards that function of business in regards to these two caveat pieces. a church which is ‸ within 500 feet, which you know I'm
the street. so I know I'm going to drive away from that so I'm yeah well I'll get my driver and my three would. but anyway the secondary to that, it says that was mentioned here is ‸ where you
the city of Cocoa will congregate so naturally I think that would fall within those two segments. so we're saying this is not going to do anything for let's just say that establishment that may be in the process of application because this will probably not actually take place for some time to come. ‸ correct?

I'm sorry There are various other things that we have separation or distancing requirements for in the code for example medical marijuana dispensing facilities that's 500 feet so there are others that use this distance that's being proposed here yeah
underage people? through the through the I'm telling you because I have a family member my son and I know many people like him who easily access this stuff. thank God not create them yet right but shops within the city sell it right and

well maybe not because I didn't always either But at least they had a fine levied upon them when that happened so I just would like to see the city push forward on ‸ if they can I know there's all types of stuff I don't understand legally but to push forward some type of effort that would find or limit the want of a business owner to sell to an underage person.
I'm not sure that I know the answer to that at the moment but I can look into that as was noted just this past year is when the legislature adopted the statute about Kratom that it can't be sold to individuals under 21
Wesley thank you I might as well add something to the point you're making If there's a business that wants to serve liquor and they're in a questionable distance they can go to the city and ask for a variance and they can be approved for it Did you know that? ‸ okay just thought I'd throw that in there to make you even more concerned I'm up for a motion I'd like to make a motion
do I have a second second go for it ‸ please go ahead I have a ‸ second that motion alrighty all right all in favor of recommending approval for 25-2023 say aye aye do I hear any opposed none heard awesome okay and F ordinance
